2957 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3158 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.242, is
3259 amended to read as follows:

3460 Section 1210.242. A. Any school nurse, public health nurse,
3561 licensed practitioner of the healing arts, nurse working under
3662 contract with a school district or any per son designated by the
3763 school administration to administer an opiate emergency opioid
3864 antagonist in the event of a suspected overdose is authorized ,
3965 regardless of whether there is a p rescription or standing order in
4066 place, to administer an opiate emergency opioid antagonist when

4496 B. The administration of a public school may autho rize one or
4597 more persons employed by the school to receive training offered by
4698 the Department of Mental Health and Substance Abuse Services, a law

4999 enforcement agency or any other entit y in recognizing the signs of
50100 an opiate opioid overdose and administering an opiate emergency
51101 opioid antagonist. Persons designated to receive this training may
52102 include, but are not limited to, th e certified and noncertified
53103 staff members required to receive annual training in c ardiopulmonary
54104 resuscitation and the Heimlich maneuver under Section 121 0.199 of
55105 Title 70 of the Oklahoma Statutes this title. If in-person training
56106 is not readily availabl e in the area, the person or persons
57107 designated under this provision may access opiate emergency opioid
58108 antagonist training materials available online thro ugh the State
59109 Department of Health or another entity. Such training shall include
60110 information on how to spot symptoms of an overdose, instruction in
61111 basic resuscitation techniques, instruction on prop er administration
62112 of an opiate emergency opioid antagonist and the importance of
63113 calling 911 for help.

65114 C. In the absence of the person or persons specific ally
66115 designated and trained to administer an opiate emergency opioid
67116 antagonist under the provisions of this section, the administratio n
68117 of a school may authorize any person, regardless of whether there is

69145 a prescription or standing order in place, to administer an opiate
70146 emergency opioid antagonist to a student or other individual
71147 exhibiting signs of an overdose.

73148 D. Any person administering an opiate emergency opioid
74149 antagonist to a student or other individual at a school site or
75150 school-sponsored event in a manner consistent with addressing opiate
76151 opioid overdose shall be covered under the Good Samaritan Act. A
77152 school and any of its employees or designees s hall be immune from
78153 civil liability in relation to the administration of an opiate
79154 emergency opioid antagonist in the event of a suspected overdose.

81155 E. As used in this section, “emergency opioid antagonist ” means
82156 a drug including but not limited to naloxo ne that blocks the effects
83157 of opioids and that is approved by the United States Food and Drug
84158 Administration for the treatment of an opioid overdose .

86159 SECTION 2. It being immediately necessary for the pr eservation
87160 of the public peace, health or safety, an emergency is hereby
88161 declared to exist, by reason whereof this act shall take effect a nd
89162 be in full force from and after its passage and approval.
