30	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

32	58		SECTION 1. AMENDATORY 19 O.S. 2021, Section 298, is
33	59		amended to read as follows:

35	60		Section 298. A. Every county clerk in this state shall require
36	61		that the mandates of the Legislature be c omplied with, as expressed
37	62		in Sections 287 and 291 of this title, and for that purpose, every
38	63		instrument offered which may be accepted by the county clerk for
39	64		recording, affecting specific real property whether of conveyance,
40	65		encumbrance, assignment, or re lease of encumbrance, lease,
41	66		assignment of lease or release of lease, shall be an original or

43	95		accordance with the provisions of subsection B of this section, and
44	96		shall by its own terms describ e the property by its specific legal
45	97		description, and provide such information as is necessary for
46	98		indexing as required in Sections 287 and 291 of this title, and on

49	99		each such instrument shall be listed the mailing address of the
50	100		grantee, mortgagee, assign ee or other designated party to which the
51	101		instrument is to be delivered after recording. If an instrument
52	102		offered to a county clerk for recording contains more than twenty -
53	103		five legal descriptions requiring separate entries in the indexes
54	104		required by Sections 287 and 291 of this title, the des criptions
55	105		shall be sorted by addition, block, and lot if platted property, or
56	106		by township, range, and section if described by governmental survey
57	107		description. Any instrument offered to a county clerk for recording
58	108		containing more than twenty -five legal descriptions per page,
59	109		counted as each description which could require a sepa rate line
60	110		entry in the numerical index, shall be accompanied by an additional
61	111		filing fee of One Dollar ($1.00) per legal description in excess of
62	112		twenty-five legal descriptions per page to be paid to the county
63	113		clerk. Unless the person offering a nonconfo rming instrument for
64	114		filing is willing to reform the instrument to conform to statutory
65	115		requirements, for which purpose it may be withdrawn and refiled
66	116		during the same business day, the county clerk may refuse to record
67	117		the same in the records of deeds, le ases or mortgages or to index

68	145		the same upon the index records referred to in Section 287 or 291 of
69	146		this title, or to file or record the same in the office of the
70	147		county clerk.

72	148		B. All documents filed of record in the office of the county
73	149		clerk pursuant to subsection A of this section or pursuant to any
74	150		other law shall be an original or a certified copy of an original
75	151		document. Such documents sha ll be clearly legible, in the English
76	152		language, using xerographically reproducible dark ink, on paper of a
77	153		color that is xerographically reproducible by the copying equipment
78	154		in use by the county clerk. Unless otherwise provided by law, such
79	155		documents shall measure no larger than eight and on e-half (8 1/2)
80	156		inches by fourteen (14) inches. All documents shall provide an area
81	157		free of printed information sufficient in size to accommodate
82	158		affixation of the documentary stamps required by Section 3201 of
83	159		Title 68 of the Oklahoma Statutes, any certif ication of the payment
84	160		of mortgage taxes required by Section 1901 et seq. o f Title 68 of
85	161		the Oklahoma Statutes, and the recording information affixed by the
86	162		county clerk upon acceptance of a document for recordation. Any
87	163		part of a signature or any stray m arkings within the margin shall
88	164		not void the requirements for accepting and filing any document by
89	165		any county within the state, provided there remains sufficient space
90	166		for the affixation of stamps and recording informa tion without

93	167		covering language contain ed in the instrument. If an instrument
94	168		submitted to the county clerk for r ecording does not contain

95	196		sufficient space for the affixation of such stamps and recording
96	197		information without covering language contained in t he instrument,
97	198		the county clerk shall attach an additional page to the document to
98	199		provide for the affixation of such stamps and recording information.
99	200		A county clerk shall not charge any additional fee or fine for stray
100	201		markings within the margin of a do cument. The top margin of all
101	202		documents shall be at least one (1) inch two (2) inches and all
102	203		other margins shall be at least one-half (1/2) one (1) inch.

104	204		C. Despite any provision in this section to the contrary, the
105	205		county clerk shall accept for filing any document that fails to meet
106	206		the requirements of subsection B of this section if:
107		-
108	207		1. The document is an origi nal or a certified copy of an
109	208		original;
110		-
111	209		2. The document is legible without the aid of magnification or
112	210		other enhancement of the text;
113		-
114	211		3. The document is xerographically reproducib le by the copying
115	212		equipment in use by the county clerk;

117	213		4. The document meets all other statutory requirements for
118	214		recordation; and

120	215		5. The person offering the instrument for recording pays the
121	216		additional fee provided in Section 32 of Title 28 of the Okla homa
122	217		Statutes for nonconforming documents.

124	218		D. Despite any provision in thi s section to the contrary, a
125	219		digitized image or electronic copy of an original or certified copy

127	248		that the document be an original or certified copy of an original
128	249		instrument or document, p rovided that the digitized image or
129	250		electronic copy is submitted for recording electronically pursuant
130	251		to the Uniform Real Property Electronic Recording Act in Title 16 of
131	252		the Oklahoma Statutes and all other rules promulgated pursuant to
132	253		that act.

136	254		E. This section shall not apply to plats, filings under the
137	255		Uniform Commercial Code, or any other instruments that may be filed
138	256		pursuant to any other law.

140	257		F. All documents accepted for fi ling, including all documents
141	258		filed before the effective date of this act February 18, 1997, shall
142	259		be deemed to comply with the requirements of this section and,
143	260		except as otherwise provided by law, impart constructive notice of
144	261		the contents of such docume nt to third parties unless a person
145	262		claiming adversely to any such document files an affidavit setting
146	263		forth the basis of s uch claim in the office of the county clerk of
147	264		the county where the property is located within six (6) months from
148	265		the effective date of this act February 18, 1997.
