7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law to be codified
8181 in the Oklahoma Statutes as Section 85.44F of Title 74, unless there
8282 is created a duplication in numbering, reads as follows:
8383 A. As used in this section:
8484 1. “Ammunition” means a loaded cartridge or shot shell, case,
8585 primer, projectile, wadding, or propellant powder;
8686 2. “Company” means a for-profit organization, association,
8787 corporation, partnershi p, joint venture, limited partnership,
8888 limited liability partnership, or limited liability company
8989 including a wholly owned subsidiary, majority-owned subsidiary,

141141 parent company, or an affiliate of those entities or associations
142142 that exists to make a profit. The term does not include a sole
143143 proprietorship;
144144 3. “Discriminate against a firearm entity or firearm trade
145145 association” means, with respect to the entity or association, to:
146146 a. refuse to engage in the trade of any goods or services
147147 with the entity or association based solely on its
148148 status as a firearm entity or firearm trade
149149 association,
150150 b. refrain from continuing an existing business
151151 relationship with the entity or associa tion based
152152 solely on its status as a firearm entity or fire arm
153153 trade association, or
154154 c. terminate an existing business relationship with the
155155 entity or association based solely on its status as a
156156 firearm entity or firearm trade association.
157157 The term does not include the policies of a vendor, merchant, retail
158158 seller, or platform that restrict or prohibit the listing or selling
159159 of ammunition, firearms, or firearm accessories. The term also does
160160 not include a company’s refusal to engage in the trade of any goods
161161 or services, decision to refrain from continuing an existing
162162 business relationship, or decision to terminate an existing business
163163 relationship to comply with federal, state, or local laws, policies,
164164 or regulations or a directive by a regulatory agency, or for any

216216 traditional business reason that is specific to the customer or
217217 potential customer and not based solely on the status of an entity
218218 or association as a firearm entity or firearm trade association;
219219 4. “Firearm” means a weapon that expels a projectile by the
220220 action of explosive or expanding gases;
221221 5. “Firearm accessory” means a device specifically designed or
222222 adapted to enable an individual to wear, carry, store, or mount a
223223 firearm on the individual or on a conveyance and an item used in
224224 conjunction with or mounted on a firearm that is not essential to
225225 the basic function of the firearm. The term includes a detachable
226226 firearm magazine;
227227 6. “Firearm entity” means:
228228 a. a firearm, firearm accessory, or firearm ammunition
229229 manufacturer, distributor, wholesale r, supplier, or
230230 retailer, and
231231 b. a gun range;
232232 7. “Firearm trade association ” means any person, corporation,
233233 unincorporated association , federation, business league, or business
234234 organization that:
235235 a. is not organized or operated for profit and for which
236236 none of its net earnings inures to the benefit of any
237237 private shareholder or ind ividual,
238238 b. has two or more firearm entities as members , and

290290 c. is exempt from federal income taxation unde r Section
291291 501(a), Internal Rev enue Code of 1986, as an
292292 organization described by Section 501(c) of that code;
293293 8. “Governmental entity” means any branch, department, agency,
294294 or instrumentality of state gove rnment, or any official or other
295295 person acting under color of state law, or any political subdivision
296296 of this state; and
297297 9. “Sole-source provider” means a supplier who provides goods
298298 or services of a unique nature or goo ds or services that are solely
299299 available through the supplier and the supplier is the only
300300 practicable source to provide s uch goods or services.
301301 B. The provisions of this section shall apply only to a
302302 contract that:
303303 1. Is between a governmental entity an d a company with at least
304304 ten (10) full-time employees;
305305 2. Has a value of at least One Hundred Thousand Dollars
306306 ($100,000.00) that is paid wholly or partly from public funds of the
307307 governmental entity; and
308308 3. Is entered into on or after the effective date of this act .
309309 Any contract entered into before the effective date of this act is
310310 governed by the law in effect on the d ate the contract was en tered
311311 into and the former law is continued in effect for that purp ose.
312312 C. Except as provided by subsection D of this section, a
313313 governmental entity shall not enter into a contract with a company

365365 for the purchase of goods or services unless the contract contains a
366366 written verification from the company that it:
367367 1. Does not have a practice, policy, guidance, or directive
368368 that discriminates against a firearm entity or firea rm trade
369369 association; and
370370 2. Will not discriminate during the term of the contract
371371 against a firearm entity or firearm trade association.
372372 D. The provisions of subsection C of this section shall not
373373 apply to a governmental entity that:
374374 1. Contracts with a sole-source provider; or
375375 2. After requesting bids, only receives bids from companies
376376 that do not comply with the provisions of subsection C of this
377377 section.
378378 E. The Central Purchasing Division of the Office of Management
379379 and Enterprise Services shall have the authority and responsibilit y
380380 of reviewing state governmental contracts to confirm that the
381381 requirements of subsection C of this section have been satisfied.
382382 SECTION 2. This act shall become effective November 1, 2023.
