4040 An Act relating to schools; amending 70 O.S. 2021,

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.508, is
5656 amended to read as foll ows:
5757 Section 1210.508. A. 1. By no later than December 31, 2016,
5858 the State Board of Education shall adopt a statewide system of
5959 student assessments in compliance with the Elementary and Secondary
6060 Education Act of 1965 (ESEA), as reauthorized and amended by P.L.
6161 No. 114-95, also known as the Every Student Succeeds Act (ESSA).
6262 2. The statewide student assessment system adopted by the Board
6363 pursuant to this subsection shall be aligned with the Oklahoma

9090 Academic Standards as adopted by the Board and which p repare
9191 students for college and careers.
9292 B. 1. The Board shall issue a request for proposals for the
9393 selection of assessments to be administered to students in grades
9494 three through twelve as a part of the statewide student assessment
9595 system adopted by th e Board pursuant to this section.
9696 2. The Board shall adopt assessments from t he selected
9797 proposals that were submitted pursuant to paragraph 1 of this
9898 subsection. The adopted assessments shall be administered by the
9999 Board for a period that is in coordina tion with the six-year subject
100100 area textbook adoption cycle unless the vendor does not fulfill the
101101 terms of the contract or fails to comply with or violates the terms
102102 of the contract. The Board shall administer the assessments
103103 beginning with the 2017 -2018 school year.
104104 C. The statewide student assessment system adopted by the Board
105105 pursuant to this section shall include assessments that:
106106 1. Are aligned with the Oklahoma subject matter standards as
107107 adopted by the Board;
108108 2. Provide a measure of comparabili ty among other states;
109109 3. Yield both norm-referenced scores and criterion -referenced
110110 scores;
111111 4. Have a track record of statistical reliability and accuracy;

139139 5. For assessments administered in high school, provide a
140140 measure of future academic perform ance.
141141 D. For the 2016-2017 school year, the Board shall administer
142142 assessments in:
143143 1. English Language Arts or Reading and Mathematics in grades
144144 three through eight and at least once in high school, during the
145145 grade span of nine through twelve;
146146 2. Science not less than once during each grade span of three
147147 through five, six through nine and ten through twelve; and
148148 3. United States History not less than once during the grade
149149 span of nine through twelve.
150150 E. 1. Beginning with the 2017 -2018 school year, th e statewide
151151 student assessment system shall include assessments in:
152152 a. English Language Arts and Mathematics in grades three
153153 through eight and at least once in high school, during
154154 the grade span of nine through twelve,
155155 b. Science not less than once during each grade span of
156156 three through five, six through nine and ten through
157157 twelve, and
158158 c. United States History, with an emphasis on civics, not
159159 less than once during the grade span of nine through
160160 twelve.
161161 2. Beginning with the 2017 -2018 school year, the sta tewide

189189 a. assessments in Reading and Wr iting in certain grades
190190 as determined by the Board, and
191191 b. contingent upon the availability of funds, an
192192 additional nationally recognized college - and career-
193193 readiness assessment or assessments as recommended by
194194 the State Department of Education which will be
195195 administered to students in high school at no cost to
196196 the student.
197197 F. 1. Beginning with students entering the ninth grade in the
198198 2017-2018 school year, each student shall t ake the assessment or
199199 assessments included in the statewide student assessment system
200200 adopted by the Board pursuant to subsection A of this section in
201201 order to graduate from a public high school with a standard diploma.
202202 All students shall take the assessm ent or assessments prior to
203203 graduation, unless otherwise exempt by law.
204204 2. Beginning with students entering the ninth grade in the
205205 2017-2018 school year, each student, in addition to taking the
206206 assessment or assessments included in the statewide student
207207 assessment system adopted by the Board pursuant to subsection A of
208208 this section, shall meet any other high school graduation
209209 requirements adopted by the Board pursuant to Section 5 of Enrolled
210210 House Bill No. 3218 of the 2nd Session of the 55th Oklahoma
211211 Legislature in order to graduate from a public high school with a
212212 standard diploma.

239239 3. For students who start the ninth grade prior to or during
240240 the 2016-2017 school year, school districts shall adopt a plan that
241241 establishes the assessment or assessments thos e students are
242242 required to take in order to graduate from a public high school with
243243 a standard diploma. The plan may also include any or all of the
244244 other high school graduation requirements adopted by the Board
245245 pursuant to Section 5 of Enrolled House Bill No. 3218 of the 2nd
246246 Session of the 55th Oklahoma Legislature that those students will be
247247 required to meet in order to graduate from a public high school with
248248 a standard diploma.
249249 4. The Board shall promulgate rules to ensure that students who
250250 transfer into an Oklahoma school district from out -of-state after
251251 the junior year of high school shall not be denied the opportunity
252252 to be awarded a standard diploma due to differing testing
253253 requirements.
254254 G. 1. Beginning with the 2025 -2026 school year:
255255 a. a student who attends a private school accredited by
256256 the State Board of Education or another accrediting
257257 association, or
258258 b. a student who is educated pursuant to the other means
259259 of education exception provided for in subsection A of
260260 Section 10-105 of this title, and
261261 for whom a taxpayer has successfully claimed a tax credit pursuant
262262 to the Oklahoma Parental Choice Tax Credit Act created in Section

289289 28-100 of this title shall be administered the assessments required
290290 by subsection E of this section.
291291 2. The assessments s hall be administered at a state -certified
292292 testing facility during the assessment window dates as established
293293 in subsection K of this section.
294294 3. If a student declines to complete the assessments required
295295 pursuant to this subsection, the taxpayer who succe ssfully claims a
296296 tax credit pursuant to the Oklahoma Parental Choice Tax Credi t Act
297297 shall repay the tax credit to the Oklahoma Tax Commission no later
298298 than sixty (60) days after the assessment window dates are
299299 concluded.
300300 H. In order to provide an indicati on of the levels of
301301 competency attained by the student in a permanent record for
302302 potential future employers and institutions of higher education,
303303 school districts shall report on the high school transcript of the
304304 student the highest-achieved score on the a ssessment or assessments
305305 included in the statewide student assessment system a dopted by the
306306 Board pursuant to subsection A of this section and any business - and
307307 industry-recognized endorsements attained.
308308 H. I. Students who do not perform at a proficiency level on
309309 assessments shall be remediated as established in the assessment
310310 requirements adopted by the Board pursuant to Section 5 of Enrolled
311311 House Bill No. 3218 of the 2nd Session of the 55th Oklahoma
312312 Legislature, subject to the availability of funding.

340340 J. 1. All assessments required by this section shall measure
341341 academic competencies in correlation with the subject matter
342342 standards adopted by the Board pursuant to Sections 11 -103.6 and 11-
343343 103.6a of this title and referred to as the Oklahoma Academic
344344 Standards. The State Board of Education shall evaluate the subject
345345 matter standards to ensure the competencies reflect high standards,
346346 are specific, well-defined, measurable, challenging, and will
347347 prepare elementary students for next -grade-level course work and
348348 secondary students for postsecondary studies at institutions of
349349 higher education or technology center schools without the need for
350350 remediation. All subject matter standards shall reflect the goals
351351 as set forth in Section 11 -103.6 of this title and of improving the
352352 state average ACT score.
353353 2. The State Department of Education shall annually evaluate
354354 the results of the assessments. The State Board of Education shall
355355 ensure that preliminary results for all statewide assessments are
356356 reported to districts no later than June 20 of each year and are
357357 presented in a manner that yiel ds detailed, diagnostic information
358358 for the purpose of guiding instruction and student remediation. As
359359 improvements are made to the assessments required by this section,
360360 the Board shall seek to increase the depth of knowledge assessed for
361361 each subject. The State Board of Education shall seek to ensure
362362 that data yielded from the assessments required in this section are

389389 utilized at the school district level to inform instruction,
390390 professional development, school improvement and remediation for
391391 students.
392392 3. The Commission for Educational Quality and Accountability
393393 shall determine the cut scores for the performance levels on all
394394 statewide assessments. The Commission shall conduct a n ongoing
395395 review to compare the statewide assessment content and performance
396396 descriptors with those of other states. Upon receipt of the review,
397397 the Commission may adjust the cut scores as necessary.
398398 4. The State Board of Education, for the purposes of c onducting
399399 reliability and validity studies, monitoring contractor adherence to
400400 professionally accepted testing standards, and providing
401401 recommendations for testing program improvement, shall retain the
402402 services of an established, independent agency or orga nization that
403403 is nationally recognized for its technical expertise in educational
404404 testing but is not engaged in the development of aptitude or
405405 achievement tests for elementary or secondary level grades. These
406406 national assessment experts shall annually con duct studies of the
407407 reliability and validity of the statewide assessments admi nistered
408408 pursuant to this section. Validity studies shall include studies of
409409 decision validity and concurrent validity.

411411 K. 1. The State Board of Education shall promulgate rules
412412 setting the assessment window dates for each statewide assessment so

439439 that the assessments are administered according to recommended
440440 testing protocols, and so that the assessment results are reported
441441 back to school districts in a timely manner. The v endor shall
442442 provide a final electronic data file of all school site, school
443443 district, and state results to the State Department of Education and
444444 the Office of Educational Quality and Accountability prior to August
445445 20 of each year. The Department shall for ward the final data files
446446 for each school district and each school site in that district to
447447 the school district. The Board shall ensure the contract with the
448448 vendor includes a provision that the vendor report assessment
449449 results directly to the Office of E ducational Quality and
450450 Accountability at the same time it is reported to the B oard.
451451 2. State, district, and site level results of all assessments
452452 required in this section shall be disaggregated by gender, race,
453453 ethnicity, disability status, migrant status , English proficiency,
454454 and status as economically disadvantaged, except that such
455455 disaggregation shall not be required in a case in which the number
456456 of students in a category is insufficient to yield statistically
457457 reliable information or the results would reveal personally
458458 identifiable information about an individual student. Each school
459459 site shall notify the student 's parents of the school 's performance
460460 levels in the Oklahoma School Testing Program as reported in the
461461 Oklahoma Educational Indicators Progra m at the end of each school
462462 year.

489489 K. L. The State Board of Education shall be responsible for the
490490 field-testing and validation of the statewide assessment system
491491 required in subsection A of this section.
492492 L. M. The State Board of Education shall develop, administer,
493493 and incorporate as a part of the Oklahoma School Testing Program,
494494 other assessment programs or procedures, including appropriate
495495 accommodations for the assessment of students with disabilities as
496496 required by the Individuals with Disabilities Ed ucation Act (IDEA),
497497 20 U.S.C., Section 1400 et seq.
498498 M. N. For purposes of developing and administering alternate
499499 assessments for students with the most significant cognitive
500500 disabilities, the State Board of Education shall not be subject to
501501 subsections D and E of Section 11-103.6a of this title.
502502 SECTION 2. This act shall become effective July 1, 2025.
503503 SECTION 3. It being immediately necessary for the preservation
504504 of the public peace, health or safety, an emergency is hereb y
505505 declared to exist, by reason whereof this act shall take effect and
506506 be in full force from and after its passage and approval.
