79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law to be codified
81	81	in the Oklahoma Statutes as Section 90 of Title 40, unless there is
82	82	created a duplication in numbering, reads as foll ows:
83	83	As used in this act:
84	84	1. "Content creation" means content shared on an online
85	85	platform in exchange for compensation;
86	86	2. "Content creator" means an individual or individuals
87	87	eighteen (18) years of ag e or older, including family members, who
88	88	create video content performed in Oklahoma in exchange for
89	89	compensation, and includes an y proprietorship, partnership, company,

142	142	particular individual or individuals, or family members, for the
143	143	purpose of that content creator. Content creator does not include a
144	144	person under the age of eighteen (18) who produces their own video
145	145	content; and
146	146	3. "Online platform" means any public-facing website, web
147	147	application, or digital application, including a mobile appl ication.
148	148	Online platform includes a social network, advertising network,
149	149	mobile operating system, search engine, email service, monetization
150	150	platform to sell digital services, streaming services, paid
151	151	subscription, or Internet access service.
152	152	SECTION 2. NEW LAW A new section of law to be codified
153	153	in the Oklahoma Statutes as Section 90.1 of Title 40, unless there
154	154	is created a duplication in numbering, reads as follows:
155	155	A. A minor is considered engaged in the work of content
156	156	creation when the following criteria are met at any time during the
157	157	previous twelve-month period:
158	158	1. At least thirty percent (30%) of the content creator 's
159	159	compensated video content produced within a thirty -day period
160	160	included the likeness, name, or photograph of the minor. Content
161	161	percentage is measured by the percentage of time the likeness, name,
162	162	or photograph of the minor visually appears or is the subject of an
163	163	oral narrative in a video segment as compared to the total length of
164	164	the segment; and

216	216	2. The number of views received per video segment on any online
217	217	platform met the online p latform's threshold for generating
218	218	compensation or the content creator received actual compensation for
219	219	video content equal to or greater than ten cents ($0.10) per view.
220	220	B. All video content creators whose content features a minor
221	221	engaged in the work of content creation shall maintain the following
222	222	records and retain the records until the minor reaches the age of
223	223	twenty-one (21):
224	224	1. The name and documentary proof of the age of the minor
225	225	engaged in the work of content creation;
226	226	2. The amount of content creation that generated compensation
227	227	as described in subsection A of this section during the reporting
228	228	period;
229	229	3. The total number of minutes of content creation for which
230	230	the content creator received compensation during the reporting
231	231	period;
232	232	4. The total number of minutes a minor was featured in content
233	233	creation during the reporting period;
234	234	5. The total compensation generated from content creation
235	235	featuring a minor during the r eporting period; and
236	236	6. The amount deposited into the trust account for the b enefit
237	237	of the minor engaged in the work of content creation as required by
238	238	Section 3 of this act.

291	291	accessible to the minor for review. The content creator shall
292	292	provide notice to the minor of the existence of the records.
293	293	SECTION 3. NEW LAW A new section of law to be codified
294	294	in the Oklahoma Statutes as Section 90.2 of Title 40, unless there
295	295	is created a duplication in numbering, reads as follows:
296	296	A. A minor who is engaged in the work of content creation
297	297	consistent with this act must be compensated by the content creator.
298	298	The content creator must set aside gross earnings on the video
299	299	content that includes the likeness, name, or photograph of the minor
300	300	in a trust account to be preserved for the benefit of the minor
301	301	until the minor reaches the age of majority, according to the
302	302	following distribution:
303	303	1. If only one minor meets the content threshold des cribed in
304	304	subsection A of Section 2 of this act, the percentage of total gross
305	305	earnings on any video segment, including the likeness, name, or
306	306	photograph of the minor that is equal to or greater than half of the
307	307	content percentage that includes the minor a s described in
308	308	subsection A of Section 2 of this act; or
309	309	2. If more than one minor meets the content threshold described
310	310	in subsection A of Section 2 of this act and a video segment
311	311	includes more than one of those minors, the percentage described in
312	312	paragraph 1 of this subsection for all minors in any segment must be

365	365	percentage of content provided by the individual minors.
366	366	B. A trust account required under this act must, at a minimum,
367	367	provide that:
368	368	1. The money in the account is available only to the minor
369	369	engaged in the work of content creation;
370	370	2. The account is held by a bank or trust company, as those
371	371	terms are defined in Section 102 of Title 6 of the Oklahoma
372	372	Statutes;
373	373	3. The money in the account becomes available to the minor
374	374	engaged in the work of content crea tion upon the minor attaining the
375	375	age of eighteen (18) years or upon a declaration that the minor is
376	376	emancipated; and
377	377	4. That the account meets the requirements o f the Uniform
378	378	Transfers to Minors Act in Title 58 of the Oklahoma Statutes .
379	379	C. Content containing the likeness of a child must be deleted
380	380	and removed from any online platform when the request is made by a
381	381	minor age thirteen (13) or older, or an adult, whose likeness
382	382	appears in the content. The request shall be in writing through
383	383	mail or an electronic communication. The content must be deleted
384	384	and removed from the online platform immediately, and in any
385	385	instance no longer than seven (7) days after the written request is
386	386	made.

438	438	SECTION 4. NEW LAW A new section of law to be codified
439	439	in the Oklahoma Statutes as Section 90.3 of Title 40, unless there
440	440	is created a duplication in numbering, reads as follows:
441	441	A. If a content creator knowingly or reckless ly violates this
442	442	act, a minor satisfying the criteria described in subsection A of
443	443	Section 2 of this act may commence a civil action to enforce the
444	444	provisions of this act regarding the trust account. In any action
445	445	brought in accordance with this act, the court may award the
446	446	following damages:
447	447	1. Actual damages;
448	448	2. Punitive damages; and
449	449	3. The costs of the action, including attorney fees and
450	450	litigation costs.
451	451	B. This act does not affect a right or remedy available under
452	452	any other law.
453	453	C. Nothing in this act shall be interpreted to have any effect
454	454	on a party that is neither the c ontent creator nor the minor who
455	455	engaged in the work of content creation.
456	456	SECTION 5. NEW LAW A new section of law to be codified
457	457	in the Oklahoma Statutes as Section 90.4 of Title 40, unless there
458	458	is created a duplication in numbering, reads as follows:
459	459	If a content creator whose content features minors engaged in
460	460	the work of content creation fails to maintain the records as
461	461	provided in Section 2 of this act, the minor may commence a civil

518	518	A minor compensated under this act is exempt from the minimum
519	519	age provisions of Section 71 of Title 40 of the Oklahoma Statutes .
520	520	SECTION 7. This act shall become effective November 1, 202 5.
