7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 26 O.S. 2021, Section 4 -109.3, as
8181 amended by Section 15, Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2022,
8282 Section 4-109.3), is amended to read as follows:
8383 Section 4-109.3. A. When a qualified elector applies for
8484 issuance or renewal of an Oklahoma driver license, or issuance of a
8585 state identification card issued pu rsuant to Section 6-105 of Title
8686 47 of the Oklahoma Statutes, he or she shall be provided voter
8787 registration services as required by the National Vot er Registration
8888 Act. All completed paper voter registration applications shall be
8989 transmitted by the agency accepting the application at the close of

141141 business each week to the State Election Board in pre addressed,
142142 postage prepaid envelopes provided by the State Election Board. If
143143 a person registers or declines to register to vote, the offi ce at
144144 which the person submits the voter registration application or the
145145 fact that the person declined to register sh all remain confidential
146146 and will be used only for vo ter registration purposes.
147147 B. A change of address for an Oklahoma driver license or st ate
148148 identification card submitted by a registered voter shall also serve
149149 as a change of address for voter registratio n purposes if the new
150150 address is within the same co unty where the voter is registered to
151151 vote. If the new address is outside the county wh ere the voter is
152152 currently registered to vote, the voter shall be sent a notice and
153153 application with instructions for registering to vote at the new
154154 address. A change of address for an Oklahoma driver license or
155155 state identification card shall not be used to update a voter
156156 registration address if the registrant states in writing that the
157157 change of address is not for vot er registration purposes.
158158 C. Licensed operators shall receive fifty cents ($0.50) per
159159 valid paper voter registration application or appli cation for change
160160 in voter registration taken by themselves and employees of the
161161 licensed operator’s office taken at the licensed operator’s office,
162162 payable by the State Election Board.
163163 D. Service Oklahoma shall notify the Secretary of the State
164164 Election Board of licensed operator appointments. Service Oklahoma

216216 shall notify the Secretary of the State Election Board of licensed
217217 operators qualified to issue driver licenses.
218218 E. The Secretary of the State El ection Board is authorized to
219219 develop with Service Oklahoma a system to electronically transmit
220220 voter registration applications from licensed operators to the State
221221 Election Board or county election boards. Such system shall be
222222 consistent with the requirements for electronic submission of voter
223223 registration applications provided in Section 4 -109.4 of this title.
224224 F. The Secretary of the State Election Board sha ll develop a
225225 system by which Service Oklahoma and motor license agents sh all
226226 provide to the Secretary electronic records containing the legal
227227 name, age, residence, citizenship information , and the electronic
228228 signature of each person who is a qualified elector or will be a
229229 qualified elector within the next two (2) years.
230230 G. Upon receiving the electron ic record for and electronic
231231 signature of a qualifie d elector or a person who will become a
232232 qualified elector within the next two (2) years, th e Secretary shall
233233 provide the information to the county election board of the county
234234 in which the person may be r egistered or preregistered as a
235235 qualified elector. The Secretary or county election board shall
236236 notify each person of the process to:
237237 1. Decline being registered as a quali fied elector; or
238238 2. Adopt a political party affiliation.

290290 H. If a person notified under subsection G of this section does
291291 not decline to be registered as an elector within twenty -one (21)
292292 calendar days after the Secretary or county election board issues
293293 the notification, the person’s electronic record and electro nic
294294 signature submitted under subsection F of this section shall
295295 constitute a completed registration ca rd for the person for purposes
296296 of this section. The person sha ll be registered to vote if the
297297 county election board determines that the person is a qual ified
298298 elector and the person is not already registered to vote. If the
299299 person neither declines to be regist ered nor selects a political
300300 party, the person shall be registered as an independent.
301301 I. A county election board shall not send a ballot to, or add
302302 to an elector registra tion list, a person who meets eligibility
303303 requirements until at least twenty-one (21) calendar days after t he
304304 Secretary or county election board provided notification to the
305305 person as described in subsection G of this section.
306306 J. The Secretary of the State Election Board shall promulgate
307307 rules and procedures to implement the requ irements of this section.
308308 SECTION 2. This act shall become effective November 1, 2023.
