3944 amending 59 O.S. 2021, Se ction 1873, which relates to

4853 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
4954 SECTION 1. AMENDATORY 59 O.S. 2021, Section 1 873, is
5055 amended to read as follows:
5156 Section 1873. A. There is hereby re -created, to continue until
5257 July 1, 2023 2026, in accordance with the provisions of the Oklahoma
5358 Sunset Law, the Oklahoma Board of Licensed Alco hol and Drug
5459 Counselors, consisting of seven (7) members, to be appointed by the
5560 Governor, with the advice and consent of the Senate, as follows:
5661 1. a. Six members who shall be alcohol and drug counselors
5762 certified by an entity recognized to do professiona l
5863 alcohol and drug counseli ng certification in this
5964 state; provided, however, five of such members shall
60-subsequently secure licensure and one such memb er
61-shall subsequently secure certification, pursuant to

92+subsequently secure licensure and one such memb er
93+shall subsequently secure certification, pursuant to
8894 the provisions of the Licensed Alcohol and Drug
8995 Counselors Act, no later th an January 1, 2005.
9096 b. Thereafter, five members shall be licensed alcohol and
9197 drug counselors at the time of appointment, and one
9298 member shall be certified as an alcohol and drug
9399 counselor at the time of appointment.
94100 c. Pursuant to the provisions of this p aragraph, the
95101 Governor shall appoint:
96102 (1) four members from a list of names submitted by
97103 the Oklahoma Drug and Alcohol Profes sional
98104 Counselors Association,
99105 (2) one member from a list of names submitted by the
100106 Oklahoma Substance A buse Services Alliance, and
101107 (3) one member from a list of names submitted by the
102108 Oklahoma Citizen Advocates for Recovery and
103109 Treatment Association.
104110 d. One member shall be appointed from and shall represent
105111 the general public. Such member shall be a reside nt
106112 of this state who has at tained the age of majority and
107113 shall not be, nor shall ever have been, a licensed or
108114 certified alcohol and drug counselor, or the spouse of
109115 a licensed or certified alcohol and drug counselor, or
110-a person who has ever had any mate rial financial
111-interest in the provision of alcohol and drug

143+a person who has ever had any mate rial financial
144+interest in the provision of alcohol and drug
138145 counseling services or has engaged in any activity
139146 directly related to the practice of alco hol and drug
140147 counseling.
141148 2. The composition of the Board shall include five members who
142149 hold a master’s or higher degree and one m ember whose highest degree
143150 held is a bachelor’s degree.
144151 3. The Governor shall appoint the members to the Board no later
145152 than July 1, 2004.
146153 B. Each member of the Board appointed as a licensed alcohol and
147154 drug counselor shall:
148155 1. Be certified or licensed to engage in the practice of
149156 alcohol and drug counseling in this state and shall be in good
150157 standing; and
151158 2. Have at least three (3) years of experience in the practice
152159 of alcohol and drug counseling in this state.
153160 C. Two of the members initially appoint ed shall serve three-
154161 year terms; two shall serve four -year terms and three shall serve
155162 five-year terms, as designated by the Governor. Thereafter, the
156163 terms of all members shall be five (5) years.
157164 D. A vacancy on the Board shal l be filled in the same man ner as
158165 the original appointment for the balance of the unexpired term.
159166 Members may succeed themselves but shall serve no mor e than two
160-consecutive terms. Each member shall serve until a successor is
161-appointed and qualified.

194+consecutive terms. Each member shall serve until a successor is
195+appointed and qualified.
188196 E. Members of the Board may b e removed from office for one or
189197 more of the following reasons:
190198 1. The refusal or inability for any reason to perform the
191199 duties of a Board member in an efficient, responsible and
192200 professional manner;
193201 2. The misuse of office fo r pecuniary or material gai n or for
194202 personal advantage for self or another;
195203 3. A violation of the laws or rules governing the practice of
196204 alcohol and drug counseling; or
197205 4. Conviction of a felony as verified by a certified copy of
198206 the record of the court of conviction.
199207 F. Members of the Board shall serve without compensation, but
200208 shall be reimbursed for actual and necessary travel expenses as
201209 provided in the State Travel Reimbursement Act.
202210 SECTION 2. This act shall become effective July 1, 2023.
203211 SECTION 3. It being immediately necessary for the preservation
204212 of the public peace, health or safety, an emergency is hereby
205213 declared to exist, by reason whereof this act shall take effect and
206214 be in full force from and after its passage and approval.
