55	50		BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
56	51		SECTION 1. AMENDATORY Section 1, Chapter 280, O.S.L.
57	52		2022 (70 O.S. Supp. 2022, Section 11 -202), is amended to read as
58	53		follows:
59	54		Section 11-202. A. A school district, charter school, virtual
60	55		charter school, state agency, public library, or university
61	56		institution of higher educ ation within The Oklahoma State System of
62	57		Higher Education may offer digital or online library database
63	58		resources to students i n kindergarten through twelfth grade only if
64	59		the vendor, person, or entity providing the resources verifies that
	60	+	all the resources comply with the provisions of subsection B of this
	61	+	section.

92		-	all the resources comply with the provisions of subsection B of this

94	88		B. Digital or online library datab ase resources offered by
95	89		school districts, charter schools, virtual charter schools, state
96	90		agencies, public libraries, or universities to students in
97	91		kindergarten through twelfth grade shall have safety policies and
98	92		technology protection measures that:
99	93		1. Prohibit and prevent a user o f the resource from sending,
100	94		receiving, viewing, or downloading materials that are child
101	95		pornography or obscene materials, as defined in Section 1024.1 of
102	96		Title 21 of the Oklahoma Statutes, or materials that depict child
103	97		sexual exploitation, as defined in Section 843.5 of Title 21 of the
104	98		Oklahoma Statutes; and
105	99		2. Filter or block access to child pornography or obscene
106	100		materials, as defined in Section 1024.1 of Title 21 of the Oklahoma
107	101		Statutes, or materials that depict child sexual exploitation, as
108	102		defined in Section 843.5 of Title 21 of the Oklahoma Statutes.
109	103		C. Notwithstanding any contract provision to the contrary, if a
110	104		provider of digital or online library resources fails to comply with
111	105		the requirements of subsection B of this section, the school
112	106		district, public charter school, state agency, public library, or
113	107		university institution of higher education shall withhold further
114	108		payments, if any, to the provider pending verification of
115	109		compliance.
	110	+	D. If a provider of digital or online library database
	111	+	resources fails to timely verify that the provider is in compliance

143		-	D. If a provider of digital or online library database
144		-	resources fails to timely verify that the provider is in compliance
145	138		with the safety policies and requirements of subsection B of this
146	139		section, the school district, public charter school, state agen cy,
147	140		public library, or university institution of higher education shall
148	141		consider the provider’s act of noncompliance a breach o f contract.
149	142		E. No later than December 1 of each year, libraries shall
150	143		submit to the Speaker of the Oklahoma House of Representative s and
151	144		President Pro Tempore of the Oklahoma State Senate an aggregate
152	145		written report on any issues related to provider comp liance with
153	146		technology protection measures required by subsection B of this
154	147		section.
155	148		F. Employees of school districts, charter schools, virtual
156	149		charter schools, state agencies, public libraries, and universities
157	150		shall not be exempt from prosecution for willful violations of state
158	151		law prohibiting indecent exposure to obscene material or child
159	152		pornography as provided in Section 1021 of Title 21 of the Oklahoma
160	153		Statutes.
161	154		G. Nothing in this act shall be construed in a manner that
162	155		applies to digital or online lib rary database resources off ered by
163	156		institutions of higher educa tion when the primary purpose of the
164	157		resources is for education or research.
165	158		SECTION 2. This act shall become effective July 1, 2023.

	160	+	of the public peace, heal th, or safety, an emergency is hereby
