65	65	An Act relating to airspace; amending 60 O.S. 2021,
66	66	Sections 803 and 805, which relate to airspace as
67	67	real property, and titles, estates, rights, and
68	68	interests pertaining to airspace; removing exceptions
69	69	for wind and solar energy agreements ; repealing 60
70	70	O.S. 2021, Section 820.1, which relates to the
71	71	Airspace Severance Restriction Act; and providing an
72	72	effective date.

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 60 O.S. 2021, Section 803, is
79	79	amended to read as follows:
80	80	Section 803. Airspace as defined herein is real propert y, and
81	81	until title thereto or rights, interests , or estates therein are
82	82	separately transferred, airspace is the property of the person or
83	83	persons holding title to the land surfa ce beneath it, subject to the
84	84	limitations relating to wind or solar energy agre ements provided in
85	85	Section 1 of this act .
86	86	SECTION 2. AMENDATORY 60 O.S. 2021, Section 805, is
87	87	amended to read as follows:

139	139	Section 805. Subject to the limitations relating to wind or
140	140	solar energy agreements provided in Section 1 o f this act, all All
141	141	forms of titles, estates, right s, and interests which may presently
142	142	exist or which may hereafter be created by law or equity or under
143	143	statutes pertaining to real property may be legally created,
144	144	transferred and conveyed in airspace, whe ther or not such airspace
145	145	is contiguous to the surf ace of the earth; and the same shall
146	146	constitute titles, estates, rights , and interests in real property
147	147	under and subject to the laws pertaining thereto.
148	148	SECTION 3. REPEALER 60 O.S. 2021, Section 820.1, is
149	149	hereby repealed.
150	150	SECTION 4. This act shall become effective November 1, 2023.
