75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
76	76	SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -9-119, is
77	77	amended to read as follows:
78	78	Section 1-9-119. A. A statement of foster parent ’s rights
79	79	shall be given to every fo ster parent annually and shall include ,
80	80	but not be limited to , the right to:
81	81	1. Be treated with dignity, respect, and consideration as a
82	82	professional member of the child welfare team;
83	83	2. Be notified of and be given appr opriate, ongoing education
84	84	and continuing education and training to develop and enhance foster
85	85	parenting skills including but not limited to childhood attachment,
86	86	the impacts of abuse and neglect on child development, long -term

140	140	3. Be informed about ways to contact the state agency or the
141	141	child-placing agency in order to receive informatio n and assistance
142	142	to access supportive services for any child in the foster parent ’s
143	143	care;
144	144	4. Receive timely financ ial reimbursement for providing foster
145	145	care services;
146	146	5. Be notified of any costs or expenses for which the foster
147	147	parent may be eligible fo r reimbursement;
148	148	6. Be provided a clear, written explanation of the individual
149	149	treatment and service plan concerni ng the child in the foster
150	150	parent’s home, listing components of the plan pursuant to the
151	151	provisions of the Oklahoma Children ’s Code;
152	152	7. Receive, at any time during which a child is placed with the
153	153	foster parent, additional or necessary information that is relevant
154	154	to the care of the child;
155	155	8. Be notified of scheduled review meetings, per manency
156	156	planning meetings, family team meetings and spec ial staffing
157	157	concerns for any foster child placed in the foster parent ’s home in
158	158	order to actively participate in t he case planning and decision -
159	159	making process regarding the child including transition meetings
160	160	between a change in permanency workers;

212	212	9. Provide input concerning the plan of services for the child
213	213	and to have that input be given full con sideration in the same
214	214	manner as information presented by any other professional on the
215	215	team;
216	216	10. Communicate with other foster parents in order to share
217	217	information regarding the foster child. In particular, receive any
218	218	information concerning the number of times a foster child has been
219	219	moved and the reasons why, and the names and telephone numbers of
220	220	the previous foster parent if the previous foster parent h as
221	221	authorized such release;
222	222	11. Communicate with other professionals who work with the
223	223	foster child within the context of the team including, but not
224	224	limited to, therapists, physicians, and teachers;
225	225	12. Be given, in a timely and consistent manner, any
226	226	information regarding the child and the child ’s family which is
227	227	pertinent to the care and needs of the child and to the making of a
228	228	permanency plan for the child. Disclosure of information shall be
229	229	limited to that information which is authorized by the pro visions of
230	230	Chapter VI of the Oklahoma Children ’s Code for foster parents;
231	231	13. Be given reasonable notice of any change in or addition to
232	232	the services provided to the child pursuant to the child ’s
233	233	individual treatment and service plan;
234	234	14. a. Be given written notice of:

287	287	with the foster parent pursuant t o Section 1-4-
288	288	805 of this title, and
289	289	(2) the reasons for the changes or termination in
290	290	placement.
291	291	b. The notice shall be waived only in emergency cases
292	292	pursuant to Section 1-4-805 of this title;
293	293	15. Be notified provided written notice by the applicable state
294	294	agency in a timely and complete manner of all court hearings,
295	295	including notice of the date and time of any court hearing, the name
296	296	of the judge or hearin g officer hearing the case, the locati on of
297	297	the hearing, and the court docket number of the case;
298	298	16. Be represented by counsel, at the foster parent ’s expense,
299	299	for any court proceedings in which the foster parent is a party, and
300	300	to permit such counsel to file a motion to intervene on behalf of a
301	301	foster parent in any applicable court proceeding;
302	302	17. Attend and be heard at any Department or court proceeding
303	303	related to a child currently placed in the home. Such right shall
304	304	not be construed to require a fos ter parent to be made a party to
305	305	such proceeding;
306	306	18. Be informed of decis ions made by the court, the state
307	307	agency or the child-placing agency concerning the child on the date
308	308	such decisions are made, and to receive a copy of the court report
309	309	upon request by the foster parent ;

362	362	foster child who was f ormerly placed with the foster parent is to
363	363	reenter foster care at the same level and type of care, if that
364	364	placement is consistent with the best int erest of the child and
365	365	other children in the home of the foster parent;
366	366	18. 20. Be provided a fair, timely, an d impartial investigation
367	367	of complaints concerning the certification of the foster pa rent;
368	368	19. 21. Be provided the opportunity to request and re ceive a
369	369	fair and impartial hearing regarding decisions that affect
370	370	certification retention or placement of children in the home and to
371	371	receive upon request all information in Department records related
372	372	to the home and the foster care services provided by t he foster
373	373	parent or family;
374	374	20. 22. Be allowed the right to exercise parental substitute
375	375	authority;
376	376	21. 23. Have timely access to the appeals process of the state
377	377	agency and child placement agency and th e right to be free from acts
378	378	of harassment and reta liation by any other p arty when exercising the
379	379	right to appeal;
380	380	22. 24. Be given the number of the statewide t oll-free Foster
381	381	Parent Hotline and county unit on-call worker on any day for which
382	382	such information is requested;

435	435	filing a grievance without adverse action by any state agency or
436	436	child-placing agency; and
437	437	24. 26. Receive a copy of the liability insurance policy the
438	438	Department of Human Se rvices maintains for every Department -
439	439	contracted foster home placement; and
440	440	27. Intervene after twelve (12) months of placement in any
441	441	action involving the involuntary termination of parental rights
442	442	involving a child who is placed with the foster parent. Such
443	443	intervention may be made anonymous ly with the foster parent
444	444	identified by initial s. The foster parent shall rec eive service
445	445	through counsel or by providing a p referred mailing address to the
446	446	Department and the court.
447	447	B. The Department of Human Serv ices and a child-placing agency
448	448	under contract with the Department shall be responsible for
449	449	implementing this section.
450	450	C. Nothing in this section shall be construed t o create a
451	451	private right of action or claim on t he part of any individual, the
452	452	Department, the Office of Juvenile Affairs, or any child -placing
453	453	agency.
454	454	SECTION 2. This act shall become effective November 1, 2023.
