9191 BE IT RESOLVED BY THE SENATE AN D THE HOUSE OF REPRESENTATIVES OF THE
9292 2ND SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
9393 SECTION 1. The Secretary of State shall refer to the people for

146146 the following proposed amendment to the Oklahoma Constitution by
147147 adding a new Section 2 to Article IV to read as follows:
148148 Section 2. A. Upon creation of any new state agency or e ntity,
149149 the Legislature shall provide a mission statement in the enabling
150150 statute, including a list of measurable benefits consistent with the
151151 mission statement, the Oklahoma Constitution and the United States
152152 Constitution, and other applicable law s of this state and of the
153153 United States. Mission statements may be amended by the ordinary
154154 processes of legislation no more than once every four (4) years.
155155 B. The Legislature shall, within two (2) years of the effective
156156 date of this section, define and codify in sta tute a mission for
157157 every state agency or entity, whether created by statute, by rule,
158158 or by the Oklahoma Constitution . Every dollar spent by this state
159159 shall pass through a state agency or entity with a mission
160160 statement. In establishing mission statements, a committe e in the
161161 Senate and a committee in the House of Representatives shall solicit
162162 and hear open public testimony, to be given under pains and
163163 penalties of perjury. Mission statements for existing agencies or
164164 entities may be amended by the ordinary processes of legislation no
165165 more than once every four (4) years.
166166 C. 1. No state agency or entity shall continue any program or
167167 endeavor that is inconsistent with its statutorily defined mission.
168168 2. A state agency or entity shall not define its own mission.

220220 D. Except as provided in subsection J of this section, the
221221 Legislature shall define one or more measurable goals, including
222222 metrics for tracking those goals, for every benefit contained in the
223223 mission statement prior to app ropriating any funds to an agency or
224224 entity. No monies shall be expended except where at leas t one
225225 measurable goal applies, except as provided for in subsection J of
226226 this section. A measurable goal is something that quantifiably
227227 demonstrates real-world results of the program and must be directly
228228 related to the improvements the program provides to the people of
229229 this state. Measures of work volume or activity in an agency or
230230 entity are not sufficient; the measurable goal must track the
231231 results and accompli shments of the agency or entity. Measurable
232232 goals may be amended by the or dinary processes of legislation no
233233 more than once every four (4) years.
234234 E. The Governor sha ll cause to be published annually a single
235235 report stating the mission statement, measurable goals, and actual
236236 results of each agency and entity of state government.
237237 F. The Secretary of Operations and Government Efficiency shall
238238 seize all appropriated and unappropriated funds of any agency or
239239 entity that:
240240 1. Does not have a stat utorily defined mission and measurable
241241 goals; or
242242 2. Fails to cooperate with the Governor ’s annual report as
243243 defined in subsection E of this section.

295295 G. Seized funds shal l be placed in the state’s rainy day fund.
296296 The agency or entity shall not recover, allocate, or spend the
297297 portion of its budget covering the period when it was not compliant
298298 with this section.
299299 H. The courts of this state shall have the power to enforce
300300 this section. The mission statement shall constitute evidence of
301301 the legislative purpose of the agency or entity if the text of the
302302 governing law is otherwise uncl ear. Defendants in any action or
303303 prosecution brought by a state entity ma y raise a relevant agency or
304304 entity’s noncompliance with this amendment as a defense.
305305 I. Violations of subs ections A through E of this section shall
306306 create a cause of action for the following government o fficials, any
307307 of whom shall have standing to sue for the enforcement of this
308308 section: the Governor, the Attorney General, or a group of
309309 legislators comprising not less than ten percent of the full
310310 Legislature of this state. Writs of mandamus, injunctions, and
311311 other appropriate remedies at law or equity shall be gr anted.
312312 J. The Legislature may waive, for a period not to exceed five
313313 (5) years, the requirements of subsections D and E of this section
314314 for an agency or entity which provides demonstrable benefit to the
315315 people of this state, but which benefit is not easily measurable or
316316 quantifiable. For any exemption, both the Senate and the House of
317317 Representatives must hold a roll call vote, and a sixty-percent
318318 supermajority must support the grant, renewal, or extension of a

371371 grant, renewal, or extension of any waiver. A seventy-percent
372372 supermajority of both the Senate and the House of Representatives
373373 may vote to override a Governor ’s veto of a waiver under this
374374 section.
375375 SECTION 2. The Ballot Title for the proposed Constitutional
376376 amendment as set forth in SECTION 1 of this resolution shall be i n

380380 THE GIST OF THE PROPOSITION IS AS FOLLOWS:
381381 This measure will amend the Oklah oma Constitution by adding a
382382 new Section 2 to Article 4. It requires the Legislature to
383383 create a mission statement and measurable goals for all new or
384384 existing state agencies or entities. Both statements and goals
385385 may be amended no more than once every f our years. The
386386 Secretary of Operations and Government Efficiency shall seize
387387 all funds of an agency or entity that violates this amendment.
388388 The courts shall enforce this amendment, and the Governor,
389389 Attorney General, or a group of at least ten percent (10%) of
390390 members of the Legislature shall have standing to sue for
391391 enforcement. The Legislature may waive or grant exceptions to
392392 the amendment through a sixty-percent supermajority vote of the
393393 Legislature. The Governor may approve or veto such waiver. The
