75	75	BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new s ection of law to be co dified
77	77	in the Oklahoma Statutes as Section 2607.2 of Title 63, unless there
78	78	is created a duplication in numbering, reads as follows:
79	79	A. As used in this section, “gender reassignment medical
80	80	treatment” means any health care to facilitate the transitioning of
81	81	a patient’s assigned gender identity on the patient ’s birth
82	82	certificate to the gender identity experienced and defined by the
83	83	patient.
84	84	1. The term includes:
85	85	a. interventions to suppress the development of
86	86	endogenous secondary sex characteristics ,

139	139	physical body with the patient ’s gender identity, and
140	140	c. medical therapies and medic al intervention used to
141	141	treat gender dysphoria.
142	142	2. The term shall not include:
143	143	a. behavioral healthcare services or mental health
144	144	counseling,
145	145	b. medications to treat depression and anxiety,
146	146	c. medications prescribed, dispensed, or administered
147	147	specifically for the purpose of treating precocious
148	148	puberty in that patient, or
149	149	d. services provided to individua ls born with ambiguou s
150	150	genitalia, incomplete genitalia, or both male a nd
151	151	female anatomy, or biochemically verifiable disorder
152	152	of sex development (DSD), including bu t not limited
153	153	to:
154	154	(1) 46,XX DSD,
155	155	(2) 46,XY DSD,
156	156	(3) sex chromosomes DSDs,
157	157	(4) XX or XY sex reversal, and
158	158	(5) ovotesticular disorder.
159	159	B. A physician or other healthcare professional shall not
160	160	provide gender reassignment medical treatment to any individual
161	161	under eighteen (18) years of age.

213	213	C. 1. The parent, legal guardian, or next friend of an
214	214	individual under eighteen (18) years of age upon whom a physician or
215	215	other healthcare professional has provided gender reassignment
216	216	medical treatment may bring a civil action against the physician or
217	217	other healthcare profess ional and obtain compensatory damages ,
218	218	injunctive relief, declaratory relief, or any other appropriate
219	219	relief.
220	220	2. An individual under eighteen (18) years of age upon whom a
221	221	physician or other healthcare professional has provided gender
222	222	reassignment medical treatment may bring an action throughout his or
223	223	her minority through a parent, legal guardian, or next friend, and
224	224	may bring an action in his or her own name at any time upon or after
225	225	reaching the age of majority.
226	226	D. There shall be no time limitation for the commencement of a
227	227	civil action brought under this section.
228	228	E. Notwithstanding any other provision of law, an actio n under
229	229	this section may be commenced, and relief may be granted, in a
230	230	judicial proceeding without regard to whether the person commencing
231	231	the action has sought or exhausted available admin istrative
232	232	remedies.
233	233	F. In any action or proceeding to enforce a pr ovision of this
234	234	section, the court shall award court costs and reasonable attorney
235	235	fees to a prevailing party who establishes a violation of this
236	236	section.
