8181 BE IT ENACTED BY THE PEO PLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 428 of Title 3A, unless there is
8484 created a duplication in numbering, reads as follows:
8585 This act shall be known and may be cited as the “Electronic
8686 Pull-Tab Device Act”.
8787 SECTION 2. AMENDATORY 3A O.S. 2021, Section 402, is

8989 Section 402. As used in the Oklahoma Charity Games Act, Section

142142 1. “Bingo” means a game in which each player receives a bingo
143143 face and covers the squares according to the numbers, letters, or
144144 combination of numbers an d letters that have been announced by the
145145 caller. The numbers and letters call ed are on an object selected at
146146 random either manually or mechanically from a receptacle in which
147147 have been placed the objects bearing the numbers, letters, or
148148 combinations of numbers and letters corresponding to the system used
149149 for designating the bingo f ace squares. The winner of each bingo
150150 game is the player who first properly covers a predet ermined and
151151 announced pattern of squares upon the bingo face being used by the
152152 player;
153153 2. “Bingo face” means a flat piece of paper which is marked off
154154 into any number of squares in any arrangemen t of rows, with each
155155 square being designated by number, lett er or combination of numbers
156156 and letters and with one or more squares designated as a “free”
157157 space with the word “Oklahoma” and a facsimile outline of a map of
158158 Oklahoma in it, which cannot be reus ed after the game in which a
159159 player has used it is over;
160160 3. “Breakopen ticket card ” means a single folded or banded
161161 ticket or a card, the face o f which is initially covered or
162162 otherwise hidden from view to conceal a number, letter, symbol, or
163163 set of letters or symbols, a few of which numbers, letters or
164164 symbols out of every set of charity game tickets have been

217217 in a breakopen ticket game;
218218 4. “Breakopen ticket game” means a game wherein a p layer
219219 receives a breakopen ticket card. A breakopen ticket game shall
220220 meet the following criteria:
221221 a. the game shall be assembled so that no pla cement of
222222 winners or losers exists that allows the possibility
223223 of prize manipulation,
224224 b. the concealed numbers, letters, or symbols shall not
225225 be visible from the outside o f the game using high
226226 intensity lamps. Protection shall be provided by the
227227 opaque paper stock employed, with the possible
228228 addition of colors and printed blockout p atterns or by
229229 use of an aluminum foil laminate,
230230 c. a unique symbol or printed security devic e, such as a
231231 specific number keyed to particular winners or the
232232 name of the symbol or some of the symbol colors
233233 changed for a window, or other similar protection
234234 shall be placed in the winning win dows of prize
235235 windows to ensure that the winner image is uni que,
236236 d. it shall not be possible to detect or pick out winning
237237 from losing tickets th rough variations in printing
238238 graphics, color, or use of different printing plat es,

290290 e. it shall not be possible to isolate winning or
291291 potential winning tickets from minor v ariations in
292292 size or cutting of the tickets comprising a particular
293293 packet, and
294294 f. each ticket in a game shall have a serial number. All
295295 tickets in a game shall ha ve the same serial number
296296 appearing in a conspicuous place on the ticket;
297297 5. “Business entity” means a person, company, corporation, or
298298 partnership organized for profit;
299299 6. “Charity game” means a bingo game, U -PIK-EM bingo game, or
300300 breakopen ticket game conducted by an organization pur suant to the
301301 provisions of the Oklahoma Charity Games Act;
302302 7. “Charity game equipment ” means any object uniquely designed
303303 for use in the conduct ing of a charity game including, but not
304304 limited to, bingo faces, U -PIK-EM bingo game sets, and breakopen
305305 ticket cards. Items used in conducting charity games which are n ot
306306 charity game equipment are ink markers, furniture and general
307307 furnishings of rooms where charity games are conducted;
308308 8. “Commission” or “ABLE Commission” means the Alcoholic
309309 Beverage Laws Enforcement Commission;
310310 9. “Day session” means the set time fr ame within which
311311 conducting of charity games is authorized beginning no earlier than
312312 10:00 a.m. and ending no later than 5:00 p.m.;

364364 10. “Deal” means one series of breakopen ticket game cards
365365 which has a stated number of winner payouts and a stated amount of
366366 the payouts;
367367 11. “Distributor” means a person or business entity that sells,
368368 markets, or otherwise provides charity game equipment to an
369369 organization;
370370 12. “Doing business” means either conducting a charity game by
371371 an organization or providing goods or services to an organization by
372372 a business entity;
373373 13. “Employee” means a person who works for compensation in a
374374 licensed charity game establishment;
375375 14. “Electronic pull-tab device” means an electronic device
376376 that displays an instant re sult from a pull-tab game by utilizing a
377377 touchscreen monitor. The device accumulates winnings for the player
378378 and prints out a voucher at the conclusion of play that can be
379379 redeemed for cash or credited to use on another electronic pull-tab
380380 device for continued play;
381381 15. “Immediate family member ” means a spouse, parent, child or
382382 sibling or spouse of a parent, child or sibling of a resident of a
383383 facility exempt from specific provisio ns of the Oklahoma Ch arity
384384 Games Act as provided in subsection C of Section 405 of this titl e;
385385 15. 16. “Licensee” means any person, organization, or business
386386 entity which has received a license from the Commission;

438438 16. 17. “Location” means the building, including the individual
439439 rooms and equipment in the rooms, grounds, and appurtenances,
440440 including adjacent premises if subject to the direct or indirect
441441 control of the organization while conducting a charity game, which
442442 are used in connection with or in fur therance of the conducting of a
443443 charity game;
444444 17. 18. “Manager” means a person who:
445445 a. is an employee of an organization,
446446 b. has supervisory authority over other employees or over
447447 the conduct of charity games, and
448448 c. has been designated as such by the org anization
449449 pursuant to the provisi ons of subsection D of Section
450450 408 of this title;
451451 18. 19. “Manufacturer” means a person or business entity that
452452 assembles from raw materials, supplies, or subparts to form a
453453 completed series of charity game equipment for u se in charity games
454454 and that sells, markets, or otherwise provides such equipment to a
455455 distributor;
456456 19. 20. “Night session” means the set time frame within which
457457 conducting of charity games is authorized beginning no earlier than
458458 5:00 p.m. and ending no l ater than 12:00 p.m. midnight;
459459 20. 21. “Organization” means a religious, charitable, labor,
460460 fraternal, educational, or other type of association or any branch,
461461 lodge, chapter, or auxiliary of such association which:

513513 a. operates without profit to its membe rs,
514514 b. has been in existence and been ope rating as a
515515 nonprofit organization for not less tha n two (2) years
516516 prior to applying for an organization license,
517517 c. is exempt from taxation pursuant to the provisions of
518518 paragraphs (3), (4), (5), (6), (7), (8), (9) , (10), or
519519 (19) of subsection (c) of Sect ion 501 or paragraph (1)
520520 of subsection (a) of Secti on 509 of the United States
521521 Internal Revenue Code of 1986, as amended, 26 U.S.C.,
522522 Section 501(c) et seq. or Section 509(a)(1), and
523523 d. formulates bylaws which clearl y identify and
524524 establish:
525525 (1) method of electing officers and their duties,
526526 (2) method by which members are elected, initiated or
527527 admitted,
528528 (3) the rights and privileges of each member,
529529 (4) that each member has one vote, and
530530 (5) that membership rights are personal to the member
531531 and not assignable;
532532 21. 22. “Progressive game” means a game in which prizes are
533533 allowed to be carried over and increased from session to session;
534534 22. 23. “U-PIK-EM bingo game” means a game played wherein a
535535 player writes the numbers on a U-PIK-EM bingo game set. The playe r
536536 retains one sheet of the set and deposits the sec ond sheet in a

590590 called are on an object selected at random either manually o r
591591 mechanically from a receptacle in which have been placed the objects
592592 bearing the numbers. The winner of each U -PIK-EM bingo game is the
593593 player who first covers all the numbers appearing on the retained
594594 sheet in accordance with the pattern as designated on the sheet; and
595595 23. 24. “U-PIK-EM bingo game set” means two paper sheets of
596596 carbonless paper both bearing identical serial numbers on which a
597597 player writes numbers or letters, wherein one sheet is retained by
598598 the player and used for playing and one shee t is held by the
599599 organization and used for verifyin g winners.
600600 SECTION 3. NEW LAW A new section of law to be codified
601601 in the Oklahoma Statutes as Section 428.1 of Title 3A, unless there
602602 is created a duplication in numbering, reads as follows:
603603 A. Each electronic pull-tab device shall bear a seal approved
604604 by the ABLE Commission.
605605 B. An electronic pull-tab device shall not be capable of being
606606 used for the purposes of engaging in any game pro hibited by the
607607 Commission.
608608 C. In addition to a video monitor or touch screen, each
609609 electronic pull-tab device may include, but not be limited to, a
610610 bill acceptor, printer, and electromechanical buttons for activatin g

662662 the game and providing player input, i ncluding a means for the
663663 player to make select ions and choices in games.
664664 D. For each electronic pull-tab device, there shall be located
665665 anywhere within the distributed pull -tab system, nonvolatile memory
666666 or its equivalent. The memory shall be maintained in a secure
667667 location for the purpose of storin g and preserving a set of critical
668668 data that has been error-checked in accordance with the critical
669669 memory requirements of this regulation.
670670 E. An electronic pull-tab device shall not have any switches,
671671 jumpers, wire posts, or other means of manipulation t hat could
672672 affect the operation or outcome of a game . The electronic pull-tab
673673 device may not have any functions or parameters adjustable through
674674 any separate video displ ay or input codes except for the adjustm ent
675675 of features that are wholly cosmetic.
676676 F. An electronic pull-tab device shall not have any of the
677677 following attributes:
678678 1. Spinning or mechanical reels ;
679679 2. Pull handle;
680680 3. Sounds or music solely intended to en tice a player to play ;
681681 4. Flashing lights or tower light;
682682 5. Top box, coin tray, tick et acceptance, hopper, coin
683683 acceptor;
684684 6. Enhanced animation, cabinet, or payglass artwork; or
685685 7. Any other attribute identified by the Commission.

737737 G. An electronic pull-tab device shall be robust enough to
738738 withstand forced illegal entry that would leave behind physical
739739 evidence of the attempted entry or such entry that causes an error
740740 code that is displayed and transmitted to the distributed pull -tab
741741 system. Any such entry attempt shall inhibit game play un til
742742 cleared and shall not affect the subsequent play or any other play,
743743 prize, or aspect of the ga me.
744744 H. The number of electronic pull -tab devices, other than those
745745 electronic pull-tab devices that are handheld, pre sent at any
746746 premises at which charitable gaming is conducted shall be limited to
747747 ten devices. The Commission shall determine whether an e lectronic
748748 pull-tab device is handheld.
749749 I. The ABLE Commission shall promulgate rules necessary to
750750 implement and enforce the provisions of the Electronic Pull-Tab
751751 Device Act.
752752 SECTION 4. This act shall become effective November 1, 2023.
