7575 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new s ection of law to be co dified
7777 in the Oklahoma Statutes as Section 2607.2 of Title 63, unless there
7878 is created a duplication in numbering, reads as follows:
7979 A. As used in this section, “gender reassignment medical
8080 treatment” means any health care to facilitate the transitioning of
8181 a patient’s assigned gender identity on the patient ’s birth
8282 certificate to the gender identity experienced and defined by the
8383 patient.
8484 1. The term includes:
8585 a. interventions to suppress the development of
8686 endogenous secondary sex characteristics ,

138138 b. interventions to align the patient ’s appearance or
139139 physical body with the patient ’s gender identity, and
140140 c. medical therapies and medic al intervention used to
141141 treat gender dysphoria.
142142 2. The term shall not include:
143143 a. behavioral healthcare services or mental health
144144 counseling,
145145 b. medications to treat depression and anxiety,
146146 c. medications prescribed, dispensed, or administered
147147 specifically for the purpose of treating precocious
148148 puberty in that patient, or
149149 d. services provided to individua ls born with ambiguou s
150150 genitalia, incomplete genitalia, or both male a nd
151151 female anatomy, or biochemically verifiable disorder
152152 of sex development (DSD), including bu t not limited
153153 to:
154154 (1) 46,XX DSD,
155155 (2) 46,XY DSD,
156156 (3) sex chromosomes DSDs,
157157 (4) XX or XY sex reversal, and
158158 (5) ovotesticular disorder.
159159 B. A physician or other healthcare professional shall not
160160 provide gender reassignment medical treatment to any individual
161161 under eighteen (18) years of age.

213213 C. 1. The parent, legal guardian, or next friend of an
214214 individual under eighteen (18) years of age upon whom a physician or
215215 other healthcare professional has provided gender reassignment
216216 medical treatment may bring a civil action against the physician or
217217 other healthcare profess ional and obtain compensatory damages ,
218218 injunctive relief, declaratory relief, or any other appropriate
219219 relief.
220220 2. An individual under eighteen (18) years of age upon whom a
221221 physician or other healthcare professional has provided gender
222222 reassignment medical treatment may bring an action throughout his or
223223 her minority through a parent, legal guardian, or next friend, and
224224 may bring an action in his or her own name at any time upon or after
225225 reaching the age of majority.
226226 D. There shall be no time limitation for the commencement of a
227227 civil action brought under this section.
228228 E. Notwithstanding any other provision of law, an actio n under
229229 this section may be commenced, and relief may be granted, in a
230230 judicial proceeding without regard to whether the person commencing
231231 the action has sought or exhausted available admin istrative
232232 remedies.
233233 F. In any action or proceeding to enforce a pr ovision of this
234234 section, the court shall award court costs and reasonable attorney
235235 fees to a prevailing party who establishes a violation of this
236236 section.

288288 SECTION 2. It being immediately necessary for the preservation
289289 of the public peace, health or safety, an emergency is hereby
290290 declared to exist, by reason whereof this act shall take effect and
291291 be in full force from and after its passage and approval.
