8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 59 O.S. 2021, Section 567.4, is
8383 amended to read as follows:
8484 Section 567.4. A. 1. The Oklahoma Board of Nursing is here by
8585 established in the State of Oklahoma. The Board shall consist of
8686 eleven (11) members who shall be citizens of the United St ates of
8787 America, and residents of Oklahoma this state, for at least the
8888 previous three (3) years. Six

142142 standing under the provis ions of the Oklahoma Nursing Practice Act,
143143 currently engaged in the practice of nursing as a Registered Nurse
144144 and shall have had no less than five (5) years of experience as a
145145 Registered Nurse. At least two of the Registered Nurs es shall be
146146 from the field of nursing education, actively associated with a
147147 recognized school of nursing in Oklahoma, and who hold an
148148 organizational role o f administration/management and who are
149149 accountable for strategic, operation al and/or performance out comes.
150150 At least two of the Registered Nurses who hold an organizational
151151 role of administration/management and who are accountable for
152152 strategic, operation al and/or performance outcomes shall represent
153153 nursing service. At least on e of the Registered Nurse s shall be
154154 currently engaged in the practice of nursing as an Advanced Practice
155155 Registered Nurse Each Registered Nurse member shall be appointed by
156156 the Governor. One of the Registered Nurse members shall possess an
157157 Associate Degree in Nursing (ADN) or a Registered Nurse diploma and
158158 shall not possess a Bachelor of Science in Nursing (BSN). One of
159159 the Registered Nurse members shall be appointed from a county with a
160160 population of less than forty thousand (40,000) .
161161 3. Three of the members shall be Licensed Practical Nurses in
162162 good standing under the provisions of the Oklahoma Nursing Practice
163163 Act and currently engaged in t he practice of practical nursing as a
164164 Licensed Practical Nurse and shall have had no less than five (5)
165165 years of experience as a Licensed Practical Nurse. One of the

223223 4. One of the members shall be a licen sed Advanced Practice
224224 Registered Nurse in good standing under the provisions of the
225225 Oklahoma Nursing Practice Act, currently en gaged in the practice of
226226 nursing as an Advanced Practice Registered Nurse and shall have had
227227 no less than five (5) years of exper ience as an Advanced Practice
228228 Registered Nurse. The Advanced Practice Regis tered Nurse member
229229 shall be appointed by the Govern or.
230230 5. Two members shall represent the public and shall be eligible
231231 voters of this state, knowledgeable in consumer hea lth concerns, and
232232 shall neither be nor ever have been associated with the provision o f
233233 health care, nor be enrolled in any health -related educational
234234 program. The public members shall be appointed by the Governor to
235235 serve coterminously with the Governor. At least one Registered
236236 Nurse Board member, one Licensed Practical Nurse Board membe r and
237237 one public Board member One of the public mem bers shall be appointed
238238 by the President Pro Tempore of the Senate. One of the public
239239 members shall be appointed by the Speaker of the House of

293293 6. Two members shall rep resent a healthcare profession other
294294 than nursing or licensed practical nursing including , but not
295295 limited to, a healthcare provider field or the healthcare
296296 administration field. One of the members representing a healthcare
297297 profession other than nursing or licensed practical nursing shall be
298298 appointed by the Speaker of the House of Representatives . One of
299299 the members representing a healthcare profession other than nursing
300300 or licensed practical nursing shall be appointed by the President
301301 Pro Tempore of the Senate from a county with a population of less
302302 than forty thousand (40,000).
303303 B. For the purpose of nominating, appointing or re appointing
304304 members to the Board, this state shall be divided into eight
305305 geographical districts, consisting of counties within t he districts
306306 as follows:
307307 District No. 1 Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,
308308 Grant, Kay, Ellis, Woodward, Major, Garf ield,
309309 Noble, Dewey, Blaine, Kingfisher and Logan;
310310 District No. 2 Roger Mills, Custer, Beckham, Washita, Caddo,
311311 Greer, Kiowa, Harmon, Jackson, Comanche, Tillman
312312 and Cotton;
313313 District No. 3 Canadian, Grady, McClain, Garvin, Stephens,
314314 Murray, Jefferson, Carter and Love;

377377 Not more than one Registered Nurse and one Licensed Prac tical
378378 Nurse and one public member shall be appointed from any one
379379 geographical district.
380380 C. The Governor shall appoint one of the Registered Nurse Board
381381 members from a list of names submitted by the Oklahoma Nurses
382382 Association and Oklahoma chapters of nat ionally recognized
383383 Registered Nurse organizations. The Governor shall appoi nt one of
384384 the Licensed Practical Nurse Board members from a list of names
385385 submitted by the Oklahoma chapters of nationally recognized nursing
386386 organizations. Individuals who are me mbers of the Oklahoma Board of
387387 Nursing prior to September 1, 1991, shall be allowed to fulfill
388388 their terms and be eligible for reappointment.

441441 C. All Board members shall be appointed for terms of five ( 5)
442442 years. Members shall serve at the pleasure of their ap pointing
443443 authorities and may be removed without cause . Upon the death,
444444 resignation, or removal of any member, a list from the
445445 aforementioned organizations shall be sub mitted to the Governor who
446446 the appointing authority shall appoint a member to fill the vacancy .
447447 1. In addition to the grounds for removal by the Governor of
448448 members appointed to the Boar d provided in Section 2 of Title 74 of
449449 the Oklahoma Statutes, it is a ground for removal if a member:
450450 a. does not have at the time of appointment the
451451 qualifications required b y subsection A of this
452452 section,
453453 b. is not employed in nursing for a period of twe lve (12)
454454 consecutive months during the term for which the
455455 member was appointed,
456456 c. is absent from more than half of the regularly
457457 scheduled Board meetings that the member is e ligible
458458 to attend during a calendar year, unless th e absence
459459 is excused by a majo rity vote of the Board, or
460460 d. cannot discharge the duties as a Board member for a
461461 substantial portion of the term for which the member
462462 is appointed because of illness or disab ility.

514514 2. The validity of an action of the Board i s not affected by
515515 the fact that it is taken when a ground for removal of a Board
516516 member exists.
517517 3. If the president of the Board has knowledge that a potential
518518 ground for removal exists, the president sha ll then notify the
519519 Governor that a potential ground for removal exists.
520520 E. D. A quorum shall be a majority of the Board which must
521521 include at least three two Registered Nurses, not including the
522522 Advanced Practice Registered Nurse Member, and one two Licensed
523523 Practical Nurse Nurses.
524524 F. E. The members of the Board shall annually elect from their
525525 number a president, vice -president and a secretary who shall also be
526526 the treasurer, and other such officers as necessary to conduct the
527527 business of the Board. It s hall hold six regular business meetings
528528 during each calendar year. Special meetings may be called by the
529529 president or secretary with five (5) days ’ notice to each member of
530530 the Board. The Board shall have a seal; it shall make and adopt all
531531 necessary rules not inconsistent with the laws of this state, th e
532532 United States, or with the Oklahoma Nursing Practice Act; and it
533533 shall perform the duties and transact the busi ness required under
534534 the provisions of the act Oklahoma Nursing Practice Act . The Board
535535 shall cause to be kept a record of a ll meetings of the Board and
536536 give notice of all meetings in accordance with the Administrative
537537 Procedures Act and the Open Meeting Act. A list of a ll persons duly

589589 licensed and qualified under this act the Oklahoma Nursing Practice
590590 Act shall be maintained by the Board. Each member of the Board
591591 shall receive, in addition to actual and necessary travel expenses
592592 as provided in the State Travel Reimburse ment Act, compensation of
593593 One Hundred Dollars ($ 100.00) for each regular sch eduled monthly
594594 meeting attended, not to exceed more than six meetings per year.
595595 All monies received by the Board shall be held by the treasurer of
596596 the Board for meeting the expens es of the Board and for the
597597 promotion of nursing education, to employ an att orney to assist the
598598 Board and other state and count y officials in carrying out the
599599 provisions of the Oklahoma Nursing Practice Act, and such other
600600 purposes which the Board may dete rmine, and shall be disbursed as
601601 directed by the Board. The Board is author ized to adopt and revise
602602 rules, not inconsistent wi th the provisions of the Oklahoma Nursing
603603 Practice Act, as may be necessary to enable it to carry into effect
604604 the provisions of the act, including rules establishing fees,
605605 charges and reimbursement costs. The Board shall appoint and employ
606606 a qualified person, who shall be a Registered Nurse to serve as
607607 Executive Director, and shall fix the compensation, notwithstanding
608608 any other provision of law including Section 3601.2 of Title 74 of
609609 the Oklahoma Statutes , in an amount not in excess of the maximum
610610 salary proposed for the Oklahoma Board of Nursing and set forth in
611611 the most recent Compensation Report prepared by or for the Office of

663663 Management and Enterprise Services, require a sa tisfactory bond, and
664664 define the duties of the Executive Director to include:
665665 1. The authority and responsibility for the operations and
666666 administration of the agency and such additional powers and duties
667667 as prescribed by the Board. As chief executive of t he Board, the
668668 Executive Director shall manage all aspects of the agency, includ ing
669669 personnel, financial and other resources, in support of the Oklahoma
670670 Nursing Practice Act, its rules and policies, and the Bo ard’s
671671 mission and strategic plan;
672672 2. The authority to accept orders as set forth in paragraph 3
673673 of this subsection on behalf o f the Board and where ratification by
674674 the Board is not required. The Executive Director shall report
675675 summaries of dispositions t o the Board at its regular meetings;
676676 3. a. Orders orders issued under Section 2 of this act,
677677 b. Agreed agreed disciplinary orders requiring an
678678 applicant or licensee to enter and comply with the
679679 Peer Assistance Program,
680680 c. Agreed agreed disciplinary orders for the
681681 reinstatement or endorsement of a
682682 license/certificate/recog nition when the applicant has
683683 practiced without an active Oklahoma
684684 license/certificate/recogni tion, and
685685 d. Agreed agreed disciplinary orders for the voluntary
686686 surrender of a license/certification/recognition.
