79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Section 85.44F of Title 74, unless there
82	82	is created a duplication in numbering, reads as follows:
83	83	A. As used in this section:
84	84	1. “Ammunition” means a loaded cartridge or shot shell, case,
85	85	primer, projectile, wadding, or propellant powder;
86	86	2. “Company” means a for-profit organization, association,
87	87	corporation, partnershi p, joint venture, limited partnership,
88	88	limited liability partnership, or limited liability company
89	89	including a wholly owned subsidiary, majority-owned subsidiary,

141	141	parent company, or an affiliate of those entities or associations
142	142	that exists to make a profit. The term does not include a sole
143	143	proprietorship;
144	144	3. “Discriminate against a firearm entity or firearm trade
145	145	association” means, with respect to the entity or association, to:
146	146	a. refuse to engage in the trade of any goods or services
147	147	with the entity or association based solely on its
148	148	status as a firearm entity or firearm trade
149	149	association,
150	150	b. refrain from continuing an existing business
151	151	relationship with the entity or associa tion based
152	152	solely on its status as a firearm entity or fire arm
153	153	trade association, or
154	154	c. terminate an existing business relationship with the
155	155	entity or association based solely on its status as a
156	156	firearm entity or firearm trade association.
157	157	The term does not include the policies of a vendor, merchant, retail
158	158	seller, or platform that restrict or prohibit the listing or selling
159	159	of ammunition, firearms, or firearm accessories. The term also does
160	160	not include a company’s refusal to engage in the trade of any goods
161	161	or services, decision to refrain from continuing an existing
162	162	business relationship, or decision to terminate an existing business
163	163	relationship to comply with federal, state, or local laws, policies,
164	164	or regulations or a directive by a regulatory agency, or for any

216	216	traditional business reason that is specific to the customer or
217	217	potential customer and not based solely on the status of an entity
218	218	or association as a firearm entity or firearm trade association;
219	219	4. “Firearm” means a weapon that expels a projectile by the
220	220	action of explosive or expanding gases;
221	221	5. “Firearm accessory” means a device specifically designed or
222	222	adapted to enable an individual to wear, carry, store, or mount a
223	223	firearm on the individual or on a conveyance and an item used in
224	224	conjunction with or mounted on a firearm that is not essential to
225	225	the basic function of the firearm. The term includes a detachable
226	226	firearm magazine;
227	227	6. “Firearm entity” means:
228	228	a. a firearm, firearm accessory, or firearm ammunition
229	229	manufacturer, distributor, wholesale r, supplier, or
230	230	retailer, and
231	231	b. a gun range;
232	232	7. “Firearm trade association ” means any person, corporation,
233	233	unincorporated association , federation, business league, or business
234	234	organization that:
235	235	a. is not organized or operated for profit and for which
236	236	none of its net earnings inures to the benefit of any
237	237	private shareholder or ind ividual,
238	238	b. has two or more firearm entities as members , and

290	290	c. is exempt from federal income taxation unde r Section
291	291	501(a), Internal Rev enue Code of 1986, as an
292	292	organization described by Section 501(c) of that code;
293	293	8. “Governmental entity” means any branch, department, agency,
294	294	or instrumentality of state gove rnment, or any official or other
295	295	person acting under color of state law, or any political subdivision
296	296	of this state; and
297	297	9. “Sole-source provider” means a supplier who provides goods
298	298	or services of a unique nature or goo ds or services that are solely
299	299	available through the supplier and the supplier is the only
300	300	practicable source to provide s uch goods or services.
301	301	B. The provisions of this section shall apply only to a
302	302	contract that:
303	303	1. Is between a governmental entity an d a company with at least
304	304	ten (10) full-time employees;
305	305	2. Has a value of at least One Hundred Thousand Dollars
306	306	($100,000.00) that is paid wholly or partly from public funds of the
307	307	governmental entity; and
308	308	3. Is entered into on or after the effective date of this act .
309	309	Any contract entered into before the effective date of this act is
310	310	governed by the law in effect on the d ate the contract was en tered
311	311	into and the former law is continued in effect for that purp ose.
312	312	C. Except as provided by subsection D of this section, a
313	313	governmental entity shall not enter into a contract with a company

365	365	for the purchase of goods or services unless the contract contains a
366	366	written verification from the company that it:
367	367	1. Does not have a practice, policy, guidance, or directive
368	368	that discriminates against a firearm entity or firea rm trade
369	369	association; and
370	370	2. Will not discriminate during the term of the contract
371	371	against a firearm entity or firearm trade association.
372	372	D. The provisions of subsection C of this section shall not
373	373	apply to a governmental entity that:
374	374	1. Contracts with a sole-source provider; or
375	375	2. After requesting bids, only receives bids from companies
376	376	that do not comply with the provisions of subsection C of this
377	377	section.
378	378	E. The Central Purchasing Division of the Office of Management
379	379	and Enterprise Services shall have the authority and responsibilit y
380	380	of reviewing state governmental contracts to confirm that the
381	381	requirements of subsection C of this section have been satisfied.
382	382	SECTION 2. This act shall become effective November 1, 2023.
