40	40		An Act relating to the State Board of Education;
41	41		amending 70 O.S. 2021, Section 3 -101, as amended by
42	42		Section 1, Chapter 182, O.S.L. 2023 (70 O.S. Supp.
43	43		2024, Section 3-101), which relates to board member
44	44		appointments; changing the appointing authority for
45	45		most members; establishing for -cause removal
46	46		procedures; eliminating reference to service at the
47	47		pleasure of the Governor; modifying vacancy
48	48		procedures; vacating current members; directing
49	49		initial appointments; providing initial appointment
50	50		terms; and declaring an emergency.

56	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	57		SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -101, as
58	58		amended by Section 1, Chapter 182, O.S.L. 2023 (70 O.S. Supp. 2024,
59	59		Section 3-101), is amended to read as follows:
60	60		Section 3-101. A. The State Board of Education shall consist
61	61		of seven (7) members. The State Superintend ent of Public
62	62		Instruction shall be a member and the chairperson of the Board. The
63	63		remaining six members shall be appointed by the Governor by and with
64	64		the advice and consent of the Senate. Except as otherwise provided
65	65		for in subsection B of this section, upon assuming office each

92	92		Governor shall appoint one member from each congressional district
93	93		and one member from the state at large Two members shall be
94	94		appointed by the Speaker of the House of Representatives, two
95	95		members shall be appointed by the Presid ent Pro tempore of the
96	96		Senate, and two members shall be appointed by the Gover nor. Each
97	97		appointment shall be made to take effect on April 2. The term of
98	98		each appointed member shall be four (4) years. Appointed members
99	99		shall serve until a successor is ap pointed. Appointed members shall
100	100		serve at the pleasure of the Governor only be removed for cause by
101	101		their appointing authority . Upon the occurrence of a vacancy the
102	102		same shall be filled by the Governor, subject to confirmation by the
103	103		Senate at the next s ession of the Legislature in the same manner as
104	104		the original appointment . The appointment to fill a vacancy shall
105	105		be made for the unexpired term.
106	106		B. On the effective date of this act, all appointed positions
107	107		of the current State Board of Education shall be deemed vacant and
108	108		the terms of persons serving on the Board shall be deemed
109	109		terminated. The Speaker of the House of Representatives, the
110	110		President Pro Tempore of the Senate, and the Governor shall each
111	111		make two initial appointments pursuant to the prov isions of this
112	112		subsection within thirty (30) days of the effective date of thi s
113	113		act, with one member appointed from each congressional district and
114	114		one member appointed from the state at large. The appointments
115	115		shall be subject to confirmation by the Sena te at the next session

142	142		of the Legislature. The terms for members appointed pursuant to
143	143		this subsection shall terminate on April 2, 2015 2029. Thereafter,
144	144		members shall be appointed as provided for in subsection A of this
145	145		section.
146	146		C. No person shall be e ligible to be appointed to serve on the
147	147		Board unless the person has been award ed a high school diploma or
148	148		certificate of high school equivalency. No person shall be
149	149		appointed to serve on the Board if the person serves on a board of
150	150		education of a school d istrict which is supervised by the Board
151	151		pursuant to Section 3 -104 of this title. Any member appointed to
152	152		the Board shall complete the workshop requirements of a new school
153	153		board member pursuant to Section 5 -110 of this title within thirteen
154	154		(13) months following or preceding the appointment of the member.
155	155		Notwithstanding any prov ision of law to the contrary, the State
156	156		Department of Education shall not charge any member of the State
157	157		Board of Education a fee for any workshop provided by the Department
158	158		for board members pursuant to Section 5 -110 of this title and shall
159	159		not pay a fee to any organization or institution of higher education
160	160		on behalf of a member of the State Board of Education, or reimburse
161	161		any member of the Board for a fee paid to any organizat ion or
162	162		institution of higher education, for attendance at a workshop or
163	163		courses to satisfy the requirements of Section 5 -110 of this title.

190	190		D. Members of the Board shall receive necessary traveling
191	191		expenses while in the performance of their duties in acco rdance with
192	192		the State Travel Reimbursement Act.
193	193		SECTION 2. It being immediately necessary for the preservation
194	194		of the public peace, health or safety, an emergency is hereby
195	195		declared to exist, by reason whereof this act shall take effect an d
196	196		be in full force from and after its passage and approval.
