4975 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5076 SECTION 1. AMENDATORY 29 O.S. 2021, Section 7 -503, is
5177 amended to read as follows:
5278 Section 7-503. A. Except as otherwise provided for by law, no
5379 person may buy, barter, trade, sell or offer, or expose f or sale all
5480 or any part of any fish or wildlife or the nest or eggs of any bird,
5581 protected by law. The carcasses or any parts thereof of legally
5682 acquired furbearing animals or coyotes may be purchased, bartered,
5783 traded, sold or offered for sale. The fur or pelt of legally
5884 acquired squirrels may be purcha sed, bartered, traded, sold or
5985 offered for sale.
6086 B. Persons licensed to propagate or sell fish or wildlife
6187 pursuant to the provisions of the Oklahoma Wildlife Conservation
62-Code and persons who have docume ntation of legally purchased fish or

139+Code and persons who have docume ntation of legally purchased fish or
90140 wildlife or parts thereof for resale are exempt from the provisions
91141 of this section.
92142 C. All wildlife or parts thereof seized pursuant to the
93143 provisions of this section and determined to be unfit for release in
94144 a suitable locale shall be sold. The proceeds from said sa le shall
95145 be deposited in the Wildlife Conservation Fund.
96146 D. No person shall buy, barter, trade, or sell, within this
97147 state, any furbearing animal, game animal, or game fish, or any part
98148 thereof, acquired from a source within or outside of this state
99149 unless at the time and place of each such sale, the seller shall
100150 possess an invoice signed by the person from whom said seller
101151 purchased said animals or fish, which shall contain a statement of
102152 the source from which said animals or fish were acquired, and the
103153 species and quantity of each species, or parts thereof, delivered to
104154 said seller.
105155 E. D. Persons who have obtained legal possession of wildlife or
106156 parts of wildlife after being given to the person for taxid ermic
107157 preparation or processing of the meat for con sumption shall be
108158 permitted to dispose of such, unless otherwise prohibited by law,
109159 under rules established by the Oklahoma Wildlife Conservation
110160 Commission.
111161 F. E. The animal, bird, fish, or part thereof shall be
112162 confiscated by the arresting authority and forwarded to the
113-Commission to be held until the matter is resolved. If a person

214+Commission to be held until the matter is resolved. If a person
141215 violating the provisions of this section is convicted, the
142216 Commission shall retain and properly dispose of the confiscated
143217 animal, bird, fish, or part thereof. If a person accused of
144218 violating the provisions of this section is acquitted, the
145219 confiscated animal, bird, fish, or part thereof shall be returned to
146220 the possession of the person from whom it was confiscated.
147221 G. F. The first violation of any of the provisions of thi s
148222 section shall be punishable by a fine of not less than One Hundred
149223 Dollars ($100.00), nor more than Five Hundred Dollars ($500.00), or
150224 by imprisonment in the county jail for a period not less than ten
151225 (10) days nor more than sixty (60) days, or by both s aid fine and
152226 imprisonment.
153227 Subsequent violations of the provisions of this section shall be
154228 punishable by a fine of not less than One Thousand Dollars
155229 ($1,000.00), or by imprisonment in the county jail for a period not
156230 less than ten (10) days nor more than sixty (60) days, or by both
157231 said fine and imprisonment.
158232 SECTION 2. This act shall become effective November 1, 2023.
