75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -2515, is
77	77	amended to read as follows:
78	78	Section 1-2515. A. Notwithstanding any other provision of this
79	79	title, Emergency Medical Services (EMS) Regions emergency medical
80	80	service (EMS) regions, Ambulance Service ambulance service districts
81	81	or municipalities are hereby authorized to regulate and control,
82	82	pursuant to duly enacted ordinance or regulation, Ambulance Service
83	83	ambulance service transports originating within the jurisdic tion of
84	84	such EMS Regions regions, Ambulance Service ambulance service
85	85	districts or municipalities.
86	86	B. Any ordinance or regulation adopted pursuant to subsection A
87	87	of this section shall meet and may exceed, but shall not be in

140	140	Commissioner of Health for Ambulance Service ambulance service
141	141	transports.
142	142	C. 1. Any ordinance or regulation adopted by an EMS Region
143	143	region, Ambulance Service ambulance service district or a
144	144	municipality may establish a sole-provider system for stretcher van
145	145	and/or Ambulance Service ambulance service transports; provided,
146	146	however, any such designated or contracted sole -provider which is
147	147	not an EMS Region region, Ambulance Service ambulance service
148	148	district, municipality, or other public entity shall be selected by
149	149	competitive bidding.
150	150	2. A contract entered into pursuant to such bidding shall be
151	151	with the lowest and best bidder and may be for an initial term of
152	152	such duration as deemed operationally and fiscally prudent by the
153	153	contracting agency. The term of such sole -provider contract shall
154	154	be made public at the time bids are solicited, which solicitation
155	155	shall be not less than sixty (60) days prior to the cont ract start
156	156	date.
157	157	D. Any EMS Region, Ambulance Service district region or
158	158	municipality may establish a sole -provider system for stretcher v an
159	159	and/or Ambulance Service or ambulance service transports or both,
160	160	and may allow additional geographic or political subdivisions to
161	161	join such a system a t any time. All ambulance service districts
162	162	shall be sole-provider systems for stretcher van and a mbulance

214	214	service transports within their geographic al boundaries. Whenever
215	215	such a geographic or political subdivision joins such a sole -
216	216	provider system, competitive bidding shall not be required and
217	217	provision for servicing the new ju risdiction may be accompl ished by
218	218	amending the existing sole -provider contract. Furthermore, in the
219	219	event the expansion of the service area of the EMS Region region,
220	220	Ambulance Service ambulance service district or the municipality is
221	221	substantial (in the s ole opinion of the govern ing body of the EMS
222	222	Region region, Ambulance Service ambulance service district or
223	223	municipality), the existing sole-provider contract may be extended
224	224	for a period sufficient to all ow reasonable opportunity for recovery
225	225	of capital costs of expansion, as det ermined by the contracting
226	226	agency.
227	227	E. The provisions of this section shall not be construed or
228	228	applied to limit the operation of any emergency medical service
229	229	district established and operating pursuant to Section 9C of Article
230	230	10 of the Oklahoma Constitu tion; provided, however, that, upon
231	231	invitation and approval of a majority of the voters of the distri ct,
232	232	any such district is hereby authorized to join by appropriate
233	233	agreement any system established by an EMS Region region, Ambulance
234	234	Service ambulance service district or a municipality pursuant to the
235	235	provisions of this section.

287	287	F. The following types of patient transports shal l be exempt
288	288	from regulation by EMS Regions regions, Ambulance Service ambulance
289	289	service districts or municipalities:
290	290	1. Any ambulance owned or operated by, or under contract to
291	291	perform ambulance transport services for, the Federal or State
292	292	government, or any agency thereof;
293	293	2. Any ambulance owned and operat ed by a hospital and in use to
294	294	transport a patient of the owner-hospital, which patient has been
295	295	admitted to and not been discharged from the owner -hospital, to or
296	296	from another hospital or medical care facility at which the pati ent
297	297	receives a diagnostic or therapeutic procedure not available at the
298	298	owner-hospital;
299	299	3. Any ambulance engaged in a routine transport call to
300	300	transport a patient from a hospital, nursing home, or dialysis
301	301	center located within an EMS Region region, Ambulance Service
302	302	ambulance service district or municipality to any location outsid e
303	303	the EMS Region region, Ambulance Service ambulance service district
304	304	or municipality;
305	305	4. Any ambulance engaged in the transport of a patient from a
306	306	location outside an EMS Region region, Ambulance Service ambulance
307	307	service district or municipality to a location inside an EMS Region
308	308	region, Ambulance Service ambulance service district or
309	309	municipality; or
