4040 An Act relating to charitable organizations; amending

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 18 O.S. 2021, Section 552.3, is
5252 amended to read as fo llows:
5353 Section 552.3. A. No charitable organization that is either
5454 located within this state or that is soliciting contributions from
5555 any person in this state, except those specifically exempt under
5656 Section 552.4 of this title, shall solicit contribution s until the
5757 charitable organization shall have registered with the Office of the
5858 Secretary of State and filed information, as required by the
5959 Oklahoma Solicitation of Charitable Contributions Act, on forms
6060 approved by that office. At the time of registrat ion, each
6161 charitable organization, except as otherwise provided in this
6262 section, shall pay a fee of Sixty-five Dollars ($65.00) Forty

8989 Dollars ($40.00). The first Fifteen Dollars ($15.00) of the fee
9090 shall be deposited to the credit of the General Revenue F und of the
9191 State Treasury. Thirty-four Dollars ($34.00) Twenty-five Dollars
9292 ($25.00) of the fee shall be deposited to the credit of the Attorney
9393 General Charitable Solicitations Enforcement Revolving Fund and the
9494 remaining Sixteen Dollars ($16.00) Fifteen Dollars ($15.00) shall be
9595 deposited to the credit of the Secretary of State C haritable
9696 Solicitations Revolving Fund. Provided, a charitable organization
9797 whose contributions during the previous registration period did not
9898 exceed Ten Thousand Dollars ($10, 000.00) or if this is the
9999 charitable organization 's first registration period and the
100100 anticipated contributions for the current registration period are
101101 not expected to exceed Ten Thousand Dollars ($10,000.00), shall pay
102102 a fee of Fifteen Dollars ($15.00) of which Ten Dollars ($10.00)
103103 shall be deposited to the credit of the Attorney G eneral Charitable
104104 Solicitations Enforcement Revolving Fund and the remaining Five
105105 Dollars ($5.00) shall be deposited to the credit of the Secretary of
106106 State Charitable Solicitati ons Revolving Fund. Each charitable
107107 organization that is required to register under this act shall
108108 register annually with the Secretary of State by the date that the
109109 charitable organization files its Form 990 or by the date, plus
110110 extensions, that it is re quired to file its Form 990, whichever
111111 occurs first. Registration shall not b e deemed to constitute an
112112 endorsement by the state or by the Secretary of State of any

139139 charitable organization or the proposed uses of the funds solicited.
140140 The information so fi led shall be available to the general public.
141141 The charitable organization shall provide the following information
142142 on the required forms:
143143 1. The legal name of the charitable organization, any trade
144144 names that the charitable organization uses, any other na me the
145145 organization may be identified or known as, and any distinctive
146146 names the organization uses for purposes of solicitation of
147147 contributions;
148148 2. The mailing address of the charitable organization;
149149 3. The name and mailing address of:
150150 a. each officer, director, trustee, and/or equivalent, and
151151 b. each salaried executive employee of the charitable
152152 organization;
153153 4. The name and mailing address of:
154154 a. each professional fundraiser or professional solicitor
155155 that will have custody of the contributions, and
156156 b. each person associated with a professional fundraiser,
157157 professional solicitor or charitable organization that
158158 is directly responsible for the payment and
159159 distribution of funds collected;
160160 5. The name and mailing address of each professional
161161 fundraising counsel utilized by the charitable organization;

188188 6. For charitable organizations that register for the first
189189 time, a statement of whether or not the charitable organization
190190 believes contributions for the first year of registration will
191191 exceed Ten Thousand D ollars ($10,000.00);
192192 7. The purposes for which the contributions solicited ar e to be
193193 used;
194194 8. For the initial registration of a newly formed charitable
195195 organization, a copy of a letter from the Internal Revenue Service,
196196 or other evidence, showing that su ch organization is exempt from
197197 federal income taxation; or, for a charitable organization that has
198198 not applied for federal income tax exemption with the Internal
199199 Revenue Service or is not required to apply for federal income tax
200200 exemption, evidence showing that said charitable organization is
201201 organized in any state or jurisdiction a s a not-for-profit entity;
202202 9. An identification of the period of time or periods during
203203 which solicitations are to be conducted, which may be specific
204204 periods, estimated or proj ected time frames, or continuous, and
205205 which may involve different periods for different types of
206206 solicitations by the same charitable organization;
207207 10. An identification of the specific method or methods of
208208 solicitation utilized by the charitable organiza tion and its agents;
209209 11. Whether the solicitation is to be conducted by the
210210 following for or on behalf of the charitable organization:

237237 professional fundraisers, employees or volunteers of the charitable
238238 organization, and/or others; and
239239 12. If the solicitation is to be conducted in whole or in part
240240 by professional fundraisers, the names and addresses of each
241241 professional fundraiser involved in the solicitation; the basis of
242242 payment or other consideration payable to each professional
243243 fundraiser and the nat ure of the arrangements between the charitable
244244 organization and each professio nal fundraiser, the specific amount,
245245 formula or percentage of compensation, or property of any kind or
246246 value to be paid or provided to each professional fundraiser; and if
247247 payment is based on a percentage, the amount of compensation as a
248248 percentage of the total contributions received, and the net amount
249249 of the total contributions received (total contributions received,
250250 less expenses of solicitation other than amounts payable to an y
251251 professional fundraiser).
252252 B. In addition to the required information in sub section A of
253253 this section, every charitable organization subject to the
254254 provisions of the Oklahoma Solicitation of Charitable Contributions
255255 Act that has solicited contributions d uring the previous fiscal year
256256 shall provide the following information:
257257 1. The gross amount of the contributions, gifts, grants and
258258 other similar amounts received by the charitable organization;
259259 2. The total Program Service Expenses of the charitable
260260 organization;

287287 3. The total Management and General Expenses of the charitable
288288 organization;
289289 4. The total Fundraising Expenses of the charitable
290290 organization; and
291291 5. The aggregate amount paid, or payable, to professional
292292 fundraisers and professional fundrais ing counsel.
293293 C. Any registration form required to be filed under this
294294 section shall be executed by signature, without more, of the person
295295 or persons signing the form, in which case the signature or
296296 signatures shall constitute the affirmation of the signat ory, under
297297 penalty of perjury, that the signature is that person 's act and deed
298298 or the act and deed of the organization, and that the facts stated
299299 therein are true.
300300 D. If a charitable organization that is registered with the
301301 Secretary of State to solicit contributions in this state changes
302302 its name or the mailing address of its principal office, or plans to
303303 engage in the solicitation of contributions using a name that is not
304304 listed on its registration form, then it shall, prior to soliciting
305305 any funds in this state using any such name, file with the Secretary
306306 of State a statement ex ecuted by an authorized officer of the
307307 organization setting forth any new name and mailing address along
308308 with a fee of Twenty -five Dollars ($25.00). Such fee shall be
309309 deposited to the credit of the General Revenue Fund of the State

337337 Revolving Fund.
338338 E. Any fraternal or membership organization not based in
339339 Oklahoma which solicits contributions from any person of this st ate
340340 by telephone, or contracts with professional fundraisers to solicit
341341 such contributions, shall be required to have at least one member or
342342 employee of the fraternal or membership organization residing within
343343 the county where the call is received.
344344 SECTION 2. This act shall become effective November 1, 2025.
