83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1272, is
85	85	amended to read as follows:

87	87	UNLAWFUL CARRY
88	88	A. Notwithstanding any other provision of law, it shall be
89	89	unlawful for any person to carry upon or about his or her person, or
90	90	in a purse or other container belonging to the person, any pistol,
91	91	revolver, shotgun or rifle whether loaded or unloaded or any

143	143	blackjack, loaded cane, hand chain, metal knuckles, or any other
144	144	offensive weapon, whether such weapon be concealed or unconcealed,
145	145	except this section shall not prohibit:
146	146	1. The proper use of guns and knives for self -defense, hunting,
147	147	fishing, educational or recreational purposes;
148	148	2. The carrying or use of weapons i n a manner otherwise
149	149	permitted by statute or authorized by the Oklahoma Self -Defense Act;
150	150	3. The carrying, possession and use of any weapon by a peace
151	151	officer or other person authorized by law to carry a weapon in the
152	152	performance of official duties and in compliance with the rules of
153	153	the employing agency;
154	154	4. The carrying or use of weapons in a courthouse by a district
155	155	judge, associate district judge or special district judge within
156	156	this state, who is in possession of a valid handgun license issued
157	157	pursuant to the provisions of the Oklahoma Self -Defense Act and
158	158	whose name appears on a list maintained by the Administrative
159	159	Director of the Courts;
160	160	5. The carrying and use of firearms and other weapons provided
161	161	in this subsection when used for the purpose of l iving history
162	162	reenactment. For purposes of this paragraph, "living history
163	163	reenactment" means depiction of historical characters, scenes,
164	164	historical life or events for entertainment, education, or
165	165	historical documentation through the wearing or use of per iod,

218	218	weapons, and other implements of the historical period; or
219	219	6. The transporting by vehicle on a public roadway or the
220	220	carrying of a firearm, concealed or unconcealed, loaded or unloaded,
221	221	by a person who is twenty-one (21) years of age or older or by a
222	222	person who is eighteen (18) years of age but not yet twenty -one (21)
223	223	years of age and the person is a member or veteran of the United
224	224	States Armed Forces, Reserves or National Guard or was di scharged
225	225	under honorable conditions from the United States Armed Forces,
226	226	Reserves or National Guard, or who meets the age requirement
227	227	provided in the provisions of Section 1 of Article III of the
228	228	Oklahoma Constitution, and the person is otherwise not disqu alified
229	229	from the possession or purchase of a firearm under state or federal
230	230	law and is not carrying the firearm in furtherance of a crime.
231	231	Except as provided in subsection B of Section 1283 of this
232	232	title, a person who has been convicted of any one of the f ollowing
233	233	offenses in this state or a violation of the equivalent law of
234	234	another state:
235	235	a. assault and battery pursuant to the provisions of
236	236	Section 644 of this title which caused serious
237	237	physical injury to the victim,
238	238	b. aggravated assault and battery purs uant to the
239	239	provisions of Section 646 of this title,

291	291	c. assault and battery that qualifies as domestic abuse
292	292	as defined in Section 644 of this title,
293	293	d. stalking pursuant to the provisions of Section 1173 of
294	294	this title,
295	295	e. a violation of an order issued un der the Protection
296	296	from Domestic Abuse Act or a domestic abuse protection
297	297	order issued by another state, or
298	298	f. a violation relating to illegal drug use or possession
299	299	under the provisions of the Uniform Controlled
300	300	Dangerous Substances Act,
301	301	shall be prohibited from carrying a firearm under the provisions of
302	302	this paragraph. Any person who carries a firearm in the manner
303	303	provided for in this paragraph shall be prohibited from carrying the
304	304	firearm into any of the places prohibited in subsection A of Section
305	305	1277 of this title or any other place currently prohibited by law.
306	306	Nothing in this section shall modify or otherwise change where a
307	307	person may legally carry a firearm.
308	308	B. Any person convicted of violating the foregoing provision
309	309	shall be guilty of a misdeme anor punishable as provided in Section
310	310	1276 of this title.
311	311	SECTION 2. AMENDATORY 21 O.S. 2021, Section 1290.8, as
312	312	amended by Section 4, Chapter 160, O.S.L. 2023 (21 O.S. Supp. 2024,

368	368	A. Except as otherwise prohibited by law, an eligible person
369	369	shall have authority to carry a concealed or unconcealed firearm in
370	370	this state when:
371	371	1. The person is in compliance with the provisions of the
372	372	Oklahoma Self-Defense Act; or
373	373	2. The person is authorized pursuant to the provisions of
374	374	Section 1272 of this title ; or
375	375	3. The person meets the age requirement provided in the
376	376	provisions of Section 1 of Article III of the Oklaho ma Constitution.
377	377	B. A person in possession of a valid state photo identificat ion
378	378	card, driver license, or valid handgun license or who presents a
379	379	valid military identification card and is in compliance with the
380	380	provisions of the Oklahoma Self -Defense Act shall be authorized to
381	381	carry such concealed or unconcealed firearm while scouting as it
382	382	relates to hunting or fishing or while hunting or fishing.
383	383	C. The person shall be required to have possession of his or
384	384	her valid handgun license, valid military ident ification card, valid
385	385	driver license, or state photo identification card at al l times when
386	386	in possession of a firearm. The person shall display either a valid
387	387	handgun license, valid military identification card, valid driver
388	388	license, or valid state photo identification card as provided for
389	389	qualified persons in this section on demand of a law enforcement

441	441	officer; provided, however, that in the absence of reasonable and
442	442	articulable suspicion of other criminal activity, an individual
443	443	carrying an unconcealed o r concealed firearm shall not be disarmed
444	444	or physically restrained unless the individual fails to display one
445	445	of the following:
446	446	1. A valid handgun license;
447	447	2. A valid military identification card;
448	448	3. A valid driver license; or
449	449	4. A valid state photo id entification card,
450	450	as provided for qualified persons in this section in response to
451	451	that demand. Any violation of the provisions of this subsection may
452	452	be punishable as a criminal offense as authorized by Section 1272 of
453	453	this title or pursuant to any othe r applicable provision of law.
454	454	Upon the arrest of any person for a violation o f the provisions
455	455	of this subsection, the person may show proof to the court that a
456	456	valid handgun license, a valid military identification card, a valid
457	457	driver license, or a valid state photo identification card has been
458	458	issued to such person and the person may state any reason why the
459	459	valid handgun license, valid military identification card, valid
460	460	driver license, or valid state photo identification card as provided
461	461	for qualified persons in this section was not carried by the person
462	462	as required by the Oklah oma Self-Defense Act. The court shall
463	463	dismiss an alleged violation of Section 1272 of this title upon
464	464	payment of court costs, if proof of a valid handgun license, a valid

517	517	photo identification card is shown to the court within ten (10) days
518	518	of the arrest of the person.
519	519	D. It shall be unlawful for any person to fail or refuse to
520	520	identify the fact that the person is in actual possession of a
521	521	concealed or unconcealed firearm pursuant to the authority of the
522	522	Oklahoma Self-Defense Act during the course of any arrest,
523	523	detainment, or routine traffic stop. Said identification shall be
524	524	required upon demand by the law enf orcement officer. No person
525	525	shall be required to identify himself or herself as lawfully in
526	526	possession of any other firearm if the law enforcement officer does
527	527	not demand the information. No person shall be required to identify
528	528	himself or herself as bein g in possession of a firearm when no
529	529	firearm is in the possession of the perso n or in any vehicle in
530	530	which the person is driving or is a passenger. Any violator of the
531	531	provisions of this subsection may be issued a citation for an amount
532	532	not exceeding One Hundred Dollars ($100.00).
533	533	E. Any law enforcement officer coming in contact with a person
534	534	whose handgun license is suspended or revoked, or who is in
535	535	possession of a handgun license which has not been lawfully issued
536	536	to that person, shall confiscate the l icense and return it to the
537	537	Oklahoma State Bureau of Investigation for appropr iate
538	538	administrative proceedings against the licensee when the license is
539	539	no longer needed as evidence in any criminal proceeding.

594	594	SECTION 3. AMENDATORY 21 O.S. 2021, Section 1290.9, is

597	597	ELIGIBILITY
598	598	The following requirements shall apply to any p erson making
599	599	application to the Oklahoma State Bureau of Investigation for a
600	600	handgun license pursuant to the provisions of the Oklahoma Self -
601	601	Defense Act. The person must:
602	602	1. Be a citizen of the United States with established residency
603	603	in the State of Oklahoma this state; or
604	604	2. Be a lawful permanent resident in the United States and have
605	605	established residency in the State of Oklahoma this state.
606	606	For purposes of the Oklahoma Self -Defense Act:
607	607	a. the term "residency" shall apply to any person who
608	608	either possesses a valid Oklahoma driver license or
609	609	state photo identification card, and physically
610	610	maintains a residence in this state or to any person,
611	611	including the spouse of such perso n, who has permanent
612	612	military orders within this state and possesses a
613	613	valid driver license from another state where such
614	614	person and spouse of such person claim residency, and

678	678	Section 1 of Article III of the Oklahoma Const itution;
679	679	5. Complete a firearms safety and training course and
680	680	demonstrate competence and qualifications with the type of pistol to
681	681	be carried by the person as provided in Section 1290.14 of this
682	682	title, and submit proof of training and qualification or an
683	683	exemption for training and qualification as authorized by Section
684	684	1290.14 of this title;
685	685	5. 6. Submit the required fee and complete the application
686	686	process as provided in Section 1290.12 of this title; and
687	687	6. 7. Comply in good faith with the provisions of the Oklahoma
688	688	Self-Defense Act.
