51	42		An Act relating to agriculture; enacting the Real
52	43		Access to Whole Milk Act of 2025; amending 2 O.S.
53	44		2021, Sections 7-413, 7-414, and 7-417, which relate
54	45		to the Oklahoma Milk and Milk Product s Act; providing
55	46		that it is a violation to sell milk or mil k products
56	47		without an appropriate or valid permit; providing
57	48		maximum number of gallons of raw milk sold to be
58	49		considered incidental; requiring permit to sale;
59	50		providing for noncodification; and providing an
60	51		effective date.

69	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
70	57		SECTION 1. NEW LAW A new section of law not to be
71	58		codified in the Oklahoma Statutes reads as follows:
	59	+	This act shall be known and may be cited as the "Real Access to
	60	+	Whole Milk Act of 2025 ".
	61	+	SECTION 2. AMENDATORY 2 O.S. 2021, Section 7 -413, is
	62	+	amended to read as follows:
	63	+	Section 7-413. It shall be unlawful for any person to
	64	+	knowingly, willfully or recklessly:

99		-	This act shall be known and may be cited as the "Real Access to
100		-	Whole Milk Act of 2025".
101		-	SECTION 2. AMENDATORY 2 O.S. 2021, Section 7 -413, is
102		-	amended to read as follows:
103		-	Section 7-413. It shall be unlawful for any person to
104		-	knowingly, willfully or recklessly:
105	91		1. Attempt to produce, haul, process or distribute, sell milk
106	92		or milk products without an appropriate and valid permit;
107	93		2. Sell, offer or expose for sale as Grade A any adulte rated or
108	94		misbranded milk or milk product;
109	95		3. Sell, offer, expose for sale or serve milk and milk products
110	96		which have not been maintained at or below the temperature specified
111	97		by the State Board of Agriculture;
112	98		4. Dip or ladle Grade A milk and milk produc ts;
113	99		5. Transfer Grade A milk and milk products at any location
114	100		other than a permitted Grade A facility designed and equipped for
115	101		such purpose;
116	102		6. Prevent, interfere or attempt to impede the Commissioner of
117	103		Agriculture from investigating and enforcing the Oklahoma Milk and
118	104		Milk Products Act;
119	105		7. Sell or serve Grade A milk and milk products from other than
120	106		the individual container, or approved bulk dispenser, received from
121	107		the distributor; or
	108	+	8. Violate any provision of the Oklahoma Milk and Milk Products
	109	+	Act.
	110	+	SECTION 3. AMENDATORY 2 O.S. 2021, Section 7 -414, is
	111	+	amended to read as follows:
	112	+	Section 7-414. A. The provisions of the Oklahoma Milk and Milk
	113	+	Products Act shall not be construed to:

149		-	8. Violate any provision of the Oklahoma Milk and Milk Products

151		-	SECTION 3. AMENDATORY 2 O.S. 2021, Section 7 -414, is
152		-	amended to read as follows:
153		-	Section 7-414. A. The provisions of the Oklahom a Milk and Milk
154		-	Products Act shall not be construed to:
155	140		1. Include incidental sales of raw mil k directly to consumers
156	141		at the farm where the milk is produced , where the average monthly
157	142		number of gallons sold does not exceed five hundred (500);
158	143		2. Preclude the advertising of the incidental sale of goat
159	144		milk; and
160	145		3. Prohibit any farmer or producer from making cheese using
161	146		milk or cream produced on the farm o f such farmer or producer.
162	147		B. For purposes of this section, incidental sales of goat milk
163	148		are those sales where the average monthly number of gallons sold
164	149		does not exceed one hundred (100).
165	150		SECTION 4. AMENDATORY 2 O.S. 2021, Sect ion 7-417, is
166	151		amended to read as follows:
167	152		Section 7-417. No person shall produce, haul, process or,
168	153		distribute, or sell ungraded raw milk or milk products or hold
169	154		themselves out as an ungraded milk producer, hauler, processor or
170	155		distributor unless such pe rson possesses an appropriate and valid
171	156		permit for the particular premises or facilities concerned. The
