85	85		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
86	86		SECTION 1. AMENDATORY 70 O.S. 2021, Section 2603, a s
87	87		amended by Section 1, Chapter 274, O.S.L. 2024 (70 O.S. Supp. 2024,
88	88		Section 2603), is amended to read as follows:
89	89		Section 2603. A. Except as otherwise provided for in
90	90		subsection B of this section and elsewhere in this section, to be
91	91		eligible to participate in the Oklahoma Higher Learning Access
92	92		Program and to qualify for an award which includes payment of an

144	144		amount equivalent to resident tuition or other tuition pursuant to
145	145		Section 2604 of this title for the first semester or other academic
146	146		unit of postsecondary enrollment, a student shall:
147	147		1. Be a resident of this state or be e nrolled in a school
148	148		district located in this state that serves students who reside in
149	149		both this state and an adjacent state pursuant to a contract as
150	150		authorized in Section 5 -117.1 of this title;
151	151		2. Be a United States citizen or lawfully present in the United
152	152		States. A student who is not a United States citizen or lawfully
153	153		present in the United States shall not be eligible to participate in
154	154		the Oklahoma Higher Learning Access Pro gram and to qualify for an
155	155		award notwithstanding the provisions of Section 324 2 of this title.
156	156		The provisions of this paragraph shall not apply to any student who
157	157		was enrolled in the Oklahoma Higher Learning Access Program prior to
158	158		the end of the 2006-2007 school year;
159	159		3. Have a record of satisfactory compliance with agreements
160	160		executed pursuant to Section 2605 of this title;
161	161		4. a. have graduated within the previous three (3) years
162	162		from a high school accredited by the State Board of
163	163		Education or the Oklah oma School of Science and
164	164		Mathematics with a minimum 2.5 cumulative grade poin t
165	165		average on a 4.0 scale for all work attempted in
166	166		grades nine through twelve,

219	219		from a high school not accredited by the Stat e Board
220	220		of Education with a minimum 2.5 cumulative grade point
221	221		average on a 4.0 scale for all work attempted in
222	222		grades nine through twelve and have achieved a
223	223		composite score of 22 or higher on the ACT test, or
224	224		c. have satisfactorily completed within the p revious
225	225		three (3) years an educational program that was
226	226		provided through a mea ns other than a public or
227	227		private school and have achieved a composite score of
228	228		22 or higher on the ACT test;
229	229		5. Have completed the curricular requirements for admission to
230	230		an institution within The Oklahoma State System of Higher Education.
231	231		Students shall also have attained a 2.5 grade point average in the
232	232		core curriculum courses. Students who attended a high school which
233	233		did not offer all the core curriculum courses or studen ts who were
234	234		educated by other means and were not offered all the core curricul um
235	235		courses shall be allowed to satisfy this curriculum requirement by
236	236		participating in a program approved by the Oklahoma State Regents
237	237		for Higher Education for remediation of hi gh school curricular
238	238		deficiencies;
239	239		6. Have satisfied admission standards as determined by the
240	240		Oklahoma State Regents for Higher Education for first -time-entering
241	241		students for the appropriate type of institution, or, if attending a

294	294		determined by the private institution. No student participating in
295	295		the Oklahoma Higher Learning Access Program shall be admitted into
296	296		an institution of higher education by special admission standards;
297	297		7. Have secured admission to, and enrolled in, an institution
298	298		which is a member of The Oklahoma State System of Higher Education,
299	299		a postsecondary vocational -technical program offered by a technology
300	300		center school that meets the requirements to be eligible for federal
301	301		student financial aid, or a private institution of higher learning
302	302		located within this state and accredited pursuant to Section 4103 of
303	303		this title; and
304	304		8. a. have established financial need according to the
305	305		provisions of subsection D of Section 2605 of this
306	306		title and standards and provisions promulgated by the
307	307		Oklahoma State Regents for Higher Education,
308	308		b. if the student was adopted between birth and twelve
309	309		(12) years of age while in the permanent custody of
310	310		the Department of Human Services, in the court -ordered
311	311		custody of a licensed private nonprofit child -placing
312	312		agency, or federally re cognized Indian tribe, as
313	313		defined by the federal Indian Child Welfare Act, have
314	314		established financial need according to the provisions
315	315		of paragraph 1 of subsection E of Section 2 605 of this

368	368		Oklahoma State Regents for Higher Education,
369	369		c. if the student was adopted between thirteen (13) and
370	370		seventeen (17) years of age while in the permanent
371	371		custody of the Department of Human Ser vices, in the
372	372		court-ordered custody of a licensed private nonprofit
373	373		child-placing agency, or federally recognized Indian
374	374		tribe, as defined by the federal Indian Child Welfare
375	375		Act, have established financial need according to the
376	376		provisions of paragraph 2 o f subsection E of Section
377	377		2605 of this title and standards and provisions
378	378		promulgated by the Oklahoma State Regents for Higher
379	379		Education, or
380	380		d. if the student was placed in the custody of the
381	381		Department of Human Services at any time during the
382	382		eighth, ninth, tenth, or eleventh grades and enrolls
383	383		in the program no later than his or h er official date
384	384		of high school graduation, have established financial
385	385		need according to the provisions of paragraph 3 of
386	386		subsection E of Section 2605 of this title and
387	387		standards and provisions promulgated by the Oklahoma
388	388		State Regents for Higher Education , or
389	389		e. if the student is the child of a public school
390	390		employee who has been employed as a public school

442	442		employee for at least five (5) consecutive years . For
443	443		the purposes of this paragraph, "public school
444	444		employee" means any teacher, librarian, certified or
445	445		registered nurse, or support employee whose salary is
446	446		paid wholly or in part from public funds. The term
447	447		"teacher" shall also include instructors and
448	448		counselors employed by the Department of Corrections
449	449		and holding valid teaching certificates issued by the
450	450		State Department of Education .
451	451		B. 1. A student shall be eligible to participate in the
452	452		Oklahoma Higher Learning Access Program and to qualify for an award
453	453		which includes payment of an amount equivalent to resident tuition
454	454		or other tuition pursuant to Section 2604 of this title for the
455	455		first semester or other academic unit of postsecondary enrollment if
456	456		the student meets all of the following criteria:
457	457		a. is a child of any person killed after January 1, 2000,
458	458		in the line of duty in any branch of the United States
459	459		Armed Forces or who died after January 1, 2000, as a
460	460		result of an injury sustained while in the line of
461	461		duty in any branch of the United States Armed Forces
462	462		and the person who was killed or died filed an
463	463		individual or joint Oklahoma income tax return for the
464	464		tax year prior to the year during which the person was
465	465		killed or died,

518	518		district located in this state th at serves students
519	519		who reside in both this state and an adjacent state
520	520		pursuant to a contract as authorized in Section 5 -

522	522		c. enrolls in an institution within The Oklahoma State
523	523		System of Higher Education prior to reaching the age
524	524		of twenty-one (21),
525	525		d. has satisfied admission standards as determined by the
526	526		Oklahoma State Regents for Higher Education for first -
527	527		time-entering students for the appropriate type of
528	528		institution, or, if attending a private institution,
529	529		has satisfied admission st andards as determined by the
530	530		private institution. No student participating in the
531	531		Oklahoma Higher Learning Access Program shall be
532	532		admitted into an institution of higher education by
533	533		special admission standards,
534	534		e. has secured admission to, and enrolled i n, an
535	535		institution which is a member of The Oklahoma State
536	536		System of Higher Edu cation, a postsecondary
537	537		vocational-technical program offered by a technology
538	538		center school that meets the requirements to be
539	539		eligible for federal student financial aid, or a
540	540		private institution of higher learning located within

593	593		this title, and
594	594		f. executes an agreement pursuant to subsection C of
595	595		Section 2605 of this title.
596	596		2. A student who is eligible to participate in the pro gram
597	597		pursuant to this subsection shall not be required to meet the
598	598		eligibility requirements set forth in subsection A of this section.
599	599		C. To retain eligibility while pursuing the program of higher
600	600		learning in which enrolled, the student shall:
601	601		1. Meet the requirements for retention and degree completion as
602	602		established by the institution in which the student is enrolled;
603	603		2. Maintain good academic standing and satisfactory academic
604	604		progress according to standards of the Oklahoma State Regents for
605	605		Higher Education;
606	606		3. Maintain satisfactory academic progress as required for
607	607		eligibility for federal Title IV student financial aid programs.
608	608		The provisions of this paragraph shall become effective for the
609	609		2012-2013 school year;
610	610		4. Comply with the standards rela ted to maintenance of
611	611		eligibility as promulgated by the Oklahoma State Regents for Higher
612	612		Education; and
613	613		5. Refrain from conduct that leads to expulsion or suspension
614	614		of more than one semester from an institution of higher education.
615	615		A student who violat es the provisions of this paragraph shall

667	667		permanently lose eligibility for pro gram benefits. The provisions
668	668		of this paragraph shall become effective January 1, 2008.
669	669		D. The Oklahoma State Regents for Higher Education and the
670	670		State Board of Career and Tec hnology Education shall promulgate
671	671		rules relating to maintenance of eligibility under the Oklahoma
672	672		Higher Learning Access Act by a student.
673	673		E. It is the intent of the Legislature that students in the
674	674		ninth grade for the 1992 -93 school year who are determi ned to be
675	675		eligible Oklahoma Higher Learning Access students pursuant to the
676	676		Oklahoma Higher Learning Access Act shall be the first students
677	677		eligible for benefits from the Oklahoma Higher Learning Access Trust
678	678		Fund.
679	679		F. The Oklahoma State Regents for Higher Education are
680	680		authorized to study, develop, and propose criteria for determining
681	681		award eligibility based upon the completion of seven semesters of
682	682		high school coursework by a student.
683	683		SECTION 2. AMENDATORY 70 O.S. 2021, Section 2 605, as
684	684		last amended by Section 2, Chapter 274, O.S.L. 2024 (70 O.S. Supp.
685	685		2024, Section 2605), is amended to read as follows:
686	686		Section 2605. A. Each school year, every fifth - through
687	687		eleventh-grade student in the public and private schools of this
688	688		state and students who are educated by other means and are in the
689	689		equivalent of the fifth through eleventh grade shall be apprised,
690	690		together with the parent, custodial parent, or guardian of the

742	742		student, of the opportunity for access to higher learning under the
743	743		Oklahoma Higher Learning Access Program. The Oklahoma State Regents
744	744		for Higher Education and the State Board of Education shall develop,
745	745		promote, and coordinate a public awareness program to be utilized in
746	746		making students and parents aware of the Oklahom a Higher Learning
747	747		Access Program.
748	748		B. On a form provided by the Oklahoma State Regents for Higher
749	749		Education, every public school district shall designate at least one
750	750		Oklahoma Higher Learning Access Program contact person, who shall be
751	751		a counselor or teach er, at each public school site in this state in
752	752		which eighth-, ninth-, tenth-, or eleventh-grade classes are taught.
753	753		When requested by the State Regents, the State Board of Education
754	754		shall assist the State Regents to ensure the designation of contact
755	755		persons. Private schools shall also designate at least one school
756	756		official as a contact person. For students who are educated by
757	757		other means, a parent or guardian or other person approved by the
758	758		State Regents shall be designated the contact person.
759	759		C. 1. Students who qualify on the basis of financial need
760	760		according to subsection D o r E of this section or who meet the
761	761		eligibility qualification set forth in subparagraph a of paragraph 1
762	762		of subsection B of Section 2603 of this title prior to entering the
763	763		eleventh grade or prior to reaching the age of sixteen (16) and the
764	764		standards and provisions promulgated by the Oklahoma State Regents
765	765		for Higher Education shall be given the opportunity throughout the

817	817		eighth-, ninth-, tenth-, and eleventh-grade years, for stud ents
818	818		enrolled in a public or private school, or between the ages of
819	819		thirteen (13) and sixteen (16), for students who are educated by
820	820		other means, to enter into participation in the program by agreeing
821	821		to, throughout the remainder of their school years or e ducational
822	822		program:
823	823		a. attend school or an educational program regularly and
824	824		do homework regularly,
825	825		b. refrain from substance abuse,
826	826		c. refrain from commission of crimes or delinquent acts,
827	827		d. have school work and school records reviewed by
828	828		mentors designated pursuant to the program,
829	829		e. provide information requested by the Oklahoma State
830	830		Regents for Higher Education or the State Board of
831	831		Education, and
832	832		f. participate in program activities.
833	833		2. Students who meet the eligibility qualification set forth in
834	834		subparagraph a of paragraph 1 of subsection B of Section 2603 of
835	835		this title after completing the eleventh grade or after reaching the
836	836		age of seventeen (17) shall be given the opportunity prior to
837	837		reaching the age of twenty -one (21) to enter into participation in
838	838		the program and shall execute an agreement with provisions as
839	839		determined by the Oklahoma State Regents for Higher Education.

891	891		3. The contact person shall maintain the agreements, which
892	892		shall be executed on forms provided by the Oklahoma State Regents
893	893		for Higher Education and managed according to regulations
894	894		promulgated by the Oklahoma State Regents for Higher Education, and
895	895		the contact person shall monitor compliance of the student with the
896	896		terms of the agreement. The Oklahoma State Regents for Higher
897	897		Education are authorized to process student agreements and verify
898	898		compliance with the agreements. Students failing to comply with the
899	899		terms of the agreement shall not be eligible for the awards provided
900	900		in Section 2604 of this title.
901	901		D. Except as otherwi se provided for in subsection E of this
902	902		section and except for students who qualify pursuant to subsection B
903	903		of Section 2603 of this title, a student shall not be found to be in
904	904		financial need for purposes of the Oklahoma Higher Learning Access
905	905		Program if:

974	974		2022-2023 school year:
975	975		a. the federal adjusted gross income of the student 's
976	976		parent(s), who have two or fewer dependent children,
977	977		exceeds Sixty Thousand Dollars ($60,000.00) per year,
978	978		b. the federal adjusted gross income of the student's
979	979		parent(s), who have three or four dependent children,
980	980		exceeds Seventy Thousand Dollars ($70,000.00) per
981	981		year, or
982	982		c. the federal adjusted gross income of the student 's
983	983		parent(s), who have five or more dependent children,
984	984		exceeds Eighty Thousand Dollars ($80,000.00) per year;
985	985		4. Beginning with the 2018 -2019 academic year, prior to
986	986		receiving any Oklahoma Higher Learning Access Program benefit award
987	987		for any year during which the student is enrolled in an institution
988	988		which is a member of The O klahoma State System of Higher Education,
989	989		a postsecondary vocational -technical program offered by a technology

1044	1044		this title, the federal adjusted gross income of the student 's
1045	1045		parent(s) exceeds One Hundred Thousand Dollars ($100,000.00) per
1046	1046		year.
1047	1047		The determination of financial qualification as set forth in
1048	1048		this paragraph shall be based on the income of the student, not the
1049	1049		income of the parent(s), if a student:
1050	1050		a. is determined to be independent of the student 's
1051	1051		parents for federal financial aid purposes,
1052	1052		b. was in the permanent custody of the Department of
1053	1053		Human Services at the time the student enrolled in the
1054	1054		program, or
1055	1055		c. was in the court-ordered custody of a federally
1056	1056		recognized Indian tribe, as defined by the federal
1057	1057		Indian Child Welfare Act, at the time the student
1058	1058		enrolled in the program.
1059	1059		The provisions of this paragraph shall apply to any student who
1060	1060		has received an Oklahoma Higher Learning Access Program benefit
1061	1061		award after the 2017 -2018 school year; and
1062	1062		5. The Oklahoma State Regents for Higher Education shall review
1063	1063		the determination of financial qu alification as set forth in
1064	1064		paragraphs 1, 2, and 3 of this subsection if the i ncome from taxable

1123	1123		disability of the student 's parent(s), does not exceed the
1124	1124		limitations set forth by paragraphs 1, 2, and 3 of this subsection,
1125	1125		the student shall be determined to have met the financial
1126	1126		qualification set forth i n paragraphs 1, 2, and 3 of this
1127	1127		subsection.
1128	1128		E. 1. A student who was adopted between birth and twelve (12)
1129	1129		years of age while in the permanent custody of the Department of
1130	1130		Human Services, in the court -ordered custody of a licensed private
1131	1131		nonprofit child-placing agency, or federally recognized Indian
1132	1132		tribe, as defined by the feder al Indian Child Welfare Act, shall not
1133	1133		be found to be in financial need for purposes of the Oklahoma Higher
1134	1134		Learning Access Program if at the time the student begins
1135	1135		postsecondary education and prior to receiving any Oklahoma Higher
1136	1136		Learning Access Program benefit award, the federal adjusted gross
1137	1137		income of the student 's parent(s) exceeds One Hundred Fifty Thousand
1138	1138		Dollars ($150,000.00) per year. The provisions of this paragraph
1139	1139		shall not apply to any student who has received an Oklahoma Higher

1197	1197		recognized Indian tribe, as defined by the federal Indian Child
1198	1198		Welfare Act, shall not be found to be in financial need for purposes
1199	1199		of the Oklahoma Higher Learning Access Program if at the time the
1200	1200		student begins postsecondary education and prior to receiving any
1201	1201		Oklahoma Higher Learning Access Program benefit award, the federal
1202	1202		adjusted gross income of the student 's parent(s) exceeds Two Hundred
1203	1203		Thousand Dollars ($200,000.00) per year. The provisions of this
1204	1204		paragraph shall not apply to any student who has received an
1205	1205		Oklahoma Higher Learning Access Program benefit award prior to the
1206	1206		2012-2013 school year.
1207	1207		3. A student who was placed in the custody of the Department of
1208	1208		Human Services at any time duri ng the eighth, ninth, tenth, or
1209	1209		eleventh grades and enrolls in the program no later than his or her
1210	1210		official date of high school graduation shall not be found to be in
1211	1211		financial need for purposes of the Oklahoma Higher Learning Access
1212	1212		Program if the federal adjusted gross income of the student exceeds
1213	1213		Sixty Thousand Dollars ($60,000.00) per year.

1270	1270		for federal financia l aid purposes. A determination of financial
1271	1271		qualification shall not be required for the student who meets the
1272	1272		criteria set forth in this subsection at the time the student
1273	1273		applies for participation in the program. The provisions of this
1274	1274		paragraph shall not apply to any student who has received an
1275	1275		Oklahoma Higher Learning Access P rogram benefit award prior to the
1276	1276		2008-2009 school year.
1277	1277		5. a. A determination of financial qualification is not
1278	1278		required for a student who is the child of a public
1279	1279		school employee at the time the student applies for
1280	1280		participation in the Oklahoma Higher Learning Access
1281	1281		Program and prior to receiving any Oklahoma Higher
1282	1282		Learning Access Program benefit award for any year
1283	1283		during which the student is enrolled in an institution
1284	1284		which is a member of The Oklahoma State System of
1285	1285		Higher Education, a postsecondary v ocational-technical
1286	1286		program offered by a technology center school that
1287	1287		meets the eligibility requirements for federal student
1288	1288		financial aid, or a private institution of higher

1344	1344		the student's parent(s) prior to the student rec eiving
1345	1345		any Oklahoma Higher Learning Access Program benefit
1346	1346		award. The provisions of this paragraph shall apply
1347	1347		to eighth-, ninth-, or tenth-grade students who are
1348	1348		enrolled in a public or private school or students
1349	1349		between the ages of thirteen (13) and fif teen (15) who
1350	1350		are educated by other means who apply for
1351	1351		participation in the program after the 202 4-2025
1352	1352		school year.
1353	1353		b. For the purposes of this paragraph, "public school
1354	1354		employee" means any teacher, librarian, certified or
1355	1355		registered nurse, or support employee whose salary is
1356	1356		paid wholly or in part from public funds. The term
1357	1357		"teacher" shall also include instructors and
1358	1358		counselors employed by the Department of Corrections
1359	1359		and holding valid teaching certificates issued by the
1360	1360		State Department of Education .
1361	1361		F. The financial qualification of a student as set forth in
1362	1362		subsections D and E of this section shall be certified by the
1363	1363		contact person or by the Oklahoma State Regents for Higher Education

1419	1419		G. Agreements shall be witnessed by the parent, custodial
1420	1420		parent, or guardian of the student, who shall further agree to:
1421	1421		1. Assist the student in achieving compliance with the
1422	1422		agreements;
1423	1423		2. Confer, when requested to do so, with the school contact
1424	1424		person, other school personnel, and program mentors;
1425	1425		3. Provide information requested by the Oklah oma State Regents
1426	1426		for Higher Education or the State Board of Education; and
1427	1427		4. Assist the student in completing forms and reports required
1428	1428		for program participation, making applications to institutions and
1429	1429		schools of higher learning, and filing applicatio ns for student
1430	1430		grants and scholarships.
1431	1431		H. The Oklahoma State Regents for Higher Education shall
1432	1432		promulgate rules for the determination of student compliance with
1433	1433		agreements made pursuant to this section.
1434	1434		I. The Oklahoma State Regents for Higher Educatio n shall
1435	1435		designate personnel to coordinate tracking of program records for
1436	1436		the years when students participating in the program are still in
1437	1437		the schools or are being educated by other means, provide staff
1438	1438		development for contact persons in the schools, and provide liaison

1492	1492		J. The school district where an Oklahoma Higher Learning Access
1493	1493		Program student is enrolled when the student begins participation in
1494	1494		the program and any subsequent school district where the student
1495	1495		enrolls shall forward information regarding participation by the
1496	1496		student in the program to a school to which the student transfers
1497	1497		upon the request of the school for the records of the student.
1498	1498		K. Students participating in the Oklahoma Higher Learning
1499	1499		Access Program shall provide their Social Security number or their
1500	1500		student identification number used by their school to the Oklahoma
1501	1501		State Regents for Higher Education. The Regents shall keep th e
1502	1502		numbers confidential and use them only for administrative purposes.
1503	1503		SECTION 3. This act shall become effective July 1, 2025.
1504	1504		SECTION 4. It being immediately necessary for the preservation
1505	1505		of the public peace, health or s afety, an emergency is hereby
1506	1506		declared to exist, by reason whereof this act shall take effect and
1507	1507		be in full force from and after its passage and approval.
