7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18 -201.1, is
7777 amended to read as follows:
7878 Section 18-201.1. A. Beginning with the 2020 -21 school year,
7979 and each school year t hereafter, the weighted membership of a school
8080 district for calculation of Foundation Ai d purposes pursuant to
8181 paragraph 1 of subsection D of Section 18 -200.1 of this title shall
8282 be the sum of the weighted pupil grade level calculation, the
8383 weighted pupil category calculation, the weighted dis trict
8484 calculation, and the weighted teacher experie nce and degree
8585 calculation. The weighted membership of a school district for
8686 calculation of Salary Incentive Aid purposes pursuant to paragraph 3
8787 of subsection D of S ection 18-200.1 of this title shall be the sum

140140 category calculation, the weighted district calculation , and the
141141 weighted teacher experience and degree calculation.
142142 B. Beginning with the 202 2-2023 school year, the weighted
143143 calculations provided for in subsection A of this sectio n shall be
144144 based on the higher weighted average daily membership of the first
145145 nine (9) weeks of the current school year or the preceding school
146146 year of a school distri ct, unless otherwise specified . The higher
147147 of the two (2) weighted average daily members hips shall be used
148148 consistently in all of the calculations; however, the weighted
149149 calculation for a statewide virtual charter school experiencing a
150150 significant decline in membership shall be based on the f irst nine
151151 (9) weeks of the current school year for the statewide virtual
152152 charter school. For purposes of this subsection, “significant
153153 decline in membership ” means equal to or greater than a fifteen
154154 percent (15%) decrease in average daily membership from the
155155 preceding school year to the average daily memb ership of the first
156156 nine (9) weeks of the current school year . The average daily
157157 membership data used for all calculations in paragraphs 1, 2, 3 , and
158158 4 of this subsection shall be the same as used in the calculation of
159159 the State Aid Formula . The weighted calculations provided for in
160160 subsection A of this section shall be determined as follows:
161161 1. The weighted pupil grade level calculation shall be

230230 eligible for the early childhood program weight shall be purs uant to
231231 the provisions of Section 1-114 of this title. The pupils eligible
232232 for the out-of-home placement pupil weight shall be students who are
233233 not residents of the school district in which they are receiving
234234 education pursuant to the provisions of subsec tion D of Section 1-
235235 113 of this title. Such weight may be claimed by the district
236236 providing educational services to such student for the days that
237237 student is enrolled in that district . If claimed, the out-of-home

290290 pupil category weights for that student. Provided, if a student
291291 resides in a juvenile detention center that is restricted to less
292292 than twelve (12) beds, the out -of-home placement pupil weight for
293293 such students shall be calculated as follows: for a center with six
294294 (6) beds - 3.0; for a center with eight (8) beds - 2.3; and for a
295295 center with ten (10) beds - 1.80.
296296 2. The weighted pupil category calculation shall be determined

370370 Except as otherwise provided , multiply the number of pupil s

374374 calculation for a school dis trict. For the 1997-98 school year and
375375 subsequent school years, the number to be multiplied by the weight
376376 assigned to the gifted category in subparagraph g of this paragraph
377377 shall be the lesser of (1) the sum of the number of studen ts who
378378 scored in the top three percent (3%) on any na tional standardized
379379 test of intellectual ability plus the number of students identified
380380 as gifted pursuant to subparagraphs a through d of paragraph 1 of
381381 Section 1210.301 of this title, or (2) the sum of the number of
382382 students who scored in the top three p ercent (3%) on any national
383383 standardized test of intellectual ability plus eight percent (8%) of
384384 the total average daily membership of the school district for the
385385 first nine (9) weeks of the school year.

437437 3. The weighted district calculation shall be deter mined by
438438 determining the calculations for each school district for both the
439439 small school district formula and the district sparsity - isolation
440440 formula, applying whi chever is the greater of the calculati ons of
441441 the two formulas and then applying the restric tions pursuant to
442442 subparagraph c of this paragraph.
443443 a. Small school district formula : 529 minus the average
444444 daily membership divided b y 529 times .2 times total
445445 average daily membership.
446446 The small school district formula calculation shall apply
447447 only to school districts whose highest average daily
448448 membership is less than 529 pupils . School districts which
449449 are consolidated or annexed afte r July 1, 2003, pursuant to
450450 the Oklahoma School Voluntary Consolidation and Annexation
451451 Act shall have the weighted distri ct size calculation for
452452 the three (3) school years following the fiscal year in
453453 which such consolidation occurred calculated to be the sum
454454 of the individual consolid ated districts computed as if the
455455 consolidation had not taken place. Thereafter, any such
456456 district which is consolidated pursuant to the Oklahoma
457457 School Voluntary Consolidation and Annexation Act shall not
458458 qualify for the weighted district calculation unl ess the
459459 district can satisfy the speci fications herein. Subject to
460460 the provisions of subpa ragraph c of this paragraph, the

514514 b. District sparsity - isolation formula:
515515 The district sparsity - isolation formula calculation shall
516516 apply only to school d istricts:
517517 (1) whose total area in square miles is greater than
518518 the average number of square miles for all school
519519 districts in this stat e; and
520520 (2) whose areal density is less than one-fourth (1/4)
521521 of the state average areal density. Areal
522522 density shall be determined by dividing the
523523 school district’s average daily membership by the
524524 school district’s total area in square miles.
525525 The district sparsity - isolation formula calculation shall
526526 be calculated as fol lows:
527527 The school district student cost factor multipl ied by
528528 the school district area factor . The resulting
529529 product shall be multiplied by the school district ’s
530530 average daily membership . Subject to the provisions
531531 of subparagraph c of this paragraph, the r esulting
532532 number shall be counted as additional studen ts for the
533533 purpose of calculating State Aid.

662662 The school district area cost factor shall be calculated as
663663 follows:
664664 Subtract the state average district area from the
665665 district area, then divide the remainder by the state
666666 average district area;
667667 however, the district area cost factor shall not excee d one
668668 (1.0).
669669 The State Board of Education shall define geographical barriers
670670 whose location in a school district would in hibit the district from
671671 consolidation or annexation . The Board shall make available an
672672 application process, review applications, and f or districts the
673673 Board deems necessary allow additional square miles to be used for
674674 the purposes of calculations used for the weighted district sparsity
675675 - isolation formula. Provided, that the additional square miles
676676 allowed for geographical barriers shal l not exceed thirty percent
677677 (30%) of the district’s actual size.
678678 c. State Aid funds which a district is calculated to
679679 receive as a result of the weighted district
680680 calculation shall be restricted as follows:
681681 If, after the weighted district calculation is
682682 applied, the district’s projected per pupil
683683 revenue exceeds one hundred fifty percent (150%)
684684 of the projected state average per pupil revenue,
685685 then the district’s State Aid shall be reduced by

746746 The July calculation of the projected per pupil
747747 revenue shall be determined by dividing the district ’s
748748 preceding year’s average daily membership (ADM) as
749749 weighted by the pupil grade level, the pup il category,
750750 the district and the teacher experience degree index
751751 calculations for projected State Aid into the
752752 district’s projected total revenues including
753753 projected funds for the State Aid Formula for the
754754 preceding year, net assessed valuation for the
755755 preceding calendar year times t hirty-nine (39) mills,
756756 county revenues excluding the county four -mills
757757 revenues for the second preceding year, other state
758758 appropriations for the preceding year , and the

824824 thirty-nine (39) mills, county revenues excluding the
825825 county four-mills revenue for the preceding year,
826826 other state appropriations for th e preceding year, and
827827 the collections for the preceding year of state
828828 apportionment, motor vehicle revenue, gross product ion
829829 tax, and R.E.A. tax.
830830 The district’s projected total revenues for each
831831 calculation shall exclude the following collections
832832 for the second preceding year: federal revenue,
833833 insurance loss payments, reimbursements, recovery of
834834 overpayments and refunds, unu sed reserves, prior

963963 C. School districts that receive State Aid funds as a r esult of
964964 qualifying for the “bilingual” pupil category weight pursuant to
965965 subparagraph k of paragraph 2 of subsection B of this section shall
966966 use the funds to provid e professional development for teacher s who
967967 offer instruction in English as a second language. Expenditures
968968 shall be reported using the Oklahoma Cost Accounting System.
969969 SECTION 2. This act shall become effective July 1, 2023.
970970 SECTION 3. It being immediately n ecessary for the preservation
971971 of the public peace, he alth, or safety, an emergency is hereby
972972 declared to exist, by reason whereof thi s act shall take effect and
973973 be in full force from and after its passage and approval.
