51	50		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	51		SECTION 1. AMENDATORY 59 O.S. 2021, Section 396, as
53	52		amended by Section 1, Chapt er 32, O.S.L. 2023 (59 O.S. Supp. 2024,
54	53		Section 396), is amended to read as follows:
55	54		Section 396. There is hereby re -created, to continue until July
56	55		1, 2024 2026, in accordance with the provisions of the Oklahoma
57	56		Sunset Law, the Oklahoma Funeral Board. A ny reference in the
58	57		statutes to the Oklahoma State Board of Embalmers and Funeral
59	58		Directors shall be a reference to the Oklahoma Funeral Board. The
60	59		Board shall consist of seven (7) persons, who shall be appointed by
61	60		the Governor. The term of membership o f each member of the Board
62	61		shall be five (5) years from the expiration of the term of the
63	62		member succeeded. Any member having served as a member of the Board

91	89		shall be eligible for reappointment. Provided that, a member of the
92	90		Board shall serve no more th an two consecutive terms and any
93	91		unexpired term that a member is appointed to shall not ap ply to this
94	92		limit. The Governor shall appoint the necessary members to the
95	93		Board upon vacancies and immediately prior to the expiration of the
96	94		various terms. Upon r equest of the Governor, appointments of a
97	95		licensed embalmer and funeral director member of the Board shall be
98	96		made from a list of five qualified persons submitted by the Oklahoma
99	97		Funeral Directors Association. An appointment to fill a vacancy
100	98		shall be for the unexpired term. A member of the Board shall serve
101	99		until a successor is appointed and qualified. No person shall be a
102	100		member of the Board, unless, at the time of appointment, the person
103	101		is of good moral character and a resident of this state. Five o f
104	102		the members shall have been actively engaged in the practice of
105	103		embalming and funeral directing in this state for not less than
106	104		seven (7) consecutive years immediately prior to the appointment of
107	105		the person, shall have an active license as provided by th e Funeral
108	106		Services Licensing Act, shall keep the license effective, and remain
109	107		a resident of this state during the entire time the person serves on
110	108		the Board. Two of the members of the Board shall be chosen from the
111	109		general public, one of whom shall, if p ossible, be a person licensed
112	110		and actively engaged in the health care field, and shall not be
113	111		licensed funeral directors or embalmers or have any interest,
114	112		directly or indirectly, in any funeral establishment or any business
