7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
7676 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -9-119, is
7777 amended to read as follows:
7878 Section 1-9-119. A. A statement of foster parent ’s rights
7979 shall be given to every fo ster parent annually and shall include ,
8080 but not be limited to , the right to:
8181 1. Be treated with dignity, respect, and consideration as a
8282 professional member of the child welfare team;
8383 2. Be notified of and be given appr opriate, ongoing education
8484 and continuing education and training to develop and enhance foster
8585 parenting skills including but not limited to childhood attachment,
8686 the impacts of abuse and neglect on child development, long -term

138138 impacts of drug and alcohol abuse on children, infant mental he alth,
139139 and childhood trauma;
140140 3. Be informed about ways to contact the state agency or the
141141 child-placing agency in order to receive informatio n and assistance
142142 to access supportive services for any child in the foster parent ’s
143143 care;
144144 4. Receive timely financ ial reimbursement for providing foster
145145 care services;
146146 5. Be notified of any costs or expenses for which the foster
147147 parent may be eligible fo r reimbursement;
148148 6. Be provided a clear, written explanation of the individual
149149 treatment and service plan concerni ng the child in the foster
150150 parent’s home, listing components of the plan pursuant to the
151151 provisions of the Oklahoma Children ’s Code;
152152 7. Receive, at any time during which a child is placed with the
153153 foster parent, additional or necessary information that is relevant
154154 to the care of the child;
155155 8. Be notified of scheduled review meetings, per manency
156156 planning meetings, family team meetings and spec ial staffing
157157 concerns for any foster child placed in the foster parent ’s home in
158158 order to actively participate in t he case planning and decision -
159159 making process regarding the child including transition meetings
160160 between a change in permanency workers;

212212 9. Provide input concerning the plan of services for the child
213213 and to have that input be given full con sideration in the same
214214 manner as information presented by any other professional on the
215215 team;
216216 10. Communicate with other foster parents in order to share
217217 information regarding the foster child. In particular, receive any
218218 information concerning the number of times a foster child has been
219219 moved and the reasons why, and the names and telephone numbers of
220220 the previous foster parent if the previous foster parent h as
221221 authorized such release;
222222 11. Communicate with other professionals who work with the
223223 foster child within the context of the team including, but not
224224 limited to, therapists, physicians, and teachers;
225225 12. Be given, in a timely and consistent manner, any
226226 information regarding the child and the child ’s family which is
227227 pertinent to the care and needs of the child and to the making of a
228228 permanency plan for the child. Disclosure of information shall be
229229 limited to that information which is authorized by the pro visions of
230230 Chapter VI of the Oklahoma Children ’s Code for foster parents;
231231 13. Be given reasonable notice of any change in or addition to
232232 the services provided to the child pursuant to the child ’s
233233 individual treatment and service plan;

286286 (1) plans to terminate the placement of the child
287287 with the foster parent pursuant t o Section 1-4-
288288 805 of this title, and
289289 (2) the reasons for the changes or termination in
290290 placement.
291291 b. The notice shall be waived only in emergency cases
292292 pursuant to Section 1-4-805 of this title;
293293 15. Be notified provided written notice by the applicable state
294294 agency in a timely and complete manner of all court hearings,
295295 including notice of the date and time of any court hearing, the name
296296 of the judge or hearin g officer hearing the case, the locati on of
297297 the hearing, and the court docket number of the case;
298298 16. Be represented by counsel, at the foster parent ’s expense,
299299 for any court proceedings in which the foster parent is a party, and
300300 to permit such counsel to file a motion to intervene on behalf of a
301301 foster parent in any applicable court proceeding;
302302 17. Attend and be heard at any Department or court proceeding
303303 related to a child currently placed in the home. Such right shall
304304 not be construed to require a fos ter parent to be made a party to
305305 such proceeding;
306306 18. Be informed of decis ions made by the court, the state
307307 agency or the child-placing agency concerning the child on the date
308308 such decisions are made, and to receive a copy of the court report
309309 upon request by the foster parent ;

361361 17. 19. Be considered as a preferred placement option when a
362362 foster child who was f ormerly placed with the foster parent is to
363363 reenter foster care at the same level and type of care, if that
364364 placement is consistent with the best int erest of the child and
365365 other children in the home of the foster parent;
366366 18. 20. Be provided a fair, timely, an d impartial investigation
367367 of complaints concerning the certification of the foster pa rent;
368368 19. 21. Be provided the opportunity to request and re ceive a
369369 fair and impartial hearing regarding decisions that affect
370370 certification retention or placement of children in the home and to
371371 receive upon request all information in Department records related
372372 to the home and the foster care services provided by t he foster
373373 parent or family;
374374 20. 22. Be allowed the right to exercise parental substitute
375375 authority;
376376 21. 23. Have timely access to the appeals process of the state
377377 agency and child placement agency and th e right to be free from acts
378378 of harassment and reta liation by any other p arty when exercising the
379379 right to appeal;
380380 22. 24. Be given the number of the statewide t oll-free Foster
381381 Parent Hotline and county unit on-call worker on any day for which
382382 such information is requested;

434434 23. 25. File a grievance and b e informed of the process for
435435 filing a grievance without adverse action by any state agency or
436436 child-placing agency; and
437437 24. 26. Receive a copy of the liability insurance policy the
438438 Department of Human Se rvices maintains for every Department -
439439 contracted foster home placement; and
440440 27. Intervene after twelve (12) months of placement in any
441441 action involving the involuntary termination of parental rights
442442 involving a child who is placed with the foster parent. Such
443443 intervention may be made anonymous ly with the foster parent
444444 identified by initial s. The foster parent shall rec eive service
445445 through counsel or by providing a p referred mailing address to the
446446 Department and the court.
447447 B. The Department of Human Serv ices and a child-placing agency
448448 under contract with the Department shall be responsible for
449449 implementing this section.
450450 C. Nothing in this section shall be construed t o create a
451451 private right of action or claim on t he part of any individual, the
452452 Department, the Office of Juvenile Affairs, or any child -placing
453453 agency.
454454 SECTION 2. This act shall become effective November 1, 2023.
