6464 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6565 SECTION 1. NEW LAW A new section o f law to be codified
6666 in the Oklahoma Statutes as Section 1371.1 of Title 59, u nless there

9595 1. "Board" means, unless otherwise explicitly stated, the State
9696 Board of Examiners of P sychologists;
9797 2. "Conditional prescription certificate " means a document
9898 issued by the State Board of Examiners of Psychologists to a
9999 licensed psychologist who has met requirements for said certificate
100100 that permits the holder to prescribe psychotropic med ication under
101101 the supervision of a supervising physician;
102102 3. "Prescription certificate" means a document issued by the
103103 State Board of Examiners of Psychologists to a licensed psychologist
104104 that permits the holder to prescribe psychotropic medication after
105105 met requirements;
106106 4. "Psychologist" has the same meaning as provided in Section
107107 1352 of Title 59 of the Oklahoma Statutes;
108108 5. "Psychotropic medication " means a controlled substance or
109109 drug that may not be dispensed or administered without a
110110 prescription and whose primary use has been approved by the federal
111111 Food and Drug Administr ation for the treatment of mental disorders
112112 or is listed as a psychotherapeutic agent in Drug Facts and
113113 Comparisons 2017, or the most recent edition of that book, or in
114114 American Hospital Formulary Service Drug Information , and includes
115115 antidepressants, antianxiety medications, stimulants,
116116 antipsychotics, and mood stabilizers; and

143143 6. "Supervising physician " means a licensed allopathic
144144 physician or osteopathic physician who is supe rvising a psychologist
145145 in the prescribing of psychotropic medication.
146146 SECTION 2. NEW LAW A new section of law to be codified
147147 in the Oklahoma Statutes as Section 1371.2 of Title 59, unless there
148148 is created a duplication in numbering, reads as follows:
149149 A. A licensed psychologist holding a conditional prescription
150150 certificate may prescribe psychotropic medication under the
151151 supervision of a supervising physician.
152152 B. A licensed psychologist holding a prescription certificate
153153 may prescribe psychotropic medication independent of the supervision
154154 of a supervising phy sician.
155155 SECTION 3. NEW LAW A new section of law to be codified
156156 in the Oklahoma Statutes as Section 1371.3 of Title 59, unless there
157157 is created a duplicati on in numbering, reads as follows:
158158 A. A psychologist may apply to the State Board of Examiners of
159159 Psychologists for a conditional prescription certificate. The
160160 application shall be made on a form approved by the Board and be
161161 accompanied by evidence satis factory to the Board that the
162162 applicant:
163163 1. Has completed a doctoral program in psychology from an
164164 accredited institution of higher education or professional school,
165165 or, if the program was not accredited at the time of the applicant 's

192192 graduation, that the program meets professional standards determined
193193 acceptable by the Board;
194194 2. Holds a current license to practice psychology in this
195195 state;
196196 3. Has successfully completed a postdoctoral master of science
197197 degree in psychopharmacology from an institution of higher education
198198 approved by the State Board of Examiners of Psychologists, th e State
199199 Board of Medical Licensure and Supervision, and the State Board of
200200 Osteopathic Examiners;
201201 4. Has passed a national certification examination approved by
202202 the State Board of Examiners of Psychologists, the State Board of
203203 Medical Licensure and Supervision, and the State Board of
204204 Osteopathic Examiners that tests the applicant 's knowledge of
205205 pharmacology in the diagnosis, care, and treatment of mental
206206 disorders;
207207 5. Within the five (5) years immediately preceding the date of
208208 application, has successfull y completed an organized program of
209209 education approved by the State Board of Examiners of Psychologists,
210210 the State Board of Medical Licensure and Supervision, and the State
211211 Board of Osteopathic Examiners which included didactic instruction
212212 of no fewer than four hundred fifty (450) classroom hours in at
213213 least the following core areas of instruction:
214214 a. neuroscience,
215215 b. pharmacology,

245245 f. appropriate and relevant physical and laboratory
246246 assessment, and
247247 g. clinical pharmacotherapeutics; or
248248 6. Within the five (5) years immediately preceding the date of
249249 application, has been certified by each of the applicant 's
250250 supervising physicians as having successfully completed a supervised
251251 and relevant clinical experience, approved by the State Board of
252252 Examiners of Psychologists, the State Board of Medical Licensure and
253253 Supervision, and the State Board of Osteopathic Examiners, of:
254254 a. no less than an eighty-hour practicum in clinical
255255 assessment and pathophysiology und er the supervision
256256 of a licensed allopathic or osteopathic physician, and
257257 b. an additional supervised practicum of at least four
258258 hundred (400) hours treating no fewer than one hu ndred
259259 patients with mental disorders. The practicum to have
260260 been supervised one-to-one by any one or a combination
261261 of a psychiatrist or other appropriately trained
262262 licensed allopathic or osteopathic physician and
263263 determined by the State Board of Examiners of
264264 Psychologists, the State Board of Medical Licensure
265265 and Supervision, and t he State Board of Osteopathic

292292 Examiners to be sufficient to competently train the
293293 applicant in the treatment of a diverse patient
294294 population. One-to-one supervision shall be pro vided
295295 either face-to-face, telephonically, or by
296296 videoconference.
297297 B. The State Board of Examiners of Psychologists shall issue a
298298 conditional prescription certificate if it finds that the applicant
299299 has met the requirements of subsection A of this section. The
300300 certificate shall be valid for a period of two (2) years, at the end
301301 of which the holder may again apply pursuant to the provisions of
302302 subsection A of this section.
303303 C. A psychologist with a conditional prescription certificate
304304 may prescribe psychotro pic medication under the supervision of a
305305 supervising physician subject to the following conditions:
306306 1. The psychologist shall continue to hold a current license to
307307 practice psychology in this state and shall maintain malpractice
308308 insurance in accordance w ith rules prescribed by the Board;
309309 2. The psychologist shall notify the Board of the name of the
310310 psychologist's supervising physician; and
311311 3. A supervising physician shall notify the supervising
312312 physician's own licensing board of the name of each psychol ogist
313313 under the supervising physician 's supervision.
314314 D. A supervising physician shall not be liable for the acts of
315315 a psychologist under the supervising physician 's supervision unless

344344 SECTION 4. This act shall bec ome effective November 1, 2025.
