6565 An Act relating to state employee leave; allowing

6767 certain circumstances; requir ing that certain
6868 employees continue to receive compensation during
6969 certain leaves of absence; providing protections for

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 840-2.20D of Title 74, unless
8080 there is created a duplication in numb ering, reads as follows:
8181 A. Any employee of this state, its departments , or agencies,
8282 shall be granted a temporary leave of abs ence upon the initial
8383 placement in his or her home of a child in the custody of the
8484 Department of Human Services . Leaves of absence under this section
8585 shall be requested in advance and shall not exceed a total of ten
8686 (10) workdays in a calendar year.

138138 B. An employee may take leave under thi s section prior to the
139139 actual placement of a child in his or her home if an absence from
140140 work is required in order for the placement to proceed.
141141 C. An employee who is granted a leave of absence pursuant to
142142 this section shall receive the base state pay without interruption
143143 during the leave of absence. The service of the employee shall be
144144 considered uninterrupted for the purpose of determining eligibility
145145 for any benefit that might other wise be affected, including
146146 determinations relating to seniority, compensation, and performance-
147147 based awards.
148148 D. A state agency shall not penalize an employee for requesting
149149 or obtaining a leave of absence pursuant to the provision s of this
150150 section.
151151 SECTION 2. This act shall become effective Nov ember 1, 2023.
