5750 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5851 SECTION 1. AMENDATORY 2 O.S. 2021, Section 3 -82, is
5952 amended to read as follows:
6053 Section 3-82. A. LICENSE REQUIRED - 1. It shall be unlawful
6154 for any person to act, operate, or do business or advertise as a
6255 commercial, noncommercial, certified applicator, temporary certified
6356 applicator, service technician, or priva te applicator unless the
6457 person has obtained a valid applicator’s license issued by the S tate
6558 Board of Agriculture for the category of pestic ide application in
6659 which the person is engaged.
60+2. A license may be issued by the Board in any category of
61+pesticide application if the applicant qualif ies and the applicant
62+is limited to the category of pesticide application named on the

94-2. A license may be issued by the Board in any category of
95-pesticide application if the applicant qualif ies and the applicant
96-is limited to the category of pesticide application named on the
9789 license. The Board may establish categories of pesticide
9890 application as necessary . Licenses shall be issued upon application

10395 3. a. An aerial license shall not be issued or be valid

109101 aerial license and pilots working u nder a license may

112104 b. The Board shall promulgate rules regarding aerial
113105 applicators and applications consistent with federal
114106 law and shall solicit the assis tance of the Federal
115107 Aviation Agency Administration in the enforcement of
116108 this subsection.

148139 5. A license shall not be issued for the category of pest icide
149140 application of any applicant or representative who has a temporary
150141 certification.
151142 B. CERTIFICATION REQUIRED - 1. A license shall be issued only
152143 after satisfactory comple tion of the certification standards by the
153144 person who shall be the certified ap plicator under the license.
154145 Temporary certified applicators do not qualify as the certified
155146 applicator for a licen se, nor may they act as a certified
156147 applicator. The Board shall deny the application for certification,
157148 recertification, issuance, or renewa l of a certificate or license
158149 for a failure to show proper qualification under the rules or for
159150 violations of any provisions of this section . A certificate in any
160151 category shall be valid for five (5) years unless suspended,
161152 canceled, or revoked by the Boa rd or until recertification is
162153 required for the category, and may be renewed after successful
163154 completion of recerti fication requirements. The Board may require
164155 certified applicators to be recertified once in a five-year period.
165156 2. A certified service tec hnician identification shall be
166157 issued upon application and completion of certification standards
167158 determined by the Board. Temporary certified applicato rs may
159+qualify as a certified service technician. No person shall act, do
160+business as, or advertise as a service technician unless the person
161+has met all the qualifications and standards as required by the
162+Board. The service technicians’ identification shall be issued in

195-qualify as a certified service technician. No person shall act, do
196-business as, or advertise as a service technician unless the person
197-has met all the qualifications and standards as required by the
198-Board. The service technicians’ identification shall be issued in
199189 the name of the licensed entity. The licensee shall ensure that the
200190 service technician identification is returned to the Board upon
201191 termination of the employee . A service technician identification
202192 shall be valid for a period of five (5) years unless suspended ,
203193 canceled, or revoked by the Board, until recertification is required
204194 by the Board, or until the service technician leaves the employ of
205195 the licensed entity. The Oklahoma Department of Agricult ure, Food,
206196 and Forestry may issue a se rvice technician identi fication upon
207197 completion of the following:
208198 a. a determination is made by the Dep artment that the
209199 applicant has successfully completed the written
210200 examination,
211201 b. the licensed entity provides a co mpleted service
212202 technician identificat ion application form at the time
213203 of testing, and
214204 c. all appropriate fees are paid at the time of testin g.
215205 3. Each license, except for private applicators, shall expire
216206 on dates established by the Department in adminis trative rules and
217207 may be renewed for t he ensuing calendar year, without penalty or
218208 reexamination, if a properly completed application is file d with the
209+Board on a date established by the Department . If the application
210+is not received by the due date, a penalty of twice the amount of
211+the renewal fee shall be charged for renewal of the license. If the
212+application is not received within thirty (30) days following the

246-Board on a date established by the Department . If the application
247-is not received by the due date, a penalty of twice the amount of
248-the renewal fee shall be charged for renewal of the license. If the
249-application is not received within thirty (30) days following the
250239 due date, an additional one-hundred-dollar penalty shall be paid
251240 prior to license renewal.
252241 All private applicator licenses are in effect for five (5) years
253242 and may be renewed by application after completion of a continuing
254243 education program or written exam approved by the Board.
255244 C. The following fees shall be paid to the Board:
256245 1. A fee of One Hundred Dollars ($100.00) for each cat egory of
257246 pesticide application shall be paid to the Board for the issuance or
258247 renewal of a commercial a pplicator business license. Not more than
259248 Five Hundred Dollars ($500.00) total category fees shall be charged
260249 annually to any business location of an ap plicator;
261250 2. A fee of Fifty Dollars ($50.00) shall be paid to the Board
262251 for each written examination c onducted by the Board;
263252 3. A fee of Fifty Dollars ($50.00) shall be paid to the Board
264253 for each practical examinatio n conducted by the Board;
265254 4. A fee of Twenty Dollars ($20.00) shall be paid to the Board
266255 for the issuance or renewal of a private applicator ’s license;
267256 5. A fee of Fifty Dollars ($50.00) shall be paid to the Board
268257 for the issuance or renewal of a noncomm ercial business license.
269258 Not more than Two Hundred Fifty Dollars ($250.00) total category
259+fees shall be charged annually to any noncommercia l business
260+location of an applicator;
261+6. A fee of Twenty Dollars ($20.00) shall be paid to the Board
262+for the issuance or renewal of service technician i dentification;

301289 7. A fee of Ten Dollars ($10.00) shall be paid to the Board for
302290 the issuance of duplica te licenses or certificates or transfer of
303291 service technician identification;
304292 8. A fee of Fifty Dollars ($50.00) s hall be paid to the Board
305293 for each recertification procedure; and
306294 9. A fee of One Hundred Dollars ($100.00) shall be paid to the
307295 Board for each reciprocal certification procedure for applicator
308296 certifications.
309297 D. All fees shall be deposited in the State Department of
310298 Agriculture Revolving Fu nd.
311299 E. Fees shall be paid to the Board prior to the processing of
312300 any application.
313301 F. Failure to pay any fee identified with licenses, permits,
314302 pesticide registrations, or certification shall require the Board to
315303 deny the application.
316304 G. INSURANCE REQUIRED - 1. The Board shall not issue a
317305 commercial applicator’s license until the applicant has furnished
318306 evidence of an insurance policy or certificate by an insurer or
319307 broker authorized to do business in this state ins uring the
320308 commercial applicator and an y agents against liability res ulting
309+from the operations of the commercial applicator. The insurance
310+shall not be applied to damage or injury to agricultural crops,
311+plants, or land being worked upon by the commercial applicator.

348-from the operations of the commercial applicator. The insurance
349-shall not be applied to damage or injury to agricultural crops,
350-plants, or land being worked upon by the commercial applicator.
351338 2. The amount of liabilit y shall not be less than that set by
352339 the Board for each property damage arising out of actual use of an y
353340 pesticide. The liability shall be maintained at not less than that
354341 sum at all times during the licensing period . The Board shall be
355342 notified fifteen (15) days prior to any reducti on in liability.
356343 3. If the furnished liability becomes unsatisfactory, t he
357344 applicant shall immediately execute new liability upon notice from
358345 the Board. If new liability is not immediate ly obtained, the Board
359346 shall, upon notice, cancel the license . It shall be unlawful for
360347 the person to engage in the business of applying pes ticides until
361348 the liability is brought into compliance and the license reinstated.
362349 H. DAMAGES - 1. An award of damages to growing crops or plants
363350 resulting from negligent application or unintentional dr ift off
364351 target that is a violation of the Combined Pesticide Law shall be
365352 limited to:
366353 a. crops or plants that are insurable under the Federal
367354 Crop Insurance Corporatio n program, or
368355 b. crops or plants that are directly sold by the producer
369356 to the consumer.
370357 In a civil action arising from damages to growing crops or
371358 plants pursuant to this subsection , an award of actual damages sh all
359+not exceed the amount of compensation a producer has received from
360+proven yield from the affected area. If the producer has no proven
361+yield from the affected area, an award of actual damages shall not

399-not exceed the amount of compensation a producer has received from
400-proven yield from the affected area. If the producer has no proven
401-yield from the affected area, an award of actual damages shall not
402388 exceed an amount equal to the county average yield for the specific
403389 crop or plant as calculat ed by the Federal Crop Insurance
404390 Corporation program.
405391 2. Prior to filing an action again st an applicator for damages
406392 to growing crops or plants, any person alleging damages to growing
407393 crops or plants shall:
408394 a. within ninety (90) calendar days of the date that the
409395 alleged damages occurred or p rior to the time that
410396 twenty-five percent (25%) of the allegedly damaged
411397 crops or plants are harvested, whichever occurs first,
412398 file a written complaint statement with the Department
413399 regarding the alleged damages, and
414400 b. between the date of filing of the w ritten complaint
415401 pursuant to subparagraph a of this paragraph and the
416402 date harvesting or destruction of the allegedly
417403 damaged crops or plants occurs, allow the applicator
418404 and the representatives of the applicator reaso nable
419405 access to the property to inspec t and take samples of
420406 the allegedly damaged crops o r plants during
421407 reasonable hours. The representatives of the
422408 applicator may include, but not be limited to, crop
409+consultants, bondsmen, and insurers . Nothing in this
410+subparagraph shall limit in any way t he harvesting or

450-consultants, bondsmen, and insurers . Nothing in this
451-subparagraph shall limit in any way t he harvesting or
452437 destruction of the allegedly damag ed crops or plants
453438 in the ordinary course of busines s and practice.
454439 2. 3. Any person failing to comply with paragraph 1 2 of this
455440 subsection shall be barred from fili ng an action for damages against
456441 the applicator.
457442 I. PERMIT REQUIRED – 1. It shall be unlawful for any person to
458443 sell, offer for sale, or di stribute within this state any restricted
459444 use pesticide without first obtaining a restricted use pesticide
460445 dealer’s permit issued by the Board.
461446 2. A permit may be issued by the Board in any category of
462447 pesticide sales if the applicant qualifies under the provisions of
463448 this section and the applicant is limited to the category of
464449 pesticide sales named on the permit . The Board may establish
465450 categories of pesticide sales as necessary.
466451 3. The permit shall be issued only upon application on a form
467452 prescribed by the Board and the application shall contain
468453 information regarding the applicant ’s proposed operation and other
469454 information as specified by the Board.
470455 4. Each business location engaged in the sale or di stribution
471456 of restricted use pesticides shall requir e a separate permit.
472457 5. The annual permit fee for a restricted use pesticide dealer
473458 permit shall be Fifty Dollars ($50.00) for each location.

501485 6. The Board may require a certified applicator to be presen t
502486 at any location where designated restricted use pe sticide sales
503487 occur.
504488 J. PESTICIDE REGISTRATION REQUIRED – 1. Every pesticide or
505489 device distributed, sold, or offe red for sale within this state or
506490 delivered for transportation or transported in intrasta te or
507491 interstate commerce shall be registered with t he Board.
508492 2. The registrant shall file with the Board a statement
509493 including, but not limited to:
510494 a. the name and address of the registrant and the name
511495 and address of the person whose name shall appear o n
512496 the label, if other than the registrant,
513497 b. the name of the pesticide or device,
514498 c. a complete copy of the labeling accompanying the
515499 pesticide or device and a statem ent of all claims to
516500 be made for it, and directions for use, and
517501 d. if requested by the B oard, a full description of the
518502 tests made and the r esults upon which the claims are
519503 based. In renewing a registration, a statement shall
520504 be required only with respec t to information which is
521505 different from the information furnished when the
522506 pesticide or device was last registered.
523507 3. Each registrant shal l pay to the Board an annual
524508 registration fee of Two Hundred Ten Dollars ($210.00) for each

552535 pesticide or device lab el registered. These fees shall be us ed by
553536 the Oklahoma Department of Agriculture, Food, and Forestry for
554537 purposes of administering pesticid e management programs. A portion
555538 of these fees, in the amount of Three Hundred Thousand Dollars
556539 ($300,000.00) annually, shall be dedicated for conductin g programs
557540 for unwanted pesticide disposal. This amount shall be deposited
558541 into the State Department o f Agriculture Unwanted Pesticide Disposal
559542 Fund and shall be dedicated for this use only.
560543 4. The Board may require the submission of the complete formula
561544 of any pesticide. Trade secrets and formulations submitted by the
562545 registrant may be kept confidential . If it appears to the Board
563546 that the composition of the pesticide is adequate to warrant the
564547 proposed claims and if the pesticide, its labeling, and ot her
565548 material required to be submitted comply with t he requirements of
566549 this section, then the pesticide shall be registered.
567550 5. If it does not appear to the Board that the pesticide or
568551 device is adequate to warrant the proposed claims for it or if the
569552 pesticide or device, its labeling, and other material r equired to be
570553 submitted do not comply with the provi sions of this section, it
571554 shall notify the applicant of the deficiencies in the pesticide,
572555 device, labeling, or oth er material required and afford the
573556 applicant an opportunity to make the necessary correc tions. If the
574557 applicant claims, in writing, that th e corrections are not necessary
575558 and requests in writing a hearing regarding the registration of the

603585 pesticide or device, the Board shall provide an oppor tunity for a
604586 hearing before refusing to issue the r egistration. In order to
605587 protect the public, the Bo ard may at any time cancel the
606588 registration of a product or device . In no event, shall
607589 registration of a pesticide or device be considered as a defense or
608590 excuse for the commission of any offense prohibi ted under this
609591 section.
610592 6. The Board may require th at pesticides be distinctively
611593 colored or discolored to protect the public health.
612594 7. Registration shall not be re quired in the case of a
613595 pesticide shipped from one plant or place within this state to
614596 another plant or place within this state that is opera ted by the
615597 same person.
616598 K. CATEGORIES OF LICENSES AND PERMITS – The Board may establish
617599 any category of license fo r pesticide application or any categor y of
618600 permit for pesticide sales.
619601 L. PERMIT AND PESTICIDE REGISTRATION EXPIRATION – 1. All
620602 permits for pesticide sales shall be issued for a period of one (1)
621603 year and the permits shall be renewed annually and shall e xpire on a
622604 date determined by the Boar d. A permit may be renewed for the
623605 ensuing year, without penalty, if a properly completed application
624606 is filed with the Board not later than the fifteenth day of the
625607 month first following the date of expiration . If the application is

655636 2. All pesticide registrations shall be issued for a period of
656637 one (1) year. The registration shall be renewed annua lly and shall
657638 expire on a date to be d etermined by the Board. Pesticide
658639 registrations may be renewed for the ensuing year, without penalty,
659640 if a properly completed application is filed with the Board not
660641 later than the fifteenth day of the month first fol lowing the date
661642 of expiration. If the application is not received by that date, a
662643 penalty of twice the amount of the renewal fee shall be ch arged for
663644 renewal of the pesticide registration.
664645 M. PESTICIDE PRODUCING ESTABLISHMENTS – 1. Definitions as used
665646 in this subsection:
666647 a. “establishment” means any site where a pesticide
667648 product, active ingredient or device is produced
668649 within the state,
669650 b. “produce” means to manufacture, prepare, propagate,
670651 compound or process any pesticide or to package,
671652 repackage, label, relabel or otherwise change the
672653 container of any pesticide or device, and
673654 c. “producer” means any person who produces,
674655 manufactures, prepares, compounds, propagates or
675656 processes any active ingredient, pesticide, or device
676657 as used in producing a pestici de.

704684 2. It shall be unlawful for any p erson to produce within this
705685 state any pesticide, active ingredient or device without first
706686 obtaining a pesticide producer establishment permit issued by the
707687 Board.
708688 3. The permit shall be issued only upon application on a form
709689 prescribed by the Board . The application shall contain information
710690 regarding the proposed operation of the applicant and other
711691 information as specified by the Board. If at any time there is a
712692 change of the information provided in or on the appl ication for a
713693 pesticide producer estab lishment permit, the producer must notify
714694 the Board in writing within thirty (30) calendar days of the change.
715695 4. The producer shall file a statement with the Board including
716696 but not limited to:
717697 a. the name and address of the company,
718698 b. the name and address of the establishment as well as
719699 the physical location, if different than the mailing
720700 address,
721701 c. the name of any pesticide, active ingredient, or
722702 device, and
723703 d. the name and address and other pertinent contact
724704 information for the responsible party.
725705 5. All permits for pesticide producer establishments shall be
726706 issued for a period of one (1) year and sha ll be renewed annually.
727707 All permits shall expire on June 30 each year and may be renewed

756735 the Board not later than the fifteenth day of the month first
757736 following the date of expiration. If the application is not
758737 received by that date, a penalty of twice the amount of the renewal
759738 fee shall be charged for renewal of the permit.
760739 6. Each pesticide producer establishment location engaged in
761740 the production of pesticides, active ingredients or dev ices shall
762741 require a separate permit.
763742 7. The annual permit fee for a pesticide producer establishment
764743 shall be One Hundred Dollars ($100.00) for each lo cation.
765744 8. If requested by the Board, a complete copy of all labeling,
766745 Material Safety Data Sheets, te chnical information associated with
767746 the pesticide, active ingredient, or device and a statement of all
768747 claims to be made as well as directions and use mu st be submitted to
769748 the Board.
770749 9. In order to determine compliance with state and federal
771750 laws, the Board may request a full disclosure of inventory records,
772751 sales and distribution records, and any other information de emed
773752 necessary by the Board.
774753 10. Every producer shall keep accurate records pertaining to
775754 pesticide, active ingredient, or device production and distribution
776755 as required by the Board . The records of the producer shall be kept
777756 intact at the principal prod ucing location in this state for at
778757 least two (2) years after the date of production and distribution

807785 immediately upon request in person, at any time during the regular
808786 business hours of the producer. Copies of records shall be
809787 furnished to any authorized agent of the Board within seven (7)
810788 working days of a written request, i n summary form, by mail, fax,
811789 email, website, or any other electronic media customarily used.
812790 N. COMPLAINT RESOLUTION - Upon receipt of a written compla int,
813791 the Board shall notify the person filing the complaint in writing of
814792 its receipt and status within two (2) working days. The person whom
815793 the complaint is filed against shall also be notified within two (2)
816794 working days. Notification that a complaint has been filed may also
817795 be given to the landowner or operator when appropriate. The
818796 resolution of a complaint is the completion of the appropriate
819797 administrative, jurisdictional, or legal remedies to the extent
820798 possible by the Department. The complainant shall be notified in
821799 writing within seven (7) working days after resolution of the
822800 complaint.
823801 SECTION 2. NEW LAW A new section of law to be codified
824802 in the Oklahoma Statutes as Section 73 of Title 23, unless there is
825803 created a duplication in numbering, reads as follows:
826804 A. An award of damages to growing crops or plants resulting
827805 from negligent application or unintentional drift off tar get that is
828806 a violation of the Combined Pesticide Law shall be limited to:

856833 1. Crops or plants that are insurable under the Federal Crop
857834 Insurance Corporation program; or
858835 2. Crops or plants that are directly sold by the producer to
859836 the consumer.
860837 B. In a civil action arising from damages to growing crops or
861838 plants pursuant to subsection A of this sec tion, an award of actual
862839 damages shall not exceed t he amount of compensation a producer has
863840 received from proven yield from the affected area. If the producer
864841 has no proven yield from the affected area, an award of ac tual
865842 damages shall not exceed an amoun t equal to the county average yield
866843 for the specific crop or plant as calculated by the Federal Crop
867844 Insurance Corporation program.
868845 SECTION 3. It being immediately necessary for the preservation
869846 of the public peace, health or safety, an emergency is hereby
870847 declared to exist, by reason wher eof this act shall take effect and
871848 be in full force from and after its passage an d approval.
