4040 An Act relating to schools; amending 70 O.S. 2021,
4141 Sections 8-101.2, as amended by Section 1, Chapter
4242 193, O.S.L. 2022, and Section 1, C hapter 368, O.S.L.

4444 114), which relate to student transfers; prohibiting
4545 appeals of certain transfer decisions; clarifying
4646 appealable transfer decisions; describing intra-
4747 district transfer options within adju sted attendance
4848 zones; permitting intra -district transfers for
4949 specialized programs in certain circumstances;
5050 modifying the amount of intra -district transfers per
5151 school year; providing an effective date; and

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. AMENDATORY 70 O.S. 2021, Section 8 -101.2, as
6060 amended by Section 1, Chapter 193, O.S.L. 2022 (70 O.S. Supp. 2024,
6161 Section 8-101.2), is amended to read as follows:
6262 Section 8-101.2. A. Except as provided in subsection B of this
6363 section, on and after Janua ry 1, 2022, the transfer of a student
6464 from the district in which the student resides to another school
6565 district furnishing instruction in the grade the student is entitled
6666 to pursue shall be granted at any time in the year unless the number

9393 of transfers exceeds the capacity of a grade level for each school
9494 site within a school district. If the capacity of a grade level for
9595 each school site within a school district is insufficient to enroll
9696 all eligible students, the school district shall select transfer
9797 students in the order in which the district received the student
9898 transfer applications. The capacity of a school district shall be
9999 determined by the school district board of educa tion based on its
100100 policy adopted pursuant to subsection B of this section. A student
101101 may be granted a one -year transfer and may automatically continue to
102102 attend the school each school year to which the student transferred
103103 with the approval of the receivin g district. At the end of each
104104 school year, a school district may deny contin ued transfer of the
105105 student for the reasons outlined in paragraphs 1 and 2 of subsection
106106 B of this section. Any brother or sister of a student who transfers
107107 may attend the schoo l district to which the student transferred, if
108108 the school district policy gives preference to sibling transfers
109109 regardless of capacity, and the brother or sister of the transferred
110110 student does not meet a basis for denial as outlined in paragraphs 1
111111 and 2 of subsection B of this section. Any child in the custody of
112112 the Department of Human Services in foster care who is living in the
113113 home of a student who transfers may attend the school district to
114114 which the student transferred. Except for a child in the custody of
115115 the Department of Human Services in foster care, a transfer student
116116 shall not transfer more than two (2) times per school year to one or

143143 more school districts in which the student does not reside, provided
144144 that the student may always reenroll at any time in his or her
145145 school district of residence. At the discretion of th e receiving
146146 district, a student who has attended a school district as a resident
147147 student for at least three (3) years prior to becoming eligible to
148148 apply as a transfer student ma y be allowed to transfer to the school
149149 district regardless of capacity.
150150 If the grade a student is entitled to pursue is not offered in
151151 the district where the student resides, the transfer shall be
152152 automatically approved.
153153 B. Each school district board of e ducation shall adopt a policy
154154 to determine the number of transfer students the school district has
155155 the capacity to accept in each grade level for each school site
156156 within a school district no later than January 1, 2022. The policy
157157 may include:
158158 1. The acts and reasons outlined in Section 24 -101.3 of this
159159 title as a basis for denial of a transfer; and
160160 2. A history of absences as a basis for denial of a transfer.
161161 For the purposes of this section, "history of absences" means ten or
162162 more absences in one semes ter that are not excused for the reasons
163163 provided for in subsection B of Secti on 10-105 of this title or due
164164 to illness.
165165 The policy shall be publicly posted on the school district
166166 website.

193193 C. By the first day of January, April, July and October, the
194194 school district board of education shall establish the number of
195195 transfer students the school district has the capacity to accept in
196196 each grade level for each school site within a school district.
197197 D. After establishing the number of transfer students the
198198 school district has the capacity to accept in each grade level for
199199 each school site within a school district, the board of education
200200 shall:
201201 1. Publish in a prominent place on the school district website
202202 the number of transfer students for each grade level for each school
203203 site within a school district which the school district has the
204204 capacity to accept; and
205205 2. Report to the State Department of Education the number of
206206 transfer students for each grade level for each school site within a
207207 school district which the school district has the capacity to
208208 accept.
209209 E. If a transfer request is deni ed by the school district based
210210 on capacities set and approved by the receiving school district 's
211211 board of education, the denial shall not be subject to appeal. If
212212 the transfer request is denied based on attendance or discipline ,
213213 the parent of the student may appeal the denial within ten (10) days
214214 of notification of the denial to the receiving school district board
215215 of education. The receiving school district board of education
216216 shall consider the appeal at its next regularly scheduled board

243243 meeting. If the receiving school district board of education denies
244244 the appeal based on attendance or discipline , the parent of the
245245 student may appeal the denial within ten (10) days of notific ation
246246 of the appeal denial to the State Board of Education , which will
247247 determine whether local school board policy was followed . The
248248 parent shall submit to the State Board of Education and the
249249 superintendent of the receiving school a notice of appeal on a form
250250 prescribed by the State Board of Education. The appeal shall be
251251 considered by the State Board of Education at its next regularly
252252 scheduled meeting, where the parent and a representative from the
253253 receiving school district may address the Board. The State Board of
254254 Education shall promulgate rules to establish the appeals process
255255 authorized by this subsection.
256256 F. Each school district board of education shall submit to the
257257 State Department of Education the number of student transfers
258258 approved and denied and whether each denial was based on capacity,
259259 acts and reasons outlined in Section 24-101.3 of this title or a
260260 history of absences as provided for in paragraph 2 of subsection B
261261 of this section. The State Department of Education shall publish
262262 the data on its website and make the data available to the Office of
263263 Educational Quality and Accountability.
264264 G. Each year, the Office of Educational Quality and
265265 Accountability shall randomly select ten percent (10%) of the school
266266 districts in the state and conduct an audit of each district 's

293293 approved and denied transfers based on the provis ions of the
294294 policies adopted by the respective school district board of
295295 education. If the Office finds inaccurate reporting of capacity
296296 levels by a school district, the Office s hall set the capacity for
297297 the school district.
298298 SECTION 2. AMENDATORY Section 1, Chapter 368, O.S.L.
299299 2024 (70 O.S. Supp. 2024, Section 8 -114), is amended to read as
300300 follows:
301301 Section 8-114. A. Except as provided in subsection B of this
302302 section, beginning July 1, 2024, the transfer of a student from one
303303 school site to another school site within the school district where
304304 the student resides shall be approved at any time in the year,
305305 unless the grade level of the receiving school site has reached
306306 capacity. If the capacity of a grade level is insufficient to
307307 enroll all eligible students, the school district shall select
308308 intra-district transfer students based on the preferences outlined
309309 in paragraph 1 of subsection B of this section and then in the order
310310 in which the intra-district transfer applications were rece ived.
311311 The school district board of education shall determine the capacity
312312 of a school site based on its policy adopted pursuant to subsection
313313 B of this section. A student may b e granted a one-year intra-
314314 district transfer and may automatically continue to attend the
315315 school site where the student transferred each school year with the
316316 approval of the school district. Students previously granted an

343343 intra-district transfer may have the option to continue an intra -
344344 district transfer as they transition to the ne xt school in the
345345 attendance zone pattern. At the end of each school year, a school
346346 district may deny continued intra -district transfer of the student
347347 for the reasons outlined in paragraphs 2 and 3 of subsection B of
348348 this section. Districts may also deny an intra -district transfer
349349 request when the district has adjusted attendance zones for managing
350350 student enrollment.
351351 1. Any sibling of a student who transfers intra -district may
352352 attend the school site to which the student transferred if the
353353 school district policy gives preference to sibling transfers
354354 regardless of capacity and the sibling of the transferred student
355355 does not meet a basis for denial as outlined in paragraphs 2 and 3
356356 of subsection B of this section.
357357 2. The child of a school district employee who resides in the
358358 school district but wishes to attend a different school site within
359359 the school district where the student resides may be granted an
360360 intra-district transfer if the school district policy gives
361361 preference to the transfer of children of sc hool district employees
362362 and the student does not meet a basis for denial as outlined in
363363 paragraphs 2 and 3 of subsection B of this section.
364364 3. A student who changes residence wi thin a school district and
365365 who wishes to attend the same school site may be granted an intra -
366366 district transfer if the school district policy gives preference to

393393 such transfers and the student does not meet a basis for denial as
394394 outlined in paragraphs 2 and 3 of subsection B of this section.
395395 4. A student may be granted an intra -district transfer to
396396 participate in specialized programs within the district if the
397397 school district policy gives preference to such transfers and the
398398 student does not meet a basis fo r denial as outlined in paragraphs 2
399399 and 3 of subsection B of this section.
400400 5. Any child in the custody of the Department of Human Services
401401 and living in foster care who resides in the home of another student
402402 who transfers intra-district may attend the s chool site to which the
403403 student transferred.
404404 Except for a child in the custody of the Department of Human
405405 Services in foster care, an intra -district transfer student shall
406406 not transfer more than two times one time per school year to other
407407 school sites within the school district where the student resides,
408408 provided that the student may always reenroll at any time in his or
409409 her school site of residence.
410410 B. Each school district board of education shall adopt a policy

442442 1. Shall include an enrollment preference and reserve capacity
443443 for:
444444 a. students who reside in the school site boundary,
445445 b. students who attended the school site the prior school
446446 year,
447447 c. siblings of students who are already enrolled at the
448448 school site,
449449 d. children of school district employees who wish to
450450 attend a different school site within the s chool
451451 district, and
452452 e. students who change residence within a school district
453453 and who wish to attend the same school site;
454454 2. May include the acts and reasons outlined in Sectio n 24-
455455 101.3 of Title 70 of the Oklahoma Statutes as a basis for denial of
456456 an intra-district transfer; and
457457 3. May include a history of absences as a basis for denial of
458458 an intra-district transfer. For the purposes of this section,
459459 "history of absences" means ten or more absences in one semester
460460 that are not excused for the reasons p rovided in subsection B of
461461 Section 10-105 of Title 70 of the Oklahoma Statutes or due to

494494 D. After establishing the number of intra -district transfer
495495 students the school district has the capacity to accept in each
496496 grade level for each school site, the board of education shall:

499499 for each school site within the school district which the district
500500 has the capacity to accept; and
501501 2. Report to the State Department of Education the number of
502502 intra-district transfer students for each grade level for each
503503 school site within t he school district which the district has the
504504 capacity to accept.
505505 SECTION 3. This act shall become effective July 1, 2025.
506506 SECTION 4. It being immediately necessary for the preservation
507507 of the public peace, health or safet y, an emergency is hereby
508508 declared to exist, by reason whereof this act shall take effect and
509509 be in full force from and after its passage and approval.
