66	66	the Protection of Human Life Act o f 2023; providing
67	67	short title; defining terms; making certain actions
68	68	with a human embryo unlawful; providing penalty;

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 1 -735.1 of Title 63, unless
78	78	there is created a duplication in numbering, reads as follows :
79	79	A. This section shall be known and may be cited as the
80	80	“Protection of Human Life Act o f 2023”.
81	81	B. As used in this section:
82	82	1. “Human embryo” means a living organism of the species Homo
83	83	sapiens at the earliest stages of development, including the single -
84	84	celled stage, that is not located in the body of a female; and
85	85	2. “Nontherapeutic research” means research that is not
86	86	intended to help preserve the life and health of the particular
87	87	embryo subjected to risk. This term does not include in vitro

139	139	fertilization and accompanying embryo transfe r to the body of a
140	140	female, nor any diagnostic test which may assist in the future care
141	141	of a child subjected to the tests, nor the extraction of adult stem
142	142	cells.
143	143	C. No person shall:
144	144	1. Knowingly conduct nontherapeutic r esearch that destroys a
145	145	human embryo or subjects a human embryo to substantial risk of
146	146	injury or death;
147	147	2. Transfer a human embryo wit h the knowledge that the embryo
148	148	will be subjected to nontherapeutic research; or
149	149	3. Use for research purposes cells or t issues that the person
150	150	knows were obtained by performing activities in violation of th is
151	151	section.
152	152	D. Any person found violating the pr ovisions of subsection C of
153	153	this section shall, upon conviction, be guilty of a misdemeanor
154	154	punishable by incarceration i n the county jail for a term not to
155	155	exceed one (1) year.
156	156	SECTION 2. This act shall become effective July 1, 2023.
157	157	SECTION 3. It being immediately necessary for the preservation
158	158	of the public peace, health or safety, an eme rgency is hereby
159	159	declared to exist, by reason whereof this act shall take effect and
160	160	be in full force from and after its passage and approval.
