64	64	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
65	65	SECTION 1. NEW LAW A new section o f law to be codified
66	66	in the Oklahoma Statutes as Section 1371.1 of Title 59, u nless there
67	67	is created a duplication in numbering, reads as follows:

95	95	1. "Board" means, unless otherwise explicitly stated, the State
96	96	Board of Examiners of P sychologists;
97	97	2. "Conditional prescription certificate " means a document
98	98	issued by the State Board of Examiners of Psychologists to a
99	99	licensed psychologist who has met requirements for said certificate
100	100	that permits the holder to prescribe psychotropic med ication under
101	101	the supervision of a supervising physician;
102	102	3. "Prescription certificate" means a document issued by the
103	103	State Board of Examiners of Psychologists to a licensed psychologist
104	104	that permits the holder to prescribe psychotropic medication after
105	105	met requirements;
106	106	4. "Psychologist" has the same meaning as provided in Section
107	107	1352 of Title 59 of the Oklahoma Statutes;
108	108	5. "Psychotropic medication " means a controlled substance or
109	109	drug that may not be dispensed or administered without a
110	110	prescription and whose primary use has been approved by the federal
111	111	Food and Drug Administr ation for the treatment of mental disorders
112	112	or is listed as a psychotherapeutic agent in Drug Facts and
113	113	Comparisons 2017, or the most recent edition of that book, or in
114	114	American Hospital Formulary Service Drug Information , and includes
115	115	antidepressants, antianxiety medications, stimulants,
116	116	antipsychotics, and mood stabilizers; and

147	147	in the Oklahoma Statutes as Section 1371.2 of Title 59, unless there
148	148	is created a duplication in numbering, reads as follows:
149	149	A. A licensed psychologist holding a conditional prescription
150	150	certificate may prescribe psychotropic medication under the
151	151	supervision of a supervising physician.
152	152	B. A licensed psychologist holding a prescription certificate
153	153	may prescribe psychotropic medication independent of the supervision
154	154	of a supervising phy sician.
155	155	SECTION 3. NEW LAW A new section of law to be codified
156	156	in the Oklahoma Statutes as Section 1371.3 of Title 59, unless there
157	157	is created a duplicati on in numbering, reads as follows:
158	158	A. A psychologist may apply to the State Board of Examiners of
159	159	Psychologists for a conditional prescription certificate. The
160	160	application shall be made on a form approved by the Board and be
161	161	accompanied by evidence satis factory to the Board that the
162	162	applicant:
163	163	1. Has completed a doctoral program in psychology from an
164	164	accredited institution of higher education or professional school,
165	165	or, if the program was not accredited at the time of the applicant 's

193	193	acceptable by the Board;
194	194	2. Holds a current license to practice psychology in this
195	195	state;
196	196	3. Has successfully completed a postdoctoral master of science
197	197	degree in psychopharmacology from an institution of higher education
198	198	approved by the State Board of Examiners of Psychologists, th e State
199	199	Board of Medical Licensure and Supervision, and the State Board of
200	200	Osteopathic Examiners;
201	201	4. Has passed a national certification examination approved by
202	202	the State Board of Examiners of Psychologists, the State Board of
203	203	Medical Licensure and Supervision, and the State Board of
204	204	Osteopathic Examiners that tests the applicant 's knowledge of
205	205	pharmacology in the diagnosis, care, and treatment of mental
206	206	disorders;
207	207	5. Within the five (5) years immediately preceding the date of
208	208	application, has successfull y completed an organized program of
209	209	education approved by the State Board of Examiners of Psychologists,
210	210	the State Board of Medical Licensure and Supervision, and the State
211	211	Board of Osteopathic Examiners which included didactic instruction
212	212	of no fewer than four hundred fifty (450) classroom hours in at
213	213	least the following core areas of instruction:
214	214	a. neuroscience,
215	215	b. pharmacology,

245	245	f. appropriate and relevant physical and laboratory
246	246	assessment, and
247	247	g. clinical pharmacotherapeutics; or
248	248	6. Within the five (5) years immediately preceding the date of
249	249	application, has been certified by each of the applicant 's
250	250	supervising physicians as having successfully completed a supervised
251	251	and relevant clinical experience, approved by the State Board of
252	252	Examiners of Psychologists, the State Board of Medical Licensure and
253	253	Supervision, and the State Board of Osteopathic Examiners, of:
254	254	a. no less than an eighty-hour practicum in clinical
255	255	assessment and pathophysiology und er the supervision
256	256	of a licensed allopathic or osteopathic physician, and
257	257	b. an additional supervised practicum of at least four
258	258	hundred (400) hours treating no fewer than one hu ndred
259	259	patients with mental disorders. The practicum to have
260	260	been supervised one-to-one by any one or a combination
261	261	of a psychiatrist or other appropriately trained
262	262	licensed allopathic or osteopathic physician and
263	263	determined by the State Board of Examiners of
264	264	Psychologists, the State Board of Medical Licensure
265	265	and Supervision, and t he State Board of Osteopathic

292	292	Examiners to be sufficient to competently train the
293	293	applicant in the treatment of a diverse patient
294	294	population. One-to-one supervision shall be pro vided
295	295	either face-to-face, telephonically, or by
296	296	videoconference.
297	297	B. The State Board of Examiners of Psychologists shall issue a
298	298	conditional prescription certificate if it finds that the applicant
299	299	has met the requirements of subsection A of this section. The
300	300	certificate shall be valid for a period of two (2) years, at the end
301	301	of which the holder may again apply pursuant to the provisions of
302	302	subsection A of this section.
303	303	C. A psychologist with a conditional prescription certificate
304	304	may prescribe psychotro pic medication under the supervision of a
305	305	supervising physician subject to the following conditions:
306	306	1. The psychologist shall continue to hold a current license to
307	307	practice psychology in this state and shall maintain malpractice
308	308	insurance in accordance w ith rules prescribed by the Board;
309	309	2. The psychologist shall notify the Board of the name of the
310	310	psychologist's supervising physician; and
311	311	3. A supervising physician shall notify the supervising
312	312	physician's own licensing board of the name of each psychol ogist
313	313	under the supervising physician 's supervision.
314	314	D. A supervising physician shall not be liable for the acts of
315	315	a psychologist under the supervising physician 's supervision unless
