75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 1-502.5 of Title 63, unless
78	78	there is created a duplication in number ing, reads as follows:
79	79	A. This act shall be known and may be cited as the “Oklahoma
80	80	Employee Protection Plan ”.
81	81	B. As used in this section, “covered entity” means:
82	82	1. A state agency;
83	83	2. A political subdivision ;
84	84	3. Any entity that accepts funds from the state, the federal
85	85	government, or a political subdivision from whatever source derived;

137	137	4. Any entity that employs individuals who are required by the
138	138	state or a political subdivision to have licensure or certification
139	139	issued by a state agency;
140	140	5. Any hospital licensed by the State Department of Healt h; or
141	141	6. Any private entity.
142	142	C. A covered entity or agent of a covered entity shall not
143	143	discriminate against, punish, demote, or isolate any employee of the
144	144	covered entity based on whether the employee has received a vaccine
145	145	used to prevent infection by any current or future variant of SARS-
146	146	CoV-2 or the development of COVID-19.
147	147	D. A covered entity or agent of a covered entity shall not be
148	148	liable in a civil action claiming an injury from exposure or
149	149	potential exposure to any current or future variant of SARS-CoV-2 or
150	150	from the development of COVID-19 if the act or omission alleged to
151	151	violate a duty of care of the covered entity or agent of the covered
152	152	entity was in compliance with this section.
153	153	SECTION 2. It being immediately necessary for the preservation
154	154	of the public peace, health or s afety, an emergency is hereby
155	155	declared to exist, b y reason whereof this act shall take effect and
156	156	be in full force from and after its pa ssage and approval.
