4040 An Act relating to wildlife; creating the Oklahoma

6262 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6363 SECTION 1. NEW LAW A new section of law to be codified
6464 in the Oklahoma Statutes as Section 4 -204 of Title 29, unless there
6565 is created a duplicat ion in numbering, reads as follows:
6666 A. Nonresidents may not hunt or fish in any Oklahoma Wildlife
6767 Management Area unless the person has first obtained an Oklahoma
6868 Habitat Stamp from the Director of the Oklahoma Wildlife

9595 Conservation Commission or authorized agents of the Director. Each
9696 person shall have the permit in addition to all other required
9797 licenses, stamps, and permits when hunting in an Oklahoma Wildlife
9898 Management Area.
9999 B. Persons excepted from the Oklahoma Habitat Stamp
100100 requirements of this se ction are:
101101 1. Nonresident active -duty military personnel stationed at
102102 military installations located in th is state; and
103103 2. Nonresident veterans.
104104 C. The Oklahoma Habitat Stamp shall be Eighty-five Dollars
105105 ($85.00). The fee shall be deposited in the Oklahoma Habitat Stamp
106106 Revolving Fund, to be used exclusively for maintenance and
107107 improvements to Oklahoma Wildlife Management Areas.
108108 D. An Oklahoma Habitat Stamp is valid for a per iod of one (1)
109109 year from the date of purchase.
110110 E. The Oklahoma Wildlife Conse rvation Commission shall
111111 prescribe, by rule, the form, design, and manner of issuance of the
112112 Oklahoma Habitat Stamp.
113113 F. 1. Any nonresident arrested for hunting in an Oklahoma
114114 Wildlife Management Area without an Oklahoma Habitat Stamp as
115115 required by the provisions of subsection A of this section may
116116 purchase a substitute temporary thirty -day stamp from the arresting
117117 game warden in lieu of posting bond. The fee for a substitute s tamp

144144 purchased pursuant to the provisions of this subsection shall be One
145145 Hundred Forty-five Dollars ($145.00).
146146 2. The fees from the temporary substitute stamp pursuant to the
147147 provisions of this subsection shall be deposited in the Oklahoma
148148 Habitat Stamp Revolving Fund, to be used exclusively for maintenance
149149 and improvements to Oklahoma Wildlife Management Areas.
150150 G. Any person convicted of violating any of the provisions of
151151 this section shall be punished by a fine of not less than Twenty -
152152 five Dollars ($25.00) nor more than One Hundred Dollars ($100.00).
153153 SECTION 2. NEW LAW A new section of law to be codified
154154 in the Oklahoma Statutes as Section 4 -205 of Title 29, unless there
155155 is created a duplication in numbering, reads as follows:
156156 There is hereby created in the State Treasury a revolving fund
157157 for the Oklahoma Wildlife Conservation Commission to be designated
158158 the "Oklahoma Habitat Stamp Revolving Fund ". The fund shall be a
159159 continuing fund, not subject to fiscal year limitations, and s hall
160160 consist of all monies received pursuant to the provisions of this
161161 section from fees for the Oklahoma Habitat Stamp and required to be
162162 deposited in the fund. All monies accruing to the credit of the
163163 fund are hereby appropriated and shall be expended b y the Commission
164164 for the purpose of Oklahoma Wildlife Management Area maintenance and
165165 improvements. Expenditures from the fund shall be made upon
166166 warrants issued by the State Treasurer against claims filed as
