7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -2515, is
7777 amended to read as follows:
7878 Section 1-2515. A. Notwithstanding any other provision of this
7979 title, Emergency Medical Services (EMS) Regions emergency medical
8080 service (EMS) regions, Ambulance Service ambulance service districts
8181 or municipalities are hereby authorized to regulate and control,
8282 pursuant to duly enacted ordinance or regulation, Ambulance Service
8383 ambulance service transports originating within the jurisdic tion of
8484 such EMS Regions regions, Ambulance Service ambulance service
8585 districts or municipalities.
8686 B. Any ordinance or regulation adopted pursuant to subsection A
8787 of this section shall meet and may exceed, but shall not be in

142142 C. 1. Any ordinance or regulation adopted by an EMS Region
143143 region, Ambulance Service ambulance service district or a
144144 municipality may establish a sole-provider system for stretcher van
145145 and/or Ambulance Service ambulance service transports; provided,
146146 however, any such designated or contracted sole -provider which is
147147 not an EMS Region region, Ambulance Service ambulance service
148148 district, municipality, or other public entity shall be selected by
149149 competitive bidding.
150150 2. A contract entered into pursuant to such bidding shall be
151151 with the lowest and best bidder and may be for an initial term of
152152 such duration as deemed operationally and fiscally prudent by the
153153 contracting agency. The term of such sole -provider contract shall
154154 be made public at the time bids are solicited, which solicitation
155155 shall be not less than sixty (60) days prior to the cont ract start
156156 date.
157157 D. Any EMS Region, Ambulance Service district region or
158158 municipality may establish a sole -provider system for stretcher v an
159159 and/or Ambulance Service or ambulance service transports or both,
160160 and may allow additional geographic or political subdivisions to
161161 join such a system a t any time. All ambulance service districts

214214 service transports within their geographic al boundaries. Whenever
215215 such a geographic or political subdivision joins such a sole -
216216 provider system, competitive bidding shall not be required and
217217 provision for servicing the new ju risdiction may be accompl ished by
218218 amending the existing sole -provider contract. Furthermore, in the
219219 event the expansion of the service area of the EMS Region region,
220220 Ambulance Service ambulance service district or the municipality is
221221 substantial (in the s ole opinion of the govern ing body of the EMS
222222 Region region, Ambulance Service ambulance service district or
223223 municipality), the existing sole-provider contract may be extended
224224 for a period sufficient to all ow reasonable opportunity for recovery
225225 of capital costs of expansion, as det ermined by the contracting
226226 agency.
227227 E. The provisions of this section shall not be construed or
228228 applied to limit the operation of any emergency medical service
229229 district established and operating pursuant to Section 9C of Article
230230 10 of the Oklahoma Constitu tion; provided, however, that, upon
231231 invitation and approval of a majority of the voters of the distri ct,
232232 any such district is hereby authorized to join by appropriate
233233 agreement any system established by an EMS Region region, Ambulance
234234 Service ambulance service district or a municipality pursuant to the
235235 provisions of this section.

287287 F. The following types of patient transports shal l be exempt
288288 from regulation by EMS Regions regions, Ambulance Service ambulance
289289 service districts or municipalities:
290290 1. Any ambulance owned or operated by, or under contract to
291291 perform ambulance transport services for, the Federal or State
292292 government, or any agency thereof;
293293 2. Any ambulance owned and operat ed by a hospital and in use to
294294 transport a patient of the owner-hospital, which patient has been
295295 admitted to and not been discharged from the owner -hospital, to or
296296 from another hospital or medical care facility at which the pati ent
297297 receives a diagnostic or therapeutic procedure not available at the
298298 owner-hospital;
299299 3. Any ambulance engaged in a routine transport call to
300300 transport a patient from a hospital, nursing home, or dialysis
301301 center located within an EMS Region region, Ambulance Service
302302 ambulance service district or municipality to any location outsid e
303303 the EMS Region region, Ambulance Service ambulance service district
304304 or municipality;
305305 4. Any ambulance engaged in the transport of a patient from a
306306 location outside an EMS Region region, Ambulance Service ambulance
307307 service district or municipality to a location inside an EMS Region
308308 region, Ambulance Service ambulance service district or
309309 municipality; or

361361 5. Any ambulance engaged in the interstate transport of a

363363 SECTION 2. This act shall become effective November 1, 2023 .
