71	71	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
72	72	SECTION 1. AMENDATORY 29 O.S. 2021, Section 4-144, is
73	73	amended to read as foll ows:
74	74	Section 4-144. A. No person may hunt or take black bear
75	75	without having first procured a license from the Director of
76	76	Wildlife Conservation or an agent of the Director.
77	77	B. The Wildlife Conservation Commission shall deci de the open
78	78	season, the bag limits, and territorial limitations for hunting or
79	79	taking black bear.
80	80	C. The fees for a license issued pursuant to this section shall
81	81	be:
82	82	1. For legal residents, One Hundred Dollars ($100.00); and
83	83	2. For nonresidents, Five Hundred Dollars ($500.00).
84	84	D. Any person who fails to obtain a license as required in
85	85	subsection A of this section and pay the fee as required in

137	137	paragraph 1 of subsection C of th is section, upon conviction, shall
138	138	be punished by a fine of not less than Two Hundred Dollars ($200.00)
139	139	nor more than Five Hundred Dollars ($500.00) or by imprisonment in
140	140	the county jail for a period not to exceed six (6) months, or by
141	141	both said fine and imprisonment.
142	142	E. Any person who fails to obtain a license as required in
143	143	subsection A of this section and pay the fee as required in
144	144	paragraph 2 of subsection C of this section, upon conviction, shall
145	145	be punished by a fine of not less than Eight Hundred Do llars
146	146	($800.00) nor more than One Thousand Dollars ($1,00 0.00) or by
147	147	imprisonment in the county jail for a period not to exceed six (6)
148	148	months, or by both said fine and imprisonment.
149	149	F. Legal residents of Oklahoma shall be exempt from the annual
150	150	black bear license requirements of subsection A of this section
151	151	provided a legal reside nt acquires a lifetime hunting or combination
152	152	lifetime hunting and fishing license pursuant to the provisions of
153	153	Section 4-114 of this title.
154	154	SECTION 2. This act shall become effective July 1, 2023.
155	155	SECTION 3. It being immediately necessary for the pre servation
156	156	of the public peace, health or safety, an emergency is hereby
157	157	declared to exist, by reason whereof thi s act shall take effect and
158	158	be in full force from and after its passage and approval.
