58 | 51 | | SECTION 1. AMENDATORY 2 O.S. 2021, Section 3 -82, is |
---|

60 | 53 | | Section 3-82. A. LICENSE REQUIRED - 1. It shall be unlawful |
---|
61 | 54 | | for any person to act, operate, or do business or advertise as a |
---|
62 | 55 | | commercial, noncommercial, certified applicator, temporary certified |
---|
63 | 56 | | applicator, service technician, or priva te applicator unless the |
---|
64 | 57 | | person has obtained a valid applicator’s license issued by the S tate |
---|
65 | 58 | | Board of Agriculture for the category of pestic ide application in |
---|
66 | 59 | | which the person is engaged. |
---|
97 | 89 | | license. The Board may establish categories of pesticide |
---|
98 | 90 | | application as necessary . Licenses shall be issued upon application |
---|
99 | 91 | | to the Board on a form prescribed by the B oard. The application |
---|
100 | 92 | | shall contain information re garding the applicant’s qualifications, |

---|
112 | 104 | | b. The Board shall promulgate rules regarding aerial |
---|
113 | 105 | | applicators and applications consistent with federal |
---|
114 | 106 | | law and shall solicit the assis tance of the Federal |
---|
115 | 107 | | Aviation Agency Administration in the enforcement of |
---|
116 | 108 | | this subsection. |
---|
148 | 139 | | 5. A license shall not be issued for the category of pest icide |
---|
149 | 140 | | application of any applicant or representative who has a temporary |
---|
150 | 141 | | certification. |
---|
151 | 142 | | B. CERTIFICATION REQUIRED - 1. A license shall be issued only |
---|
152 | 143 | | after satisfactory comple tion of the certification standards by the |
---|
153 | 144 | | person who shall be the certified ap plicator under the license. |
---|
154 | 145 | | Temporary certified applicators do not qualify as the certified |
---|
155 | 146 | | applicator for a licen se, nor may they act as a certified |
---|
156 | 147 | | applicator. The Board shall deny the application for certification, |
---|
157 | 148 | | recertification, issuance, or renewa l of a certificate or license |
---|
158 | 149 | | for a failure to show proper qualification under the rules or for |
---|
159 | 150 | | violations of any provisions of this section . A certificate in any |
---|
160 | 151 | | category shall be valid for five (5) years unless suspended, |
---|
161 | 152 | | canceled, or revoked by the Boa rd or until recertification is |
---|
162 | 153 | | required for the category, and may be renewed after successful |
---|
163 | 154 | | completion of recerti fication requirements. The Board may require |
---|
164 | 155 | | certified applicators to be recertified once in a five-year period. |
---|
165 | 156 | | 2. A certified service tec hnician identification shall be |
---|
166 | 157 | | issued upon application and completion of certification standards |
---|
167 | 158 | | determined by the Board. Temporary certified applicato rs may |
---|
199 | 189 | | the name of the licensed entity. The licensee shall ensure that the |
---|
200 | 190 | | service technician identification is returned to the Board upon |
---|
201 | 191 | | termination of the employee . A service technician identification |
---|
202 | 192 | | shall be valid for a period of five (5) years unless suspended , |

203 | 193 | | canceled, or revoked by the Board, until recertification is required |

204 | 194 | | by the Board, or until the service technician leaves the employ of |
---|
205 | 195 | | the licensed entity. The Oklahoma Department of Agricult ure, Food, |
---|
206 | 196 | | and Forestry may issue a se rvice technician identi fication upon |
---|
207 | 197 | | completion of the following: |

208 | 198 | | a. a determination is made by the Dep artment that the |
---|
209 | 199 | | applicant has successfully completed the written |
---|
210 | 200 | | examination, |
---|
211 | 201 | | b. the licensed entity provides a co mpleted service |
---|
212 | 202 | | technician identificat ion application form at the time |
---|
213 | 203 | | of testing, and |
---|
214 | 204 | | c. all appropriate fees are paid at the time of testin g. |
---|
215 | 205 | | 3. Each license, except for private applicators, shall expire |
---|
216 | 206 | | on dates established by the Department in adminis trative rules and |
---|
217 | 207 | | may be renewed for t he ensuing calendar year, without penalty or |
---|
218 | 208 | | reexamination, if a properly completed application is file d with the |
---|
250 | 239 | | due date, an additional one-hundred-dollar penalty shall be paid |
---|
251 | 240 | | prior to license renewal. |
---|
252 | 241 | | All private applicator licenses are in effect for five (5) years |
---|
253 | 242 | | and may be renewed by application after completion of a continuing |

254 | 243 | | education program or written exam approved by the Board. |

255 | 244 | | C. The following fees shall be paid to the Board: |

261 | 250 | | 2. A fee of Fifty Dollars ($50.00) shall be paid to the Board |

263 | 252 | | 3. A fee of Fifty Dollars ($50.00) shall be paid to the Board |
---|
264 | 253 | | for each practical examinatio n conducted by the Board; |

266 | 255 | | for the issuance or renewal of a private applicator ’s license; |

---|
311 | 299 | | E. Fees shall be paid to the Board prior to the processing of |
---|
312 | 300 | | any application. |
---|
313 | 301 | | F. Failure to pay any fee identified with licenses, permits, |
---|
314 | 302 | | pesticide registrations, or certification shall require the Board to |
---|
315 | 303 | | deny the application. |
---|
316 | 304 | | G. INSURANCE REQUIRED - 1. The Board shall not issue a |
---|
317 | 305 | | commercial applicator’s license until the applicant has furnished |
---|
318 | 306 | | evidence of an insurance policy or certificate by an insurer or |
---|
319 | 307 | | broker authorized to do business in this state ins uring the |
---|
320 | 308 | | commercial applicator and an y agents against liability res ulting |
---|
351 | 338 | | 2. The amount of liabilit y shall not be less than that set by |
---|
352 | 339 | | the Board for each property damage arising out of actual use of an y |
---|
353 | 340 | | pesticide. The liability shall be maintained at not less than that |
---|
354 | 341 | | sum at all times during the licensing period . The Board shall be |
---|
355 | 342 | | notified fifteen (15) days prior to any reducti on in liability. |
---|
356 | 343 | | 3. If the furnished liability becomes unsatisfactory, t he |
---|
357 | 344 | | applicant shall immediately execute new liability upon notice from |
---|
358 | 345 | | the Board. If new liability is not immediate ly obtained, the Board |
---|
359 | 346 | | shall, upon notice, cancel the license . It shall be unlawful for |
---|
360 | 347 | | the person to engage in the business of applying pes ticides until |
---|
361 | 348 | | the liability is brought into compliance and the license reinstated. |
---|
362 | 349 | | H. DAMAGES - 1. An award of damages to growing crops or plants |
---|
363 | 350 | | resulting from negligent application or unintentional dr ift off |
---|
364 | 351 | | target that is a violation of the Combined Pesticide Law shall be |
---|
365 | 352 | | limited to: |
---|
366 | 353 | | a. crops or plants that are insurable under the Federal |
---|
367 | 354 | | Crop Insurance Corporatio n program, or |
---|
368 | 355 | | b. crops or plants that are directly sold by the producer |
---|
369 | 356 | | to the consumer. |
---|
370 | 357 | | In a civil action arising from damages to growing crops or |
---|
371 | 358 | | plants pursuant to this subsection , an award of actual damages sh all |
---|
402 | 388 | | exceed an amount equal to the county average yield for the specific |
---|
403 | 389 | | crop or plant as calculat ed by the Federal Crop Insurance |
---|
404 | 390 | | Corporation program. |
---|
405 | 391 | | 2. Prior to filing an action again st an applicator for damages |
---|
406 | 392 | | to growing crops or plants, any person alleging damages to growing |
---|
407 | 393 | | crops or plants shall: |
---|
408 | 394 | | a. within ninety (90) calendar days of the date that the |
---|
409 | 395 | | alleged damages occurred or p rior to the time that |
---|
410 | 396 | | twenty-five percent (25%) of the allegedly damaged |
---|
411 | 397 | | crops or plants are harvested, whichever occurs first, |
---|
412 | 398 | | file a written complaint statement with the Department |
---|
413 | 399 | | regarding the alleged damages, and |
---|
414 | 400 | | b. between the date of filing of the w ritten complaint |
---|
415 | 401 | | pursuant to subparagraph a of this paragraph and the |
---|
416 | 402 | | date harvesting or destruction of the allegedly |
---|
417 | 403 | | damaged crops or plants occurs, allow the applicator |
---|
418 | 404 | | and the representatives of the applicator reaso nable |
---|
419 | 405 | | access to the property to inspec t and take samples of |
---|
420 | 406 | | the allegedly damaged crops o r plants during |
---|
421 | 407 | | reasonable hours. The representatives of the |
---|
422 | 408 | | applicator may include, but not be limited to, crop |
---|
452 | 437 | | destruction of the allegedly damag ed crops or plants |
---|
453 | 438 | | in the ordinary course of busines s and practice. |
---|
454 | 439 | | 2. 3. Any person failing to comply with paragraph 1 2 of this |
---|
455 | 440 | | subsection shall be barred from fili ng an action for damages against |
---|
456 | 441 | | the applicator. |
---|
457 | 442 | | I. PERMIT REQUIRED – 1. It shall be unlawful for any person to |
---|
458 | 443 | | sell, offer for sale, or di stribute within this state any restricted |
---|
459 | 444 | | use pesticide without first obtaining a restricted use pesticide |
---|
460 | 445 | | dealer’s permit issued by the Board. |
---|
461 | 446 | | 2. A permit may be issued by the Board in any category of |
---|
462 | 447 | | pesticide sales if the applicant qualifies under the provisions of |
---|
463 | 448 | | this section and the applicant is limited to the category of |
---|
464 | 449 | | pesticide sales named on the permit . The Board may establish |
---|
465 | 450 | | categories of pesticide sales as necessary. |
---|
466 | 451 | | 3. The permit shall be issued only upon application on a form |
---|
467 | 452 | | prescribed by the Board and the application shall contain |
---|
468 | 453 | | information regarding the applicant ’s proposed operation and other |
---|
469 | 454 | | information as specified by the Board. |
---|
470 | 455 | | 4. Each business location engaged in the sale or di stribution |
---|
471 | 456 | | of restricted use pesticides shall requir e a separate permit. |
---|
472 | 457 | | 5. The annual permit fee for a restricted use pesticide dealer |
---|
473 | 458 | | permit shall be Fifty Dollars ($50.00) for each location. |

507 | 491 | | interstate commerce shall be registered with t he Board. |
---|
508 | 492 | | 2. The registrant shall file with the Board a statement |
---|
509 | 493 | | including, but not limited to: |
---|
510 | 494 | | a. the name and address of the registrant and the name |
---|
511 | 495 | | and address of the person whose name shall appear o n |
---|
512 | 496 | | the label, if other than the registrant, |
---|
513 | 497 | | b. the name of the pesticide or device, |
---|
514 | 498 | | c. a complete copy of the labeling accompanying the |
---|
515 | 499 | | pesticide or device and a statem ent of all claims to |
---|
516 | 500 | | be made for it, and directions for use, and |
---|
517 | 501 | | d. if requested by the B oard, a full description of the |
---|
518 | 502 | | tests made and the r esults upon which the claims are |
---|
519 | 503 | | based. In renewing a registration, a statement shall |
---|
520 | 504 | | be required only with respec t to information which is |
---|
521 | 505 | | different from the information furnished when the |
---|
522 | 506 | | pesticide or device was last registered. |
---|
523 | 507 | | 3. Each registrant shal l pay to the Board an annual |
---|
524 | 508 | | registration fee of Two Hundred Ten Dollars ($210.00) for each |

557 | 540 | | for unwanted pesticide disposal. This amount shall be deposited |

558 | 541 | | into the State Department o f Agriculture Unwanted Pesticide Disposal |
---|
559 | 542 | | Fund and shall be dedicated for this use only. |
---|
560 | 543 | | 4. The Board may require the submission of the complete formula |
---|
561 | 544 | | of any pesticide. Trade secrets and formulations submitted by the |
---|
562 | 545 | | registrant may be kept confidential . If it appears to the Board |
---|
563 | 546 | | that the composition of the pesticide is adequate to warrant the |
---|
564 | 547 | | proposed claims and if the pesticide, its labeling, and ot her |
---|
565 | 548 | | material required to be submitted comply with t he requirements of |
---|
566 | 549 | | this section, then the pesticide shall be registered. |
---|
567 | 550 | | 5. If it does not appear to the Board that the pesticide or |
---|
568 | 551 | | device is adequate to warrant the proposed claims for it or if the |
---|
569 | 552 | | pesticide or device, its labeling, and other material r equired to be |
---|
570 | 553 | | submitted do not comply with the provi sions of this section, it |
---|
571 | 554 | | shall notify the applicant of the deficiencies in the pesticide, |
---|
572 | 555 | | device, labeling, or oth er material required and afford the |
---|
573 | 556 | | applicant an opportunity to make the necessary correc tions. If the |
---|
574 | 557 | | applicant claims, in writing, that th e corrections are not necessary |
---|
575 | 558 | | and requests in writing a hearing regarding the registration of the |
---|

610 | 592 | | 6. The Board may require th at pesticides be distinctively |
---|
611 | 593 | | colored or discolored to protect the public health. |
---|
612 | 594 | | 7. Registration shall not be re quired in the case of a |
---|
613 | 595 | | pesticide shipped from one plant or place within this state to |
---|
614 | 596 | | another plant or place within this state that is opera ted by the |
---|
615 | 597 | | same person. |
---|
616 | 598 | | K. CATEGORIES OF LICENSES AND PERMITS – The Board may establish |
---|
617 | 599 | | any category of license fo r pesticide application or any categor y of |
---|
618 | 600 | | permit for pesticide sales. |
---|
619 | 601 | | L. PERMIT AND PESTICIDE REGISTRATION EXPIRATION – 1. All |
---|
620 | 602 | | permits for pesticide sales shall be issued for a period of one (1) |
---|
621 | 603 | | year and the permits shall be renewed annually and shall e xpire on a |
---|
622 | 604 | | date determined by the Boar d. A permit may be renewed for the |
---|
623 | 605 | | ensuing year, without penalty, if a properly completed application |
---|
624 | 606 | | is filed with the Board not later than the fifteenth day of the |
---|

---|
664 | 645 | | M. PESTICIDE PRODUCING ESTABLISHMENTS – 1. Definitions as used |
---|
665 | 646 | | in this subsection: |
---|
666 | 647 | | a. “establishment” means any site where a pesticide |
---|
667 | 648 | | product, active ingredient or device is produced |
---|
668 | 649 | | within the state, |
---|
669 | 650 | | b. “produce” means to manufacture, prepare, propagate, |
---|
670 | 651 | | compound or process any pesticide or to package, |
---|
671 | 652 | | repackage, label, relabel or otherwise change the |
---|
672 | 653 | | container of any pesticide or device, and |
---|
673 | 654 | | c. “producer” means any person who produces, |
---|
674 | 655 | | manufactures, prepares, compounds, propagates or |
---|
675 | 656 | | processes any active ingredient, pesticide, or device |
---|

818 | 796 | | resolution of a complaint is the completion of the appropriate |
