77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
78	78	SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
79	79	last amended by Section 2, Chapter 208, O.S.L. 2022 (29 O.S. Supp.
80	80	2022, Section 4-112), is amended to read as follows:
81	81	Section 4-112. A. Except as otherwise provided f or in the
82	82	Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
83	83	Act, no person may hunt, pursue, trap, harass , catch, kill, take o r
84	84	attempt to take in any manner, use, have in possession, sell, or
85	85	transport all or any portion of any wildlife except fish, without
86	86	having first procure d a license from the Department of Wildlife
87	87	Conservation. The Oklahoma Wildlife Conservation Commissio n shall
88	88	designate a consecutive Saturday and Sunday in September of each

141	141	without first procuring a hunting license pursuant to the provisions
142	142	of this section.
143	143	B. The following legal residents of Oklahoma shall be exempt
144	144	from the annual hunting license requirement of paragraph 1 of
145	145	subsection E of this section and the following nonresiden ts shall be
146	146	exempt from the annual nonresid ent hunting licenses required
147	147	pursuant to paragraph 1 of subsection C of this section:
148	148	1. Legal residents under sixteen (16) years of age;
149	149	2. Legal residents sixty -five (65) years of age or older
150	150	provided they have obtained a senio r citizen lifetime hunt ing or
151	151	combination hunting and fishing l icense pursuant to th e provisions
152	152	of Section 4-114 of this title;
153	153	3. Legal residents born on or before January 1, 1923;
154	154	4. Legal resident veterans having a disability of sixty percent
155	155	(60%) or more and registered w ith the veterans registry created by
156	156	the Oklahoma Department of Veterans Affairs; provided, that if the
157	157	veteran has previously received an exemption pursuant to this
158	158	paragraph, no registration with the veteran s registry shall be
159	159	required;
160	160	5. Legal resident owners or tenants who hunt on land own ed or
161	161	leased by them;
162	162	6. Any nonresident under fourteen (14) years of age;

214	214	7. Legal residents having a proven disability which rende rs
215	215	them nonambulatory and confines them to a wheelchair, as certified
216	216	by a physician licensed in this state or in any stat e which borders
217	217	this state;
218	218	8. Any legal resident or nonresident under eighteen (18) years
219	219	of age who is in the physical custody of a child care facility as
220	220	defined by Section 402 of Title 10 of the Oklahoma Statute s; and
221	221	9. Any legal resident or nonresi dent hunting, pursuin g,
222	222	trapping, harassing, catching, killing, taking, or attempting to
223	223	take in any manner any species of rattlesnake during an organized
224	224	rattlesnake-hunting event or festival and who has a rattlesna ke
225	225	permit issued pursuant to Section 4 -143 of this title.
226	226	C. Except as otherwise provided for in the Oklahoma Wildlife
227	227	Conservation Code, the nonresident hunting licenses is sued pursuant
228	228	to this section and the fee for each license shall be:
229	229	1. Annual hunting license for nonresidents huntin g game other
230	230	than deer, antelope, elk or bear which expire s one (1) year after
231	231	the date of issuance – One Hundred Seventy-five Dollars ($175.00).
232	232	Nonresidents hunting big game or combi nation big game and upland
233	233	game in a commercial hunting area shall be r equired to have this
234	234	license;
235	235	2. Gun hunting license for deer for nonresidents which shall be
236	236	valid for hunting all deer allowed during the current calendar year
237	237	deer gun season – Two Hundred Seventy-nine Dollars ($279.00);

301	301	Five Dollars ($305.00);
302	302	7. Five-day hunting license for nonresidents h unting game other
303	303	than deer, antelope, elk, quail, turkey, or bear – Seventy-four
304	304	Dollars ($74.00). Nonresidents hunting big game or combination big
305	305	game and upland game in a commercial hunting area shall be re quired
306	306	to have this license; and
307	307	8. Ten-day hunting license for non residents hunting small game
308	308	and upland game in a commercial hunting area – Five Dollars ($5.00).
309	309	D. Of the fees collected pursuant to the provisions of
310	310	subsection C of this section:
311	311	1. Five Dollars ($5.00) of the license fee of each license
312	312	issued pursuant to paragraph s 1 through 7 of subsection C of this

365	365	for each license issued pursuant to paragraph 8 of subsection C of
366	366	this section shall be deposited in the Wildlife Land Acquisition
367	367	Fund created pursuant to the provisions of Section 4 -132 of this
368	368	title; and
369	369	2. Five Dollars ($5.00) of the license fee for ea ch license
370	370	issued pursuant to paragraphs 1 through 8 of subsection C of this
371	371	section shall be for the Oklahoma Wildlife Land Stamp and shall be
372	372	deposited in the Oklahoma Wildlife Land Fund created pursuant to the
373	373	provisions of Section 4-141 of this title.
374	374	E. Except as otherwise provided, the annual resident hunting
375	375	licenses issued pursuant to this subsection shall expire one (1)
376	376	year after the date of issuance. The resident hunting licenses
377	377	issued pursuant to t his section and the fee for each license shal l
378	378	be:
379	379	1. Annual hunting license for residents eighteen (18) years of
380	380	age and older – Thirty-one Dollars ($31.00);
381	381	2. Annual hunting license for residents sixteen (16) or
382	382	seventeen (17) years of age – Six Dollars ($6.00);
383	383	3. Ten-day hunting license for residents for small game in a
384	384	commercial hunting area - Five Dollars ($5.00);
385	385	4. Five-year disability hunting license for residents for at
386	386	least six (6) months who a re receiving Social Security Disability
387	387	benefits, Supplemental Security Income benefits or disability

440	440	231a, or residents who are one-hundred-percent disabled and are
441	441	receiving disability paym ents from the Multiple Injury Trust Fund
442	442	pursuant to Section 31 of Title 85A of the Oklahom a Statutes - Ten
443	443	Dollars ($10.00);
444	444	5. Gun hunting license for de er for residents eighteen (18)
445	445	years of age or older - Nineteen Dollars ($19.00). The following
446	446	persons shall be exempt:
447	447	a. residents with proper certification from the United
448	448	States Department of Veterans Affairs or its
449	449	successor, certifying that the per son is a disabled
450	450	veteran in receipt of compensation at the on e-hundred-
451	451	percent rate and register ed with the veterans registry
452	452	created by the Oklahoma Department of Veterans
453	453	Affairs; provided, that if the veteran has previously
454	454	received an exemption pursua nt to this subparagraph,
455	455	no registration with the veterans reg istry shall be
456	456	required, and
457	457	b. residents hunting in big game or combin ation big game
458	458	and upland game commercial hunting areas;
459	459	6. Gun hunting license for deer for residents under eighteen
460	460	(18) years of age – Nine Dollars ($9.00);

605	605	13. Bonus, special or additional gun hunting license for deer
606	606	for residents - Nineteen Dollars ($19.00). The following persons
607	607	shall be exempt:
608	608	a. residents with proper certification from the United
609	609	States Department of Veterans Affairs or i ts
610	610	successor, certifying that the person is a disabled

673	673	the license fee shall be for the Oklahoma Wildlife Land Stamp and
674	674	shall be deposited in the Oklahoma Wildlife Land Fund created
675	675	pursuant to the provisions of Section 4-141 of this title.
676	676	G. The provisions of this section shall not be construed to
677	677	require a hunting license, resident or nonresident, of any person
678	678	merely because the person participates, as owner or handler of an
679	679	entry, as an official, or as a spectator in the conduct of a field
680	680	trial or performance test of dogs, whether a resident or non resident
681	681	of this state. No license to hunt shall be required of any person
682	682	engaged in training or working dogs, provided that person is in no
683	683	way engaged in hunting and does not take or attempt to take in any
684	684	manner any game.

736	736	H. 1. Any person arrested f or hunting game other than deer,
737	737	antelope, elk, bear or turkey wi thout a valid hunting licens e as
738	738	required by the provisions of subsectio n A of this section may
739	739	purchase a substitute temporary thirty-day license from the
740	740	arresting game warden in lieu of po sting bond. Proof of hunter
741	741	safety certification will not be req uired for the temporary
742	742	substitute license. The fee for a substitute li cense purchased
743	743	pursuant to the provisions of this subsection shall be:
744	744	a. for legal residents, Fifty Dollars ($50.00), and
745	745	b. for nonresidents, One Hundred Forty-five Dollars
746	746	($145.00).
747	747	2. Except as otherwise p rovided for by this subsection, the
748	748	fees from licenses purchased pursuant to the provisions of this
749	749	subsection shall be deposited in the Wildlife Conservation Fund to
750	750	be used exclusively for developing, managing, preserving, and
751	751	protecting wildlife and wil dlife habitat.
752	752	I. Any person producing proo f in court that a current hunting
753	753	license issued by the Department of Wildlife Conservation to that
754	754	person was in force at the time of the alleged offense shall be
755	755	entitled to dismissa l of a charge of violating t his section upon
756	756	payment of court costs. If proof of a current hunting license
757	757	issued by the Department to the person that was in force at the time
758	758	of the alleged offense is presented to the court or district

811	811	charge shall be dismissed without payment of court costs.
812	812	J. Unless a substitute license is purchased as provided for by
813	813	subsection H of this section, any resident convicted of violating
814	814	the provisions of this section shall be punished b y the imposition
815	815	of a fine of not less than Twenty-five Dollars ($25.00) nor more
816	816	than Two Hundred Dollars ($200.00), or by imprisonment in the county
817	817	jail for a period not to exceed thirty (30) days, or by both.
818	818	K. Unless a substitute license is purchase d as provided for by
819	819	subsection H of this section, any nonresident convicted of violating
820	820	the provisions of this section shall be punished by the imposition
821	821	of a fine of not less than Two Hundred Dollars ($200.00) nor more
822	822	than Five Hundred Dollars ($500.0 0), or by imprisonment in the
823	823	county jail for a period not to exceed six (6) months, or by both.
824	824	L. The Oklahoma Wildlife Conservation Commission shall
825	825	promulgate any rules necessary to implement the provisions of this
826	826	section.
827	827	SECTION 2. This act shall become effective November 1, 2023.
