85	85	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86	SECTION 1. NEW LAW A new section of law to be codified
87	87	in the Oklahoma Statutes as Section 5-107C of Title 70, unless there
88	88	is created a duplication in numb ering, reads as follows:
89	89	A. A member of a school district board of education may be
90	90	removed from office by means of a recall petition demanding the
91	91	removal of a board member and the elec tion of a successor to t he
92	92	member. The recall petition shall be signed by not l ess than

144	144	thirty-three percent (33%) of the qualified electors of the board
145	145	district based on the total number of votes cast at the l ast board
146	146	district election. The recall petiti on shall be filed wi th the
147	147	school district board of education. The petition sh all contain a
148	148	specific statement of th e grounds on which removal is sought. The
149	149	form for the recall petition shall be prescribed by the State
150	150	Election Board. No signature on a petition shall be de emed valid if
151	151	signed more than six (6) months prior to the filing of the petition.
152	152	B. Upon presentation of a recall petition as provided for in
153	153	subsection A of this section, a school district board of education
154	154	shall, within ten (10) days, order and fix a date for holding the
155	155	election. The board of education sh all notify, by resolution, the
156	156	secretary of the county election board as provided for in S ection
157	157	13A-109 of Title 26 of the Oklahoma Statutes. An election shall not
158	158	be held prior to one hundred eighty (180) days after the board of
159	159	education member has tak en office or within one hundred eighty (180)
160	160	days before the next board district election.
161	161	C. Any member of a school district board of education sought to
162	162	be removed pursuant to the provisions of this section may be a
163	163	candidate to succeed himself or herself. Candidates wishing to
164	164	succeed the member shall file declarations of candidacy in the same
165	165	place and manner as a general election for a member as provided for
166	166	in Section 13A-105 of Title 26 of the Oklahoma Statutes . If after

218	218	the filing period is close d no candidate has filed, the incumbent
219	219	member shall continue to serve on the board of edu cation.
220	220	D. 1. If the incumbent member is elected, the member shall
221	221	continue to serve on the board of education.
222	222	2. If an individual other than the incumbent member is elected,
223	223	the incumbent shall be deemed removed from office upon or at the
224	224	time the winner of the election is declared. The successor shall
225	225	assume the office within ten (1 0) days after receiving notification
226	226	of the election results. He or she shall ho ld office for the
227	227	unexpired term of the predecessor.
228	228	SECTION 2. This act shall become effective July 1, 2023.
229	229	SECTION 3. It being immediately necessary for the preservation
230	230	of the public peace, health , or safety, an emergency is hereby
231	231	declared to exist, by re ason whereof this act shall take effect and
232	232	be in full force from and after its passage and approval.
