6565 An Act relating to planning and zoning; requ iring

6767 bodies; clarifying terms of when certain easements
6868 are approved and disapproved; requiring additional
6969 approval of boards of county commissioners under

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 863.3A of Title 19, unless there
8080 is created a duplication in numbering, reads as follows:
8181 In order to minimize conflicts with land -use planning, each
8282 conservation easement shall be app roved by the appropriate governing
8383 body. Such approving body shall first refer the proposed
8484 acquisition to and receive comments from the local planning
8585 commission with jurisdiction over such property, which shall , within
8686 sixty (60) days of the referral , provide such comments regarding the
8787 conformity of the proposed acquisition to comprehensive planning for
8888 the area. If such comments are not received within sixty days, the

140140 proposed acquisition shall be deemed approved by the local planning
141141 commission. If the property is located partially or entirely within
142142 the boundaries or zoning jurisdiction of a municipality or county,
143143 approval of the governing body of such municipality or county shall
144144 be required. If such property is located entirely outside the
145145 boundaries and zoning jurisdiction o f any municipality or county,
146146 approval of the board of county commissioners shall be required.
147147 Approval of a proposed acquisition may be de nied upon a finding by
148148 the appropriate governing body that the acquisition is not in the
149149 public interest when the easement is inconsistent wi th:
150150 1. A comprehensive plan for the area which had been officia lly
151151 adopted and was in force at the time of the con veyance; or
152152 2. Any national, state, regional, or local program furthering
153153 conservation; or
154154 3. Any known proposal by a governmental body for use of the
155155 land.
156156 SECTION 2. It being immediate ly necessary for the preservation
157157 of the public peace, health or safety, an emergency is hereby
158158 declared to exist, by reason whereof this act shall take ef fect and
159159 be in full force from and after its passage an d approval.
