8585 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8686 SECTION 1. NEW LAW A new section of law to be codified
8787 in the Oklahoma Statutes as Section 5-107C of Title 70, unless there
8888 is created a duplication in numb ering, reads as follows:
8989 A. A member of a school district board of education may be
9090 removed from office by means of a recall petition demanding the
9191 removal of a board member and the elec tion of a successor to t he
9292 member. The recall petition shall be signed by not l ess than

144144 thirty-three percent (33%) of the qualified electors of the board
145145 district based on the total number of votes cast at the l ast board
146146 district election. The recall petiti on shall be filed wi th the
147147 school district board of education. The petition sh all contain a
148148 specific statement of th e grounds on which removal is sought. The
149149 form for the recall petition shall be prescribed by the State
150150 Election Board. No signature on a petition shall be de emed valid if
151151 signed more than six (6) months prior to the filing of the petition.
152152 B. Upon presentation of a recall petition as provided for in
153153 subsection A of this section, a school district board of education
154154 shall, within ten (10) days, order and fix a date for holding the
155155 election. The board of education sh all notify, by resolution, the
156156 secretary of the county election board as provided for in S ection
157157 13A-109 of Title 26 of the Oklahoma Statutes. An election shall not
158158 be held prior to one hundred eighty (180) days after the board of
159159 education member has tak en office or within one hundred eighty (180)
160160 days before the next board district election.
161161 C. Any member of a school district board of education sought to
162162 be removed pursuant to the provisions of this section may be a
163163 candidate to succeed himself or herself. Candidates wishing to
164164 succeed the member shall file declarations of candidacy in the same
165165 place and manner as a general election for a member as provided for
166166 in Section 13A-105 of Title 26 of the Oklahoma Statutes . If after

218218 the filing period is close d no candidate has filed, the incumbent
219219 member shall continue to serve on the board of edu cation.
220220 D. 1. If the incumbent member is elected, the member shall
221221 continue to serve on the board of education.
222222 2. If an individual other than the incumbent member is elected,
223223 the incumbent shall be deemed removed from office upon or at the
224224 time the winner of the election is declared. The successor shall
225225 assume the office within ten (1 0) days after receiving notification
226226 of the election results. He or she shall ho ld office for the
227227 unexpired term of the predecessor.
228228 SECTION 2. This act shall become effective July 1, 2023.
229229 SECTION 3. It being immediately necessary for the preservation
230230 of the public peace, health , or safety, an emergency is hereby
231231 declared to exist, by re ason whereof this act shall take effect and
232232 be in full force from and after its passage and approval.
