5142 An Act relating to agriculture; enacting the Real

6956 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7057 SECTION 1. NEW LAW A new section of law not to be
7158 codified in the Oklahoma Statutes reads as follows:
59+This act shall be known and may be cited as the "Real Access to
60+Whole Milk Act of 2025 ".
61+SECTION 2. AMENDATORY 2 O.S. 2021, Section 7 -413, is
62+amended to read as follows:
63+Section 7-413. It shall be unlawful for any person to
64+knowingly, willfully or recklessly:

99-This act shall be known and may be cited as the "Real Access to
100-Whole Milk Act of 2025".
101-SECTION 2. AMENDATORY 2 O.S. 2021, Section 7 -413, is
102-amended to read as follows:
103-Section 7-413. It shall be unlawful for any person to
104-knowingly, willfully or recklessly:
10591 1. Attempt to produce, haul, process or distribute, sell milk
10692 or milk products without an appropriate and valid permit;
10793 2. Sell, offer or expose for sale as Grade A any adulte rated or
10894 misbranded milk or milk product;
10995 3. Sell, offer, expose for sale or serve milk and milk products
11096 which have not been maintained at or below the temperature specified
11197 by the State Board of Agriculture;
11298 4. Dip or ladle Grade A milk and milk produc ts;
11399 5. Transfer Grade A milk and milk products at any location
114100 other than a permitted Grade A facility designed and equipped for
115101 such purpose;
116102 6. Prevent, interfere or attempt to impede the Commissioner of
117103 Agriculture from investigating and enforcing the Oklahoma Milk and
118104 Milk Products Act;
119105 7. Sell or serve Grade A milk and milk products from other than
120106 the individual container, or approved bulk dispenser, received from
121107 the distributor; or
108+8. Violate any provision of the Oklahoma Milk and Milk Products
109+Act.
110+SECTION 3. AMENDATORY 2 O.S. 2021, Section 7 -414, is
111+amended to read as follows:
112+Section 7-414. A. The provisions of the Oklahoma Milk and Milk
113+Products Act shall not be construed to:

149-8. Violate any provision of the Oklahoma Milk and Milk Products

151-SECTION 3. AMENDATORY 2 O.S. 2021, Section 7 -414, is
152-amended to read as follows:
153-Section 7-414. A. The provisions of the Oklahom a Milk and Milk
154-Products Act shall not be construed to:
155140 1. Include incidental sales of raw mil k directly to consumers
156141 at the farm where the milk is produced , where the average monthly
157142 number of gallons sold does not exceed five hundred (500);
158143 2. Preclude the advertising of the incidental sale of goat
159144 milk; and
160145 3. Prohibit any farmer or producer from making cheese using
161146 milk or cream produced on the farm o f such farmer or producer.
162147 B. For purposes of this section, incidental sales of goat milk
163148 are those sales where the average monthly number of gallons sold
164149 does not exceed one hundred (100).
165150 SECTION 4. AMENDATORY 2 O.S. 2021, Sect ion 7-417, is
166151 amended to read as follows:
167152 Section 7-417. No person shall produce, haul, process or,
168153 distribute, or sell ungraded raw milk or milk products or hold
169154 themselves out as an ungraded milk producer, hauler, processor or
170155 distributor unless such pe rson possesses an appropriate and valid
171156 permit for the particular premises or facilities concerned. The
