7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
7878 SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
7979 last amended by Section 2, Chapter 208, O.S.L. 2022 (29 O.S. Supp.
8080 2022, Section 4-112), is amended to read as follows:
8181 Section 4-112. A. Except as otherwise provided f or in the
8282 Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
8383 Act, no person may hunt, pursue, trap, harass , catch, kill, take o r
8484 attempt to take in any manner, use, have in possession, sell, or
8585 transport all or any portion of any wildlife except fish, without
8686 having first procure d a license from the Department of Wildlife
8787 Conservation. The Oklahoma Wildlife Conservation Commissio n shall
8888 designate a consecutive Saturday and Sunday in September of each

140140 year as free hunting days in which resid ents of this state may hunt
141141 without first procuring a hunting license pursuant to the provisions
142142 of this section.
143143 B. The following legal residents of Oklahoma shall be exempt
144144 from the annual hunting license requirement of paragraph 1 of
145145 subsection E of this section and the following nonresiden ts shall be
146146 exempt from the annual nonresid ent hunting licenses required
147147 pursuant to paragraph 1 of subsection C of this section:
148148 1. Legal residents under sixteen (16) years of age;
149149 2. Legal residents sixty -five (65) years of age or older
150150 provided they have obtained a senio r citizen lifetime hunt ing or
151151 combination hunting and fishing l icense pursuant to th e provisions
152152 of Section 4-114 of this title;
153153 3. Legal residents born on or before January 1, 1923;
154154 4. Legal resident veterans having a disability of sixty percent
155155 (60%) or more and registered w ith the veterans registry created by
156156 the Oklahoma Department of Veterans Affairs; provided, that if the
157157 veteran has previously received an exemption pursuant to this
158158 paragraph, no registration with the veteran s registry shall be
159159 required;
160160 5. Legal resident owners or tenants who hunt on land own ed or
161161 leased by them;
162162 6. Any nonresident under fourteen (14) years of age;

214214 7. Legal residents having a proven disability which rende rs
215215 them nonambulatory and confines them to a wheelchair, as certified
216216 by a physician licensed in this state or in any stat e which borders
217217 this state;
218218 8. Any legal resident or nonresident under eighteen (18) years
219219 of age who is in the physical custody of a child care facility as
220220 defined by Section 402 of Title 10 of the Oklahoma Statute s; and
221221 9. Any legal resident or nonresi dent hunting, pursuin g,
222222 trapping, harassing, catching, killing, taking, or attempting to
223223 take in any manner any species of rattlesnake during an organized
224224 rattlesnake-hunting event or festival and who has a rattlesna ke
225225 permit issued pursuant to Section 4 -143 of this title.
226226 C. Except as otherwise provided for in the Oklahoma Wildlife
227227 Conservation Code, the nonresident hunting licenses is sued pursuant
228228 to this section and the fee for each license shall be:
229229 1. Annual hunting license for nonresidents huntin g game other
230230 than deer, antelope, elk or bear which expire s one (1) year after
231231 the date of issuance – One Hundred Seventy-five Dollars ($175.00).
232232 Nonresidents hunting big game or combi nation big game and upland
233233 game in a commercial hunting area shall be r equired to have this
234234 license;
235235 2. Gun hunting license for deer for nonresidents which shall be
236236 valid for hunting all deer allowed during the current calendar year
237237 deer gun season – Two Hundred Seventy-nine Dollars ($279.00);

290290 shall expire on January 15 of the calendar year after the year
291291 purchased or if purchased during the deer archery season it shall
292292 expire at the end of that d eer archery season – Two Hundred Seventy-
293293 nine Dollars ($279.00);
294294 4. Primitive firearms hunting lic ense for deer for nonresidents
295295 which shall be valid for hunting all deer allowed during the current
296296 calendar year deer primitive firearms season – Two Hundred Seventy-
297297 nine Dollars ($279.00);
298298 5. Hunting license for antelope for nonresidents – Three
299299 Hundred Five Dollars ($305.00);
300300 6. Hunting license for elk for nonresidents – Three Hundred
301301 Five Dollars ($305.00);
302302 7. Five-day hunting license for nonresidents h unting game other
303303 than deer, antelope, elk, quail, turkey, or bear – Seventy-four
304304 Dollars ($74.00). Nonresidents hunting big game or combination big
305305 game and upland game in a commercial hunting area shall be re quired
306306 to have this license; and
307307 8. Ten-day hunting license for non residents hunting small game
308308 and upland game in a commercial hunting area – Five Dollars ($5.00).
309309 D. Of the fees collected pursuant to the provisions of
310310 subsection C of this section:
311311 1. Five Dollars ($5.00) of the license fee of each license
312312 issued pursuant to paragraph s 1 through 7 of subsection C of this

364364 section and Two Dollars and fifty cents ($2.50) of the license fee
365365 for each license issued pursuant to paragraph 8 of subsection C of
366366 this section shall be deposited in the Wildlife Land Acquisition
367367 Fund created pursuant to the provisions of Section 4 -132 of this
368368 title; and
369369 2. Five Dollars ($5.00) of the license fee for ea ch license
370370 issued pursuant to paragraphs 1 through 8 of subsection C of this
371371 section shall be for the Oklahoma Wildlife Land Stamp and shall be
372372 deposited in the Oklahoma Wildlife Land Fund created pursuant to the
373373 provisions of Section 4-141 of this title.
374374 E. Except as otherwise provided, the annual resident hunting
375375 licenses issued pursuant to this subsection shall expire one (1)
376376 year after the date of issuance. The resident hunting licenses
377377 issued pursuant to t his section and the fee for each license shal l
378378 be:
379379 1. Annual hunting license for residents eighteen (18) years of
380380 age and older – Thirty-one Dollars ($31.00);
381381 2. Annual hunting license for residents sixteen (16) or
382382 seventeen (17) years of age – Six Dollars ($6.00);
383383 3. Ten-day hunting license for residents for small game in a
384384 commercial hunting area - Five Dollars ($5.00);
385385 4. Five-year disability hunting license for residents for at
386386 least six (6) months who a re receiving Social Security Disability
387387 benefits, Supplemental Security Income benefits or disability

439439 benefits under the Railroad Retirement Act, 45 U.S.C.A ., Section
440440 231a, or residents who are one-hundred-percent disabled and are
441441 receiving disability paym ents from the Multiple Injury Trust Fund
442442 pursuant to Section 31 of Title 85A of the Oklahom a Statutes - Ten
443443 Dollars ($10.00);
444444 5. Gun hunting license for de er for residents eighteen (18)
445445 years of age or older - Nineteen Dollars ($19.00). The following
446446 persons shall be exempt:
447447 a. residents with proper certification from the United
448448 States Department of Veterans Affairs or its
449449 successor, certifying that the per son is a disabled
450450 veteran in receipt of compensation at the on e-hundred-
451451 percent rate and register ed with the veterans registry
452452 created by the Oklahoma Department of Veterans
453453 Affairs; provided, that if the veteran has previously
454454 received an exemption pursua nt to this subparagraph,
455455 no registration with the veterans reg istry shall be
456456 required, and
457457 b. residents hunting in big game or combin ation big game
458458 and upland game commercial hunting areas;
459459 6. Gun hunting license for deer for residents under eighteen
460460 (18) years of age – Nine Dollars ($9.00);

531531 The following persons shall be exempt:

598598 ($50.00). Residents hunting in big game or combination b ig game and
599599 upland game commercial hunting a reas shall be exempt from this
600600 license;
601601 12. Hunting license for antelope for residents – Fifty Dollars
602602 ($50.00). Residents hunting in big game or combination big game and
603603 upland game commercial hunting area s shall be exempt from this
604604 license; and
605605 13. Bonus, special or additional gun hunting license for deer
606606 for residents - Nineteen Dollars ($19.00). The following persons
607607 shall be exempt:
608608 a. residents with proper certification from the United
609609 States Department of Veterans Affairs or i ts
610610 successor, certifying that the person is a disabled

671671 F. Of the fees collected pursuant to the provisions of
672672 paragraph 1 of subsection E of this section, Five Dollars ($5.00 ) of
673673 the license fee shall be for the Oklahoma Wildlife Land Stamp and
674674 shall be deposited in the Oklahoma Wildlife Land Fund created
675675 pursuant to the provisions of Section 4-141 of this title.
676676 G. The provisions of this section shall not be construed to
677677 require a hunting license, resident or nonresident, of any person
678678 merely because the person participates, as owner or handler of an
679679 entry, as an official, or as a spectator in the conduct of a field
680680 trial or performance test of dogs, whether a resident or non resident
681681 of this state. No license to hunt shall be required of any person
682682 engaged in training or working dogs, provided that person is in no
683683 way engaged in hunting and does not take or attempt to take in any
684684 manner any game.

736736 H. 1. Any person arrested f or hunting game other than deer,
737737 antelope, elk, bear or turkey wi thout a valid hunting licens e as
738738 required by the provisions of subsectio n A of this section may
739739 purchase a substitute temporary thirty-day license from the
740740 arresting game warden in lieu of po sting bond. Proof of hunter
741741 safety certification will not be req uired for the temporary
742742 substitute license. The fee for a substitute li cense purchased
743743 pursuant to the provisions of this subsection shall be:
744744 a. for legal residents, Fifty Dollars ($50.00), and
745745 b. for nonresidents, One Hundred Forty-five Dollars
746746 ($145.00).
747747 2. Except as otherwise p rovided for by this subsection, the
748748 fees from licenses purchased pursuant to the provisions of this
749749 subsection shall be deposited in the Wildlife Conservation Fund to
750750 be used exclusively for developing, managing, preserving, and
751751 protecting wildlife and wil dlife habitat.
752752 I. Any person producing proo f in court that a current hunting
753753 license issued by the Department of Wildlife Conservation to that
754754 person was in force at the time of the alleged offense shall be
755755 entitled to dismissa l of a charge of violating t his section upon
756756 payment of court costs. If proof of a current hunting license
757757 issued by the Department to the person that was in force at the time
758758 of the alleged offense is presented to the court or district

810810 attorney within seventy-two (72) hours after t he violation, the
811811 charge shall be dismissed without payment of court costs.
812812 J. Unless a substitute license is purchased as provided for by
813813 subsection H of this section, any resident convicted of violating
814814 the provisions of this section shall be punished b y the imposition
815815 of a fine of not less than Twenty-five Dollars ($25.00) nor more
816816 than Two Hundred Dollars ($200.00), or by imprisonment in the county
817817 jail for a period not to exceed thirty (30) days, or by both.
818818 K. Unless a substitute license is purchase d as provided for by
819819 subsection H of this section, any nonresident convicted of violating
820820 the provisions of this section shall be punished by the imposition
821821 of a fine of not less than Two Hundred Dollars ($200.00) nor more
822822 than Five Hundred Dollars ($500.0 0), or by imprisonment in the
823823 county jail for a period not to exceed six (6) months, or by both.
824824 L. The Oklahoma Wildlife Conservation Commission shall
825825 promulgate any rules necessary to implement the provisions of this
826826 section.
827827 SECTION 2. This act shall become effective November 1, 2023.
