54 | 54 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

55 | 55 | | SECTION 1. NEW LAW A new section of law not to be |
---|
56 | 56 | | codified in the Oklahoma Statutes reads as follows: |

57 | 57 | | This act shall be known and may be cited as the "Anti-Fungi Act |

59 | 59 | | SECTION 2. AMENDATORY 41 O.S. 2021, Section 118, is |

99 | 99 | | 4. Make repairs in a timely manner with respect to the |
---|
100 | 100 | | situation or as outlined by th e leasing agreement; |
---|
101 | 101 | | 5. If mold is present in or around the dwelling unit, the |
---|
102 | 102 | | landlord must begin appropriate mold treatment within three (3) |
---|
103 | 103 | | business days of a report being ma de and complete treatment no more |
---|
104 | 104 | | than seven (7) business days beginning after the first day of |
---|
105 | 105 | | treatment; |
---|
106 | 106 | | 6. Except in the case of one - or two-family residences or where |
---|
107 | 107 | | provided by a governmental entity, provide and maintain appropriate |
---|
108 | 108 | | receptacles and conveniences for the removal of ashes, garbage, |
---|
109 | 109 | | rubbish and other waste incide ntal to the occupancy of the dwelling |
---|
110 | 110 | | unit and arrange for the frequent removal of such wastes; and |
---|
111 | 111 | | 5. 7. Except in the case of a single -family residence or where |
---|
112 | 112 | | the service is supplied by direct and independently metered utility |
---|

---|
140 | 140 | | reasonable amounts of hot water at all times and reasonable heat. |
---|
141 | 141 | | B. The landlord and tenant of a dwelling unit may agree by a |
---|
142 | 142 | | conspicuous writing independent of the rental agreement that the |
---|
143 | 143 | | tenant is to perform specifi ed repairs, maintenance tasks, |
---|
144 | 144 | | alterations or remodeling. |
---|
145 | 145 | | C. Prior to the commencement of a rental agreement, if a |
---|
146 | 146 | | landlord knows or has reason to know that the dwelling unit or any |
---|
147 | 147 | | part of the premises was used in the manufacture of methamphetamine, |
---|
148 | 148 | | the landlord shall disclose this information to a prospective |
---|
149 | 149 | | tenant. Provided however, if the landlord has had the level of |
---|
150 | 150 | | contamination assessed within the dwelling unit or perti nent part of |
---|
151 | 151 | | the premises, and it has been determined that the level of |
---|
152 | 152 | | contamination does not exceed one -tenth of one microgram (0.1 mcg) |
---|
153 | 153 | | per one hundred square centimeters (100 cm2) of surface materials |
---|
154 | 154 | | within the dwelling unit or pertinent part of the p remises, no |
---|
155 | 155 | | disclosure shall be required. |
---|
156 | 156 | | D. A landlord found in violation paragraph 5 of subsection A of |
---|
157 | 157 | | this act shall be subject to: |
---|
158 | 158 | | 1. Coverage of tenant medical bill that arise from mold |
---|
159 | 159 | | allergies or other conditions proven to have exacerbated by |
---|
160 | 160 | | prolonged exposure to mold spores; and |
---|
161 | 161 | | 2. A fine not to exceed One Thousand Dollars ($1,000.00) |
---|
