8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 683.1 of Title 12, unless there
8484 is created a duplication in numb ering, reads as follows:
8585 This act shall be known and may be cited a s the “Public
8686 Participation Protection Act ”.

141141 A. A party, other than a gove rnment agency, entity, or employee
142142 acting in an official capacity, may file a special motion to dismiss
143143 a claim under this section if the claim infringes upon that party ’s
144144 exercise of the constitutional right of petition, free speech , or
145145 association under the United States Constituti on or the Oklahoma
146146 Constitution in connection with a public issue, which includes:
147147 1. The right of free speech, which means a communication that
148148 falls with the protection of the Constitution of the United States
149149 or the Oklahoma Constitution;
150150 2. The right to petition the government through :
151151 a. a communication in connection with an issue under
152152 consideration or review by a legislative, executive,
153153 administrative, judicial, or other official body,
154154 b. a communication that is reasonably li kely to encourage
155155 consideration or review of an issue by a legislative,
156156 executive, administrative, jud icial, or other official
157157 body, or
158158 c. a communication that is reasonably l ikely to enlist a
159159 public participation in an effort to effect
160160 consideration of an issue by a legislative, executive,
161161 administrative, judicial, or other official body; or
162162 3. The right of association, meaning a communication between
163163 individuals who join together to collecti vely express, promote,

215215 pursue, or defend common interests that fall within the Constitution
216216 of the United States or the Oklahoma Constitution.
217217 B. A special motion to dismiss und er this section shall be
218218 filed no later than sixty (60) days after the date of service of the
219219 legal action. The court may extend the time to file a motion under
220220 this section for good cause.
221221 C. All discovery, ex cept specified and l imited discovery
222222 relevant to the motion, in the proceeding shall be stay ed upon the
223223 filing of a special motion to dismiss under this secti on. The stay
224224 of discovery shall rem ain in effect until the entry of the order
225225 ruling on the motion and any interlocutory appeal thereof .
226226 Notwithstanding the stay imposed by this section, the court, on
227227 motion by a party or the court ’s own motion and for good cause
228228 shown, may order specified and limited discovery relevant to the
229229 motion.
230230 SECTION 3. NEW LAW A new sec tion of law to be codified
231231 in the Oklahoma Statutes as Section 683.3 of Title 12, unless there
232232 is created a duplication i n numbering, reads as follows:
233233 A. The court shall conduct an expedited hearing on the motion.
234234 A hearing on the motion shall be held no later than thirty (30) days
235235 after service of the motion, or thirty (30) days of ordering
236236 discovery, unless docket conditions of the court require a later
237237 hearing, upon a showing of good cause, or by agreement of the
238238 parties.

290290 B. 1. If the moving party makes an initial sh owing by a
291291 preponderance of the evidence that the legal action infringes u pon a
292292 party’s exercise of the constitutional right to free speech, right
293293 to petition, or right of association, the court shall grant the
294294 motion to dismiss unless the party bringing the action can establish
295295 a prima facie case for th e legal action.
296296 2. Notwithstanding the provisions of this subsection, the court
297297 shall grant the motion to dismiss if the moving party establish es
298298 each element of a valid defense to the claim.
299299 3. Notwithstanding the provisions of this subsection , if a
300300 party against whom a special motion to dismiss is brought under this
301301 title can show that the party’s claim is a constitutionally
302302 protected public interest action and is used for effective political
303303 expression or injury , or as means of communicating useful
304304 information to the public, then the motion to dismiss shall be
305305 denied.
306306 4. The court shall conside r pleadings and supporting and
307307 opposing affidavits stating the facts upon which the liability or
308308 defense is based.
309309 5. The court shall rule on a sp ecial motion to dismiss as soon
310310 as possible, but no later than thirty (30) days after hearing the
311311 motion. If the court does not rule on a motion to dismiss within
312312 such period, the motion is considered to have been d enied by
313313 operation of law.

365365 C. An order granting or denying a sp ecial motion to dismiss

367367 SECTION 4. NEW LAW A new s ection of law to be codified
368368 in the Oklahoma Statutes as Section 683.4 of Title 12, unless there

370370 A. If the court orders dismissa l of a legal action under this
371371 act, the court shall award to the moving party court costs and
372372 reasonable attorney fees including those incurre d on the motion.
373373 B. If the court finds that a special motion to dismiss is
374374 frivolous and solely intended to cause unnecessary delay, the court
375375 shall award court costs and reasonable a ttorney fees to the party
376376 opposing the motion.
377377 SECTION 5. NEW LAW A ne w section of law to be codified
378378 in the Oklahoma Statutes as Section 683.5 of Title 12, unless there
379379 is created a duplication in numb ering, reads as follows:
380380 A. The court shall not grant a speci al motion to dismiss under
381381 this act in any action brough t to enforce an important
382382 constitutional or statutory right by the general public, or in an
383383 action seeking declarator y or injunctive relief against a government
384384 entity, agency, or employee acting in an official capacity.
385385 B. This act shall not apply to proceedings under Title 10 A or
386386 Title 43 of the Oklahoma Statutes, or an application for a
387387 protective order.

440440 1. Apply to an enfor cement action, with the exception of an
441441 action directed again st an individual or entity requesting
442442 information in accordance with the Oklahoma Open Records Act that is
443443 brought in the name of the state or a politica l subdivision of the
444444 state by the attorney general, a distri ct attorney or county
445445 attorney;
446446 2. Result in findings or determinations that are admissible
447447 into evidence at any later stage of the case or in any subsequent
448448 action;
449449 3. Affect or limit the authority of a court to award sanctions,
450450 court costs, attorney fees or any other relief available under any
451451 statute, court rule, or other authority;
452452 4. Affect, limit, or preclude the right of the moving party to
453453 any defense, remedy, immunity, or privilege otherwise authorized by
454454 law;
455455 5. Affect the substantive law governing any asserted claim; or
456456 6. Create a private cause of action.
457457 SECTION 6. This act shall become effective November 1, 2023.
