4040 An Act relating to the State Board of Education;
4141 amending 70 O.S. 2021, Section 3 -101, as amended by
4242 Section 1, Chapter 182, O.S.L. 2023 (70 O.S. Supp.

4545 most members; establishing for -cause removal
4646 procedures; eliminating reference to service at the
4747 pleasure of the Governor; modifying vacancy
4848 procedures; vacating current members; directing
4949 initial appointments; providing initial appointment

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -101, as
5858 amended by Section 1, Chapter 182, O.S.L. 2023 (70 O.S. Supp. 2024,
5959 Section 3-101), is amended to read as follows:
6060 Section 3-101. A. The State Board of Education shall consist
6161 of seven (7) members. The State Superintend ent of Public
6262 Instruction shall be a member and the chairperson of the Board. The
6363 remaining six members shall be appointed by the Governor by and with
6464 the advice and consent of the Senate. Except as otherwise provided
6565 for in subsection B of this section, upon assuming office each

9292 Governor shall appoint one member from each congressional district
9393 and one member from the state at large Two members shall be
9494 appointed by the Speaker of the House of Representatives, two
9595 members shall be appointed by the Presid ent Pro tempore of the
9696 Senate, and two members shall be appointed by the Gover nor. Each
9797 appointment shall be made to take effect on April 2. The term of
9898 each appointed member shall be four (4) years. Appointed members
9999 shall serve until a successor is ap pointed. Appointed members shall
100100 serve at the pleasure of the Governor only be removed for cause by
101101 their appointing authority . Upon the occurrence of a vacancy the
102102 same shall be filled by the Governor, subject to confirmation by the
103103 Senate at the next s ession of the Legislature in the same manner as
104104 the original appointment . The appointment to fill a vacancy shall
105105 be made for the unexpired term.
106106 B. On the effective date of this act, all appointed positions
107107 of the current State Board of Education shall be deemed vacant and
108108 the terms of persons serving on the Board shall be deemed
109109 terminated. The Speaker of the House of Representatives, the
110110 President Pro Tempore of the Senate, and the Governor shall each
111111 make two initial appointments pursuant to the prov isions of this
112112 subsection within thirty (30) days of the effective date of thi s
113113 act, with one member appointed from each congressional district and
114114 one member appointed from the state at large. The appointments
115115 shall be subject to confirmation by the Sena te at the next session

142142 of the Legislature. The terms for members appointed pursuant to
143143 this subsection shall terminate on April 2, 2015 2029. Thereafter,
144144 members shall be appointed as provided for in subsection A of this
145145 section.
146146 C. No person shall be e ligible to be appointed to serve on the
147147 Board unless the person has been award ed a high school diploma or
148148 certificate of high school equivalency. No person shall be
149149 appointed to serve on the Board if the person serves on a board of
150150 education of a school d istrict which is supervised by the Board
151151 pursuant to Section 3 -104 of this title. Any member appointed to
152152 the Board shall complete the workshop requirements of a new school
153153 board member pursuant to Section 5 -110 of this title within thirteen
154154 (13) months following or preceding the appointment of the member.
155155 Notwithstanding any prov ision of law to the contrary, the State
156156 Department of Education shall not charge any member of the State
157157 Board of Education a fee for any workshop provided by the Department
158158 for board members pursuant to Section 5 -110 of this title and shall
159159 not pay a fee to any organization or institution of higher education
160160 on behalf of a member of the State Board of Education, or reimburse
161161 any member of the Board for a fee paid to any organizat ion or
162162 institution of higher education, for attendance at a workshop or
163163 courses to satisfy the requirements of Section 5 -110 of this title.

190190 D. Members of the Board shall receive necessary traveling
191191 expenses while in the performance of their duties in acco rdance with
192192 the State Travel Reimbursement Act.
193193 SECTION 2. It being immediately necessary for the preservation
194194 of the public peace, health or safety, an emergency is hereby
195195 declared to exist, by reason whereof this act shall take effect an d
196196 be in full force from and after its passage and approval.
