8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified
9191 in the Oklahoma Statutes as Section 2 -1111 of Title 63, unless there
9292 is created a duplication in numbering, reads as follows:

145145 1. “Chronic nonmalignant pain” means pain unrelated to cancer
146146 which persists beyond the usual course of disease or t he injury that
147147 is the cause of the pain or more than ninety (90) calendar days
148148 after surgery;
149149 2. “Licensed prescriber” means a prescriber as defined in
150150 Section 353.1 of Title 59 of the Oklahoma Statutes other than a
151151 veterinarian, who has the authority to prescribe any controlled
152152 dangerous substance under Section 2 -312 of Title 63 of the Oklahoma
153153 Statutes; and
154154 3. “Pain management clinic” or “clinic” means any publicly or
155155 privately owned facility:
156156 a. that engages in significant paid advertising in any
157157 medium for any type of pain management services, and
158158 b. where in any month over sixty percent (60%) of
159159 patients who are not being seen for hospice or
160160 palliative care are prescribed opioids,
161161 benzodiazepines, bar biturates, or carisoprodol for the
162162 treatment of chronic nonmalignant pain.
163163 SECTION 2. NEW LAW A ne w section of law to be codified

166166 A. Each pain management cl inic shall register with the Oklahoma

219219 1. The clinic is affiliated wi th an accredited medical school
220220 at which training is provided for medical students, residents, or
221221 fellows;
222222 2. The clinic does not prescribe controlled dangerous
223223 substances for the treatment of pain;
224224 3. The clinic primarily treats hospice or palliative ca re
225225 patients; or
226226 4. A majority of the patients treated by the clinic are t reated
227227 for acute pain.
228228 B. Each clinic location shall be registered separately
229229 regardless of whether the clinic is operated under the same business
230230 name or management as another cl inic and each clinic location shall
231231 be a permanent, fixed, physical address of operation.
232232 C. As a part of registration, a clin ic shall designate an owner
233233 or administrator who is responsible for ensuring compliance with all
234234 requirements related to registrati on and operation of the clinic
235235 under this act. Within ten (10) calendar d ays after termination of
236236 a designated administrator, the clinic shall notify the Bureau of
237237 the identity of another designated administrator for that clinic.
238238 Failing to have a designated administrator at the location of the
239239 registered clinic may be the bas is for a summary suspension of the
240240 clinic registration certificate as described in this section.

292292 D. The Bureau shall deny registration to any pain management
293293 clinic owned by or with any contractual or employment relationship
294294 with a licensed prescriber:
295295 1. Whose Drug Enforcement Administration number has ever been
296296 revoked;
297297 2. Whose application for a license to prescribe, dispense , or
298298 administer a controlled substance has been denied for disciplinary
299299 action by the appropriate licensing board; or
300300 3. Who has been convicted of or pleaded guilty or nolo
301301 contendere to, regardless of adjudication, an offense that
302302 constitutes a felony for receipt of illicit or diverted drugs
303303 including a controlled substance listed in Sc hedule I, II, III, IV,
304304 or V of the Uniform Controlled Dangerous Substances Act, in this
305305 state, any other state, or the United States.
306306 E. If the Bureau finds that a pain management clinic is owned,
307307 directly or indirectly, by a person meeting any criteria listed in
308308 subsection D of this section, the Bureau shall revoke the
309309 certificate of registration previously issued by the Bureau. As
310310 determined by rule, the Bureau may grant an exemption to denying a
311311 registration or revoking a previously issued registration if more
312312 than five (5) years have elapsed since adjudication. As used in
313313 this section, the term “convicted” includes an adjudication of guilt
314314 following a plea of guilty or nolo contendere or the forfeiture of a
315315 bond when charged with a crime.

367367 F. If the registration of a pain man agement clinic is revoked
368368 or suspended, the designated administrator of the pain management
369369 clinic, the owner or lessor of the pain management clinic property,
370370 the manager, and the proprietor shall cea se to operate the facility
371371 as a pain management clinic as of the effective date of the
372372 suspension or revocation.
373373 G. If a pain management clinic registration is revoked or
374374 suspended, the designated administrator of the pain management
375375 clinic, the owner or lessor of the clinic property, the manager , or
376376 the proprietor is responsible for removing all signs and symbols
377377 identifying the premises as a pain management clinic.
378378 H. If the clinic’s registration is revoked, any person named in
379379 the registration document s of the pain management clinic including
380380 persons owning or oper ating the pain management clinic shall not, as
381381 an individual or as a part of a group, apply to operate a pain
382382 management clinic for one (1) year after the date the registration
383383 is revoked.
384384 I. The period of suspension for the registration of a pain
385385 management clinic shall be prescribed by the Bureau but shall not
386386 exceed one (1) year.
387387 J. A change of ownership of a registered pain management clinic
388388 shall require submission of a new registration application.

440440 SECTION 3. NEW LAW A new section of law to be codified
441441 in the Oklahoma Statutes as Section 2-1113 of Title 63, unless there
442442 is created a duplication in numbering, reads as follows:
443443 A. A licensed prescriber shall not be employed or contracted by
444444 or otherwise practice i n a pain management clinic if the clinic is
445445 not licensed by the Oklahoma State Bureau of Narcotics and Dangerous
446446 Drugs Control under this act and registered with the Bureau under
447447 Section 2-301 et seq. of Title 63 of the Oklahoma Statutes. A
448448 licensed prescriber who qualifies to practice in a pain management
449449 clinic pursuant to rul es adopted by the appropriate licensing board
450450 may continue to practice in a pain management clinic as long as the
451451 licensed prescriber continues to meet the qualifications prescribed
452452 in the rules. A licensed prescriber who violates this subsection is
453453 subject to disciplinary action by the appropriate licensing board.
454454 B. Only a licensed prescriber licensed in this state and
455455 authorized to prescribe controlled dangerous substances under
456456 Section 2-312 of Title 63 of the Oklahoma Statutes may prescribe a
457457 controlled dangerous substance on the premises of a reg istered pain
458458 management clinic and only to the extent allowed by Section 2-312 of
459459 Title 63 of the Oklahoma Statutes . No person shall dispense any
460460 controlled dangerous substance on the premises of a pain m anagement
461461 clinic. The provisions of this subsection shall not be construed to
462462 expand or otherwise modify the prescriptive authority of any
463463 licensed prescriber.

515515 C. A licensed prescriber shall perform a phys ical examination
516516 of a patient on the same day that t he licensed prescriber prescribes
517517 a controlled substance to a patient at a pain management clin ic.
518518 D. A licensed prescriber authorized to prescribe controlled
519519 dangerous substances who practices at a pain management clinic is
520520 responsible for maintaining the control and security of his or her
521521 prescription blanks and an y other method used for prescribing
522522 controlled dangerous substance pain medication. The licensed
523523 prescriber shall notify, in writing, the Bureau within twenty-four
524524 (24) hours following any theft or loss of a prescription bl ank or
525525 breach of any other method for prescribing pain medication. The
526526 provisions of this subsection shall not be construed to exempt a
527527 licensed prescriber from any electronic prescription requirements
528528 stipulated in Section 2-309 of Title 63 of the Oklahoma Statutes.
529529 E. The designated administrator of a pain management clinic
530530 shall notify the Bureau in writing of the date of termination of
531531 employment within ten (10) calendar days after terminating his or
532532 her employment with a pain management clinic that is required to be
533533 registered pursuant to this act .
534534 F. The owners of a pain management clinic are jointly
535535 responsible for ensuring compliance with the following faci lity and
536536 physical operations requirements:
537537 1. A pain management clinic shall be located and operated at a
538538 publicly accessible fixed location and shall:

590590 a. display a sign that can be viewed b y the public that
591591 contains the clinic name, hours of operation , and a
592592 street address,
593593 b. have a publicly listed telephone number and a
594594 dedicated phone number to send and receive facsimiles,
595595 c. have a reception and waiting area,
596596 d. provide a restroom,
597597 e. have private patient examination rooms,
598598 f. have treatment rooms, i f treatment is being provided
599599 to the patients, and
600600 g. display a printed sign located in a conspicuous place
601601 in the waiting room viewable by the public with the
602602 name and contact information of the clinic’s
603603 designated administrator and the names of all licensed
604604 prescribers practicing in the clinic; and
605605 2. This section does not excuse a licensed prescriber from
606606 providing any treatment or performing any medical duty without the
607607 proper equipment and materials as required by the standard of care.
608608 This section does not supersede the level of care, skill, or
609609 treatment recognized in general law related to health care
610610 licensure.
611611 G. Each owner or designated administrator of a pain management
612612 clinic is responsible for ensuring compliance with infection

664664 prevention and control requirements stipulated by the Occupational
665665 Safety and Health Administration.
666666 H. The designated administrator shall establish a quality
667667 assurance program that includes the identification, investigation,
668668 and analysis of the frequency and causes of adverse incidents to
669669 patients. The designated administrator is responsible for ensuring
670670 compliance with the quality assurance requirements.
671671 I. The designated administrator is responsible for ensuring
672672 compliance with the following d ata collection and reporting
673673 requirements:
674674 1. The designated administrator for each pain management clinic
675675 shall report all significant adverse incidents to the Bureau; and
676676 2. The designated administrator shall also report to the
677677 Bureau, in writing, on a quarterly basis the following data:
678678 a. the number of new and repeat patients seen a nd treated
679679 at the clinic who are p rescribed controlled dangerous
680680 substance medications for the treatment of chro nic,
681681 nonmalignant pain,
682682 b. the number of patients diagnosed with substance use
683683 disorder,
684684 c. the number of patients discharged due to drug
685685 diversion, and
686686 d. the number of patients treated at the clinic whose
687687 domicile is located somewhere other than in this

739739 state. A patient’s domicile is the patient’s fixed or
740740 permanent home to which he or she intends to return
741741 even though he or she may temporarily reside
742742 elsewhere.
743743 J. The data and reports specified in subsection I of this
744744 section shall be accessible to each appropriate licensing board.
745745 K. Each pain management clin ic shall establish a written po licy
746746 and administrative process for transferring care of patients
747747 diagnosed with a substance use disorder where appropriate for their
748748 continued treatment. Each appropriate licensing board shall issue
749749 guidance on best practices to ensure appropriate referr al and
750750 treatment of patients with a substance use disorder.
751751 L. Upon referral by the ap propriate licensing board, the Bureau
752752 shall investigate suspected instances of drug diversion involving a
753753 pain management clinic. Nothing in this act shall be construed to
754754 restrict the appropriate licensing board from con ducting its own
755755 investigation into instances of suspected drug diversion.
756756 SECTION 4. NEW LAW A new sectio n of law to be codified
757757 in the Oklahoma Statutes as Section 2-1114 of Title 63, unless there
758758 is created a duplication in number ing, reads as follows:
759759 A. The Oklahoma State Bureau of Narcotics and Dangerous Drugs
760760 Control may impose an administrative fine on a clinic of up to One
761761 Thousand Dollars ($1,000.00) per violation for vio lating the

814814 enforce this act.
815815 B. Each day a violation continues after the date fixed for
816816 termination of the violati on as ordered by the Bureau constitutes an
817817 additional, separate, and distinct violation.
818818 C. The Bureau may impose a fine and, in the case of an owner -
819819 operated pain management clinic, revoke or deny a pain management
820820 clinic’s registration if the clinic’s owner or designated
821821 administrator knowingly and intentionally misrepresents actions
822822 taken to correct a violation.
823823 D. An owner or designated administrator of a pain management
824824 clinic who concurren tly operates an unregistered pain management
825825 clinic is subject to an administrative fine of One Thousand Dollars
826826 ($1,000.00) per day.
827827 E. If the owner of a pain management clinic that requires
828828 registration fails to apply t o register the clinic upon a chan ge of
829829 ownership and operates the clinic under the new ownershi p, the owner
830830 is subject to a fine of One Thousand Dollars ($1,000.00).
831831 SECTION 5. NEW LAW A n ew section of law to be codified
832832 in the Oklahoma Statutes as Section 2 -1115 of Title 63, unless there
833833 is created a duplication in numbering , reads as follows:
834834 The Oklahoma State Bureau of Narcotics and Dangerous Drugs
835835 Control and all appropriate licensing boards shall promulgate such
836836 rules as are necessary to implement the pr ovisions of this act.
