78 | 78 | | SECTION 1. AMENDATORY 10 O.S. 2021, Section 403, as |

81 | 81 | | Section 403. A. The provisions of the Oklahoma Child Care |

82 | 82 | | Facilities Licensing Act shall not apply to: |
---|
83 | 83 | | 1. Care provided in a child ’s own home or by relatives; |
---|
84 | 84 | | 2. Informal arrangements which parents make with friends or |
---|
85 | 85 | | neighbors for the occasional care of their children; |
---|
86 | 86 | | 3. Care provided by an attorney-in-fact authorized by Section |
---|
87 | 87 | | 700 of this title who exercises parental or legal authority on a |
---|
88 | 88 | | continuous basis for not less than twenty -four (24) hours and |

158 | 158 | | 9. A program of specialized activity or instruction f or |

159 | 159 | | children that is not designed or intended for ch ild care purposes |
---|
160 | 160 | | and operates not more tha n five (5) hours per week including, but |

161 | 161 | | not limited to, scouts, 4-H clubs and summer resident youth camps, |
---|

226 | 226 | | fewer hours a week and is located in a county with a |
---|
227 | 227 | | population of less than one hundred thousand (100,000) |
---|
228 | 228 | | according to the latest Federal Decennial Census; |
---|
229 | 229 | | 11. Facilities whose primary purpose is medical treatment; |
---|
230 | 230 | | 12. Boarding schools that have education as their pr imary |
---|
231 | 231 | | purpose and that are recognized as accredited by the State Board of |
---|
232 | 232 | | Education. To be exempt, such programs shall: |
---|
233 | 233 | | a. have classroom facilities that are not used for |
---|
234 | 234 | | residential living, |
---|
235 | 235 | | b. not have been granted nor have assumed legal custody |
---|
236 | 236 | | of any child attending the facility, and |
---|
237 | 237 | | c. adhere to standard educational holiday and seasonal |
---|
238 | 238 | | recess periods to permit s tudents reasonable |

298 | 298 | | and are free to come and go; |
---|
299 | 299 | | 16. A program in tribal land as defined at 2 5 U.S.C.A. 1903 |
---|
300 | 300 | | (10); and |
---|
301 | 301 | | 17. A program on a military base or federal property , or a |
---|
302 | 302 | | facility licensed as a family child care provider by a branch of the |
---|
303 | 303 | | United States Department of Defense or by the United S tates Coast |
---|
304 | 304 | | Guard. |
---|
305 | 305 | | B. The provisions of the Oklahoma Child Care Facilities |
---|
306 | 306 | | Licensing Act shall be equally incumbent upon all private and public |
---|
307 | 307 | | child care facilities , both for-profit and not-for-profit. |
---|
308 | 308 | | C. State child care assistance subsidy payments may only be |
---|
309 | 309 | | paid to licensed programs. |
---|
310 | 310 | | SECTION 2. This act shall become effective November 1, 2023. |
