40	40	An Act relating to schools; requiring certain school
41	41	districts to obtain and record citizenship status of
42	42	enrolling students; requiring annual report to the
43	43	State Department of Education; prescribing report
44	44	requirements and exclusions; clarifying construction
45	45	of section; providing for codification; providing an
46	46	effective date; and declaring an emergency.

52	52	BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A ne w section of law to be codified
54	54	in the Oklahoma Statutes as Section 24 -162 of Title 70, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	A. Publicly funded school districts shall obtain proof of
57	57	United States citizenship or legal immigration status from a parent
58	58	or legal guardian of a student or emancipated minor at the time of
59	59	enrollment. Proof of citizenship or legal immigration status may be
60	60	shown through one of the following:
61	61	1. An original or certified copy of a United States bi rth
62	62	certificate;
63	63	2. A valid, unexpired United States passport;

90	90	3. A valid Oklahoma driver license;
91	91	4. A valid Oklahoma identification card;
92	92	5. A Certificate of Naturalization ;
93	93	6. A Certificate of Citizenship;
94	94	7. Consular Report of Birth Abroad or Certification of Birth
95	95	with a professional English translation;
96	96	8. Unexpired Permanent Resident Card;
97	97	9. Unexpired Employment Authorization Card; or
98	98	10. Valid, unexpired foreign passport with the original United
99	99	States visa entry stamp.
100	100	B. 1. Each school district shall record the citizenship status
101	101	of each student enrolled, including students for which a parent or a
102	102	legal guardian of a student, or the emancipated minor , could not
103	103	provide proof of citizenship or legal immigration status as outlined
104	104	in subsection A of this section .
105	105	2. Each school district shall submit an annual report to the
106	106	State Department of Education containing the number of enrolled
107	107	students who:
108	108	a. provided proof of United States citizenship,
109	109	b. provided proof of legal immigration sta tus, and
110	110	c. failed to provide proof of citizenship or legal
111	111	immigration status.
112	112	3. The annual report shall exclude any personally identifiable
113	113	information.

140	140	4. Nothing in this section shall be construed to prohibit, or
141	141	inhibit, any child from receiving the education they are entitled to
142	142	receive under state or federal law.
143	143	SECTION 2. This act shall become effective July 1, 2025.
144	144	SECTION 3. It being immediately necessary for the preservation
145	145	of the public peace, health or sa fety, an emergency is hereby
146	146	declared to exist, by reason whereof this act shall take effect and
147	147	be in full force from and after its passage and approval.
