7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 74 O.S. 2021, Section 85.42, is
7777 amended to read as follows:
7878 Section 85.42. A. 1. Except as otherwise provided for in this
7979 section or other applicable law, any agency, whether or not su ch
8080 agency is subject to the Oklahoma Central Purcha sing Act, is
8181 prohibited from entering into a sole source contract or a contra ct
8282 for professional services with or for the services of any person,
8383 who has terminated employment with or who has been terminat ed by
8484 that agency for one (1) year after the termin ation date of the
8585 employee from the agency. The provisions of this subsectio n shall
8686 not prohibit an agency from hiring or rehiring such person as a
8787 state employee.

139139 2. Any chief administrative officer of an agency, whether or
140140 not such agency is subject to the Oklahoma Central Purchasing Act,
141141 shall not enter into any contract for n onprofessional or
142142 professional services for the purpose of or which would result in
143143 the circumvention of the full -time equivalent employee limitation
144144 established by law for such a gency.
145145 B. Each contract entered into by any person or firm w ith the
146146 State of Oklahoma shall include a statement certifying that no
147147 person who has been involved in any manner in the development of
148148 that contract while employed by the state shall be employed to
149149 fulfill any of the services provided for under the contra ct. This
150150 subsection shall not preclude faculty and staff of the institutions
151151 within The State System of Higher Education from negotiating and
152152 participating in research grants and educational con tracts. Nor
153153 shall this subsection apply to Oklahoma Departme nt of Commerce
154154 personnel who contract to provide services to the Oklahoma Capital
155155 Investment Board.
156156 C. As used in this section, “person” is defined as means any
157157 state official or employee of a d epartment, board, bureau,
158158 commission, agency, trusteeship, au thority, council, committee,
159159 trust, school district, fair board, court, executive office,
160160 advisory group, task force, study group, supported in whole or in
161161 part by public funds or entrusted with the expenditure of public
162162 funds or administering or operating public property, and all

214214 committees, or subcommittees thereof, judges, justices and state

216216 D. Notwithstanding anything to the cont rary in this section,
217217 the following sole source or professional services contracts are
218218 allowed at any time:
219219 1. A contract for professional services at any time with a
220220 person who is a qualified interpreter for the deaf; and
221221 2. A contract between a busines s entity that is a part -time
222222 certified court report er and the Administrative Office of the
223223 Courts, on behalf of the district courts, or the Office of the
224224 Attorney General; and
225225 3. A contract entered into by the Executive Director of the
226226 Oklahoma Indigent Defense System for the purpose of providing court -
227227 appointed representation for indigent defendants pursuan t to the
228228 Indigent Defense Act.
229229 E. Provided the provisions specified in subsection B of this
230230 section are satisfied, the following professional services contracts
231231 are allowed:
232232 1. The Department of Trans portation, Oklahoma Water Resources
233233 Board, Department of Environm ental Quality, Oklahoma Tourism and
234234 Recreation Department, the Oklahoma Turnpike Authority and the
235235 Oklahoma Department of Agriculture, Food, and Forestry may contract
236236 with a person who has re tired from state service;

288288 2. To maintain public health infrastru cture and preparedness,
289289 the State Department of Health and city -county health departments
290290 may contract with a physician assistant, registere d nurse, advanced
291291 practice nurse, nurse midwife, re gistered dietician, occupational
292292 therapist, physical therapist or speech-language pathologist who has
293293 retired from state service; and
294294 3. The Department of Mental Health and Substance Abuse Services
295295 may contract with a physician, re gistered nurse, register ed
296296 pharmacist or person meeting the definitio n of a licensed ment al
297297 health professional, as defined in Title 43A of the Oklahoma
298298 Statutes, who has separated and/or retired from state service.
299299 SECTION 2. This act shall become effective November 1, 2023.
