81	81	BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Section 428 of Title 3A, unless there is
84	84	created a duplication in numbering, reads as follows:
85	85	This act shall be known and may be cited as the “Electronic
86	86	Pull-Tab Device Act”.
87	87	SECTION 2. AMENDATORY 3A O.S. 2021, Section 402, is
88	88	amended to read as follows:
89	89	Section 402. As used in the Oklahoma Charity Games Act, Section

142	142	1. “Bingo” means a game in which each player receives a bingo
143	143	face and covers the squares according to the numbers, letters, or
144	144	combination of numbers an d letters that have been announced by the
145	145	caller. The numbers and letters call ed are on an object selected at
146	146	random either manually or mechanically from a receptacle in which
147	147	have been placed the objects bearing the numbers, letters, or
148	148	combinations of numbers and letters corresponding to the system used
149	149	for designating the bingo f ace squares. The winner of each bingo
150	150	game is the player who first properly covers a predet ermined and
151	151	announced pattern of squares upon the bingo face being used by the
152	152	player;
153	153	2. “Bingo face” means a flat piece of paper which is marked off
154	154	into any number of squares in any arrangemen t of rows, with each
155	155	square being designated by number, lett er or combination of numbers
156	156	and letters and with one or more squares designated as a “free”
157	157	space with the word “Oklahoma” and a facsimile outline of a map of
158	158	Oklahoma in it, which cannot be reus ed after the game in which a
159	159	player has used it is over;
160	160	3. “Breakopen ticket card ” means a single folded or banded
161	161	ticket or a card, the face o f which is initially covered or
162	162	otherwise hidden from view to conceal a number, letter, symbol, or
163	163	set of letters or symbols, a few of which numbers, letters or
164	164	symbols out of every set of charity game tickets have been

218	218	4. “Breakopen ticket game” means a game wherein a p layer
219	219	receives a breakopen ticket card. A breakopen ticket game shall
220	220	meet the following criteria:
221	221	a. the game shall be assembled so that no pla cement of
222	222	winners or losers exists that allows the possibility
223	223	of prize manipulation,
224	224	b. the concealed numbers, letters, or symbols shall not
225	225	be visible from the outside o f the game using high
226	226	intensity lamps. Protection shall be provided by the
227	227	opaque paper stock employed, with the possible
228	228	addition of colors and printed blockout p atterns or by
229	229	use of an aluminum foil laminate,
230	230	c. a unique symbol or printed security devic e, such as a
231	231	specific number keyed to particular winners or the
232	232	name of the symbol or some of the symbol colors
233	233	changed for a window, or other similar protection
234	234	shall be placed in the winning win dows of prize
235	235	windows to ensure that the winner image is uni que,
236	236	d. it shall not be possible to detect or pick out winning
237	237	from losing tickets th rough variations in printing
238	238	graphics, color, or use of different printing plat es,

291	291	potential winning tickets from minor v ariations in
292	292	size or cutting of the tickets comprising a particular
293	293	packet, and
294	294	f. each ticket in a game shall have a serial number. All
295	295	tickets in a game shall ha ve the same serial number
296	296	appearing in a conspicuous place on the ticket;
297	297	5. “Business entity” means a person, company, corporation, or
298	298	partnership organized for profit;
299	299	6. “Charity game” means a bingo game, U -PIK-EM bingo game, or
300	300	breakopen ticket game conducted by an organization pur suant to the
301	301	provisions of the Oklahoma Charity Games Act;
302	302	7. “Charity game equipment ” means any object uniquely designed
303	303	for use in the conduct ing of a charity game including, but not
304	304	limited to, bingo faces, U -PIK-EM bingo game sets, and breakopen
305	305	ticket cards. Items used in conducting charity games which are n ot
306	306	charity game equipment are ink markers, furniture and general
307	307	furnishings of rooms where charity games are conducted;
308	308	8. “Commission” or “ABLE Commission” means the Alcoholic
309	309	Beverage Laws Enforcement Commission;
310	310	9. “Day session” means the set time fr ame within which
311	311	conducting of charity games is authorized beginning no earlier than
312	312	10:00 a.m. and ending no later than 5:00 p.m.;

364	364	10. “Deal” means one series of breakopen ticket game cards
365	365	which has a stated number of winner payouts and a stated amount of
366	366	the payouts;
367	367	11. “Distributor” means a person or business entity that sells,
368	368	markets, or otherwise provides charity game equipment to an
369	369	organization;
370	370	12. “Doing business” means either conducting a charity game by
371	371	an organization or providing goods or services to an organization by
372	372	a business entity;
373	373	13. “Employee” means a person who works for compensation in a
374	374	licensed charity game establishment;
375	375	14. “Electronic pull-tab device” means an electronic device
376	376	that displays an instant re sult from a pull-tab game by utilizing a
377	377	touchscreen monitor. The device accumulates winnings for the player
378	378	and prints out a voucher at the conclusion of play that can be
379	379	redeemed for cash or credited to use on another electronic pull-tab
380	380	device for continued play;
381	381	15. “Immediate family member ” means a spouse, parent, child or
382	382	sibling or spouse of a parent, child or sibling of a resident of a
383	383	facility exempt from specific provisio ns of the Oklahoma Ch arity
384	384	Games Act as provided in subsection C of Section 405 of this titl e;
385	385	15. 16. “Licensee” means any person, organization, or business
386	386	entity which has received a license from the Commission;

438	438	16. 17. “Location” means the building, including the individual
439	439	rooms and equipment in the rooms, grounds, and appurtenances,
440	440	including adjacent premises if subject to the direct or indirect
441	441	control of the organization while conducting a charity game, which
442	442	are used in connection with or in fur therance of the conducting of a
443	443	charity game;
444	444	17. 18. “Manager” means a person who:
445	445	a. is an employee of an organization,
446	446	b. has supervisory authority over other employees or over
447	447	the conduct of charity games, and
448	448	c. has been designated as such by the org anization
449	449	pursuant to the provisi ons of subsection D of Section
450	450	408 of this title;
451	451	18. 19. “Manufacturer” means a person or business entity that
452	452	assembles from raw materials, supplies, or subparts to form a
453	453	completed series of charity game equipment for u se in charity games
454	454	and that sells, markets, or otherwise provides such equipment to a
455	455	distributor;
456	456	19. 20. “Night session” means the set time frame within which
457	457	conducting of charity games is authorized beginning no earlier than
458	458	5:00 p.m. and ending no l ater than 12:00 p.m. midnight;
459	459	20. 21. “Organization” means a religious, charitable, labor,
460	460	fraternal, educational, or other type of association or any branch,
461	461	lodge, chapter, or auxiliary of such association which:

515	515	nonprofit organization for not less tha n two (2) years
516	516	prior to applying for an organization license,
517	517	c. is exempt from taxation pursuant to the provisions of
518	518	paragraphs (3), (4), (5), (6), (7), (8), (9) , (10), or
519	519	(19) of subsection (c) of Sect ion 501 or paragraph (1)
520	520	of subsection (a) of Secti on 509 of the United States
521	521	Internal Revenue Code of 1986, as amended, 26 U.S.C.,
522	522	Section 501(c) et seq. or Section 509(a)(1), and
523	523	d. formulates bylaws which clearl y identify and
524	524	establish:
525	525	(1) method of electing officers and their duties,
526	526	(2) method by which members are elected, initiated or
527	527	admitted,
528	528	(3) the rights and privileges of each member,
529	529	(4) that each member has one vote, and
530	530	(5) that membership rights are personal to the member
531	531	and not assignable;
532	532	21. 22. “Progressive game” means a game in which prizes are
533	533	allowed to be carried over and increased from session to session;
534	534	22. 23. “U-PIK-EM bingo game” means a game played wherein a
535	535	player writes the numbers on a U-PIK-EM bingo game set. The playe r
536	536	retains one sheet of the set and deposits the sec ond sheet in a

593	593	player who first covers all the numbers appearing on the retained
594	594	sheet in accordance with the pattern as designated on the sheet; and
595	595	23. 24. “U-PIK-EM bingo game set” means two paper sheets of
596	596	carbonless paper both bearing identical serial numbers on which a
597	597	player writes numbers or letters, wherein one sheet is retained by
598	598	the player and used for playing and one shee t is held by the
599	599	organization and used for verifyin g winners.
600	600	SECTION 3. NEW LAW A new section of law to be codified
601	601	in the Oklahoma Statutes as Section 428.1 of Title 3A, unless there
602	602	is created a duplication in numbering, reads as follows:
603	603	A. Each electronic pull-tab device shall bear a seal approved
604	604	by the ABLE Commission.
605	605	B. An electronic pull-tab device shall not be capable of being
606	606	used for the purposes of engaging in any game pro hibited by the
607	607	Commission.
608	608	C. In addition to a video monitor or touch screen, each
609	609	electronic pull-tab device may include, but not be limited to, a
610	610	bill acceptor, printer, and electromechanical buttons for activatin g

663	663	player to make select ions and choices in games.
664	664	D. For each electronic pull-tab device, there shall be located
665	665	anywhere within the distributed pull -tab system, nonvolatile memory
666	666	or its equivalent. The memory shall be maintained in a secure
667	667	location for the purpose of storin g and preserving a set of critical
668	668	data that has been error-checked in accordance with the critical
669	669	memory requirements of this regulation.
670	670	E. An electronic pull-tab device shall not have any switches,
671	671	jumpers, wire posts, or other means of manipulation t hat could
672	672	affect the operation or outcome of a game . The electronic pull-tab
673	673	device may not have any functions or parameters adjustable through
674	674	any separate video displ ay or input codes except for the adjustm ent
675	675	of features that are wholly cosmetic.
676	676	F. An electronic pull-tab device shall not have any of the
677	677	following attributes:
678	678	1. Spinning or mechanical reels ;
679	679	2. Pull handle;
680	680	3. Sounds or music solely intended to en tice a player to play ;
681	681	4. Flashing lights or tower light;
682	682	5. Top box, coin tray, tick et acceptance, hopper, coin
683	683	acceptor;
684	684	6. Enhanced animation, cabinet, or payglass artwork; or
685	685	7. Any other attribute identified by the Commission.

737	737	G. An electronic pull-tab device shall be robust enough to
738	738	withstand forced illegal entry that would leave behind physical
739	739	evidence of the attempted entry or such entry that causes an error
740	740	code that is displayed and transmitted to the distributed pull -tab
741	741	system. Any such entry attempt shall inhibit game play un til
742	742	cleared and shall not affect the subsequent play or any other play,
743	743	prize, or aspect of the ga me.
744	744	H. The number of electronic pull -tab devices, other than those
745	745	electronic pull-tab devices that are handheld, pre sent at any
746	746	premises at which charitable gaming is conducted shall be limited to
747	747	ten devices. The Commission shall determine whether an e lectronic
748	748	pull-tab device is handheld.
749	749	I. The ABLE Commission shall promulgate rules necessary to
750	750	implement and enforce the provisions of the Electronic Pull-Tab
751	751	Device Act.
752	752	SECTION 4. This act shall become effective November 1, 2023.
