81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Section 2607.2 of Title 63, unless there
84	84	is created a duplication in numbering, reads as follows:
85	85	A. A physician or other healthcare professional shall not
86	86	provide gender transition surgery to any individual under eighteen
87	87	(18) years of age.
88	88	B. A person may bring an action against a physician or other
89	89	healthcare professional who provided gender transition surgery to
90	90	the person if the gender transition surgery caused the person to not

142	142	be able to enjoy the natural reproductivity functions of child
143	143	bearing and rearing that the person would have enjoyed if not for
144	144	the gender transition surgery .
145	145	C. If the person is under eighteen (18) years of age, he or she
146	146	may bring an action throughout their minority through a parent or
147	147	legal guardian, and may bring an action in their o wn name upon
148	148	reaching majority.
149	149	D. 1. Notwithstanding any other provision of law, there shall
150	150	be no time limitation for the commencement of an action brought
151	151	under this section except as provided by this subsection.
152	152	2. There shall be a rebuttable presumption that the plaintiff ,
153	153	based solely on his or her age, would be capable of bearing children
154	154	if not for the gender transition surgery .
155	155	3. If the presumption described in paragraph 2 of this
156	156	subsection is successfully rebutted, the court shall dismiss the
157	157	cause of action.
158	158	E. A plaintiff who establis hes a violation of subsection A of
159	159	this section and who can show that he or she has suffered harm as
160	160	described in subsection B of this section may be granted:
161	161	1. Compensatory damages appropriate to the loss of natural
162	162	reproductivity functions as described in subsection B of this
163	163	section;
164	164	2. Punitive damages; or
165	165	3. Any other appropriate relief.
