5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1272, is

6262 UNLAWFUL CARRY
6363 A. Notwithstanding any other provision of law, it shall be
6464 unlawful for any person to carry upon or about his or her person, or
6565 in a purse or other container belonging to the person, any pistol,
6666 revolver, shotgun or rifle whether loaded or unloaded or any

9393 blackjack, loaded cane, hand chain, metal knuckle s, or any other
9494 offensive weapon, whether such weapon be concealed or unconcealed,
9595 except this section shall not prohibit:
9696 1. The proper use of guns and knives for self -defense, hunting,
9797 fishing, educational or recreational purposes;
9898 2. The carrying or u se of weapons in a manner otherwise
9999 permitted by statute or authorized by the Oklahoma Self-Defense Act;
100100 3. The carrying, possession and use of any weapon by a peace
101101 officer or other person authorized by law to carry a weapon in the
102102 performance of officia l duties and in compliance with the rules of
103103 the employing agency;
104104 4. The carrying or use of weapons in a courthouse by a district
105105 judge, associate district judge or special district judge within
106106 this state, who is in possession of a valid handgun license issued
107107 pursuant to the provisions of the Oklahoma Self -Defense Act and
108108 whose name appears on a list maintained by the Administrative
109109 Director of the Courts;
110110 5. The carrying and use of firearms and other weapons provided
111111 in this subsection when used for t he purpose of living history
112112 reenactment. For purposes of this paragraph, "living history
113113 reenactment" means depiction of historical characters, scenes,
114114 historical life or events for entertainment, education, or
115115 historical documentation through the wearin g or use of period,

142142 historical, antique or vintage clothing, accessories, fire arms,
143143 weapons, and other implements of the historical period; or
144144 6. The transporting by vehicle on a public roadway or the
145145 carrying of a firearm, concealed or unconcealed, loade d or unloaded,
146146 by a person who is twenty -one (21) years of age or older or by a
147147 person who is eighteen (18) years of age but not yet twenty -one (21)
148148 years of age and the person is a member or veteran of the United
149149 States Armed Forces, Reserves or National Guard or was discharged
150150 under honorable conditions from the United States Arme d Forces,
151151 Reserves or National Guard, and the person is otherwise not
152152 disqualified from the possession or purchase of a firearm under
153153 state or federal law and is not carrying the firearm in furtherance
154154 of a crime; or
155155 7. The carrying of a concealed handgun at a polling place
156156 during any election conducted by the State of Oklahoma, a county or
157157 municipality by a person who is twenty -one (21) years of age or
158158 older or by a person who i s eighteen (18) years of age but not yet
159159 twenty-one (21) years of age and the person is a member or veteran
160160 of the United States Armed Forces, Reserves or National Guard or was
161161 discharged under honorable conditions from the United States Armed
162162 Forces, Reserves or National Guard, and the person is otherwise not
163163 disqualified from the possession or purchase of a firearm under
164164 state or federal law .

191191 Except as provided in subsection B of Section 1283 of this
192192 title, a person who has been convicted of any one of th e following
193193 offenses in this state or a violation of the equivalent law of
194194 another state:
195195 a. assault and battery pursuant to the provisions of
196196 Section 644 of this title which caused serious
197197 physical injury to the victim,
198198 b. aggravated assault and battery p ursuant to the
199199 provisions of Section 646 of this title,
200200 c. assault and battery that qualifies as domestic abuse
201201 as defined in Section 644 of this title,
202202 d. stalking pursuant to the provisions of Section 1173 of
203203 this title,
204204 e. a violation of an order issued under the Protection
205205 from Domestic Abuse Act or a domestic abuse protection
206206 order issued by another state, or
207207 f. a violation relating to illegal drug use or possession
208208 under the provisions of the Uniform Controlled
209209 Dangerous Substances Act,
210210 shall be prohibited from carrying a firearm under the provisions of
211211 this paragraph. Any person who carries a firearm in the manner
212212 provided for in this paragraph shall be prohibited from carrying the
213213 firearm into any of the places prohibited in subsection A of Section
214214 1277 of this title or any other place currently prohibited by law.

242242 person may legally carry a firearm.
243243 B. Any person convicted of violating the foregoing provision
244244 shall be guilty of a misd emeanor punishable as provided in Section
245245 1276 of this title.

249249 UNLAWFUL CARRY IN CERTAIN PLACES

251251 A. It shall be unlawful for any person , including a person in
252252 possession of a valid handgun license issued pursuant to the
253253 provisions of the Oklahoma Self -Defense Act, to carry any concealed
254254 or unconcealed firearm into any of the following places:
255255 1. Any structure, building, or office space w hich is owned or
256256 leased by a city, town, county, state or federal governmental
257257 authority for the purpose of conducting business with the public;
258258 2. Any courthouse, courtroom, prison, jail, detention facility
259259 or any facility used to process, hold or house arrested persons,
260260 prisoners or persons alleged delinquent or adjudicated delin quent,
261261 except as provided in Section 21 of Title 57 of the Oklahoma
262262 Statutes;
263263 3. Any public or private elementary or public or private
264264 secondary school, except as provided in su bsections C and D of this

292292 4. Any publicly owned or operated sports arena or venue during
293293 a professional sporting event, unless allowed by the event holder;
294294 5. Any place where gambling is authorized by law, unless
295295 allowed by the property owner;
296296 6. Any other place specifically prohibited by law; and
297297 7. Any property set as ide by a county, city, town, public trust
298298 with a county, city or town as a beneficiary, or state governmental
299299 authority for an event that is secured with minimum -security
300300 provisions. For purposes of this paragraph, a minimum -security
301301 provision consists of a location that is secured utilizing the
302302 following:
303303 a. a metallic-style security fence that is at least eight
304304 (8) feet in height that encompasses the property and
305305 is secured in such a way as to deter unauthorized
306306 entry,
307307 b. controlled access points staffed by a uniformed,
308308 commissioned peace officer, and
309309 c. a metal detector whereby persons walk or otherwise
310310 travel with their property through or by the metal
311311 detector.
312312 B. 1. It shall be lawful for a person to carry a concealed or
313313 unconcealed firearm on the following properties:

341341 a. any property set aside for the use or parking of any
342342 vehicle, whether attended or unattended, by a city,
343343 town, county, state or federal government al
344344 authority;,

346346 b. any property set aside for the use or parking of any
347347 vehicle, whether attended or unattended, which is open
348348 to the public, or by any entity engaged in gambling
349349 authorized by law;,
350350 3. Any
351351 c. any property adjacent to a structure, b uilding or
352352 office space in which concealed or unconcealed weapons
353353 are prohibited by the provisions of this section ;,
354354 4. Any
355355 d. any property designated by a city, town, county or
356356 state governmental authority as a park, recreational
357357 area, wildlife refuge, w ildlife management area or
358358 fairgrounds; provided, nothing in this paragraph sh all
359359 be construed to authorize any entry by a person in
360360 possession of a concealed or unconcealed firearm into
361361 any structure, building, office space or event which
362362 is specifically prohibited by the provisions of
363363 subsection A of this section ;,

391391 e. any property set aside by a public or private
392392 elementary or secondary school for the use or parking
393393 of any vehicle, whether attended or unattended;
394394 provided, however, the firearm sha ll be stored and
395395 hidden from view in a locked motor vehicle when the
396396 motor vehicle is left unattended on school property ;,
397397 and
398398 6. Any
399399 f. any public property set aside temporarily by a county,
400400 city, town, public trust with a county, city or town
401401 as a beneficiary, or state governmental authority for
402402 the holder of an event permit that is without minimum -
403403 security provisions, as such term is defined in
404404 paragraph 7 of subsection A of this section; provided,
405405 the carry of firearms within said permitted event area
406406 shall be limited to concealed carry of a handgun
407407 unless otherwise authorized b y the holder of the event
408408 permit.
409409 2. The carrying of a concealed handgun at a polling place
410410 during any election conducted by the State of Oklahoma, a county or
411411 municipality by a person who is twenty -one (21) years of age or
412412 older or by a person who is eighteen (18) years of age but not yet
413413 twenty-one (21) years of age and the person is a member or veteran
414414 of the United States Armed Forces, Reserves or National Guard or was

441441 discharged under honorable conditions from the United States Armed
442442 Forces, Reserves or National Guard, and the person is otherwise not
443443 disqualified from the possession or purchase of a firearm under
444444 state or federal law.
445445 3. Nothing contained in any provision of this subsection or
446446 subsection C of this section shall be construed to authorize or
447447 allow any person in control of any place described in subsection A
448448 of this section to establish any policy or rule that has the effect
449449 of prohibiting any person in lawful p ossession of a handgun license
450450 or otherwise in lawful possession of a firearm from carrying or
451451 possessing the firearm on the property described in this subsection.
452452 C. A concealed or unconcealed weapon may be carried onto
453453 private school property or in any school bus or vehicle used by any
454454 private school for transportation of students or teachers by a
455455 person who is licensed pursuant to the Oklahoma Self -Defense Act,
456456 provided a policy has been adopted by the governing entity of the
457457 private school that authori zes the carrying and possession of a
458458 weapon on private school property or in a ny school bus or vehicle
459459 used by a private school. Except for acts of gross negligence or
460460 willful or wanton misconduct, a governing entity of a private school
461461 that adopts a policy which authorizes the possession of a weapon on
462462 private school property, a school bus or vehicle used by the private
463463 school shall not be subject to liability for any injuries arising
464464 from the adoption of the policy. The provisions of this subsection

491491 shall not apply to claims pursuant to the Administrative Workers '
492492 Compensation Act.
493493 D. Notwithstanding paragraph 3 of subsection A of this section,
494494 a board of education of a school district may adopt a policy
495495 pursuant to Section 5 -149.2 of Title 70 of the Ok lahoma Statutes to
496496 authorize the carrying of a handgun onto school property by school
497497 personnel specifically designated by the board of education,
498498 provided such personnel either:
499499 1. Possess a valid armed security guard license as provided for
500500 in Section 1750.1 et seq. of Title 59 of the Oklahoma Statutes; or
501501 2. Hold a valid reserv e peace officer certification as provided
502502 for in Section 3311 of Title 70 of the Oklahoma Statutes.
503503 Nothing in this subsection shall be construed to restrict authority
504504 granted elsewhere in law to carry firearms.
505505 E. Notwithstanding the provisions of subsection A of this
506506 section, on any property designated as a municipal zoo or park of
507507 any size that is owned, leased, operated or managed by:
508508 1. A public trust created pursuant to th e provisions of Section
509509 176 of Title 60 of the Oklahoma Statutes; or
510510 2. A nonprofit entity,
511511 an individual shall be allowed to carry a concealed handgun but not
512512 openly carry a handgun on the property.
513513 F. Any person violating the provisions of paragraph 2 or 3 of
514514 subsection A of this section shall, upon conviction, be guilty of a

541541 misdemeanor punishable by a fine not to exceed Two Hundred Fifty
542542 Dollars ($250.00). A person violating any other provision of
543543 subsection A of this section may be denied entrance o nto the
544544 property or removed from the property. If the person refuses to
545545 leave the property and a peace officer is summoned, the person may
546546 be issued a citation for an amount not to exceed Two Hundred Fifty
547547 Dollars ($250.00).
548548 G. No person in possession of a valid handgun license issued
549549 pursuant to the provisions of the Oklahoma Self -Defense Act or who
550550 is carrying or in possession of a firearm as otherwise permitted by
551551 law or who is carrying or in possession of a machete, blackjack,
552552 loaded cane, hand chain or metal knuckles shall be authorized to
553553 carry the firearm, machete, blackjack , loaded cane, hand chain or
554554 metal knuckles into or upon any college, university or technology
555555 center school property, except as provided in this subsection. For
556556 purposes of this subsection, the following property shall not be
557557 construed to be college, university or technology center school
558558 property:
559559 1. Any property set aside for the use or parking of any motor
560560 vehicle, whether attended or unattended, provided the firearm,
561561 machete, blackjack, loaded cane, hand chain or metal knuckles are
562562 carried or stored as required by law and the firearm, machete,
563563 blackjack, loaded cane, hand chain or metal knuckles are not removed
564564 from the motor vehicle without the prior consent of the college or

591591 university president or technology center school administrator while
592592 the vehicle is on any college, university or technology center
593593 school property;
594594 2. Any property authorized for possession or use of firearms,
595595 machetes, blackjacks, loaded canes, hand chains or metal knuckles by
596596 college, university or technology center school po licy; and
597597 3. Any property authorized by the written consent of the
598598 college or university president or technology center school
599599 administrator, provided the written consent is car ried with the
600600 firearm, machete, blackjack, loaded cane, hand chain or metal
601601 knuckles and the valid handgun license while on college, university
602602 or technology center school property.
603603 The college, university or technology center school may notify
604604 the Oklahoma State Bureau of Investigation within ten (10) days of a
605605 violation of any pro vision of this subsection by a licensee. Upon
606606 receipt of a written notification of violation, the Bureau shall
607607 give a reasonable notice to the licensee and hold a hearing. At t he
608608 hearing, upon a determination that the licensee has violated any
609609 provision of this subsection, the licensee may be subject to an
610610 administrative fine of Two Hundred Fifty Dollars ($250.00) and may
611611 have the handgun license suspended for three (3) months.
612612 Nothing contained in any provision of this subsection shall be
613613 construed to authorize or allow any college, university or
614614 technology center school to establish any policy or rule that has

641641 the effect of prohibiting any person in lawful possession of a
642642 handgun license or any person in lawful possession of a firearm,
643643 machete, blackjack, loaded cane, hand chain or metal knuckles from
644644 possession of a firearm, machete, blackjack, loaded cane, hand chain
645645 or metal knuckles in places described in paragraphs 1, 2 and 3 of
646646 this subsection. Nothing contained in any provision of this
647647 subsection shall be construed to limit the authority of any college,
648648 university or technology center school in this state from taking
649649 administrative action against any student for any viola tion of any
650650 provision of this subsection.
651651 H. The provisions of this section shall not apply to the
652652 following:
653653 1. Any peace officer or any person authorized by law to carry a
654654 firearm in the course of employment;
655655 2. District judges, associate district jud ges and special
656656 district judges, who are in possession of a valid handgun lice nse
657657 issued pursuant to the provisions of the Oklahoma Self -Defense Act
658658 and whose names appear on a list maintained by the Administrative
659659 Director of the Courts, when acting in th e course and scope of
660660 employment within the courthouses of this state;
661661 3. Private investigators with a firearms authorization when
662662 acting in the course and scope of employment;
663663 4. Elected officials of a county, who are in possession of a
664664 valid handgun license issued pursuant to the provisions of the

691691 Oklahoma Self-Defense Act, may carry a concealed handgun when acting
692692 in the performance of his or her duties within the courthouses of
693693 the county in which he or she was elected. The provisions of this
694694 paragraph shall not allow the elected county official to carry the
695695 handgun into a courtroom;
696696 5. The sheriff of any county may authorize certain employees of
697697 the county, who possess a valid handgun license issued pursuant to
698698 the provisions of the Oklahoma Self -Defense Act, to carry a
699699 concealed handgun when acting in the course and scope of employment
700700 within the courthouse in the county in which the person is employed.
701701 Nothing in the Oklahoma Self -Defense Act shall prohibit the sheriff
702702 from requiring additional in struction or training before granting
703703 authorization to carry a concealed handgun within the courthouse.
704704 The provisions of this paragraph and of paragraph 6 of this
705705 subsection shall not allow the county employee to carry the handgun
706706 into a courtroom, sheri ff's office, adult or juvenile jail or any
707707 other prisoner detention area; and
708708 6. The board of county commissioners of any county may
709709 authorize certain employees of the county, who possess a valid
710710 handgun license issued pursuant to the provisions of the Ok lahoma
711711 Self-Defense Act, to carry a concealed handgun when acting in the
712712 course and scope of employment on county annex facilities or grounds
713713 surrounding the county courthouse.

740740 I. For the purposes of this section, "motor vehicle" means any
741741 automobile, truck, minivan, sports utility vehicle, or motorcycle,
742742 as defined in Section 1 -135 of Title 47 of the Oklahoma Statutes,
743743 equipped with a locked accessory container within or affixed to the
744744 motorcycle.
745745 SECTION 3. AMENDATORY 21 O.S. 20 21, Section 1280.1, is
746746 amended to read as follows:
747747 Section 1280.1.
748748 POSSESSION OF FIREARM ON SCHOOL PROPERTY
749749 A. It shall be unlawful for any person to have in his or her
750750 possession on any public or private school property or while in any
751751 school bus or vehicle used by any school for transportation of
752752 students or teachers any firearm or weapon designated in Section
753753 1272 of this title, except as provided in subsection C of this
754754 section or as otherwise authorized by law.
755755 B. For purposes of this section:
756756 1. "School property" means any publicly owned property held for
757757 purposes of elementary, secondary or vocational -technical education,
758758 and shall not include property owned by public school districts or
759759 where such property is leased or rented to an individual or
760760 corporation and used for purposes other than educational;
761761 2. "Private school" means a school that offers a course of
762762 instruction for students in one or more grades from prekindergarten

790790 and
791791 3. "Motor vehicle" means any automobile, truck, minivan or
792792 sports utility vehicle.
793793 C. Firearms and weapons are allowed on school property and
794794 deemed not in violation of subsection A of this section as follows:
795795 1. A gun or knife designed for hunting or f ishing purposes kept
796796 in a privately owned vehicle and properly displayed or st ored as
797797 required by law, provided such vehicle containing said gun or knife
798798 is driven onto school property only to transport a student to and
799799 from school and such vehicle does no t remain unattended on school
800800 property;
801801 2. A gun or knife used for the purposes of participating in the
802802 Oklahoma Department of Wildlife Conservation -certified hunter
803803 training education course or any other hunting, fishing, safety or
804804 firearms training cour ses, or a recognized firearms sports event,

806806 provided the course or event is approved by the principal or chief
807807 administrator of the school where the course or event is offered,
808808 and provided the weapon is properly displayed or stored as required
809809 by law pending participation in the course, event, program or

837837 3. Weapons in the possession of any peace officer or other
838838 person authorized by law to possess a weapon in the performance of
839839 his or her duties and responsibilities;
840840 4. A concealed or unconcealed wea pon carried onto private
841841 school property or in any school bus or vehicle used by any private
842842 school for transportation of students or teachers by a person who is
843843 licensed pursuant to the Oklahoma Self -Defense Act, provided a
844844 policy has been adopted by the governing entity of the private
845845 school that authorizes the possession of a weapon on private school
846846 property or in any school bus or vehicle used by a private school.
847847 Except for acts of gross negligence or willful or wanton misconduct,
848848 a governing entity of a private school that adopts a policy which
849849 authorizes the possession of a weapon on private school property, a
850850 school bus or vehicle used by the private school shall be immun e
851851 from liability for any injuries arising from the adoption of the
852852 policy. The provisions of this paragraph shall not apply to claims
853853 pursuant to the Workers ' Compensation Code;
854854 5. A gun, knife, bayonet or other weapon in the possession of a
855855 member of a veterans group, the national guard, active military, the
856856 Reserve Officers' Training Corps (ROTC) or Junior ROTC, in order to
857857 participate in a ceremony, assembly or educational program approved
858858 by the principal or chief administrator of a school or school
859859 district where the ceremony, assembly or educational program is
860860 being held; provided, however, the gun or other weapon that uses

888888 school property;
889889 6. A handgun carried in a motor vehicle purs uant to a valid
890890 handgun license authorized by the Oklahoma Self -Defense Act onto
891891 property set aside by a public or private elementary or secondary
892892 school for the use or parking of any vehicle; provided, however,
893893 said handgun shall be stored and hidden from view in a locked motor
894894 vehicle when the motor vehicle is left unattended on school
895895 property; and
896896 7. A handgun carried onto public school property by school
897897 personnel who have been designated by the board of education,
898898 provided such personnel either:
899899 a. possess a valid armed security guard license as
900900 provided for in Section 1750.1 et seq. of Title 59 of
901901 the Oklahoma Statutes, or
902902 b. hold a valid reserve peace officer certification as
903903 provided for in Section 3311 of Title 70 of the
904904 Oklahoma Statutes,
905905 if a policy has been adopted by the board of education of the school
906906 district that authorizes the carrying of a handgun onto public
907907 school property by such personnel ; and
908908 8. A concealed handgun at a polling place located on public
909909 school property during any elec tion conducted by the State of
910910 Oklahoma, a county or municipality by a person who is twenty-one

937937 (21) years of age or older or by a person who is eighteen (18) years
938938 of age but not yet twenty -one (21) years of age and the person is a
939939 member or veteran of th e United States Armed Forces, Reserves or
940940 National Guard or was discharged under honorable conditions from the
941941 United States Armed Forces, Reserves or National Guard, and the
942942 person is otherwise not disqualified from the possession or purchase
943943 of a firearm under state or federal law .
944944 Nothing in this subsection shall be construed to restrict
945945 authority granted elsewhere in law to carry firearms.
946946 D. Any person violating the provisions of this section shall,
947947 upon conviction, be guilty of a misdemeanor punishab le by a fine of
948948 not to exceed Two Hundred Fifty Dollars ($250.00).
949949 SECTION 4. AMENDATORY 21 O.S. 2021, Section 1290.24, as
950950 amended by Section 5, Chapter 160, O.S.L. 2023 (21 O.S. Supp. 2024,
951951 Section 1290.24), is amended to read as follows:
952952 Section 1290.24.
953953 IMMUNITY
954954 A. The state or any political subdivision of the state, as
955955 defined in Section 152 of Title 51 of the Oklahoma Statutes, and its
956956 officers, agents and employees shall be immune from and not subject
957957 to liability resulting or arising from:
958958 1. Failure to prevent the licensing of an individual for whom
959959 the receipt of the license is unlawful pursuant to the provisions of

988988 2. Any action or misconduct wit h a firearm committed by a
989989 person pursuant to the provisions of the Oklahoma S elf-Defense Act
990990 or by any person who obtains a firearm;
991991 3. Any injury to any person during a firearm training course
992992 conducted by a firearms instructor certified by the Council on Law
993993 Enforcement Education and Training to conduct training under the
994994 Oklahoma Self-Defense Act, or injury from any misfire or malfunction
995995 of any firearm on a training course firing range supervised by a
996996 certified firearms instructor under the provisions of the Oklahoma
997997 Self-Defense Act, or any injury resulting from carrying a con cealed
998998 or unconcealed firearm pursuant to any firearms training; and
999999 4. Any action or finding pursuant to a hearing conducted in
10001000 accordance with the Administrative Procedures Ac t as required in the
10011001 Oklahoma Self-Defense Act; and
10021002 5. Any action or misconduct with a handgun committed by a
10031003 person authorized pursuant to subsection A of Section 1272 of this
10041004 title to carry a concealed handgun at a polling place during any
10051005 election conducted by the State of Oklahoma, a county or
10061006 municipality.
10071007 B. Firearms instruc tors certified by the Council on Law
10081008 Enforcement Education and Training to conduct training for the
10091009 Oklahoma Self-Defense Act shall be immune from and not subject to
