4950 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5051 SECTION 1. AMENDATORY 59 O.S. 2021, Section 1000.4a, as
5152 amended by Section 3, Chapter 185, O.S.L. 2023 (59 O.S. Supp. 2024,
5253 Section 1000.4a), is amended to read as follows:
5354 Section 1000.4a. A. The Construction Industries Board shall
5455 have the additional powers to:
5556 1. Receive and convey information relating to the skilled
5657 trades regulated by the Construction Industries Board including, but
5758 not limited to, workforce develop ment; and
5859 2. Enter into contracts with the Oklahoma Department of Career
5960 and Technology Education or, any Oklahoma State Board o f Career and
6061 Technology Education fully accredited vocational or technical
6162 school, or any accredited system of education institution in the
62-State of Oklahoma this state receiving state appropriations and

89+State of Oklahoma this state receiving state appropriations and
9090 offering programs in secondary and or postsecondary instruction that
9191 provide electrical, mechanical, plumbing or roofing trade coursework
9292 for any of the following purposes, or com bination thereof:
9393 a. developing and implementing instructional courses on
9494 Oklahoma Statutes and rules that govern the
9595 electrical, mechanical, plumbing and roofing trades,
9696 which courses can be in conjunction with instruction
9797 in performing trade work or instruction on statewide -
9898 adopted trade codes, or both, for the advancement of
9999 the electrical, mechanical, plumbing and roofing
100100 trades, or
101101 b. developing and implementing a workforce development
102102 program that will create interest in the pursuit of a
103103 skilled trade career. The workforce development
104104 program may consist of, but is shall not be limited
105105 to, use of the Internet, community and sc hool
106106 presentations, and research and instruction on the
107107 electrical, mechanical, plumbing and roofing trades ,
108108 and may be implemented through public awareness and
109109 public information campaigns to promote skilled trades
110110 and skilled trade careers as provided in this section.
111111 B. All contracts pursuant to this section shall be approved by
112112 the Construction Industries Board in accordance with the Oklahoma

139+Open Meeting Act. Costs of the contracts for education and
141140 workforce development programs shall be paid from t he Skilled Trade
142141 Education and Workforce Development Fund established herein created
143142 in subsection E of this section and funded by administrative fines
144143 or penalties as described in this section. Applications for
145144 proposals are to be submitted to the Board on forms provided
146145 requiring sufficient justification and information to evaluate
147146 costs, return on investment, value, and viabil ity of the proposal.
148147 Any contracts will include the requirement that the recipient of the
149148 funds will, upon the completion of the contract, provide a written
150149 report to the Board providing an accounting of expenditures,
151150 describing an explanation of the funds used for the services
152151 provided and the success of outreach demonstrating a return on the
153152 investment including, but not limited to, an accounting of
154153 accomplishments.
155154 C. Fines or penalties collected by the Board and deposited in
156155 the Oklahoma Mechanical Li censing Revolving Fund, the Electrical
157156 Revolving Fund, the Plumbing Licensing Revolving Fund and the
158157 Roofing Contractor Registrat ion Revolving Fund may be transferred to
159158 the Skilled Trade Education and Workforce Development Fund created
160159 in subsection E of this section for the following purposes:
161160 1. To develop instructional materials on Oklahoma laws,
162161 statutes and rules, as they rel ate to the plumbing, mechanical,
163162 electrical and roofing trades and state licensing standards;

191189 2. To cover the cost of equipmen t, materials, personnel and any
192190 other costs of developing and implementing the trade curriculum; and
193191 3. To cover the cost of equ ipment, materials, personnel and any
194192 other costs of developing and implementing the workforce development
195193 program used to promote the plumbing, mechanical, electrical and
196194 roofing trades as a career in Oklahoma.
197195 D. The Skilled Trade Education and Workforce Development Fund
198196 monies shall be used only for the advancement of trade -related
199197 education and workforce development, and only if available based
200198 upon statutory limitations.
201199 E. 1. There is hereby created in the State Treasury a
202200 revolving fund for the Con struction Industries Board to be
203201 designated the "Skilled Trade Education and Workforce Development
204202 Fund". The fund shall be a continuing fund, not subject to fiscal
205203 year limitations. The fund shall consist of an annual transfer of
206204 fully adjudicated fine revenue received in the Oklahoma Mechanical
207205 Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
208206 Licensing Revolving F und or Roofing Contractor Registration
209207 Revolving Fund as determined pursuant to this section. Funds may be
210208 transferred only from the prior fiscal year.
211209 2. If actual receipts, not including fine receipts, exceed
212210 actual expenses and outstanding encumbrances, then one hundred
213211 percent (100%) of all fully adjudicated fine revenue received shall
214212 be transferred from each specific trade r evolving fund: the

242239 Oklahoma Mechanical Licensing Revolving Fund, Electrical Revolving
243240 Fund, Plumbing Licensing Revolving Fund or Roofing Contractor
244241 Registration Revolving Fund.
245242 3. If at any time the receipts in the Oklahoma Mechanical
246243 Licensing Revolving Fund, Electrical Revolving Fund, Plumbing
247244 Licensing Revolving Fund or Roofing Contractor Registration
248245 Revolving Fund, not including fine receipts, are less than actual
249246 expenses and outstanding encumbrances, then the difference of fine
250247 receipts over actual expenses and outstanding encumbrances, if any,
251248 shall be transferred.
252249 4. If at any time the annual receipts in the Oklahoma
253250 Mechanical Licensing Revolving Fund, Electrical Revolving Fund,
254251 Plumbing Licensing Revolving Fund or Roofing Contractor Registratio n
255252 Revolving Fund, including fine receipts, are less than the actual
256253 expenses and outstanding encumbrances, there shall be no transfer of
257254 funds for that period.
258255 5. All monies accruing to the credit of the Skilled Trade
259256 Education and Workforce Development F und may be budgeted and
260257 expended by the Construction Industries Board for workforce
261258 development as it relates to the skilled tr ades and to contract for
262259 the services identified in this act. Expenditures from the fund
263260 shall be made upon warrants issued by t he State Treasurer against
264261 claims filed as prescribed by law with the Director of the Office of
265262 Management and Enterprise Services for approval and payment.

293289 6. All unexpended or outstanding Skilled Trade Education and
294290 Workforce Development Funds from any written agreement where work or
295291 services have not been previously approved by specific quote or cost
296292 estimate and have not been performed within eighteen (18) months of
297293 the date the agreement was signed are hereby released from the
298294 agreement and are availa ble for future agreements approved by the
299295 Board pursuant to this act, except for specific quotes, estimates,
300296 or invoices that previously have been approved for payment,
301297 performance has been initiated, and completed within twenty -four
302298 (24) months of the sig ned agreement.
303299 SECTION 2. This act shall become effective November 1, 2025.
