81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Section 683.1 of Title 12, unless there
84	84	is created a duplication in numb ering, reads as follows:
85	85	This act shall be known and may be cited a s the “Public
86	86	Participation Protection Act ”.
87	87	SECTION 2. NEW LAW A new section of law to be codified
88	88	in the Oklahoma Statutes as Section 683.2 of Title 12, unless there

141	141	A. A party, other than a gove rnment agency, entity, or employee
142	142	acting in an official capacity, may file a special motion to dismiss
143	143	a claim under this section if the claim infringes upon that party ’s
144	144	exercise of the constitutional right of petition, free speech , or
145	145	association under the United States Constituti on or the Oklahoma
146	146	Constitution in connection with a public issue, which includes:
147	147	1. The right of free speech, which means a communication that
148	148	falls with the protection of the Constitution of the United States
149	149	or the Oklahoma Constitution;
150	150	2. The right to petition the government through :
151	151	a. a communication in connection with an issue under
152	152	consideration or review by a legislative, executive,
153	153	administrative, judicial, or other official body,
154	154	b. a communication that is reasonably li kely to encourage
155	155	consideration or review of an issue by a legislative,
156	156	executive, administrative, jud icial, or other official
157	157	body, or
158	158	c. a communication that is reasonably l ikely to enlist a
159	159	public participation in an effort to effect
160	160	consideration of an issue by a legislative, executive,
161	161	administrative, judicial, or other official body; or
162	162	3. The right of association, meaning a communication between
163	163	individuals who join together to collecti vely express, promote,

216	216	of the United States or the Oklahoma Constitution.
217	217	B. A special motion to dismiss und er this section shall be
218	218	filed no later than sixty (60) days after the date of service of the
219	219	legal action. The court may extend the time to file a motion under
220	220	this section for good cause.
221	221	C. All discovery, ex cept specified and l imited discovery
222	222	relevant to the motion, in the proceeding shall be stay ed upon the
223	223	filing of a special motion to dismiss under this secti on. The stay
224	224	of discovery shall rem ain in effect until the entry of the order
225	225	ruling on the motion and any interlocutory appeal thereof .
226	226	Notwithstanding the stay imposed by this section, the court, on
227	227	motion by a party or the court ’s own motion and for good cause
228	228	shown, may order specified and limited discovery relevant to the
229	229	motion.
230	230	SECTION 3. NEW LAW A new sec tion of law to be codified
231	231	in the Oklahoma Statutes as Section 683.3 of Title 12, unless there
232	232	is created a duplication i n numbering, reads as follows:
233	233	A. The court shall conduct an expedited hearing on the motion.
234	234	A hearing on the motion shall be held no later than thirty (30) days
235	235	after service of the motion, or thirty (30) days of ordering
236	236	discovery, unless docket conditions of the court require a later
237	237	hearing, upon a showing of good cause, or by agreement of the
238	238	parties.

290	290	B. 1. If the moving party makes an initial sh owing by a
291	291	preponderance of the evidence that the legal action infringes u pon a
292	292	party’s exercise of the constitutional right to free speech, right
293	293	to petition, or right of association, the court shall grant the
294	294	motion to dismiss unless the party bringing the action can establish
295	295	a prima facie case for th e legal action.
296	296	2. Notwithstanding the provisions of this subsection, the court
297	297	shall grant the motion to dismiss if the moving party establish es
298	298	each element of a valid defense to the claim.
299	299	3. Notwithstanding the provisions of this subsection , if a
300	300	party against whom a special motion to dismiss is brought under this
301	301	title can show that the party’s claim is a constitutionally
302	302	protected public interest action and is used for effective political
303	303	expression or injury , or as means of communicating useful
304	304	information to the public, then the motion to dismiss shall be
305	305	denied.
306	306	4. The court shall conside r pleadings and supporting and
307	307	opposing affidavits stating the facts upon which the liability or
308	308	defense is based.
309	309	5. The court shall rule on a sp ecial motion to dismiss as soon
310	310	as possible, but no later than thirty (30) days after hearing the
311	311	motion. If the court does not rule on a motion to dismiss within
312	312	such period, the motion is considered to have been d enied by
313	313	operation of law.

370	370	A. If the court orders dismissa l of a legal action under this
371	371	act, the court shall award to the moving party court costs and
372	372	reasonable attorney fees including those incurre d on the motion.
373	373	B. If the court finds that a special motion to dismiss is
374	374	frivolous and solely intended to cause unnecessary delay, the court
375	375	shall award court costs and reasonable a ttorney fees to the party
376	376	opposing the motion.
377	377	SECTION 5. NEW LAW A ne w section of law to be codified
378	378	in the Oklahoma Statutes as Section 683.5 of Title 12, unless there
379	379	is created a duplication in numb ering, reads as follows:
380	380	A. The court shall not grant a speci al motion to dismiss under
381	381	this act in any action brough t to enforce an important
382	382	constitutional or statutory right by the general public, or in an
383	383	action seeking declarator y or injunctive relief against a government
384	384	entity, agency, or employee acting in an official capacity.
385	385	B. This act shall not apply to proceedings under Title 10 A or
386	386	Title 43 of the Oklahoma Statutes, or an application for a
387	387	protective order.
388	388	C. This act shall not:

442	442	information in accordance with the Oklahoma Open Records Act that is

446	446	2. Result in findings or determinations that are admissible
447	447	into evidence at any later stage of the case or in any subsequent

449	449	3. Affect or limit the authority of a court to award sanctions,
450	450	court costs, attorney fees or any other relief available under any
451	451	statute, court rule, or other authority;
452	452	4. Affect, limit, or preclude the right of the moving party to
453	453	any defense, remedy, immunity, or privilege otherwise authorized by
454	454	law;
455	455	5. Affect the substantive law governing any asserted claim; or
456	456	6. Create a private cause of action.
457	457	SECTION 6. This act shall become effective November 1, 2023.
