7575 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
7676 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
7777 SECTION 1. The Secretary of State shall refer to the people for
7878 their approval or rejection, as and in the manner provided b y law,
7979 the following proposed amendment to the Oklahoma Constitution by
8080 adding a new Section 54 to Article V to read as follows:
8181 Section 54. A. The Legislature, state agency, department, or
8282 commission shall not implement any mandate to any political
8383 subdivision of this State, unless a specific appropriation is made
8484 to fund the political subdivision for all costs related to the
8585 mandate. If no appropriation is made to the political subdivisions,
8686 the mandate shall be considered an unfunded mandate and
8787 unenforceable. Any financial impact of any size determined to exist

139139 by the political subdivision shall be sufficient to deem as an
140140 unfunded mandate. Financial increases related to clerical work,
141141 office supplies, and creating and submitting rep orts, shall be
142142 exempt from this section .
143143 B. As used in this section, “unfunded mandate” means any act,
144144 law, order, decision, policy , or official action implemented by the
145145 Legislature, state agency, department, or commission that mandat es a
146146 political subdivision, by action or inaction to expend funds to
147147 implement or eliminate any policy, ordinan ce, program, or activity
148148 without being fully appropriated .
149149 SECTION 2. The Ballot Title for the proposed Constituti onal
150150 amendment as set forth in SECTION 1 of this resolution shall be in
151151 the following form:

154154 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
155155 This measure adds Section 54 of Article 5 of the Oklahoma

213213 SECTION 3. The President Pro Tempore of the Senate shall,
