55 | 60 | | SECTION 1. AMENDATORY 6 3 O.S. 2021, Section 2 -415, is |

57 | 62 | | Section 2-415. A. The provisions of the Trafficking in Illegal |
---|
58 | 63 | | Drugs Act shall apply to persons convicted of violations with |
---|

---|

96 | 102 | | 10. Oxycodone; |

100 | 106 | | B. Except as otherwise authorized by the Uniform Controlled |
---|
101 | 107 | | Dangerous Substances Act, it shall be unlawful for any person to: |
---|
102 | 108 | | 1. Knowingly distribute, manufacture, bring into this state or |
---|
103 | 109 | | possess a controlled substance specified in subsection A of this |
---|
104 | 110 | | section in the quantities specified in subsection C of this section; |
---|
105 | 111 | | 2. Possess any controlled substance with the intent to |
---|
106 | 112 | | manufacture a controlled substance specified in subsection A of this |
---|
107 | 113 | | section in quantities specified in subsection C of this section; or |
---|
108 | 114 | | 3. Use or solicit the use of services of a person less than |
---|
109 | 115 | | eighteen (18) years of age to distribute or manufacture a controlled |
---|
110 | 116 | | dangerous substance specified in subsection A of this section in |
---|
111 | 117 | | quantities specified in subsection C of this section. |
---|

496 | 510 | | 1, 2, 3 and 4 of subsection C of this section shall, in addition to |
---|
497 | 511 | | any fines specified by this section, be punishable by a term of |
---|
498 | 512 | | imprisonment as follows: |
---|
499 | 513 | | 1. For trafficking, a first violation of this section, a term |
---|
500 | 514 | | of imprisonment in the custody of the Department of Corrections not |
---|
501 | 515 | | to exceed twenty (20) years; |
---|
502 | 516 | | 2. For trafficking, a second violation of this section, a term |
---|
503 | 517 | | of imprisonment in the De partment of Corrections of not less than |
---|
504 | 518 | | four (4) years nor more than life, for which the person shall serve |
---|
505 | 519 | | fifty percent (50%) of the sentence before being eligible for parole |
---|
506 | 520 | | consideration; |
---|
507 | 521 | | 3. For trafficking, a third or subsequent violation of this |
---|
508 | 522 | | section, a term of imprisonment in the custody of the Department of |
---|
509 | 523 | | Corrections of not less than twenty (20) years nor more than life, |
---|
538 | 553 | | Persons convicted of trafficking shall not be eligible for |
---|
539 | 554 | | earned credits or any other type of credits which have the effect of |
---|
540 | 555 | | reducing the length of sentence to less than fifty percent (50%) of |
---|
541 | 556 | | the sentence imposed; and |

542 | 557 | | If the person is convicted of aggravated trafficking, the person |
---|
543 | 558 | | shall serve eighty-five percent (85%) of such sentence before being |
---|
544 | 559 | | eligible for parole consideration. |

545 | 560 | | E. The penalties specified in subsections C and D of this |
---|
546 | 561 | | section are subject to the enhancements enumerated in subsections E |
---|
547 | 562 | | and F of Section 2-401 of this title. |

548 | 563 | | F. Any person convicted of any offense described in this |
---|
549 | 564 | | section shall, in addition to any fine imposed, pay a special |
---|
550 | 565 | | assessment trauma-care fee of One Hundred Dollars ($100.00) to be |
---|
551 | 566 | | deposited into the Trauma Care Assistance Revolving Fund created in |
---|
552 | 567 | | Section 1-2530.9 of this title and the assessment p ursuant to |
---|
553 | 568 | | Section 2-503.2 of this title. |
---|
554 | 569 | | SECTION 2. AMENDATORY 63 O.S. 2021, Section 420, as |
---|

557 | 572 | | Section 420. A. A per son in possession of a state -issued |
---|
558 | 573 | | medical marijuana patient license shall be able to: |
---|
559 | 574 | | 1. Consume marijuana legally; |
---|
588 | 604 | | 3. Legally possess six mature marijuana plants and the |
---|
589 | 605 | | harvested marijuana therefrom; |
---|
590 | 606 | | 4. Legally possess six seedling plants; |
---|
591 | 607 | | 5. Legally possess one (1) ounce or twenty -eight and three |
---|
592 | 608 | | tenths (28.3) grams of concentrated marijuana; |
---|
593 | 609 | | 6. Legally possess seventy -two (72) ounces or two thousand |
---|
594 | 610 | | thirty-seven and six-tenths (2037.6) grams of edible marijuana; |
---|
595 | 611 | | 7. Legally possess up to eight (8) ounces or two hundred |
---|
596 | 612 | | twenty-six and four-tenths (226.4) grams of marijuana in their |
---|
597 | 613 | | residence; and |
---|
598 | 614 | | 8. Legally possess seventy -two (72) ounces of topical |
---|
599 | 615 | | marijuana. |
---|
600 | 616 | | B. Possession of up to one and one -half (1.5) ounces or forty - |
---|
601 | 617 | | two and forty-five one-hundredths (42.45) grams of marijuana by |
---|
602 | 618 | | persons who can state a medical condition at the time of the stop |
---|
603 | 619 | | and issuance of a written citation or arrest, but are not in |
---|
604 | 620 | | possession of a state -issued medical marijuana patient license, |
---|
605 | 621 | | shall constitute a misdemeanor offense punishable by a fine not to |
---|
606 | 622 | | exceed Four Hundred Dollars ($400.00) and shall not be subject to |
---|
607 | 623 | | imprisonment for the offense. A ny law enforcement officer who comes |
---|
608 | 624 | | in contact with a person in violation of this subsection and who is |
---|
609 | 625 | | satisfied as to the identity of the person, as well as any other |
---|
638 | 655 | | answer the charge against the person in the appropriate court. Upon |
---|
639 | 656 | | receiving the written promise of the alleged violator to answer as |
---|
640 | 657 | | specified in the citation, the law enforcement officer shall release |
---|
641 | 658 | | the person upon personal recognizance unless there has been a |
---|
642 | 659 | | violation of another provision of law. |
---|
643 | 660 | | C. The Oklahoma Medical Marijuana Authority shall be |
---|
644 | 661 | | established which shall receive applications for medical marijuana |
---|
645 | 662 | | patient and caregiver license recipi ents, dispensaries, growers, and |
---|
646 | 663 | | processors within sixty (60) days of the passage of this initiative. |
---|
647 | 664 | | D. The Authority shall, within thirty (30) days of passage of |
---|
648 | 665 | | this initiative, make available on its website, in an easy -to-find |
---|
649 | 666 | | location, an application for a medical marijuana patient license. |
---|
650 | 667 | | The license shall be valid for two (2) years. The biannual |
---|
651 | 668 | | application fee shall be One Hundred Dollars ($100.00), or Twenty |
---|
652 | 669 | | Dollars ($20.00) for individuals on Medicaid, Medicare or |
---|
653 | 670 | | SoonerCare. The methods of p ayment shall be provided on the website |
---|
654 | 671 | | of the Authority. Reprints of the medical marijuana patient license |
---|
655 | 672 | | shall be Twenty Dollars ($20.00). |
---|
656 | 673 | | E. A short-term medical marijuana patient license application |
---|
657 | 674 | | shall also be made available on the website of the Authority. A |
---|
658 | 675 | | short-term medical marijuana patient license shall be granted to any |
---|
659 | 676 | | applicant who can meet the requirements for a two -year medical |
---|
688 | 706 | | medical marijuana patient licenses shall be issued for sixty (60) |
---|
689 | 707 | | days. The fee for a short -term medical marijuana patient license, |
---|
690 | 708 | | reprints of the short -term medical marijuana patient license, and |
---|
691 | 709 | | the procedure for extending or rene wing the license shall be |
---|
692 | 710 | | determined by the Executive Director of the Authority. |
---|
693 | 711 | | F. A temporary medical marijuana patient license application |
---|
694 | 712 | | shall also be made available on the website of the Authority for |
---|
695 | 713 | | residents of other states. Temporary medical ma rijuana patient |
---|
696 | 714 | | licenses shall be granted to any medical marijuana license holders |
---|
697 | 715 | | from other states, provided that such states have state -regulated |
---|
698 | 716 | | medical marijuana programs, and applicants can prove they are |
---|
699 | 717 | | members of such programs. Temporary medical marijuana patient |
---|
700 | 718 | | licenses shall be issued for thirty (30) days. The cost for a |
---|
701 | 719 | | temporary license shall be One Hundred Dollars ($100.00). Renewal |
---|
702 | 720 | | shall be granted with r esubmission of a new application. No |
---|
703 | 721 | | additional criteria shall be required. Reprint s of the temporary |
---|
704 | 722 | | medical marijuana patient license shall be Twenty Dollars ($20.00). |
---|
705 | 723 | | G. Medical marijuana patient license applicants shall submit |
---|
706 | 724 | | their applications to the Authority for approval. The applicant |
---|
707 | 725 | | shall be a resident of this state and shal l prove residency by a |
---|
708 | 726 | | valid driver license, utility bills, or other accepted methods. |
---|
738 | 757 | | for rejection, to the applicant within fourteen (14) business days |
---|
739 | 758 | | of receipt of the application. Approved applicants shall be issued |
---|
740 | 759 | | a medical marijuana patient license which shall act as proof of his |
---|
741 | 760 | | or her approved status. Ap plications may only be rejected or denied |
---|
742 | 761 | | based on the applicant not meeting stated criteria or improper |
---|
743 | 762 | | completion of the application. |
---|
744 | 763 | | I. The Authority shall make availa ble, both on its website and |
---|
745 | 764 | | through a telephone verification system, an easy method to validate |
---|
746 | 765 | | the authenticity of the medical marijuana patient license by the |
---|
747 | 766 | | unique twenty-four-character identification number. |
---|
748 | 767 | | J. The Authority shall ensure that all medical marijuana |
---|
749 | 768 | | patient and caregiver records and information are sealed to protect |
---|
750 | 769 | | the privacy of medical marijuana patient license applicants. |
---|
751 | 770 | | K. A caregiver license shall be made available for qualified |
---|
752 | 771 | | caregivers of a medical marijuana patient license holder who is |
---|
753 | 772 | | homebound. As provided in Section 427.11 of this title, the |
---|
754 | 773 | | caregiver license shall provide the caregiver the same rights as the |
---|
755 | 774 | | medical marijuana patient licensee including the ability to possess |
---|
756 | 775 | | marijuana, marijuana products and mature and immature plants or |
---|
757 | 776 | | cultivated medical marijuana pursuant to the Oklahoma Medical |
---|
758 | 777 | | Marijuana and Patient Protection Act, but excluding the ability to |
---|
788 | 808 | | status of the medical marijuana patient and proof that the applicant |
---|
789 | 809 | | is the designee of the medical marijuana patient. The applicant |
---|
790 | 810 | | shall also submit proof that he or she is eighteen (18) years of age |
---|
791 | 811 | | or older and proof of his or her state residency. This shall be the |
---|
792 | 812 | | only criteria for a caregiver license. A licensed caregiver shall |
---|

841 | 862 | | N. Counties and cities may enact medical marijua na guidelines |
