63 | 56 | | BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA: |

64 | 57 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
65 | 58 | | in the Oklahoma Statutes as Section 1 -1150 of Title 63, unless there |
---|
66 | 59 | | is created a duplication in numbering, reads as follows: |

67 | 60 | | A. As used in this act: |
---|
100 | 92 | | originating from an agricultural food animal but that, in lieu of |
---|
101 | 93 | | being derived from meat processing, is derived from manufacturing |
---|
102 | 94 | | cells or nonanimal sources, including processes in which one or more |
---|
103 | 95 | | stem cells are initiall y isolated from an agricultural food animal, |
---|
104 | 96 | | are grown in vitro, and may be manipulated, as part of a |
---|
105 | 97 | | manufacturing operation; |
---|
106 | 98 | | 3. "Identifying meat term" means any word or phrase that |
---|
107 | 99 | | states, indicates, suggests, or desc ribes a meat product and |
---|
108 | 100 | | includes any: |
---|
109 | 101 | | a. common name for the species of the agricultural food |
---|
110 | 102 | | animal subject to slaughter and processing, including |
---|
111 | 103 | | calf, chicken, cow, goat, hog, kid, lamb, pig, |
---|
112 | 104 | | poultry, sheep, or turkey, |
---|
113 | 105 | | b. any characteristic of a species of the agricultural |
---|
114 | 106 | | food animal subject to slaughter and processing, |
---|
115 | 107 | | including beef, broiler, cabrito, chevon, fryer, lamb, |
---|
116 | 108 | | mutton, pork, poulet, veal, or yearling, and |
---|
117 | 109 | | c. common name used to describe a major cut of a meat of |
---|
118 | 110 | | an agricultural food animal slaughtered and processed, |
---|
| 111 | + | including a major meat cut or any other common name |
---|
| 112 | + | that a reasonable purchaser would immediately and |
---|
| 113 | + | exclusively associate with a meat product prepared for |

156 | 147 | | tenderloin, or any comparable word or phrase; |
---|
157 | 148 | | 4. "Insect-protein food product" means a food product having |
---|
158 | 149 | | one or more sensory attributes that resemble a type of tissue |
---|
159 | 150 | | originating from an agricultural food animal but that, in lieu of |
---|
160 | 151 | | being derived from me at processing, is derived from manufacturing |
---|
161 | 152 | | insect parts; |
---|
162 | 153 | | 5. "Manufactured-protein food product" means a cultivated |
---|
163 | 154 | | protein food product, insect -protein food product, or plant -protein |
---|
164 | 155 | | food product containing more than a trace amount of plant -protein |
---|
165 | 156 | | food products; |
---|
166 | 157 | | 6. "Plant-protein food product" means a food product having one |
---|
167 | 158 | | or more sensory attributes that resemble a type of tissue found in a |
---|
168 | 159 | | species of agricultural food animal but that, in lieu of being |
---|
| 160 | + | derived from meat processing, is derived from ma nufacturing plant |
---|
| 161 | + | parts; and |
---|
| 162 | + | 7. "Qualifying term" means a word, compound word, or phrase |

| 163 | + | that would clearly disclose to a reasonable purchaser of meat |

| 165 | + | cultivated, cell cultured, fake, grown in a lab, imitation, insect, |
---|
196 | | - | derived from meat processing, is derived from manufacturing plant |
---|
197 | | - | parts; and |
---|
198 | | - | 7. "Qualifying term" means a word, compound word, or phrase |
---|
199 | | - | that would clearly disclose to a reasonable purchaser of meat |
---|
200 | | - | products that a food product is not a meat product including cell - |
---|
201 | | - | cultivated, cell cultured, fake, grown in a lab, imitation, insect, |
---|
202 | 192 | | insect-based, insect protein, lab -created, lab-grown, meat-free, |
---|
203 | 193 | | meatless, plant, plant -based, vegan, vegetable, vegetarian, veggie, |
---|
204 | 194 | | or any comparable word or phrase. |
---|
205 | 195 | | B. No person shall falsely advertise or misbrand any food or |
---|
206 | 196 | | distribute, offer for sale, or sell any misbranded food. |
---|
207 | 197 | | C. A food shall be deemed to be falsely advertised or |
---|
208 | 198 | | misbranded if: |
---|
209 | 199 | | 1. For any manufactured -protein food product that is labeled |
---|
210 | 200 | | with an identifying meat term , such manufactured-protein food |
---|
211 | 201 | | product is not labeled with a conspicuous and prominent qualifying |
---|
212 | 202 | | term in close proximity to the identifying meat term; or |
---|
213 | 203 | | 2. For any manufactured -protein food product that is labeled |
---|
214 | 204 | | with an identifying meat term and offered for sale at a food |
---|
215 | 205 | | establishment, such manufactured -protein food product is not labeled |
---|
216 | 206 | | in a manner that is clearly and distinctly separate from any product |
---|
217 | 207 | | that is made from tissue originating from any agricultural food |
---|
218 | 208 | | animal. |
---|
252 | 241 | | 2. For any manufactured-protein food product that is offered |
---|
253 | 242 | | for sale at a food establishment, such manufactured -protein food |
---|
254 | 243 | | product is not stored in a manner that: |
---|
255 | 244 | | a. keeps such product separate from tissue originating |
---|
256 | 245 | | from agricultural food animals, and |
---|
257 | 246 | | b. uses distinctive shelf tags or other posted |
---|
258 | 247 | | representations to identify and distinguish such |
---|
259 | 248 | | manufactured-protein food product from tissue |
---|
260 | 249 | | originating from agricultural food animals. |
---|
261 | 250 | | E. The Department of Agriculture, Food, and Forestry shall |
---|
262 | 251 | | investigate all credible complaints that food products are falsely |
---|
263 | 252 | | advertised or misbranded as meat products. |
---|
264 | 253 | | F. Any person who violates the provisions of this act shall, |
---|
265 | 254 | | upon conviction, be guilty of a misdemeanor. |
---|
266 | 255 | | G. A manufacturer of food under Sections 1 -1118, 1-1118.1, and |
---|
267 | 256 | | 1-1119 of Title 63 of the Oklahoma Statutes that violates this act |
---|
268 | 257 | | shall be subject to all enforcement measures as provided by rule of |
---|
269 | 258 | | the Department of Agriculture, Food, and Forestry . |
---|
297 | | - | H. The Department of Agriculture, Food, and Forestry may adopt |
---|
298 | | - | rules as necessary to implement this section. |
---|
299 | | - | SECTION 2. This act shall become effective November 1, 2025. |
