3258 SECTION 1. AMENDATORY 19 O.S. 2021, Section 298, is
3359 amended to read as follows:

3560 Section 298. A. Every county clerk in this state shall require
3661 that the mandates of the Legislature be c omplied with, as expressed
3762 in Sections 287 and 291 of this title, and for that purpose, every
3863 instrument offered which may be accepted by the county clerk for
3964 recording, affecting specific real property whether of conveyance,
4065 encumbrance, assignment, or re lease of encumbrance, lease,
4166 assignment of lease or release of lease, shall be an original or

4294 certified copy of an original instrument and clearly legible in
4395 accordance with the provisions of subsection B of this section, and
4496 shall by its own terms describ e the property by its specific legal
4597 description, and provide such information as is necessary for
4698 indexing as required in Sections 287 and 291 of this title, and on

4999 each such instrument shall be listed the mailing address of the
50100 grantee, mortgagee, assign ee or other designated party to which the
51101 instrument is to be delivered after recording. If an instrument
52102 offered to a county clerk for recording contains more than twenty -
53103 five legal descriptions requiring separate entries in the indexes
54104 required by Sections 287 and 291 of this title, the des criptions
55105 shall be sorted by addition, block, and lot if platted property, or
56106 by township, range, and section if described by governmental survey
57107 description. Any instrument offered to a county clerk for recording
58108 containing more than twenty -five legal descriptions per page,
59109 counted as each description which could require a sepa rate line
60110 entry in the numerical index, shall be accompanied by an additional
61111 filing fee of One Dollar ($1.00) per legal description in excess of
62112 twenty-five legal descriptions per page to be paid to the county
63113 clerk. Unless the person offering a nonconfo rming instrument for
64114 filing is willing to reform the instrument to conform to statutory
65115 requirements, for which purpose it may be withdrawn and refiled
66116 during the same business day, the county clerk may refuse to record
67117 the same in the records of deeds, le ases or mortgages or to index

68145 the same upon the index records referred to in Section 287 or 291 of
69146 this title, or to file or record the same in the office of the
70147 county clerk.

72148 B. All documents filed of record in the office of the county
73149 clerk pursuant to subsection A of this section or pursuant to any
74150 other law shall be an original or a certified copy of an original
75151 document. Such documents sha ll be clearly legible, in the English
76152 language, using xerographically reproducible dark ink, on paper of a
77153 color that is xerographically reproducible by the copying equipment
78154 in use by the county clerk. Unless otherwise provided by law, such
79155 documents shall measure no larger than eight and on e-half (8 1/2)
80156 inches by fourteen (14) inches. All documents shall provide an area
81157 free of printed information sufficient in size to accommodate
82158 affixation of the documentary stamps required by Section 3201 of
83159 Title 68 of the Oklahoma Statutes, any certif ication of the payment
84160 of mortgage taxes required by Section 1901 et seq. o f Title 68 of
85161 the Oklahoma Statutes, and the recording information affixed by the
86162 county clerk upon acceptance of a document for recordation. Any
87163 part of a signature or any stray m arkings within the margin shall
88164 not void the requirements for accepting and filing any document by
89165 any county within the state, provided there remains sufficient space
90166 for the affixation of stamps and recording informa tion without

93167 covering language contain ed in the instrument. If an instrument
94168 submitted to the county clerk for r ecording does not contain

95196 sufficient space for the affixation of such stamps and recording
96197 information without covering language contained in t he instrument,
97198 the county clerk shall attach an additional page to the document to
98199 provide for the affixation of such stamps and recording information.
99200 A county clerk shall not charge any additional fee or fine for stray
100201 markings within the margin of a do cument. The top margin of all
101202 documents shall be at least one (1) inch two (2) inches and all
102203 other margins shall be at least one-half (1/2) one (1) inch.

104204 C. Despite any provision in this section to the contrary, the
105205 county clerk shall accept for filing any document that fails to meet
106206 the requirements of subsection B of this section if:

108207 1. The document is an origi nal or a certified copy of an
109208 original;

111209 2. The document is legible without the aid of magnification or
112210 other enhancement of the text;

114211 3. The document is xerographically reproducib le by the copying
115212 equipment in use by the county clerk;

117213 4. The document meets all other statutory requirements for
118214 recordation; and

120215 5. The person offering the instrument for recording pays the
121216 additional fee provided in Section 32 of Title 28 of the Okla homa
122217 Statutes for nonconforming documents.

124218 D. Despite any provision in thi s section to the contrary, a
125219 digitized image or electronic copy of an original or certified copy

126247 of an original instrument or document shall sa tisfy the requirement
127248 that the document be an original or certified copy of an original
128249 instrument or document, p rovided that the digitized image or
129250 electronic copy is submitted for recording electronically pursuant
130251 to the Uniform Real Property Electronic Recording Act in Title 16 of
131252 the Oklahoma Statutes and all other rules promulgated pursuant to
132253 that act.

136254 E. This section shall not apply to plats, filings under the
137255 Uniform Commercial Code, or any other instruments that may be filed
138256 pursuant to any other law.

140257 F. All documents accepted for fi ling, including all documents
141258 filed before the effective date of this act February 18, 1997, shall
142259 be deemed to comply with the requirements of this section and,
143260 except as otherwise provided by law, impart constructive notice of
144261 the contents of such docume nt to third parties unless a person
145262 claiming adversely to any such document files an affidavit setting
146263 forth the basis of s uch claim in the office of the county clerk of
147264 the county where the property is located within six (6) months from
148265 the effective date of this act February 18, 1997.
266+SECTION 2. This act shall become effective November 1, 2023.
