5459 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5560 SECTION 1. AMENDATORY 6 3 O.S. 2021, Section 2 -415, is
5661 amended to read as follows:
5762 Section 2-415. A. The provisions of the Trafficking in Illegal
5863 Drugs Act shall apply to persons convicted of violations with
5964 respect to the following substances:
6065 1. Marijuana;
6166 2. Cocaine or coca leaves;
6267 3. Heroin;
63-4. Amphetamine or methamphetamine;
64-5. Lysergic acid diethylamide (LSD);

100106 B. Except as otherwise authorized by the Uniform Controlled
101107 Dangerous Substances Act, it shall be unlawful for any person to:
102108 1. Knowingly distribute, manufacture, bring into this state or
103109 possess a controlled substance specified in subsection A of this
104110 section in the quantities specified in subsection C of this section;
105111 2. Possess any controlled substance with the intent to
106112 manufacture a controlled substance specified in subsection A of this
107113 section in quantities specified in subsection C of this section; or
108114 3. Use or solicit the use of services of a person less than
109115 eighteen (18) years of age to distribute or manufacture a controlled
110116 dangerous substance specified in subsection A of this section in
111117 quantities specified in subsection C of this section.
112-Violation of this section shall b e known as "trafficking in

145+Violation of this section shall be known as "trafficking in
146+illegal drugs". Separate types of controlled substances described
147+in subsection A of this section when possessed at the same time in
141148 violation of any provision of this section shall constitute a
142149 separate offense for each substance.
143150 Any person who commits the conduct described in paragraph 1, 2
144151 or 3 of this subsection and represents th e quantity of the
145152 controlled substance to be an amount described in subsection C of
146153 this section shall be punished under the provisions appropriate for
147154 the amount of controlled substance represented, regardless of the
148155 actual amount.
149156 C. In the case of a vi olation of the provisions of subsection B
150157 of this section, involving:
151158 1. Marijuana:
152159 a. twenty-five Twenty-five (25) pounds or more of a
153160 mixture or substance containing a detectable amount of
154161 marijuana shall be punishable by a fine of not less
155162 than Twenty-five Thousand Dollars ($25,000.00) and not
156163 more than One Hundred Thousand Dollars ($100,000.00),
157164 or
158165 b. one thousand (1,000) pounds or more of a mixture or
159166 substance containing a detectable amount of marijuana
160167 shall be deemed aggravated trafficking punishab le by a
161168 fine of not less than One Hundred Thousand Dollars

450463 a. one (1) gram or more of a mixture containing fentanyl
451464 or carfentanil, or any fentanyl analogs or derivatives
452465 shall be trafficking punishable by a term of
453466 imprisonment in the custody of the Department of
454467 Corrections not to exce ed twenty (20) years and by a
455468 fine of not less than One Hundred Thousand Dollars
456469 ($100,000.00) and not more than Two Hundred Fifty
457470 Thousand Dollars ($250,000.00), or
458471 b. five (5) grams or more of a mixture containing
459472 fentanyl or carfentanil, or any fentanyl analogs or

493507 D. Any person who violates the provisions of this section with
494508 respect to marijuana, cocaine , coca leaves, cocaine base, heroin,
495509 amphetamine or methamphetamine in a quantity spe cified in paragraphs
496510 1, 2, 3 and 4 of subsection C of this section shall, in addition to
497511 any fines specified by this section, be punishable by a term of
498512 imprisonment as follows:
499513 1. For trafficking, a first violation of this section, a term
500514 of imprisonment in the custody of the Department of Corrections not
501515 to exceed twenty (20) years;
502516 2. For trafficking, a second violation of this section, a term
503517 of imprisonment in the De partment of Corrections of not less than
504518 four (4) years nor more than life, for which the person shall serve
505519 fifty percent (50%) of the sentence before being eligible for parole
506520 consideration;
507521 3. For trafficking, a third or subsequent violation of this
508522 section, a term of imprisonment in the custody of the Department of
509523 Corrections of not less than twenty (20) years nor more than life,
510-of which the person shall serve fifty percent (50%) of the sentence
511-before being eligible for parole consideration.

551+of which the person shall serve fifty percent (50%) of the sentence
552+before being eligible for parole consideration.
538553 Persons convicted of trafficking shall not be eligible for
539554 earned credits or any other type of credits which have the effect of
540555 reducing the length of sentence to less than fifty percent (50%) of
541556 the sentence imposed; and
542557 If the person is convicted of aggravated trafficking, the person
543558 shall serve eighty-five percent (85%) of such sentence before being
544559 eligible for parole consideration.
545560 E. The penalties specified in subsections C and D of this
546561 section are subject to the enhancements enumerated in subsections E
547562 and F of Section 2-401 of this title.
548563 F. Any person convicted of any offense described in this
549564 section shall, in addition to any fine imposed, pay a special
550565 assessment trauma-care fee of One Hundred Dollars ($100.00) to be
551566 deposited into the Trauma Care Assistance Revolving Fund created in
552567 Section 1-2530.9 of this title and the assessment p ursuant to
553568 Section 2-503.2 of this title.
554569 SECTION 2. AMENDATORY 63 O.S. 2021, Section 420, as
555570 amended by Section 1, Chapter 182, O.S.L. 2024 (63 O.S. Supp. 2024,
556571 Section 420), is amended to read as follows:
557572 Section 420. A. A per son in possession of a state -issued
558573 medical marijuana patient license shall be able to:
559574 1. Consume marijuana legally;
560-2. Legally possess up to three (3) ounces or eighty -four and
561-nine-tenths (84.9) grams of marijuana on their person;

592608 tenths (28.3) grams of concentrated marijuana;
593609 6. Legally possess seventy -two (72) ounces or two thousand
594610 thirty-seven and six-tenths (2037.6) grams of edible marijuana;
595611 7. Legally possess up to eight (8) ounces or two hundred
596612 twenty-six and four-tenths (226.4) grams of marijuana in their
597613 residence; and
598614 8. Legally possess seventy -two (72) ounces of topical
599615 marijuana.
600616 B. Possession of up to one and one -half (1.5) ounces or forty -
601617 two and forty-five one-hundredths (42.45) grams of marijuana by
602618 persons who can state a medical condition at the time of the stop
603619 and issuance of a written citation or arrest, but are not in
604620 possession of a state -issued medical marijuana patient license,
605621 shall constitute a misdemeanor offense punishable by a fine not to
606622 exceed Four Hundred Dollars ($400.00) and shall not be subject to
607623 imprisonment for the offense. A ny law enforcement officer who comes
608624 in contact with a person in violation of this subsection and who is
609625 satisfied as to the identity of the person, as well as any other
610-pertinent information the law enforcement officer deems necessary,
611-shall issue to the person a written citation containing a notice to

653+pertinent information the law enforcement officer deems necessary,
654+shall issue to the person a written citation containing a notice to
638655 answer the charge against the person in the appropriate court. Upon
639656 receiving the written promise of the alleged violator to answer as
640657 specified in the citation, the law enforcement officer shall release
641658 the person upon personal recognizance unless there has been a
642659 violation of another provision of law.
643660 C. The Oklahoma Medical Marijuana Authority shall be
644661 established which shall receive applications for medical marijuana
645662 patient and caregiver license recipi ents, dispensaries, growers, and
646663 processors within sixty (60) days of the passage of this initiative.
647664 D. The Authority shall, within thirty (30) days of passage of
648665 this initiative, make available on its website, in an easy -to-find
649666 location, an application for a medical marijuana patient license.
650667 The license shall be valid for two (2) years. The biannual
651668 application fee shall be One Hundred Dollars ($100.00), or Twenty
652669 Dollars ($20.00) for individuals on Medicaid, Medicare or
653670 SoonerCare. The methods of p ayment shall be provided on the website
654671 of the Authority. Reprints of the medical marijuana patient license
655672 shall be Twenty Dollars ($20.00).
656673 E. A short-term medical marijuana patient license application
657674 shall also be made available on the website of the Authority. A
658675 short-term medical marijuana patient license shall be granted to any
659676 applicant who can meet the requirements for a two -year medical
660-marijuana patient license, but whose physician recommendation for
661-medical marijuana is only valid for sixty (60) days. Short -term

705+medical marijuana is only valid for sixty ( 60) days. Short-term
688706 medical marijuana patient licenses shall be issued for sixty (60)
689707 days. The fee for a short -term medical marijuana patient license,
690708 reprints of the short -term medical marijuana patient license, and
691709 the procedure for extending or rene wing the license shall be
692710 determined by the Executive Director of the Authority.
693711 F. A temporary medical marijuana patient license application
694712 shall also be made available on the website of the Authority for
695713 residents of other states. Temporary medical ma rijuana patient
696714 licenses shall be granted to any medical marijuana license holders
697715 from other states, provided that such states have state -regulated
698716 medical marijuana programs, and applicants can prove they are
699717 members of such programs. Temporary medical marijuana patient
700718 licenses shall be issued for thirty (30) days. The cost for a
701719 temporary license shall be One Hundred Dollars ($100.00). Renewal
702720 shall be granted with r esubmission of a new application. No
703721 additional criteria shall be required. Reprint s of the temporary
704722 medical marijuana patient license shall be Twenty Dollars ($20.00).
705723 G. Medical marijuana patient license applicants shall submit
706724 their applications to the Authority for approval. The applicant
707725 shall be a resident of this state and shal l prove residency by a
708726 valid driver license, utility bills, or other accepted methods.
709-H. The Authority shall review the medi cal marijuana patient
710-license application; approve, reject, or deny the application; and
711-mail the approval, rejection, or denial letter stating any reasons

754+H. The Authority shall review the medical marijuana patient
755+license application; ap prove, reject, or deny the application; and
756+mail the approval, rejection, or denial l etter stating any reasons
738757 for rejection, to the applicant within fourteen (14) business days
739758 of receipt of the application. Approved applicants shall be issued
740759 a medical marijuana patient license which shall act as proof of his
741760 or her approved status. Ap plications may only be rejected or denied
742761 based on the applicant not meeting stated criteria or improper
743762 completion of the application.
744763 I. The Authority shall make availa ble, both on its website and
745764 through a telephone verification system, an easy method to validate
746765 the authenticity of the medical marijuana patient license by the
747766 unique twenty-four-character identification number.
748767 J. The Authority shall ensure that all medical marijuana
749768 patient and caregiver records and information are sealed to protect
750769 the privacy of medical marijuana patient license applicants.
751770 K. A caregiver license shall be made available for qualified
752771 caregivers of a medical marijuana patient license holder who is
753772 homebound. As provided in Section 427.11 of this title, the
754773 caregiver license shall provide the caregiver the same rights as the
755774 medical marijuana patient licensee including the ability to possess
756775 marijuana, marijuana products and mature and immature plants or
757776 cultivated medical marijuana pursuant to the Oklahoma Medical
758777 Marijuana and Patient Protection Act, but excluding the ability to
759-use marijuana or marijuana products unless the caregiver has a
760-medical marijuana pa tient license. Applicants for a caregiver

806+medical marijuana patient license. Applica nts for a caregiver
807+license shall submit proof of the license status and homebound
788808 status of the medical marijuana patient and proof that the applicant
789809 is the designee of the medical marijuana patient. The applicant
790810 shall also submit proof that he or she is eighteen (18) years of age
791811 or older and proof of his or her state residency. This shall be the
792812 only criteria for a caregiver license. A licensed caregiver shall
793813 not cultivate medical marijuana for more than five medical marijuana
794814 patient licensees and shall not charge a medical marijuana patient
795815 licensee for cultivating medical mariju ana in excess of the actual
796816 costs incurred in cultivating the medical marijuana.
797817 L. All applicants for a medical marijuana patient license shall
798818 be eighteen (18) years of age or older. A special exception shall
799819 be granted to an applicant under the age of eighteen (18); however,
800820 these applications shall be signed by two physicians and the parent
801821 or legal guardian of the applicant.
802822 M. All applications for a medical marijua na patient license
803823 shall be signed by an Oklahoma physician licensed by and in good
804824 standing with the State Board of Medical Licensure and Supervision,
805825 the State Board of Osteopathic Examiners, or the Board of Podiatric
806826 Medical Examiners. There are no qualifying conditions. A medical
807827 marijuana patient license shall be recommended accordi ng to the
808828 accepted standards a reasonable and prudent physician would follow
809-when recommending or approving any medication. N o physician may be
810-unduly stigmatized, penalized, subjected to discipline, sanctioned,
811-reprimanded or harassed for signing a medical marijuana patient

838859 license application; provided, the physician acted in accordance
839860 with the provisions of this subsection and all other rules governing
840861 the medical license of the physician in this state.
841862 N. Counties and cities may enact medical marijua na guidelines
842863 allowing medical marijuana patient license holders or caregiver
843864 license holders to exceed the state limits set forth in subsection A
844865 of this section.
845866 SECTION 3. This act shall become effective November 1, 2025.
