48 | 53 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA: |

49 | 54 | | SECTION 1. AMENDATORY 59 O.S. 2021, Section 1 873, is |
---|
50 | 55 | | amended to read as follows: |

51 | 56 | | Section 1873. A. There is hereby re -created, to continue until |
---|
52 | 57 | | July 1, 2023 2026, in accordance with the provisions of the Oklahoma |
---|
53 | 58 | | Sunset Law, the Oklahoma Board of Licensed Alco hol and Drug |
---|
54 | 59 | | Counselors, consisting of seven (7) members, to be appointed by the |
---|
55 | 60 | | Governor, with the advice and consent of the Senate, as follows: |
---|
56 | 61 | | 1. a. Six members who shall be alcohol and drug counselors |
---|
57 | 62 | | certified by an entity recognized to do professiona l |
---|
58 | 63 | | alcohol and drug counseli ng certification in this |
---|
59 | 64 | | state; provided, however, five of such members shall |
---|
88 | 94 | | the provisions of the Licensed Alcohol and Drug |
---|
89 | 95 | | Counselors Act, no later th an January 1, 2005. |
---|
90 | 96 | | b. Thereafter, five members shall be licensed alcohol and |
---|
91 | 97 | | drug counselors at the time of appointment, and one |
---|
92 | 98 | | member shall be certified as an alcohol and drug |
---|
93 | 99 | | counselor at the time of appointment. |
---|
94 | 100 | | c. Pursuant to the provisions of this p aragraph, the |
---|
95 | 101 | | Governor shall appoint: |
---|
96 | 102 | | (1) four members from a list of names submitted by |
---|
97 | 103 | | the Oklahoma Drug and Alcohol Profes sional |
---|
98 | 104 | | Counselors Association, |
---|
99 | 105 | | (2) one member from a list of names submitted by the |
---|
100 | 106 | | Oklahoma Substance A buse Services Alliance, and |
---|
101 | 107 | | (3) one member from a list of names submitted by the |
---|
102 | 108 | | Oklahoma Citizen Advocates for Recovery and |
---|
103 | 109 | | Treatment Association. |
---|
104 | 110 | | d. One member shall be appointed from and shall represent |
---|
105 | 111 | | the general public. Such member shall be a reside nt |
---|
106 | 112 | | of this state who has at tained the age of majority and |
---|
107 | 113 | | shall not be, nor shall ever have been, a licensed or |
---|
108 | 114 | | certified alcohol and drug counselor, or the spouse of |
---|
109 | 115 | | a licensed or certified alcohol and drug counselor, or |
---|
138 | 145 | | counseling services or has engaged in any activity |
---|
139 | 146 | | directly related to the practice of alco hol and drug |
---|
140 | 147 | | counseling. |
---|
141 | 148 | | 2. The composition of the Board shall include five members who |
---|
142 | 149 | | hold a master’s or higher degree and one m ember whose highest degree |
---|
143 | 150 | | held is a bachelor’s degree. |
---|
144 | 151 | | 3. The Governor shall appoint the members to the Board no later |
---|
145 | 152 | | than July 1, 2004. |
---|
146 | 153 | | B. Each member of the Board appointed as a licensed alcohol and |
---|
147 | 154 | | drug counselor shall: |
---|
148 | 155 | | 1. Be certified or licensed to engage in the practice of |
---|
149 | 156 | | alcohol and drug counseling in this state and shall be in good |
---|
150 | 157 | | standing; and |
---|
151 | 158 | | 2. Have at least three (3) years of experience in the practice |
---|
152 | 159 | | of alcohol and drug counseling in this state. |
---|
153 | 160 | | C. Two of the members initially appoint ed shall serve three- |
---|
154 | 161 | | year terms; two shall serve four -year terms and three shall serve |
---|
155 | 162 | | five-year terms, as designated by the Governor. Thereafter, the |
---|
156 | 163 | | terms of all members shall be five (5) years. |
---|
157 | 164 | | D. A vacancy on the Board shal l be filled in the same man ner as |
---|
158 | 165 | | the original appointment for the balance of the unexpired term. |
---|
159 | 166 | | Members may succeed themselves but shall serve no mor e than two |
---|
188 | 196 | | E. Members of the Board may b e removed from office for one or |
---|
189 | 197 | | more of the following reasons: |
---|
190 | 198 | | 1. The refusal or inability for any reason to perform the |
---|
191 | 199 | | duties of a Board member in an efficient, responsible and |
---|
192 | 200 | | professional manner; |
---|
193 | 201 | | 2. The misuse of office fo r pecuniary or material gai n or for |
---|
194 | 202 | | personal advantage for self or another; |
---|
195 | 203 | | 3. A violation of the laws or rules governing the practice of |
---|
196 | 204 | | alcohol and drug counseling; or |
---|
197 | 205 | | 4. Conviction of a felony as verified by a certified copy of |
---|
198 | 206 | | the record of the court of conviction. |
---|
199 | 207 | | F. Members of the Board shall serve without compensation, but |
---|
200 | 208 | | shall be reimbursed for actual and necessary travel expenses as |
---|
201 | 209 | | provided in the State Travel Reimbursement Act. |
---|
202 | 210 | | SECTION 2. This act shall become effective July 1, 2023. |
---|
203 | 211 | | SECTION 3. It being immediately necessary for the preservation |
---|
204 | 212 | | of the public peace, health or safety, an emergency is hereby |
---|
205 | 213 | | declared to exist, by reason whereof this act shall take effect and |
---|
206 | 214 | | be in full force from and after its passage and approval. |
