7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new section of law to be codified
7777 in the Oklahoma Statutes as Section 1 -735.1 of Title 63, unless
7878 there is created a duplication in numbering, reads as follows :
7979 A. This section shall be known and may be cited as the
8080 “Protection of Human Life Act o f 2023”.
8181 B. As used in this section:
8282 1. “Human embryo” means a living organism of the species Homo
8383 sapiens at the earliest stages of development, including the single -
8484 celled stage, that is not located in the body of a female; and
8585 2. “Nontherapeutic research” means research that is not
8686 intended to help preserve the life and health of the particular
8787 embryo subjected to risk. This term does not include in vitro

139139 fertilization and accompanying embryo transfe r to the body of a
140140 female, nor any diagnostic test which may assist in the future care
141141 of a child subjected to the tests, nor the extraction of adult stem
142142 cells.
143143 C. No person shall:
144144 1. Knowingly conduct nontherapeutic r esearch that destroys a
145145 human embryo or subjects a human embryo to substantial risk of
146146 injury or death;
147147 2. Transfer a human embryo wit h the knowledge that the embryo
148148 will be subjected to nontherapeutic research; or
149149 3. Use for research purposes cells or t issues that the person
150150 knows were obtained by performing activities in violation of th is
151151 section.
152152 D. Any person found violating the pr ovisions of subsection C of
153153 this section shall, upon conviction, be guilty of a misdemeanor
154154 punishable by incarceration i n the county jail for a term not to
155155 exceed one (1) year.
156156 SECTION 2. This act shall become effective July 1, 2023.
157157 SECTION 3. It being immediately necessary for the preservation
158158 of the public peace, health or safety, an eme rgency is hereby
159159 declared to exist, by reason whereof this act shall take effect and
160160 be in full force from and after its passage and approval.
