75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 74 O.S. 2021, Section 85.42, is
77	77	amended to read as follows:
78	78	Section 85.42. A. 1. Except as otherwise provided for in this
79	79	section or other applicable law, any agency, whether or not su ch
80	80	agency is subject to the Oklahoma Central Purcha sing Act, is
81	81	prohibited from entering into a sole source contract or a contra ct
82	82	for professional services with or for the services of any person,
83	83	who has terminated employment with or who has been terminat ed by
84	84	that agency for one (1) year after the termin ation date of the
85	85	employee from the agency. The provisions of this subsectio n shall
86	86	not prohibit an agency from hiring or rehiring such person as a
87	87	state employee.

139	139	2. Any chief administrative officer of an agency, whether or
140	140	not such agency is subject to the Oklahoma Central Purchasing Act,
141	141	shall not enter into any contract for n onprofessional or
142	142	professional services for the purpose of or which would result in
143	143	the circumvention of the full -time equivalent employee limitation
144	144	established by law for such a gency.
145	145	B. Each contract entered into by any person or firm w ith the
146	146	State of Oklahoma shall include a statement certifying that no
147	147	person who has been involved in any manner in the development of
148	148	that contract while employed by the state shall be employed to
149	149	fulfill any of the services provided for under the contra ct. This
150	150	subsection shall not preclude faculty and staff of the institutions
151	151	within The State System of Higher Education from negotiating and
152	152	participating in research grants and educational con tracts. Nor
153	153	shall this subsection apply to Oklahoma Departme nt of Commerce
154	154	personnel who contract to provide services to the Oklahoma Capital
155	155	Investment Board.
156	156	C. As used in this section, “person” is defined as means any
157	157	state official or employee of a d epartment, board, bureau,
158	158	commission, agency, trusteeship, au thority, council, committee,
159	159	trust, school district, fair board, court, executive office,
160	160	advisory group, task force, study group, supported in whole or in
161	161	part by public funds or entrusted with the expenditure of public
162	162	funds or administering or operating public property, and all

214	214	committees, or subcommittees thereof, judges, justices and state
215	215	legislators.
216	216	D. Notwithstanding anything to the cont rary in this section,
217	217	the following sole source or professional services contracts are
218	218	allowed at any time:
219	219	1. A contract for professional services at any time with a
220	220	person who is a qualified interpreter for the deaf; and
221	221	2. A contract between a busines s entity that is a part -time
222	222	certified court report er and the Administrative Office of the
223	223	Courts, on behalf of the district courts, or the Office of the
224	224	Attorney General; and
225	225	3. A contract entered into by the Executive Director of the
226	226	Oklahoma Indigent Defense System for the purpose of providing court -
227	227	appointed representation for indigent defendants pursuan t to the
228	228	Indigent Defense Act.
229	229	E. Provided the provisions specified in subsection B of this
230	230	section are satisfied, the following professional services contracts
231	231	are allowed:
232	232	1. The Department of Trans portation, Oklahoma Water Resources
233	233	Board, Department of Environm ental Quality, Oklahoma Tourism and
234	234	Recreation Department, the Oklahoma Turnpike Authority and the
235	235	Oklahoma Department of Agriculture, Food, and Forestry may contract
236	236	with a person who has re tired from state service;

289	289	the State Department of Health and city -county health departments
290	290	may contract with a physician assistant, registere d nurse, advanced
291	291	practice nurse, nurse midwife, re gistered dietician, occupational
292	292	therapist, physical therapist or speech-language pathologist who has
293	293	retired from state service; and
294	294	3. The Department of Mental Health and Substance Abuse Services
295	295	may contract with a physician, re gistered nurse, register ed
296	296	pharmacist or person meeting the definitio n of a licensed ment al
297	297	health professional, as defined in Title 43A of the Oklahoma
298	298	Statutes, who has separated and/or retired from state service.
299	299	SECTION 2. This act shall become effective November 1, 2023.
