38	41		An Act relating to students; amending 70 O.S. 2021,
39	42		Section 27-103, which relates to the Oklahoma
40	43		Extracurricular Activities Accountability Act;
41	44		requiring certain association’s written policy to
42	45		include certain provision regarding legal
43	46		representation; providing an effective date; and
44	47		declaring an emergency.

50	53		BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
51	54		SECTION 1. AMENDATORY 70 O.S. 2021, Section 27 -103, is
52	55		amended to read as follows:
53	56		Section 27-103. A public school or school district shall not be
54	57		a member of any school a thletic association unless that associat ion
55	58		has adopted a written policy that requir es the following:
56	59		1. All records of the a ssociation to be made accessible
57	60		consistent with the provisions of the Oklahoma Open Records Act;
58	61		2. All meetings of the associat ion to be open and conducted in
59	62		a manner consistent with the provisions of the Oklah oma Open Meeting
60	63		Act, including specifical ly the notice and agenda, voting and
61	64		executive session requirements; and

88	92		3. An annual financial audit and a compliance audit of a ll
89	93		funds of the association in accordanc e with the auditing standards
90	94		set forth in the Oklahoma Public School Audit Law. In a ddition, the
91	95		association shall have performance audits conducted of the
92	96		operations of the association. A performance audit shall be
93	97		conducted no later than December 31, 2014, and by December 31 every
94	98		five (5) years thereafter; and
95	99		4. The association to contract for legal representation with
96	100		the Office of the Attorney General.
97	101		SECTION 2. This act shall become effect ive July 1, 2023.
98	102		SECTION 3. It being immediately necessary for the preservation
99	103		of the public peace, health , or safety, an emergency is hereby
100	104		declared to exist, by reason whereof thi s act shall take effect and
101	105		be in full force from and a fter its passage and approval.
