65	65	An Act relating to state employee leave; allowing
66	66	state employees to take a leave of absence under
67	67	certain circumstances; requir ing that certain
68	68	employees continue to receive compensation during
69	69	certain leaves of absence; providing protections for
70	70	certain employees during a leave of absence;

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 840-2.20D of Title 74, unless
80	80	there is created a duplication in numb ering, reads as follows:
81	81	A. Any employee of this state, its departments , or agencies,
82	82	shall be granted a temporary leave of abs ence upon the initial
83	83	placement in his or her home of a child in the custody of the
84	84	Department of Human Services . Leaves of absence under this section
85	85	shall be requested in advance and shall not exceed a total of ten
86	86	(10) workdays in a calendar year.

138	138	B. An employee may take leave under thi s section prior to the
139	139	actual placement of a child in his or her home if an absence from
140	140	work is required in order for the placement to proceed.
141	141	C. An employee who is granted a leave of absence pursuant to
142	142	this section shall receive the base state pay without interruption
143	143	during the leave of absence. The service of the employee shall be
144	144	considered uninterrupted for the purpose of determining eligibility
145	145	for any benefit that might other wise be affected, including
146	146	determinations relating to seniority, compensation, and performance-
147	147	based awards.
148	148	D. A state agency shall not penalize an employee for requesting
149	149	or obtaining a leave of absence pursuant to the provision s of this
150	150	section.
151	151	SECTION 2. This act shall become effective Nov ember 1, 2023.
