7575 BE IT RESOLVED BY THE SENA TE AND THE HOUSE OF REPRESENTATIVES OF THE
7676 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
7777 SECTION 1. The Secretary of State shall refer to the people for
7878 their approval or rejection, as and in the mann er provided by law,
7979 the following proposed amendment to Section 26 of Article X of the
8080 Oklahoma Constitution to read as follows:
8181 Section 26. (a) Except as herein otherwise provided, no
8282 county, city, town, township, school district, or other political
8383 corporation, or subdivision of the state , shall be allowed to become
8484 indebted, in any manner, or for any purpose, to an amount exceed ing,
8585 in any year, the income and revenue provided for such year without
8686 the assent of three-fifths of the voters thereof of the county,
8787 city, town, township, or othe r political corporation or subdivision

139139 of the state or the assent of a majority of the voters of the school
140140 district, voting at an election, to be held for that purpose, nor,
141141 in cases requiring such assent, shall any indeb tedness be allowed to
142142 be incurred to an amount, including existing indebtedness, in the
143143 aggregate exceeding five percent (5%) of the valuation of the
144144 taxable property therein, to be ascerta ined from the last assessment
145145 for state and county purposes previou s to the incurring of such
146146 indebtedness: Provided, that if a school district ha s an absolute
147147 need therefor, such district ma y, with the assent of th ree-fifths of
148148 the voters thereof voting at an election to be held for that
149149 purpose, incur indebtedness to a n amount, including existing
150150 indebtedness, in the aggregate exceeding five perce nt (5%) but not
151151 exceeding ten percent (10%) o f the valuation of the t axable property
152152 therein, to be ascertain ed from the last assessment for state and
153153 county purposes previous to the incurring of such indebtedn ess, for
154154 the purpose of acquiring or improving school sites, constructing,
155155 repairing, remodeling or equipping buildings, or acquiring school
156156 furniture, fixtures, or equipment; and such assent to such
157157 indebtedness shall be deemed to be a sufficient showing of such
158158 absolute need, unless otherwise provid ed by law. Provided further,
159159 that if a city or town has an absolute n eed therefor, such city or
160160 town may, with the assent of three -fifths of the voters thereof
161161 voting at an election to be held for that purpose , incur
162162 indebtedness to an amount, including e xisting indebtedness, in the

214214 aggregate exceeding five percent (5%) but not exceeding ten percent
215215 (10%) of the valuation of the taxable property therein, to be
216216 ascertained from the last assessment for state and county purposes
217217 previous to the incurring of s uch indebtedness, and such assent to
218218 such indebtedness shall be deemed to be a sufficient showing of such
219219 absolute need unless otherwise provided by law. Provided, further,
220220 that any county, city, town, school district, or other political
221221 corporation, or subdivision of the state , incurring any indebt edness
222222 requiring the assent of the voters as aforesaid , shall, before or at
223223 the time of doing so, provide for the collection of an annual tax
224224 sufficient to pay the i nterest on such indebtedness as it falls due,
225225 and also to constitute a sinking fund for the payment of the
226226 principal thereof within twenty -five (25) years from the time of
227227 contracting the same, and provided further that no thing in this
228228 section shall preven t, under such conditions and limitations as
229229 shall be prescribed by law, any school district from contracting
230230 with:
231231 (1) certificated personnel for periods e xtending one (1) year
232232 beyond the current fiscal year; or
233233 (2) a school superintendent for periods ex tending more than one
234234 (1) year, but not to exc eed three (3) years beyond the current
235235 fiscal year.
236236 (b) If a county approves an exemption of household goods of the
237237 heads of families and livestock employed in support of the family

289289 from ad valorem taxation pu rsuant to the provisions of subsection
290290 (b) B of Section 6 of this article, the percentage lim itations on
291291 indebtedness as specified in subsection (a) of this s ection for
292292 political subdivisions or political corporations loca ted in any such
293293 county shall be adju sted by multiplying the percentage levels
294294 specified in subsection (a) of this section by th e millage
295295 adjustment factor as specified in subsection (b) of Sec tion 8A of
296296 this article.
297297 (c) If approved by the people, the ame ndment to this section
298298 shall become effective January 1, 1993.
299299 SECTION 2. The Ballot Title for the propo sed Constitutional
300300 amendment as set forth in SECTION 1 of this resolution shall be in
301301 the following form:

304304 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
305305 This measure amends Section 26 of Article 10 of the Oklahoma
306306 Constitution. This measure would allow a school district to
307307 become indebted upon approval of a m ajority of the voters of the
308308 school district, rathe r than the approval of three-fifths of the
309309 voters of the school district.
