8686 SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, a s
8787 amended by Section 1, Chapter 274, O.S.L. 2024 (70 O.S. Supp. 2024,
8888 Section 2603), is amended to read as follows:
8989 Section 2603. A. Except as otherwise provided for in
9090 subsection B of this section and elsewhere in this section, to be
9191 eligible to participate in the Oklahoma Higher Learning Access
9292 Program and to qualify for an award which includes payment of an

144144 amount equivalent to resident tuition or other tuition pursuant to
145145 Section 2604 of this title for the first semester or other academic
146146 unit of postsecondary enrollment, a student shall:
147147 1. Be a resident of this state or be e nrolled in a school
148148 district located in this state that serves students who reside in
149149 both this state and an adjacent state pursuant to a contract as
150150 authorized in Section 5 -117.1 of this title;
151151 2. Be a United States citizen or lawfully present in the United
152152 States. A student who is not a United States citizen or lawfully
153153 present in the United States shall not be eligible to participate in
154154 the Oklahoma Higher Learning Access Pro gram and to qualify for an
155155 award notwithstanding the provisions of Section 324 2 of this title.
156156 The provisions of this paragraph shall not apply to any student who
157157 was enrolled in the Oklahoma Higher Learning Access Program prior to
158158 the end of the 2006-2007 school year;
159159 3. Have a record of satisfactory compliance with agreements
160160 executed pursuant to Section 2605 of this title;
161161 4. a. have graduated within the previous three (3) years
162162 from a high school accredited by the State Board of
163163 Education or the Oklah oma School of Science and
164164 Mathematics with a minimum 2.5 cumulative grade poin t
165165 average on a 4.0 scale for all work attempted in
166166 grades nine through twelve,

219219 from a high school not accredited by the Stat e Board
220220 of Education with a minimum 2.5 cumulative grade point
221221 average on a 4.0 scale for all work attempted in
222222 grades nine through twelve and have achieved a
223223 composite score of 22 or higher on the ACT test, or
224224 c. have satisfactorily completed within the p revious
225225 three (3) years an educational program that was
226226 provided through a mea ns other than a public or
227227 private school and have achieved a composite score of
228228 22 or higher on the ACT test;
229229 5. Have completed the curricular requirements for admission to
230230 an institution within The Oklahoma State System of Higher Education.
231231 Students shall also have attained a 2.5 grade point average in the
232232 core curriculum courses. Students who attended a high school which
233233 did not offer all the core curriculum courses or studen ts who were
234234 educated by other means and were not offered all the core curricul um
235235 courses shall be allowed to satisfy this curriculum requirement by
236236 participating in a program approved by the Oklahoma State Regents
237237 for Higher Education for remediation of hi gh school curricular
238238 deficiencies;
239239 6. Have satisfied admission standards as determined by the
240240 Oklahoma State Regents for Higher Education for first -time-entering
241241 students for the appropriate type of institution, or, if attending a

294294 determined by the private institution. No student participating in
295295 the Oklahoma Higher Learning Access Program shall be admitted into
296296 an institution of higher education by special admission standards;
297297 7. Have secured admission to, and enrolled in, an institution
298298 which is a member of The Oklahoma State System of Higher Education,
299299 a postsecondary vocational -technical program offered by a technology
300300 center school that meets the requirements to be eligible for federal
301301 student financial aid, or a private institution of higher learning
302302 located within this state and accredited pursuant to Section 4103 of
303303 this title; and
304304 8. a. have established financial need according to the
305305 provisions of subsection D of Section 2605 of this
306306 title and standards and provisions promulgated by the
307307 Oklahoma State Regents for Higher Education,
308308 b. if the student was adopted between birth and twelve
309309 (12) years of age while in the permanent custody of
310310 the Department of Human Services, in the court -ordered
311311 custody of a licensed private nonprofit child -placing
312312 agency, or federally re cognized Indian tribe, as
313313 defined by the federal Indian Child Welfare Act, have
314314 established financial need according to the provisions
315315 of paragraph 1 of subsection E of Section 2 605 of this

385385 need according to the provisions of paragraph 3 of
386386 subsection E of Section 2605 of this title and
387387 standards and provisions promulgated by the Oklahoma
388388 State Regents for Higher Education , or
389389 e. if the student is the child of a public school

442442 employee for at least five (5) consecutive years . For
443443 the purposes of this paragraph, "public school
444444 employee" means any teacher, librarian, certified or
445445 registered nurse, or support employee whose salary is
446446 paid wholly or in part from public funds. The term
447447 "teacher" shall also include instructors and
448448 counselors employed by the Department of Corrections
449449 and holding valid teaching certificates issued by the
450450 State Department of Education .
451451 B. 1. A student shall be eligible to participate in the
452452 Oklahoma Higher Learning Access Program and to qualify for an award
453453 which includes payment of an amount equivalent to resident tuition
454454 or other tuition pursuant to Section 2604 of this title for the
455455 first semester or other academic unit of postsecondary enrollment if
456456 the student meets all of the following criteria:
457457 a. is a child of any person killed after January 1, 2000,
458458 in the line of duty in any branch of the United States
459459 Armed Forces or who died after January 1, 2000, as a
460460 result of an injury sustained while in the line of
461461 duty in any branch of the United States Armed Forces
462462 and the person who was killed or died filed an
463463 individual or joint Oklahoma income tax return for the
464464 tax year prior to the year during which the person was
465465 killed or died,

517517 b. is a resident of this state or is enrolled in a school
518518 district located in this state th at serves students
519519 who reside in both this state and an adjacent state
520520 pursuant to a contract as authorized in Section 5 -
521521 117.1 of this title,
522522 c. enrolls in an institution within The Oklahoma State
523523 System of Higher Education prior to reaching the age
524524 of twenty-one (21),
525525 d. has satisfied admission standards as determined by the
526526 Oklahoma State Regents for Higher Education for first -
527527 time-entering students for the appropriate type of
528528 institution, or, if attending a private institution,
529529 has satisfied admission st andards as determined by the
530530 private institution. No student participating in the
531531 Oklahoma Higher Learning Access Program shall be
532532 admitted into an institution of higher education by
533533 special admission standards,
534534 e. has secured admission to, and enrolled i n, an
535535 institution which is a member of The Oklahoma State
536536 System of Higher Edu cation, a postsecondary
537537 vocational-technical program offered by a technology
538538 center school that meets the requirements to be
539539 eligible for federal student financial aid, or a
540540 private institution of higher learning located within

592592 this state and accredited pursuant to Section 4103 of
593593 this title, and
594594 f. executes an agreement pursuant to subsection C of
595595 Section 2605 of this title.
596596 2. A student who is eligible to participate in the pro gram
597597 pursuant to this subsection shall not be required to meet the
598598 eligibility requirements set forth in subsection A of this section.
599599 C. To retain eligibility while pursuing the program of higher
600600 learning in which enrolled, the student shall:
601601 1. Meet the requirements for retention and degree completion as
602602 established by the institution in which the student is enrolled;
603603 2. Maintain good academic standing and satisfactory academic
604604 progress according to standards of the Oklahoma State Regents for
605605 Higher Education;
606606 3. Maintain satisfactory academic progress as required for
607607 eligibility for federal Title IV student financial aid programs.
608608 The provisions of this paragraph shall become effective for the
609609 2012-2013 school year;
610610 4. Comply with the standards rela ted to maintenance of
611611 eligibility as promulgated by the Oklahoma State Regents for Higher
612612 Education; and
613613 5. Refrain from conduct that leads to expulsion or suspension
614614 of more than one semester from an institution of higher education.
615615 A student who violat es the provisions of this paragraph shall

667667 permanently lose eligibility for pro gram benefits. The provisions
668668 of this paragraph shall become effective January 1, 2008.
669669 D. The Oklahoma State Regents for Higher Education and the
670670 State Board of Career and Tec hnology Education shall promulgate
671671 rules relating to maintenance of eligibility under the Oklahoma
672672 Higher Learning Access Act by a student.
673673 E. It is the intent of the Legislature that students in the
674674 ninth grade for the 1992 -93 school year who are determi ned to be
675675 eligible Oklahoma Higher Learning Access students pursuant to the
676676 Oklahoma Higher Learning Access Act shall be the first students
677677 eligible for benefits from the Oklahoma Higher Learning Access Trust
678678 Fund.
679679 F. The Oklahoma State Regents for Higher Education are
680680 authorized to study, develop, and propose criteria for determining
681681 award eligibility based upon the completion of seven semesters of
682682 high school coursework by a student.
683683 SECTION 2. AMENDATORY 70 O.S. 2021, Section 2 605, as
684684 last amended by Section 2, Chapter 274, O.S.L. 2024 (70 O.S. Supp.
685685 2024, Section 2605), is amended to read as follows:
686686 Section 2605. A. Each school year, every fifth - through
687687 eleventh-grade student in the public and private schools of this
688688 state and students who are educated by other means and are in the
689689 equivalent of the fifth through eleventh grade shall be apprised,
690690 together with the parent, custodial parent, or guardian of the

742742 student, of the opportunity for access to higher learning under the
743743 Oklahoma Higher Learning Access Program. The Oklahoma State Regents
744744 for Higher Education and the State Board of Education shall develop,
745745 promote, and coordinate a public awareness program to be utilized in
746746 making students and parents aware of the Oklahom a Higher Learning
747747 Access Program.
748748 B. On a form provided by the Oklahoma State Regents for Higher
749749 Education, every public school district shall designate at least one
750750 Oklahoma Higher Learning Access Program contact person, who shall be
751751 a counselor or teach er, at each public school site in this state in
752752 which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
753753 When requested by the State Regents, the State Board of Education
754754 shall assist the State Regents to ensure the designation of contact
755755 persons. Private schools shall also designate at least one school
756756 official as a contact person. For students who are educated by
757757 other means, a parent or guardian or other person approved by the
758758 State Regents shall be designated the contact person.
759759 C. 1. Students who qualify on the basis of financial need
760760 according to subsection D o r E of this section or who meet the
761761 eligibility qualification set forth in subparagraph a of paragraph 1
762762 of subsection B of Section 2603 of this title prior to entering the
763763 eleventh grade or prior to reaching the age of sixteen (16) and the
764764 standards and provisions promulgated by the Oklahoma State Regents
765765 for Higher Education shall be given the opportunity throughout the

817817 eighth-, ninth-, tenth-, and eleventh-grade years, for stud ents
818818 enrolled in a public or private school, or between the ages of
819819 thirteen (13) and sixteen (16), for students who are educated by
820820 other means, to enter into participation in the program by agreeing
821821 to, throughout the remainder of their school years or e ducational
822822 program:
823823 a. attend school or an educational program regularly and
824824 do homework regularly,
825825 b. refrain from substance abuse,
826826 c. refrain from commission of crimes or delinquent acts,
827827 d. have school work and school records reviewed by
828828 mentors designated pursuant to the program,
829829 e. provide information requested by the Oklahoma State
830830 Regents for Higher Education or the State Board of
831831 Education, and
832832 f. participate in program activities.
833833 2. Students who meet the eligibility qualification set forth in
834834 subparagraph a of paragraph 1 of subsection B of Section 2603 of
835835 this title after completing the eleventh grade or after reaching the
836836 age of seventeen (17) shall be given the opportunity prior to
837837 reaching the age of twenty -one (21) to enter into participation in
838838 the program and shall execute an agreement with provisions as
839839 determined by the Oklahoma State Regents for Higher Education.

891891 3. The contact person shall maintain the agreements, which
892892 shall be executed on forms provided by the Oklahoma State Regents
893893 for Higher Education and managed according to regulations
894894 promulgated by the Oklahoma State Regents for Higher Education, and
895895 the contact person shall monitor compliance of the student with the
896896 terms of the agreement. The Oklahoma State Regents for Higher
897897 Education are authorized to process student agreements and verify
898898 compliance with the agreements. Students failing to comply with the
899899 terms of the agreement shall not be eligible for the awards provided
900900 in Section 2604 of this title.
901901 D. Except as otherwi se provided for in subsection E of this
902902 section and except for students who qualify pursuant to subsection B
903903 of Section 2603 of this title, a student shall not be found to be in
904904 financial need for purposes of the Oklahoma Higher Learning Access
905905 Program if:
906906 1. Beginning with eighth -, ninth-, or tenth-grade students who
907907 are enrolled in a public or private school or students between the
908908 ages of thirteen (13) and fifteen (15) who are educated by other
909909 means who apply for participation in the program in the 201 7-2018
910910 school year, the federal adjusted gross income of the student 's
911911 parent(s) exceeds Fifty -five Thousand Dollars ($55,000.00) per year;
912912 2. Beginning with eighth -, ninth-, tenth-, or eleventh-grade
913913 students who are enrolled in a public or private schoo l or students
914914 between the ages of thirteen (13) and sixteen (16) who are educa ted

970970 3. Beginning with eighth -, ninth-, tenth-, or eleventh-grade
971971 students who are enrolled in a public or private school or students
972972 between the ages of thirteen (13) and sixteen (16) who are educated
973973 by other means who apply for participation in the program in the
974974 2022-2023 school year:
975975 a. the federal adjusted gross income of the student 's
976976 parent(s), who have two or fewer dependent children,
977977 exceeds Sixty Thousand Dollars ($60,000.00) per year,
978978 b. the federal adjusted gross income of the student's
979979 parent(s), who have three or four dependent children,
980980 exceeds Seventy Thousand Dollars ($70,000.00) per
981981 year, or
982982 c. the federal adjusted gross income of the student 's
983983 parent(s), who have five or more dependent children,
984984 exceeds Eighty Thousand Dollars ($80,000.00) per year;
985985 4. Beginning with the 2018 -2019 academic year, prior to
986986 receiving any Oklahoma Higher Learning Access Program benefit award
987987 for any year during which the student is enrolled in an institution
988988 which is a member of The O klahoma State System of Higher Education,
989989 a postsecondary vocational -technical program offered by a technology

10441044 this title, the federal adjusted gross income of the student 's
10451045 parent(s) exceeds One Hundred Thousand Dollars ($100,000.00) per
10461046 year.
10471047 The determination of financial qualification as set forth in
10481048 this paragraph shall be based on the income of the student, not the
10491049 income of the parent(s), if a student:
10501050 a. is determined to be independent of the student 's
10511051 parents for federal financial aid purposes,
10521052 b. was in the permanent custody of the Department of
10531053 Human Services at the time the student enrolled in the
10541054 program, or
10551055 c. was in the court-ordered custody of a federally
10561056 recognized Indian tribe, as defined by the federal
10571057 Indian Child Welfare Act, at the time the student
10581058 enrolled in the program.
10591059 The provisions of this paragraph shall apply to any student who
10601060 has received an Oklahoma Higher Learning Access Program benefit
10611061 award after the 2017 -2018 school year; and
10621062 5. The Oklahoma State Regents for Higher Education shall review
10631063 the determination of financial qu alification as set forth in
10641064 paragraphs 1, 2, and 3 of this subsection if the i ncome from taxable

11221122 the federal Social Security Administration due to the death or
11231123 disability of the student 's parent(s), does not exceed the
11241124 limitations set forth by paragraphs 1, 2, and 3 of this subsection,
11251125 the student shall be determined to have met the financial
11261126 qualification set forth i n paragraphs 1, 2, and 3 of this
11271127 subsection.
11281128 E. 1. A student who was adopted between birth and twelve (12)
11291129 years of age while in the permanent custody of the Department of
11301130 Human Services, in the court -ordered custody of a licensed private
11311131 nonprofit child-placing agency, or federally recognized Indian
11321132 tribe, as defined by the feder al Indian Child Welfare Act, shall not
11331133 be found to be in financial need for purposes of the Oklahoma Higher
11341134 Learning Access Program if at the time the student begins
11351135 postsecondary education and prior to receiving any Oklahoma Higher
11361136 Learning Access Program benefit award, the federal adjusted gross
11371137 income of the student 's parent(s) exceeds One Hundred Fifty Thousand
11381138 Dollars ($150,000.00) per year. The provisions of this paragraph
11391139 shall not apply to any student who has received an Oklahoma Higher

11931193 2. A student who was adopted between thirteen (13) and
11941194 seventeen (17) years of age while in the permanent custody of the
11951195 Department of Human Services, in the court -ordered custody of a
11961196 licensed private nonprofit child -placing agency, or federally
11971197 recognized Indian tribe, as defined by the federal Indian Child
11981198 Welfare Act, shall not be found to be in financial need for purposes
11991199 of the Oklahoma Higher Learning Access Program if at the time the
12001200 student begins postsecondary education and prior to receiving any
12011201 Oklahoma Higher Learning Access Program benefit award, the federal
12021202 adjusted gross income of the student 's parent(s) exceeds Two Hundred
12031203 Thousand Dollars ($200,000.00) per year. The provisions of this
12041204 paragraph shall not apply to any student who has received an
12051205 Oklahoma Higher Learning Access Program benefit award prior to the
12061206 2012-2013 school year.
12071207 3. A student who was placed in the custody of the Department of
12081208 Human Services at any time duri ng the eighth, ninth, tenth, or
12091209 eleventh grades and enrolls in the program no later than his or her
12101210 official date of high school graduation shall not be found to be in
12111211 financial need for purposes of the Oklahoma Higher Learning Access
12121212 Program if the federal adjusted gross income of the student exceeds
12131213 Sixty Thousand Dollars ($60,000.00) per year.

12651265 4. Except for students who qualify pursuant to subsection B of
12661266 Section 2603 of this title, the determination of financial
12671267 qualification as set forth in this subse ction shall be based on the
12681268 income of the student, not the income of the parent(s), if the
12691269 student is determined to be independent of the student 's parent(s)
12701270 for federal financia l aid purposes. A determination of financial
12711271 qualification shall not be required for the student who meets the
12721272 criteria set forth in this subsection at the time the student
12731273 applies for participation in the program. The provisions of this
12741274 paragraph shall not apply to any student who has received an
12751275 Oklahoma Higher Learning Access P rogram benefit award prior to the
12761276 2008-2009 school year.
12771277 5. a. A determination of financial qualification is not
12781278 required for a student who is the child of a public
12791279 school employee at the time the student applies for
12801280 participation in the Oklahoma Higher Learning Access
12811281 Program and prior to receiving any Oklahoma Higher
12821282 Learning Access Program benefit award for any year
12831283 during which the student is enrolled in an institution
12841284 which is a member of The Oklahoma State System of
12851285 Higher Education, a postsecondary v ocational-technical
12861286 program offered by a technology center school that
12871287 meets the eligibility requirements for federal student
12881288 financial aid, or a private institution of higher

13421342 State Regents for Higher Education shall verify the
13431343 five (5) consecutive years of full-time employment of
13441344 the student's parent(s) prior to the student rec eiving
13451345 any Oklahoma Higher Learning Access Program benefit
13461346 award. The provisions of this paragraph shall apply
13471347 to eighth-, ninth-, or tenth-grade students who are
13481348 enrolled in a public or private school or students
13491349 between the ages of thirteen (13) and fif teen (15) who
13501350 are educated by other means who apply for
13511351 participation in the program after the 202 4-2025
13521352 school year.
13531353 b. For the purposes of this paragraph, "public school
13541354 employee" means any teacher, librarian, certified or
13551355 registered nurse, or support employee whose salary is
13561356 paid wholly or in part from public funds. The term
13571357 "teacher" shall also include instructors and
13581358 counselors employed by the Department of Corrections
13591359 and holding valid teaching certificates issued by the
13601360 State Department of Education .
13611361 F. The financial qualification of a student as set forth in
13621362 subsections D and E of this section shall be certified by the
13631363 contact person or by the Oklahoma State Regents for Higher Education

14191419 G. Agreements shall be witnessed by the parent, custodial
14201420 parent, or guardian of the student, who shall further agree to:
14211421 1. Assist the student in achieving compliance with the
14221422 agreements;
14231423 2. Confer, when requested to do so, with the school contact
14241424 person, other school personnel, and program mentors;
14251425 3. Provide information requested by the Oklah oma State Regents
14261426 for Higher Education or the State Board of Education; and
14271427 4. Assist the student in completing forms and reports required
14281428 for program participation, making applications to institutions and
14291429 schools of higher learning, and filing applicatio ns for student
14301430 grants and scholarships.
14311431 H. The Oklahoma State Regents for Higher Education shall
14321432 promulgate rules for the determination of student compliance with
14331433 agreements made pursuant to this section.
14341434 I. The Oklahoma State Regents for Higher Educatio n shall
14351435 designate personnel to coordinate tracking of program records for
14361436 the years when students participating in the program are still in
14371437 the schools or are being educated by other means, provide staff
14381438 development for contact persons in the schools, and provide liaison

14921492 J. The school district where an Oklahoma Higher Learning Access
14931493 Program student is enrolled when the student begins participation in
14941494 the program and any subsequent school district where the student
14951495 enrolls shall forward information regarding participation by the
14961496 student in the program to a school to which the student transfers
14971497 upon the request of the school for the records of the student.
14981498 K. Students participating in the Oklahoma Higher Learning
14991499 Access Program shall provide their Social Security number or their
15001500 student identification number used by their school to the Oklahoma
15011501 State Regents for Higher Education. The Regents shall keep th e
15021502 numbers confidential and use them only for administrative purposes.
15031503 SECTION 3. This act shall become effective July 1, 2025.
15041504 SECTION 4. It being immediately necessary for the preservation
15051505 of the public peace, health or s afety, an emergency is hereby
15061506 declared to exist, by reason whereof this act shall take effect and
15071507 be in full force from and after its passage and approval.
