4538 An Act relating to public health and safety; defining
4639 terms; prohibiting the misbranding of food;
4740 prohibiting the distribution of, offer for sale, and
4841 the selling of any falsely advertised or misbranded
4942 food; providing when food is misbranded; providing
5043 when a manufactured-protein food product is falsely
5144 advertised; requiring the Department of Agriculture,
5245 Food, and Forestry to investigate all credible claims
5346 of misbranded or falsely advertised food; providing
5447 punishment for violation; providing the Department of
5548 Agriculture, Food, and Forestry certain rulemaking
5649 authority; providing for codification; and providing
5750 an effective date.

6356 BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:
6457 SECTION 1. NEW LAW A new section of law to be codified
6558 in the Oklahoma Statutes as Section 1 -1150 of Title 63, unless there
6659 is created a duplication in numbering, reads as follows:
6760 A. As used in this act:
61+1. "Agricultural food animal" means any domesticated animal
62+belonging to the bovine, caprine, ovine, or porcine species, or any
63+domesticated chicken or turkey;
64+2. "Cultivated-protein food product" means a food product
65+having one or more sensory attributes that resemble a type of tissue

95-1. "Agricultural food animal" means any domesticated animal
96-belonging to the bovine, caprine, ovine, or porcine species, or any
97-domesticated chicken or turkey;
98-2. "Cultivated-protein food product" means a food produc t
99-having one or more sensory attributes that resemble a type of tissue
10092 originating from an agricultural food animal but that, in lieu of
10193 being derived from meat processing, is derived from manufacturing
10294 cells or nonanimal sources, including processes in which one or more
10395 stem cells are initiall y isolated from an agricultural food animal,
10496 are grown in vitro, and may be manipulated, as part of a
10597 manufacturing operation;
10698 3. "Identifying meat term" means any word or phrase that
10799 states, indicates, suggests, or desc ribes a meat product and
108100 includes any:
109101 a. common name for the species of the agricultural food
110102 animal subject to slaughter and processing, including
111103 calf, chicken, cow, goat, hog, kid, lamb, pig,
112104 poultry, sheep, or turkey,
113105 b. any characteristic of a species of the agricultural
114106 food animal subject to slaughter and processing,
115107 including beef, broiler, cabrito, chevon, fryer, lamb,
116108 mutton, pork, poulet, veal, or yearling, and
117109 c. common name used to describe a major cut of a meat of
118110 an agricultural food animal slaughtered and processed,
111+including a major meat cut or any other common name
112+that a reasonable purchaser would immediately and
113+exclusively associate with a meat product prepared for
114+sale in normal commercial channels, including bacon,
115+bologna, bone, brat, bratwurst, brisket, burger, butt,

147-that a reasonable purchaser would immediately and
148-exclusively associate with a meat product prepared for
149-sale in normal commercial channels, including bacon,
150-bologna, bone, brat, bratwurst, brisket, burger, butt,
151142 chop, chuck, cold cut, cutlet, filet, flat iron,
152143 frank, frankfurter, ham, hamburger, hock, hot dog,
153144 jerky, liverwurst, loin, London broil, lunch meat, New
154145 York strip, pepperoni, porterhouse, rib, ribeye,
155146 roast, salami, sausage, shank, sirloin, sparerib,
156147 tenderloin, or any comparable word or phrase;
157148 4. "Insect-protein food product" means a food product having
158149 one or more sensory attributes that resemble a type of tissue
159150 originating from an agricultural food animal but that, in lieu of
160151 being derived from me at processing, is derived from manufacturing
161152 insect parts;
162153 5. "Manufactured-protein food product" means a cultivated
163154 protein food product, insect -protein food product, or plant -protein
164155 food product containing more than a trace amount of plant -protein
165156 food products;
166157 6. "Plant-protein food product" means a food product having one
167158 or more sensory attributes that resemble a type of tissue found in a
168159 species of agricultural food animal but that, in lieu of being
160+derived from meat processing, is derived from ma nufacturing plant
161+parts; and
162+7. "Qualifying term" means a word, compound word, or phrase
163+that would clearly disclose to a reasonable purchaser of meat
164+products that a food product is not a meat product including cell -
165+cultivated, cell cultured, fake, grown in a lab, imitation, insect,

196-derived from meat processing, is derived from manufacturing plant
197-parts; and
198-7. "Qualifying term" means a word, compound word, or phrase
199-that would clearly disclose to a reasonable purchaser of meat
200-products that a food product is not a meat product including cell -
201-cultivated, cell cultured, fake, grown in a lab, imitation, insect,
202192 insect-based, insect protein, lab -created, lab-grown, meat-free,
203193 meatless, plant, plant -based, vegan, vegetable, vegetarian, veggie,
204194 or any comparable word or phrase.
205195 B. No person shall falsely advertise or misbrand any food or
206196 distribute, offer for sale, or sell any misbranded food.
207197 C. A food shall be deemed to be falsely advertised or
208198 misbranded if:
209199 1. For any manufactured -protein food product that is labeled
210200 with an identifying meat term , such manufactured-protein food
211201 product is not labeled with a conspicuous and prominent qualifying
212202 term in close proximity to the identifying meat term; or
213203 2. For any manufactured -protein food product that is labeled
214204 with an identifying meat term and offered for sale at a food
215205 establishment, such manufactured -protein food product is not labeled
216206 in a manner that is clearly and distinctly separate from any product
217207 that is made from tissue originating from any agricultural food
218208 animal.
209+D. A manufactured-protein food product is falsely advert ised or
210+misbranded if:
211+1. All labeling or advertising for such manufactured -protein
212+food product that lists an identifying meat term does not include a
213+conspicuous and prominent qualifying term in close proximity to the
214+identifying meat term; or

246-D. A manufactured-protein food product is falsely advertised or
247-misbranded if:
248-1. All labeling or advertising for such manufactured -protein
249-food product that lists an identifying meat term does not include a
250-conspicuous and prominent qualifying term in close proximity to the
251-identifying meat term; or
252241 2. For any manufactured-protein food product that is offered
253242 for sale at a food establishment, such manufactured -protein food
254243 product is not stored in a manner that:
255244 a. keeps such product separate from tissue originating
256245 from agricultural food animals, and
257246 b. uses distinctive shelf tags or other posted
258247 representations to identify and distinguish such
259248 manufactured-protein food product from tissue
260249 originating from agricultural food animals.
261250 E. The Department of Agriculture, Food, and Forestry shall
262251 investigate all credible complaints that food products are falsely
263252 advertised or misbranded as meat products.
264253 F. Any person who violates the provisions of this act shall,
265254 upon conviction, be guilty of a misdemeanor.
266255 G. A manufacturer of food under Sections 1 -1118, 1-1118.1, and
267256 1-1119 of Title 63 of the Oklahoma Statutes that violates this act
268257 shall be subject to all enforcement measures as provided by rule of
269258 the Department of Agriculture, Food, and Forestry .
259+H. The Department of Agriculture, Food, and Forestry may adopt
260+rules as necessary to implement this section.
261+SECTION 2. This act shall become effective November 1, 2025.

299-SECTION 2. This act shall become effective November 1, 2025.
