81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 59 O.S. 2021, Section 567.4, is
83	83	amended to read as follows:
84	84	Section 567.4. A. 1. The Oklahoma Board of Nursing is here by
85	85	established in the State of Oklahoma. The Board shall consist of
86	86	eleven (11) members who shall be citizens of the United St ates of
87	87	America, and residents of Oklahoma this state, for at least the
88	88	previous three (3) years. Six
89	89	2. Three of the members shall be Registered Nurses , none of
90	90	whom are Advanced Practice Registered Nur ses, and shall be in good

147	147	recognized school of nursing in Oklahoma, and who hold an
148	148	organizational role o f administration/management and who are
149	149	accountable for strategic, operation al and/or performance out comes.
150	150	At least two of the Registered Nurses who hold an organizational
151	151	role of administration/management and who are accountable for
152	152	strategic, operation al and/or performance outcomes shall represent
153	153	nursing service. At least on e of the Registered Nurse s shall be
154	154	currently engaged in the practice of nursing as an Advanced Practice
155	155	Registered Nurse Each Registered Nurse member shall be appointed by
156	156	the Governor. One of the Registered Nurse members shall possess an
157	157	Associate Degree in Nursing (ADN) or a Registered Nurse diploma and
158	158	shall not possess a Bachelor of Science in Nursing (BSN). One of
159	159	the Registered Nurse members shall be appointed from a county with a
160	160	population of less than forty thousand (40,000) .
161	161	3. Three of the members shall be Licensed Practical Nurses in
162	162	good standing under the provisions of the Oklahoma Nursing Practice
163	163	Act and currently engaged in t he practice of practical nursing as a
164	164	Licensed Practical Nurse and shall have had no less than five (5)
165	165	years of experience as a Licensed Practical Nurse. One of the

226	226	nursing as an Advanced Practice Registered Nurse and shall have had
227	227	no less than five (5) years of exper ience as an Advanced Practice
228	228	Registered Nurse. The Advanced Practice Regis tered Nurse member
229	229	shall be appointed by the Govern or.
230	230	5. Two members shall represent the public and shall be eligible
231	231	voters of this state, knowledgeable in consumer hea lth concerns, and
232	232	shall neither be nor ever have been associated with the provision o f
233	233	health care, nor be enrolled in any health -related educational
234	234	program. The public members shall be appointed by the Governor to
235	235	serve coterminously with the Governor. At least one Registered
236	236	Nurse Board member, one Licensed Practical Nurse Board membe r and
237	237	one public Board member One of the public mem bers shall be appointed
238	238	by the President Pro Tempore of the Senate. One of the public
239	239	members shall be appointed by the Speaker of the House of

303	303	B. For the purpose of nominating, appointing or re appointing
304	304	members to the Board, this state shall be divided into eight
305	305	geographical districts, consisting of counties within t he districts
306	306	as follows:
307	307	District No. 1 Cimarron, Texas, Beaver, Harper, Woods, Alfalfa,
308	308	Grant, Kay, Ellis, Woodward, Major, Garf ield,
309	309	Noble, Dewey, Blaine, Kingfisher and Logan;
310	310	District No. 2 Roger Mills, Custer, Beckham, Washita, Caddo,
311	311	Greer, Kiowa, Harmon, Jackson, Comanche, Tillman
312	312	and Cotton;
313	313	District No. 3 Canadian, Grady, McClain, Garvin, Stephens,
314	314	Murray, Jefferson, Carter and Love;

377	377	Not more than one Registered Nurse and one Licensed Prac tical
378	378	Nurse and one public member shall be appointed from any one
379	379	geographical district.
380	380	C. The Governor shall appoint one of the Registered Nurse Board
381	381	members from a list of names submitted by the Oklahoma Nurses
382	382	Association and Oklahoma chapters of nat ionally recognized
383	383	Registered Nurse organizations. The Governor shall appoi nt one of
384	384	the Licensed Practical Nurse Board members from a list of names
385	385	submitted by the Oklahoma chapters of nationally recognized nursing
386	386	organizations. Individuals who are me mbers of the Oklahoma Board of
387	387	Nursing prior to September 1, 1991, shall be allowed to fulfill
388	388	their terms and be eligible for reappointment.

441	441	C. All Board members shall be appointed for terms of five ( 5)
442	442	years. Members shall serve at the pleasure of their ap pointing
443	443	authorities and may be removed without cause . Upon the death,
444	444	resignation, or removal of any member, a list from the
445	445	aforementioned organizations shall be sub mitted to the Governor who
446	446	the appointing authority shall appoint a member to fill the vacancy .
447	447	1. In addition to the grounds for removal by the Governor of
448	448	members appointed to the Boar d provided in Section 2 of Title 74 of
449	449	the Oklahoma Statutes, it is a ground for removal if a member:
450	450	a. does not have at the time of appointment the
451	451	qualifications required b y subsection A of this
452	452	section,
453	453	b. is not employed in nursing for a period of twe lve (12)
454	454	consecutive months during the term for which the
455	455	member was appointed,
456	456	c. is absent from more than half of the regularly
457	457	scheduled Board meetings that the member is e ligible
458	458	to attend during a calendar year, unless th e absence
459	459	is excused by a majo rity vote of the Board, or
460	460	d. cannot discharge the duties as a Board member for a
461	461	substantial portion of the term for which the member
462	462	is appointed because of illness or disab ility.

514	514	2. The validity of an action of the Board i s not affected by
515	515	the fact that it is taken when a ground for removal of a Board
516	516	member exists.
517	517	3. If the president of the Board has knowledge that a potential
518	518	ground for removal exists, the president sha ll then notify the
519	519	Governor that a potential ground for removal exists.
520	520	E. D. A quorum shall be a majority of the Board which must
521	521	include at least three two Registered Nurses, not including the
522	522	Advanced Practice Registered Nurse Member, and one two Licensed
523	523	Practical Nurse Nurses.
524	524	F. E. The members of the Board shall annually elect from their
525	525	number a president, vice -president and a secretary who shall also be
526	526	the treasurer, and other such officers as necessary to conduct the
527	527	business of the Board. It s hall hold six regular business meetings
528	528	during each calendar year. Special meetings may be called by the
529	529	president or secretary with five (5) days ’ notice to each member of
530	530	the Board. The Board shall have a seal; it shall make and adopt all
531	531	necessary rules not inconsistent with the laws of this state, th e
532	532	United States, or with the Oklahoma Nursing Practice Act; and it
533	533	shall perform the duties and transact the busi ness required under
534	534	the provisions of the act Oklahoma Nursing Practice Act . The Board
535	535	shall cause to be kept a record of a ll meetings of the Board and
536	536	give notice of all meetings in accordance with the Administrative
537	537	Procedures Act and the Open Meeting Act. A list of a ll persons duly

589	589	licensed and qualified under this act the Oklahoma Nursing Practice
590	590	Act shall be maintained by the Board. Each member of the Board
591	591	shall receive, in addition to actual and necessary travel expenses
592	592	as provided in the State Travel Reimburse ment Act, compensation of
593	593	One Hundred Dollars ($ 100.00) for each regular sch eduled monthly
594	594	meeting attended, not to exceed more than six meetings per year.
595	595	All monies received by the Board shall be held by the treasurer of
596	596	the Board for meeting the expens es of the Board and for the
597	597	promotion of nursing education, to employ an att orney to assist the
598	598	Board and other state and count y officials in carrying out the
599	599	provisions of the Oklahoma Nursing Practice Act, and such other
600	600	purposes which the Board may dete rmine, and shall be disbursed as
601	601	directed by the Board. The Board is author ized to adopt and revise
602	602	rules, not inconsistent wi th the provisions of the Oklahoma Nursing
603	603	Practice Act, as may be necessary to enable it to carry into effect
604	604	the provisions of the act, including rules establishing fees,
605	605	charges and reimbursement costs. The Board shall appoint and employ
606	606	a qualified person, who shall be a Registered Nurse to serve as
607	607	Executive Director, and shall fix the compensation, notwithstanding
608	608	any other provision of law including Section 3601.2 of Title 74 of
609	609	the Oklahoma Statutes , in an amount not in excess of the maximum
610	610	salary proposed for the Oklahoma Board of Nursing and set forth in
611	611	the most recent Compensation Report prepared by or for the Office of

664	664	define the duties of the Executive Director to include:
665	665	1. The authority and responsibility for the operations and
666	666	administration of the agency and such additional powers and duties
667	667	as prescribed by the Board. As chief executive of t he Board, the
668	668	Executive Director shall manage all aspects of the agency, includ ing
669	669	personnel, financial and other resources, in support of the Oklahoma
670	670	Nursing Practice Act, its rules and policies, and the Bo ard’s
671	671	mission and strategic plan;
672	672	2. The authority to accept orders as set forth in paragraph 3
673	673	of this subsection on behalf o f the Board and where ratification by
674	674	the Board is not required. The Executive Director shall report
675	675	summaries of dispositions t o the Board at its regular meetings;
676	676	3. a. Orders orders issued under Section 2 of this act,
677	677	b. Agreed agreed disciplinary orders requiring an
678	678	applicant or licensee to enter and comply with the
679	679	Peer Assistance Program,
680	680	c. Agreed agreed disciplinary orders for the
681	681	reinstatement or endorsement of a
682	682	license/certificate/recog nition when the applicant has
683	683	practiced without an active Oklahoma
684	684	license/certificate/recogni tion, and
685	685	d. Agreed agreed disciplinary orders for the voluntary
686	686	surrender of a license/certification/recognition.
