179179 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
180180 SECTION 1. NEW LAW A new section of law to be codified
181181 in the Oklahoma Statutes as Section 28 -100 of Title 70, unless there
182182 is created a duplication in numbering, reads as follows:
183183 A. This act shall be known and may b e cited as the “Oklahoma
184184 Parent Empowerment Act for Kids”.
185185 B. It is the intent of the Legislature that parents, legal
186186 guardians, and others with legal authority over children in this
187187 state be able to access educational services that meet the needs of
188188 their individual children by directing State Aid for wh ich each

241241 Legislature affirms that parents and legal guardians are best suited
242242 to make decisions to help children in this state reach their full
243243 potential and achieve a brighter future.
244244 SECTION 2. NEW LAW A new section of law to be codified
245245 in the Oklahoma Statutes as Section 28 -101 of Title 70, unless there
246246 is created a duplication in numbering, reads as follows:
247247 A. As used in the Oklahoma Parent Empowerment Act for K ids:
248248 1. “Agency” means the Office of the State Treasurer;
249249 2. “Curriculum” means a complete course of study for a
250250 particular content area or grade level;
251251 3. “Oklahoma Parent Empowerment Act for Kids Acco unt” or “OK
252252 PEAK Account” means the account in whic h funds are deposited by the
253253 Agency to pay for qualifying education expenses for an OK PEAK
254254 student;
255255 4. “Education service provider ” means a person, business,
256256 public school district, public charter school , magnet school,
257257 institution within The Oklahoma St ate System of Higher Education, or
258258 organization that receives payments from a parent directing an OK
259259 PEAK Account to provide educational goods and/or services to OK PEAK
260260 students;
261261 5. “Eligible student” means:
262262 a. a resident of this state who lives in a county with a
263263 population of more than ten thousand (10,000) or whose

316316 than ten thousand (10,000) according to the latest
317317 Federal Decennial Census, and who is eligible to
318318 enroll in a public school in this state, or
319319 b. a resident of this state who lives in a county with a
320320 population of less than ten thousand (10,000)
321321 according to the latest Federal Decennial Census and
322322 who is eligible to enroll in a public school in this
323323 state that has been determined by a report ing agency
324324 to be a trigger district ;
325325 6. “OK PEAK student” means an eligible student approved for
326326 participation in the OK PEAK Account Program;
327327 7. “Parent” means a biological or adoptive parent, legal
328328 guardian, custodian, or other person with legal author ity to act on
329329 behalf of an eligible student;
330330 8. “Qualified expense” means the following services provided by
331331 an education service provider:
332332 a. tuition and/or fees at a private school accredited or
333333 in the process of obtaining accreditation by the State
334334 Board of Education or another accrediting associatio n
335335 approved by the State Board of Education,
336336 b. tuition and/or fees for non -public online learning

391391 d. services contracted for a nd provided by a public
392392 school district, public c harter school, or magnet
393393 school including but not limited to classes and
394394 extracurricular activities and programs,
395395 e. textbooks, curriculum, or other instruc tional
396396 materials including but not limited to suppl emental
397397 materials or associated online instructio n required by
398398 an education service provider,
399399 f. computer hardware or other technological devices,
400400 educational software, and applications that are used
401401 to meet an OK PEAK student’s curriculum needs,
402402 g. tuition and/or fees for a curriculum or program, along
403403 with related instruments, supplies, accessories, and
404404 materials, that provides instruction in drama, music,
405405 speech and debate, agriculture, or other similar
406406 activities,
407407 h. school uniforms,
408408 i. fees for nationally standardized assessments including
409409 but not limited to assessments used to determine
410410 college admission and advanced placement examinations
411411 as well as tuition and/or fees for tutoring or
412412 preparatory courses for the assessments,

465465 specialized after-school education programs; provided,
466466 however, that such expense does not include before -
467467 school or after-school childcare,
468468 k. tuition, fees, instructional ma terials, and assessment
469469 fees for a curriculum or pr ogram offered by a
470470 technology center school,
471471 l. educational services and therapies including but not
472472 limited to occupational, behavioral, physical, speech -
473473 language, and audiology therapies,
474474 m. tuition and fees for concurrent enrollment at an
475475 institution within The Oklahoma State System of Higher
476476 Education,
477477 n. fees for transportation paid to a fee -for-service
478478 provider for the student to travel to and from an
479479 education service provider, or
480480 o. any other qualified expense approved by the Agency ;
481481 9. “Reporting agency” means:
482482 a. the parent’s state representati ve or state senator,
483483 b. the board of education for the resident district of
484484 the parent, as determined by Section 1 -113 of Title 70
485485 of the Oklahoma Statutes,
486486 c. the State Board of Education, or

539539 resides; and
540540 10. “Trigger district” means a school district in this state
541541 where any of the following concepts or activities have been
542542 advocated or tolerated:
543543 a. violations of Section 24 -157 of Title 70 of the
544544 Oklahoma Statutes,
545545 b. violations of Section 1-125 of Title 70 of the
546546 Oklahoma Statutes,
547547 c. violations of Section 27 -106 of Title 70 of the
548548 Oklahoma Statutes,
549549 d. instruction in gender identity and sexual orien tation
550550 including instruction designed to promote ge nder
551551 confusion,
552552 e. possession of books wh ich contain obscene material as
553553 defined by Section 1024.1 of Title 21 of the Oklahoma
554554 Statutes,
555555 f. curriculum which is sexual in nature, except as
556556 provided for in Section 11-105.1 of Title 70 of the
557557 Oklahoma Statutes,
558558 g. the presence of any school employee or volunteer
559559 engaged in anthropomorphic behavior commonly referred
560560 to as furries,

612612 h. climate change ideology including, but not limited to,
613613 disparaging the oil and natural gas industry or the
614614 agriculture industry,
615615 i. curriculum promoting social and emotio nal learning,
616616 j. curriculum promoting animal rights activism,
617617 k. instruction that disparages the Second Amendment to
618618 the United States Constitution,
619619 l. ideology that encourages efforts to defund the police,
620620 or
621621 m. curriculum promoting a Marxist ideology inc luding, but
622622 not limited to, violations of Section 1266.4 of Title
623623 21 of the Oklahoma Statutes .
624624 B. There is hereby created the Oklahoma Parent Empowerment Act
625625 for Kids or OK PEAK Program to be administered by the Ag ency to
626626 provide an OK PEAK Account for qualified expenses to support the
627627 education of OK PEAK students in this state.
628628 C. 1. To apply for an OK PEAK Account, a parent of an eligible
629629 student shall submit a n application to the Agency on a form
630630 prescribed by the Agency and published on its website. The
631631 application may be submitted online or by mail.
632632 2. The Agency shall establish procedures to approve
633633 applications within ten (10) business days after receipt. There
634634 shall be no deadline for submission of appl ications. Applications

686686 shall be approved if the parent signs an agreement to do all of the
687687 following:
688688 a. use the OK PEAK Account only for qualified expenses to
689689 provide an education for an eligible student in at
690690 least the subjects of reading, English langu age arts,
691691 mathematics, science, and socia l studies,
692692 b. not enroll the eligible student as a full -time student
693693 in a public school district, public charter school, or
694694 magnet school after acceptance of an OK PEAK Account,
695695 c. comply with rules and requirements of the OK PEAK
696696 Account Program established by the Agency, and
697697 d. not accept a scholarship from the Lindsey Nicole Henry
698698 Scholarships for Students with Disabilities Program
699699 created by Section 13 -101.2 of Title 70 of the
700700 Oklahoma Statutes while participatin g in the OK PEAK
701701 Account Program.
702702 3. No student shall, on the grounds of race, color, or national
703703 origin, be excluded from participation in, be denied the benefits
704704 of, or be subjected to discrimination un der the OK PEAK Account
705705 Program.
706706 D. Nothing in this act shall be construed to require that an OK
707707 PEAK student be enrolled full time or part time in a private school
708708 or a nonpublic online school.

760760 E. The Agency shall renew OK PEAK Accounts on an annual basis.
761761 An account may be closed if:
762762 1. The parent of an OK PEAK student re-enrolls the student as a
763763 full-time student in a public school, as provided for by subsection
764764 F of this section;
765765 2. The Agency closes the account due to intentional misuse as
766766 provided for in Section 3 of this act; or
767767 3. The OK PEAK student graduates from high school or reaches
768768 the age of twenty-one (21), whichever comes first.
769769 F. The parent of an OK PEAK student shall notify the Agency
770770 within five (5) days of the student re -enrolling in a public school
771771 district, public charter schoo l, or magnet school. Upon receipt of
772772 the notification required by this subsection, the Agency shall
773773 suspend deposits into the student ’s OK PEAK Account. Any unused
774774 funds remaining in the OK PEAK Account at the end of the appl icable
775775 calendar year shall be remitted to the General Revenue Fund.
776776 G. 1. For each eligible student approved to participate in the
777777 OK PEAK Account Program, the Agency shall notify the State
778778 Department of Education and request calcul ation of the amount of
779779 State Aid for which the stud ent is eligible. Within ten (10)
780780 business days of receiving the request, the State Department of
781781 Education shall notify the Agency of the calculated amount, which
782782 shall be equivalent to the total State Ai d factors including pu pil
783783 category weights for the applicable school year multiplied by the

836836 year.
837837 2. The State Department of Education on a monthly basis shall
838838 transfer to the Agency for depo sit into the OK PEAK Account
839839 Revolving Fund created pursuant to Section 5 of this act an amount
840840 equal to one-twelfth (1/12) of the total amount necessary to fund
841841 all OK PEAK Accounts requested for the applicable school year.
842842 Within ten (10) business days of a deposit required by this
843843 paragraph, the Office of the State Treasurer shall make funds
844844 available in OK PEAK Accounts.
845845 3. Prior to the monthly deposit required by this subsection,
846846 the Agency shall notify the State Department of Education if changes
847847 to the number of partici pating OK PEAK students will result in a
848848 modification of the monthly deposit amount.
849849 H. An education service provider shall not share, refund, or
850850 rebate any amount of an OK PEAK Account with the parent or OK PEAK
851851 student. A refund or rebate for goods or services purchased with an
852852 OK PEAK Account shall be credited to the OK PEAK Account.
853853 I. Parents shall be prohibited from making personal deposits
854854 into an OK PEAK Account. However, no parent shall be restricted
855855 from making payments f or educational goods a nd services not covered
856856 by funds in a student’s OK PEAK Account.

908908 J. Monies received pursuant to the OK PEAK Account Program
909909 shall not constitute taxable income to the parent or OK PEAK
910910 student.
911911 K. Funds deposited into an OK PEAK Account but unused shall
912912 accrue from month to month an d from year to year unless the account
913913 is closed pursuant to the provisions of subsection E of this
914914 section.
915915 SECTION 3. NEW LAW A new section of law to be codified
916916 in the Oklahoma Statutes as Section 28 -102 of Title 70, unless there
917917 is created a duplication in numbering, reads as follows:
918918 A. To implement the provisions of the Oklahoma Parent
919919 Empowerment Act for Kids , the Agency shall maintain and make
920920 publicly available on its websi te an updated list of education
921921 service providers.
922922 B. The Agency shall provide parents of OK PEAK students a
923923 written explanation of qualified expenses for which an OK PEAK
924924 Account may be used, the responsibilities of parents, the duties of
925925 the Agency, and the role of any priva te financial management firm or
926926 other private organization with which the Agency may contract to
927927 administer the Oklahoma Parent Empowerment Act for Kids .
928928 C. The Agency shall provide parents of OK PEAK students with
929929 disabilities notice that participation i n the OK PEAK Account
930930 Program shall have the same effect as a parental revocation of
931931 consent pursuant to 20 U.S.C., Sections 1414(a)(1)(D) and 1414(C) of

984984 explanation of the rights parents of OK PEAK students with
985985 disabilities have under IDEA and any applicable state laws and
986986 regulations.
987987 D. The Agency may contract with a private financial management
988988 firm or other private organization to administer in full or in part
989989 the OK PEAK Account Program.
990990 E. The Agency may withhold f unding from deposits made pursuant
991991 to subsection G of Section 2 of this act to administer the OK PEAK
992992 Account Program in an amount not to exceed five percent (5%)
993993 annually for the first two years after the effective date of thi s
994994 act and three percent (3%) annually thereafter.
995995 F. The Agency shall establish a commercially viable, cost -
996996 effective, and parent -friendly system of payment for services from
997997 OK PEAK Accounts to education service providers by electro nic or
998998 online funds transfer.
999999 1. The system of pay ment established purs uant to this
10001000 subsection shall provide maximum flexibility for parents by
10011001 facilitating direct payments to education service providers whenever
10021002 possible, provide a parent -friendly system for requests for pre -
10031003 approval of qualified expense s, and timely reimbur sement for
10041004 qualified expenses.
10051005 2. The Agency may contract with private entities to develop the

10581058 G. The Agency shall implement a commercially viable, cost -
10591059 effective, and parent-friendly system for parents to publicly ra te,
10601060 review, and share information about education service providers.
10611061 H. If an education service provider requires partial payment of
10621062 tuition or fees to reserve a place for an OK PEAK student prior to
10631063 the start of the school year, the partial payment may b e paid by the
10641064 Agency prior to the start of the school year in which the OK PEAK
10651065 Account is opened and deducted in equal amounts from monthly
10661066 deposits into OK PEAK Accounts. If the parent of an OK PEAK student
10671067 chooses not to use the education service provi der, the partial
10681068 reservation payment shall be remitted to the Agency within fifteen
10691069 (15) business days of notification of the decision and credited to
10701070 the OK PEAK student’s OK PEAK Account.
10711071 I. The Agency shall have the authority to conduct an audit or
10721072 contract for the auditin g of OK PEAK Accounts and shall conduct
10731073 random audits of ten percent (10%) of OK PEAK Accounts on an annual
10741074 basis.
10751075 J. The Agency shall have the authority to remove any parent or
10761076 OK PEAK student from eligibility for an OK PEAK Account in the event
10771077 of intentional and substantial misuse of OK PEAK Account funds.
10781078 1. The Agency shall create procedures to ensure a fair process
10791079 to determine whether an intentional and substantial misuse of OK
10801080 PEAK Account funds has occurred. If misuse by a p arent is
10811081 established but the OK PEAK student is determined to be free from

11341134 Account in the future if placed with a different parent, guardian,
11351135 or other person with legal authority to act on beh alf of the

11371137 2. The Agency shall have the authority to refer suspected cases
11381138 of intentional and substantial misuse of OK PEAK Account funds to
11391139 the Attorney General for investigation if evidence of fraudulent use
11401140 of funds is obtained.
11411141 3. A parent or OK PEAK student may, pursuant to the
11421142 Administrative Procedures Act, appeal the Agency ’s decision to
11431143 remove the parent or student from eligibility for an OK PEAK
11441144 Account.
11451145 K. The Agency may cease payments to an education service
11461146 provider from OK PEAK Accounts if the Agency determines the
11471147 education service provider has:
11481148 1. Intentionally and substantially misrepresented information
11491149 or failed to refund any overpayments in a t imely manner; or
11501150 2. Routinely failed to provide OK PEAK students with promised
11511151 educational goods or services.
11521152 L. The Agency shall create procedures to ensure a fair process
11531153 to determine whether an education service provider should be
11541154 prohibited from rece iving payments from OK PEAK Accounts.
11551155 1. If the Agency prohibits an education servi ce provider from
11561156 receiving payments pursuant to this subsection, the Agency shall

12101210 2. Education service providers may, pursuant to the
12111211 Administrative Procedures Act, appeal the Agenc y’s decision to
12121212 prohibit them from receiving OK PEAK Account payments.
12131213 M. The Agency may accept gifts and grants from any source to
12141214 support administration of the OK PEAK Account Program, to inform the
12151215 public about the OK PEAK Account Program, and to fund additional OK
12161216 PEAK Accounts.
12171217 N. The Agency may promulgate rules to implement the provisions
12181218 of this act, which shall include but not be limited to:
12191219 1. Establishing or con tracting for the establishment of an
12201220 online anonymous fraud reporting service;
12211221 2. Establishing an anonymous telephone hotline for fraud
12221222 reporting;
12231223 3. Requiring a surety bond for education service providers
12241224 receiving more than One Hundred Thousand Dollars ($100,000.00) in OK
12251225 PEAK Account funds; and
12261226 4. Refunding payments from education s ervice providers back to
12271227 OK PEAK Accounts.

12821282 A. The Agency may approve education service providers on its
12831283 own initiative, at the request of parents, or at the request of a
12841284 prospective education service provider.
12851285 B. A prospective education service provider seeking to
12861286 participate in the OK PEAK Account Program shall:
12871287 1. Submit notice to the Agency that it wishes to participate
12881288 and receive OK PEAK Account funds designated by parents for payment
12891289 of educational goods and services; and
12901290 2. Agree not to refund, r ebate, or share OK PEAK Account funds
12911291 with parents or OK PEAK students in any manner, except that funds
12921292 may be remitted or refunded to an OK PEAK Account.
12931293 C. A public school district, public charter school, or magnet
12941294 school in which an OK PEAK student was enrolled shall provide a
12951295 private school that is an education service provider and that has an
12961296 OK PEAK student enrolled with a complete copy of the OK PEAK
12971297 student’s records within five (5) business days of receiving the
12981298 request for records. The provision of records pursuant to this
12991299 subsection shall be in accordance with the provisions of the Family
13001300 Educational Rights and Privacy Act of 1974 (FERPA).
13011301 D. Nothing in this act shall limit the independence or autonomy
13021302 of an education service provider or make t he actions of an education
13031303 service provider the act ions of state government. Education service
13041304 providers shall be given maximum freedom to provide fo r the
13051305 educational needs of OK PEAK students without governmental control.

13571357 1. An education service provide r that accepts payment from an
13581358 OK PEAK Account as directed by parents pursuant to this act shall
13591359 not be considered an agent of the state or federal go vernment.
13601360 2. An education service provider shall not be required to alter
13611361 its creed, practices, admission s policy, or curriculum to accept
13621362 payments as directed by parents from an OK PEAK Account.
13631363 E. Nothing in this act shall be construed to expand the
13641364 regulatory authority of the state, its officers, or any public
13651365 school to impose any additional regulation of education service
13661366 providers beyond those necessary to enforce the requirements of the
13671367 OK PEAK Account Program.
13681368 F. Upon a finding of noncompliance wi th the provisions of
13691369 subsections D and E of this section by the Attorney General, the
13701370 Agency shall receive a five percent (5%) reduction in state funding
13711371 for the fiscal year following the year of noncompliance.
13721372 G. A parent of an OK PEAK student shall have a cause of action
13731373 against the Agency for noncompliance with the provisions of
13741374 subsections D and E of this section.
13751375 SECTION 5. NEW LAW A new section of law to be codified
13761376 in the Oklahoma Statutes as Section 28 -104 of Title 70, unles s there

14341434 gifts, grants, donations, and bequests. All monies accruing to the
14351435 credit of the fund are hereby appropriated and may be budgeted and
14361436 expended by the Office of the State Treasurer for the purpose of
14371437 implementing the pro visions of the Oklahoma Parent Empowerment Act
14381438 for Kids. Expenditures from the fund shall be made upon warrants
14391439 issued by the State Treasurer against claims filed as prescribed by
14401440 law with the Director of the Office of Management and Enterprise
14411441 Services for approval and payment.
14421442 SECTION 6. NEW LAW A new section of law to be codified
14431443 in the Oklahoma Statutes as Section 28 -105 of Title 70, unless there
14441444 is created a duplication in numbering, reads as follows:
14451445 A. In any legal proceedin g challenging the application of the
14461446 Oklahoma Parent Empowerment Act for Kids to an education service
14471447 provider, the state bears the burden of establis hing both that its
14481448 action is necessary and that it does not impose any undue burden on
14491449 the education service provider.
14501450 B. No liability shall arise on the pa rt of the Agency, the
14511451 state, a public school district, a public charter school, or a
14521452 magnet school based on the award of or use of an OK PEAK Account
14531453 pursuant to this act.
14541454 C. If any part of the Oklahoma Parent Empowerment Act for Kids
14551455 is challenged in a s tate court as violating either the state or

15081508 students shall be permitted to intervene for the purposes of
15091509 defending the OK PEAK Account Program’s constitutionality. However,
15101510 for the purposes of judicial administration, a court may require
15111511 that all parents of eligible students and OK PEAK students file a
15121512 joint brief so long as they are not required to join any brief filed
15131513 on behalf of any named state defendant.
15141514 D. The provisions of the Oklahoma Parent Empowerment Act for
15151515 Kids shall be severable, and if any provision of the Oklahoma Parent
15161516 Empowerment Act for Kids or the application thereof to any person or
15171517 circumstances is held invalid, such inv alidity shall not affect the
15181518 other provisions or ap plications of this Act, which can be given
15191519 effect without the invalid provision or application.
15201520 SECTION 7. This act shall become effective July 1, 2023.
15211521 SECTION 8. It being immediately necessary for the preservation
15221522 of the public peace, health, or safety, an emergency is hereby
15231523 declared to exist, by reason whereof this act shall take effect and
15241524 be in full force from and after its passage and approval.
