7777 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTA TIVES OF THE
7878 2ND SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
7979 SECTION 1. The Secretary of State shall refer to the people for
8080 their approval or rejection, as and in the manne r provided by law,
8181 the following proposed amendment to Section 2 of Article VII of the
8282 Oklahoma Constitution to read as follows:
8383 Section 2. The Supreme Court shall consist of nine Justices
8484 until the number shall be changed by statute and each Justice shal l
8585 be from a separate district of the State. Each district shall
8686 remain as presently cons tituted until otherwise provided by Statute.
8787 The terms of office of the Justices o f the Supreme Court shall be
8888 six years and shall commence on the second Monday of Ja nuary

140140 following their election. Any Justice who is elected to office
141141 after the effective date of this amendment shall be eligible to
142142 serve no more than twelve (12) years on the Supreme Court. The
143143 years served by any Justice appointed or elected to serve less than
144144 a full term to fill a vacancy in office shall not be in cluded in the
145145 twelve-year limitation set forth herein; but no Justice who has
146146 completed twelve (12) years in office shall thereafter be eligible
147147 to serve a partial term. Any Justice who is serving a term in
148148 office or who has been elected or appointed to serve a term in
149149 office on the effective date of this amendment shall be entitled to
150150 complete his or her term and shall be eligible to serve an
151151 additional twelve (12) years thereafter. Those appointed or elected
152152 to fill vacancies shall assume office immediately upon qualifying
153153 for the office. Each Justice, at the time of his election or
154154 appointment, shall have atta ined the age of thirty years, shall have
155155 been a qualified elector in the distric t for at least one year
156156 immediately prior to the date of filing or appointment, and shall
157157 have been a licensed practicing attorney or judge of a court of
158158 record, or both, in Oklahoma for five years preceding his election
159159 or appointment and shall continue to be a duly licensed attorney
160160 while in office to be eligible to hold the office. The Justices
161161 shall choose from among their members a Chief Justice and a Vice

219219 THE GIST OF THE PROPOSITIO N IS AS FOLLOWS:
220220 This measure would amend Section 2 of Article 7 of the Oklahoma
221221 Constitution. The measure would impose a term limit of 12 years
222222 on Justices of the Su preme Court. It allows members to serve
223223 more than 12 years if filling a vacancy for a partial term. It
224224 allows Justices serving when this measure is approved to finish
225225 a term then serve 12 additional years.
